11 Gilmore & Bell, P.C. 08/09/2017 EXCERPT OF MINUTES OF A MEETING OF THE GOVERNING BODY OF RENO COUNTY, KANSAS HELD ON AUGUST 15, 2017 The Board of County Commissioners met in regular session at the usual meeting place in the County, at 9:00 A.M., the following members being present and participating, to-wit: Absent: The Chairman declared that a quorum was present and called the meeting to order. * * * * * * * * * * * * * * (Other Proceedings) The Chairman re-opened a public hearing, adjourned from August 1, 2017, for the purpose of considering proposed special assessments, in connection with improvements made to Blue Spruce Combined Sewer District in the County. It was determined by the governing body that notice of the public hearing was duly published and mailed in accordance with K.S.A a01 et seq. and Charter Resolution No. XXVII. Thereafter, the Chairman closed the public hearing. Thereupon, a Resolution was presented entitled: A RESOLUTION LEVYING SPECIAL ASSESSMENTS ON CERTAIN PROPERTY TO PAY THE COSTS OF SEWER IMPROVEMENTS TO SERVE BLUE SPRUCE COMBINED SEWER DISTRICT, RENO COUNTY, KANSAS, AS HERETOFORE AUTHORIZED BY RESOLUTION NO , AS AMENDED BY RESOLUTION NO , OF THE BOARD OF COUNTY COMMISSIONERS; AND PROVIDING FOR THE COLLECTION OF SUCH SPECIAL ASSESSMENTS. The Resolution was considered and discussed; and on motion of Commissioner seconded by Commissioner, the Resolution as a whole was passed by the following roll call vote: Yea: Nay: Thereupon, a majority of the members of the governing body having voted in favor of the adoption of the Resolution, it was given No _, was approved and signed by the Chairman and attested by the County Clerk; and the County Clerk was ordered to cause the Resolution to be published one time in the official County newspaper as required by law, and to cause to be mailed a Notice of Assessment to each and all of the known property owners affected thereby. 13 Gilmore & Bell, P.C. 08/09/2017 (Published in Hutchinson News, on August 17, 2017) RESOLUTION NO A RESOLUTION LEVYING SPECIAL ASSESSMENTS ON CERTAIN PROPERTY TO PAY THE COSTS OF SEWER IMPROVEMENTS TO SERVE BLUE SPRUCE COMBINED SEWER DISTRICT, RENO COUNTY, KANSAS, AS HERETOFORE AUTHORIZED BY RESOLUTION NO , AS AMENDED BY RESOLUTION NO , OF THE BOARD OF COUNTY COMMISSIONERS; AND PROVIDING FOR THE COLLECTION OF SUCH SPECIAL ASSESSMENTS. WHEREAS, the Board of County Commissioners of Reno County, Kansas (the "County"), acting as governing body of Blue Spruce Combined Sewer District (the District ) has heretofore authorized certain sewer improvements (the "Improvements") to be constructed pursuant to K.S.A a01 et seq. and Charter Resolution No. XXVII (the Act ); and WHEREAS, the Board of County Commissioners desires to levy assessments on certain property benefited by the construction of the Improvements, and is required by the Act to call and hold a public hearing to consider such special assessments, and to publish a proposed assessment resolution once in a newspaper of general circulation within the County at least 10 days prior to the date of the public hearing thereon, which resolution shall state the cost of the Improvements, the proposed method of assessment, the date, time and place of the public hearing to consider the proposed special assessments and that written or oral objections will be considered at the hearing; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF RENO COUNTY, KANSAS: Section 1. Required Information and Notice. The Board of County Commissioners will meet for the purpose of holding a public hearing, as provided by K.S.A a01 et seq. and Charter Resolution No. XXVII, at 206 West First Street, Hutchinson, Kansas in the County, on August 1, 2017 at 9:00 a.m., or as soon thereafter as may be heard. Said public hearing is for the purpose of hearing any and all oral or written objections to proposed assessments in connection with the following described improvements, authorized by Resolution No , as amended by Resolution No : That there be constructed improvements to modify the existing locations of irrigation from the wastewater lagoon facilities, replace influent lift station and upgrade erosion protections, to serve the District, all in accordance with plans and specifications therefor that have been submitted to and approved by the Kansas secretary of health and environment. The property in the District, to be assessed for the cost of the Improvements, is: KMC\ \ASSESSMENT PH II 1

14 Block A, Lots 1-12; Block B, Lots 1-16; Block C, Lots 1-17; Block D, Lots 1-15; Block E, Lots 1-15; and Block F, Lots 1-8, all in Blue Spruce I Subdivision, Reno County, Kansas. Block G, upon which are sewer lagoons, is excluded from this listing of properties to be assessed. Block 1, Lots 5-14, all in Blue Spruce II Subdivision, Reno County, Kansas. Block 1, Lots 1-8; Block 2, Lots 1-8; Block 3, Lots 1-8; Block 4, Lots 1-8; Block 5, Lots 1-11; Block 6, Lots 1-6; and Block 7, Lots 1-8, all in Blue Spruce III Subdivision, Reno County, Kansas. The total costs of the Improvements are $568, Improvement costs shall be assessed equally parcel, among 138 parcels identified in the District. 100% of the cost of the Improvements shall be assessed against the property in the District, described above. Section 2. Levy of Assessments. After holding the hearing described in Section 1 of this Resolution, and for the purpose of paying the costs of the Improvements described in Section 1, there are hereby levied and assessed the amounts (with such clerical or administrative amendments thereto as may be approved by the County Counselor) against the property described on Exhibit A attached hereto. Section 3. Payment of Assessments. The amounts so levied and assessed in Section 2 of this Resolution shall be due and payable from and after the date of publication of this Resolution. Such amounts may be paid in whole or in part within thirty (30) days from the date of adoption of this Resolution. Section 4. Notification. The Clerk shall notify the owners of the properties described in Exhibit A attached hereto insofar as known to said Clerk, of the amounts of their respective assessments; and, said notice shall further state that unless such assessments are paid within thirty (30) days from the date of adoption of this Resolution, bonds will be issued therefor, and the amount of such assessment will be collected in installments with interest. Section 5. Certification. Any amount of special assessments not paid within the time prescribed in Section 2 hereof shall be certified by the Clerk in the same manner and at the same time as other taxes are certified and will be collected in 20 annual installments, together with interest on such amounts at a rate not exceeding the maximum rate therefor as prescribed by the Act. Interest on the assessed amount remaining unpaid between the effective date of this Resolution and the date the first installment is payable, but not less than the amount of interest due during the coming year on any outstanding bonds issued to finance the Improvements, shall be added to the first installment. The interest for one year on all unpaid installments shall be added to each subsequent installment until paid. Section 6. Effective Date. This Resolution shall take effect and be in force from and after its adoption and publication once in the official County newspaper. 16 NOTICE OF ASSESSMENT August 15, 2017 Reno County, Kansas Property Owner: You are hereby notified, as owner of record of the property described on Schedule I attached hereto, that pursuant to Resolution No (the "Resolution") of Reno County, Kansas (the "County") there has been assessed against said property the costs of certain internal improvements heretofore authorized by the governing body of the County (the "Improvements"). The description of the Improvements, the resolution number authorizing the same and the amount of assessment are set forth on Schedule I attached hereto. You may pay this assessment in whole or in part to the County Treasurer of the County within thirty (30) days from the date hereof; and if the amount is not paid within said time period, bonds will be issued therefor, and the balance of such assessment will be collected in twenty (20) annual installments, together with interest on such amounts remaining unpaid at a rate not exceeding the maximum rate therefor as prescribed by K.S.A a01 et seq. and Charter Resolution No. XXVII.
