3 Foreword The International Chamber of Commerce United Arab Emirates (ICC-UAE) was established in 2004 under the Federation of UAE Chambers of Commerce and Industry with the support of local chambers to foster a healthy and competitive economic environment and to give the UAE businesses the opportunity to be a part of the global ecosystem. In the last 14 years of its existence, the ICC-UAE which represents the commercial, industrial and business enterprises in the country at a global level along with the Paris-based International Secretariat of ICC, promoted the scope and reach of the UAE business community around the world. 5 Welcome Since its inception over a decade ago, ICC-UAE represents the UAE business community and promotes its competitiveness in international business arenas while supporting them to be at the forefront of outstanding global businesses. Continuing its efforts to organise more events that complement its goal of representing the local business community at the global level, ICC-UAE newly elected board which represents the Federation of UAE Chambers, the 7 local Chambers and 5 other elected members has drawn out an impressive calendar of events for the year Hassan Al Hashemi Secretary General "Our objective is to provide the best platform for the members of our commissions to pursue their contribution to the betterment of the private sector in the United Arab Emirates." The Programme of Action for 2018 based on the Chapter s vision, suggestions and recommendations from its office bearers, has been drafted in line with the current economic and business needs and in light of the economic and investment environment witnessed currently by the world and the UAE along with their assessed future impacts. It also includes hosting of trainings and seminars on key subjects relevant to the UAE and networking events with various UAE Chambers as well as ICC-UAE s participation in various regional and international events. The programme also includes the launch of new activities to promote membership and ICC products and publications such as the Incoterms 2010 and UCP 600. Over the years, the ICC-UAE has been focusing on providing the best services to its member companies through its extensive network and relationship with local and global chambers while allowing them to access the three commissions on Banking, Customs and Trade Facilitation, and Arbitration in their overseas dealings. We look forward to attracting more members to the ICC-UAE Chapter for the benefit offered in getting access to the corridors of power, gaining influence through national committees and groups, staying connected with the world s most influential and dynamic companies, while building skills and receiving members benefits on ICC publications, trainings and conferences around the world. 3

7 What is ICC? ICC is the world business organization, a representative body that speaks with authority on behalf of enterprises from all sectors in every part of the world. The fundamental mission of ICC is to promote open international trade and investment and help business meet the challenges and opportunities of globalization. Its conviction that trade is a powerful force for peace and prosperity dates from the organization s origins early in the 20 th century. The small group of far-sighted business leaders who founded ICC called themselves the merchants of peace. ICC has three main activities: rule setting, dispute resolution, and policy advocacy. Because its member companies and associations are themselves engaged in international business, ICC has unrivalled authority in making rules that govern the conduct of business across borders. Although these rules are voluntary, they are observed in countless thousands of transactions every day and have become part of the fabric of international trade. ICC also provides essential services, foremost among them the ICC International Court of Arbitration, the world s leading arbitral institution. Another service is the World Chambers Federation, ICC s worldwide network of chambers of commerce, fostering interaction and exchange of chamber best practice. ICC also offers specialized training and seminars and is an industry-leading publisher of practical and educational reference tools for international business, banking and arbitration. Business leaders and experts drawn from the ICC membership establish the business stance on broad issues of trade and investment policy as well as on relevant technical subjects. These include anti-corruption, banking, the digital economy, marketing ethics, environment and energy, competition policy and intellectual property, among others. ICC works closely with the United Nations, the World Trade Organization and intergovernmental forums including the G20. 15 Advocacy & Expertise Arbitration and ADR Through its Commission on Arbitration and ADR, ICC is a leader in the field of international dispute resolution. The commission is a unique rule-making body and think tank for worldwide forms of dispute settlement. Banking The ICC Banking Commission has identified five work areas that are key to its success. These include Traditional Trade Services, Open Account and Supply Chain Financing, Global Regulation, Legal and Compliance Issues, Risk and Asset Management. Customs and Trade Facilitation Through its Commission on Customs and Trade Facilitation, ICC focuses on customs reform and modernization, the implementation of transparent, simplified, harmonized customs policies and procedures and to promote competitive and efficient transport markets worldwide. Commercial Law and Practice Through its Commission on Commercial Law and Practice and several tasks forces and working groups, ICC leads rule-making in specific issues and tools relating to global business and trade. Competition ICC's views on international competition policy are formulated by its Commission on Competition, which gathers over 300 experts on competition law, including legal advisors from industrial and commercial enterprises and lawyers in private practice, from 40 countries. Corporate responsibility and anti-corruption A growing number of companies across the world increasingly recognize that doing business with integrity is the only right way of doing business. Digital Economy The ICC Commission on the Digital Economy seeks to promote the global development of the digital economy and stable growth of information and communication technology (ICT) through private sector policy leadership, regulatory advocacy and the promotion of best practice. Environment and Energy ICC examines major environmental- and energy-related policy issues of interest to world business via its Commission on Environment and Energy. The commission provides business input by elaborating multi-sectorial policy positions, achievements and highlighting business solutions to environmental issues and problems. Intellectual Property ICC works to promote efficient intellectual property (IP) systems that support international trade, encourage investment in creation and innovation, and facilitate sustainable economic development. It believes that intellectual property protection encourages the development of knowledge-based industries, and creates a favourable climate for foreign direct investment and technology transfer. Task forces work to develop and promote positions reflecting business views on intellectual property. Marketing and Advertising The International Chamber of Commerce (ICC) is uniquely positioned to provide insightful guidance on marketing and advertising around the globe. As the world business organization, whose membership is composed of thousands of enterprises from all sectors and geographical regions, ICC continues to be a key player in the ever-changing landscape of modern marketing and advertising. Taxation ICC promotes an international tax system that eliminates tax obstacles to cross-border trade and investment. Its tax policy is formulated by its Commission on Taxation, which promotes transparent and non-discriminatory treatment of foreign investment and earnings that eliminates tax obstacles to cross-border trade and investment. Trade and Investment policy The private sector has a key role to play in ensuring an open international environment that will facilitate cross-border trade and investment by business to sustain the economic recovery, job creation and sustainable development. 13

16 Commission on Arbitration & ADR The Commission on Arbitration and ADR is ICC's rule-making body and unique think tank in the field of international dispute resolution. As a forum for pooling ideas on issues relating to international arbitration and other forms of dispute resolution, the ICC Commission on Arbitration and ADR aims to: Draft and revise ICC s Arbitration, Mediation, Expert, Dispute Board Rules and other forms of dispute resolution rules. ICC is not only a world leader in dispute resolution services, but is also the preferred arbitral institution. 17 Commission on Banking The World's Essential Rule-Making Body for the Banking Industry. To serve as a global forum and rule-making body for banks worldwide, with particular focus on the financing of international trade. With over 80 years of experience and more than 600 members in more than 100 countries, the ICC Banking Commission - ICC largest commission - has rightly gained the reputation of being the most authoritative voice in the field of trade finance. The ICC Banking Commission produces universally accepted rules and guidelines for international banking practice. ICC rules and guidelines on documentary credits, entitled UCP 600, are the most successful privately drafted rules for trade ever developed, serving as the basis of US$2 trillion worth of trade transactions a year. Rules and Guidelines on Documentary Credits (UCP 600) Uniform Rules for Forfaiting (URF) Uniform Demand Guarantees Rules (URDG 758) Uniform Rules for Bank Payment Obligation (URBPO) International Standard Banking Practice (ISBP) Through its representative body in the UAE having 25 Banks as members, the ICC UAE Banking Commission will give you a voice to shape the world's most used trade finance rules of tomorrow while building skills and expertise of the latest trends of today. ICC UAE Banking Commission also contributes to the drafting and revision of the various ICC rules for banking practices, including UCP 600, URDG and ISBP. 15

18 Commission on Customs and Trade Facilitation The commission's mandate is to promote simplified customs policies and procedures as well as other measures to facilitate international trade. The ICC Commission on Customs and Trade Facilitation has over 250 members from nearly 50 countries. Commission members comprise customs policy, transport and logistics specialists from ICC member companies and business representative organizations. The liberalization of world trade and investment has drawn attention to practical obstacles to the free flow of goods, services and investment across borders - in particular those related to customs policies and procedures, and transport markets. The central objective of the Commission on Customs and Trade Facilitation is to overcome these barriers, to ensure that the liberalization of global trade and investment has a positive impact at the level of the individual international trade transaction and in the business of transport and logistics. The commission's work focuses on customs reform and modernization, the implementation of transparent, simplified, harmonized customs policies and procedures and to promote competitive and efficient transport markets worldwide. The Commission on Customs and Trade Facilitation works closely with various organizations in order to tackle different issues related to customs procedures harmonization and trade facilitation. Through its representative body in the UAE, the ICC UAE Commission on Customs and Trade Facilitation contributes to the drafting and revision of the various rules including the transfer pricing and customs value, the making transport greener and smarter, the Incoterms 2010 rules, the supply chain connectivity and the digitalization of transport infrastructure, cross border linkages, and customs procedures. 16

19 Our Influence In an unprecedented move, the United Nations (UN) General Assembly has granted Observer Status to the International Chamber of Commerce (ICC). Granting Observer Status to ICC sends a powerful signal that the UN recognizes business as a vital partner. We stand ready to ensure that the private sector plays a full role in meeting the ambition of the 2030 agenda. Sunil Mittal ICC Chairman The decision-taken by 193 members of the UN General Assembly during its on-going 71st session in New York is the first time that a business organisation has been admitted as an Observer at the UN General Assembly. The list of UN observers is highly restricted and features principally intergovernmental organisations. The new role for ICC means that business will for the first time have direct voice in the UN system. The decision paves the way for ICC to contribute directly to the work of the General Assembly and reflects the vital role the private sector will play in implementing the UN s 2030 Agenda for Sustainable Development. ICC has indicated that its key areas of engagement with the United Nations will be trade, sustainable development, the global refugee crisis, and the digital economy. 17

21 Who can become a member of ICC-UAE? All companies and establishments registered and licensed to operate in the UAE and involved in international business, whether private, corporate, public or state-owned, shall be eligible to become members of the ICC-UAE. Chambers of Commerce and professional societies and associations based in the UAE, whether local, regional or national including bilateral chambers of commerce, representing foreign business in the UAE, may join the ICC-UAE. Scholars, academics, professionals and individuals involved in international business are eligible for individual membership of the ICC-UAE. Non-voting honorary membership may be conferred to individuals (but not establishments) who have outstanding contribution to the ICC-UAE business. Honorary members shall be exempt from fees.
