7 CIVIL LAW SUB-WORKING GROUP SERVICE OF DOCUMENTS & TAKING OF EVIDENCE ABROAD CI/2018/ FEBRUARY 2018 RECKLINGSHAUSEN, GERMANY 15 DECEMBER 2018 This two-day training will raise awareness to the European dimension in the field of civil procedure; provide training on the EU Regulations including the relevant case law on cross-border taking of evidence and service of documents; promote contacts between national judges from different Member States. The seminar is designed to be practice-oriented and focused on peer and expert training. Participating judges will deal with concrete situations and be faced with real questions by means of case studies and workshops in which active participation is encouraged. The training will serve as a forum for the exchange of knowledge and best practices between judges and prosecutors from across the EU. 8 CYBERCRIME, PROBLEMS OF JURISDICTION AND INTERNATIONAL COOPERATION IN CRIMINAL MATTERS CR/2018/ MARCH 2018 LISBON, PORTUGAL 8 JANUARY 2018 One-day-and-a-half training based on a learn-by-doing methodology. Judges and prosecutors from all member States will be involved in a series of practical workshops addressing problems of jurisdiction and international cooperation in cybercrime, working on case scenarios inspired by real facts and involving both national and cross-border judicial cooperation. This training will require strong interaction between the participants forming the workshop groups. Participants will comment on the practical cases according to their national legal systems and, most importantly, learn about their colleagues systems in counterpart Member States. The seminar will address such issues as international framework on cybercrime, the conflict of jurisdiction and cross-border access to data, remote access to digital data, open source evidence, international cooperation in criminal matters in the light of the EIO. Participants will be assisted by international and national experts, Europol and Eurojust representatives. The training will include presentations on the role of Europol and EUROJUST in judicial cooperation in criminal matters, as well as a framework lecture on the topic of the training s practical case. 9 LANGUAGE TRAINING ON THE VOCABULARY OF JUDICIAL COOPERATION IN CIVIL MATTERS LI/2018/ MARCH 2018 NATIONAL INSTITUTE OF MAGISTRACY, BUCHAREST, ROMANIA 15 JANUARY 2018 A five-day, face-to-face course designed for EU judges and prosecutors working within judicial cooperation in civil matters. It aims at developing both legal and linguistics skills of the participants by combining legal information and language exercises in a practical and dynamic way. Participants are divided in four small groups, three to be developed in and one to be carried out in French. Each group is trained for the entire week by a team composed of a linguist expert and a legal expert acting simultaneously. The course combines theoretical and practical sessions of the four basic language skills: reading, writing, speaking, listening, within legal terminology. Before the face-to-face seminar components, participants will be invited to check their knowledge and prepare for the seminars by doing some legal and language exercises, which will be prepared by the project experts, and available for participants on EJTN s training platform. 10 EU ASYLUM LAW AD/2018/ MARCH 2018 HELSINKI, FINLAND 20 DECEMBER 2017 : Day-and-a-half training on the legal framework and key jurisprudential developments in the field of EU asylum law and policy. This training will combine practical workshops with framework lectures focused on central issues arising from the case-law of the European Court of Human Rights, the assessment of country of origin information (COI), and the standards for the assessment of the credibility of asylum claims. In small breakout groups, participants will analyse practical case-studies inspired by real facts and exchange views on national approaches to the treatment of asylum claims and the application of the relevant EU and international law. The sessions will be led by practitioners and academics in the field of EU human rights and asylum law and will serve as a forum for the exchange of knowledge and best practices between practitioners from the different EU Member States. 13 EJTN-AEAJ TRAINING ON CONFLICTS OF NORMS/ MULTI-LEVEL PROTECTION IN THE APPLICATION OF FUNDAMENTAL RIGHTS HFR/2018/ MARCH 2018 THESSALONIKI, GREECE 5 JANUARY 2018 : Day-and-a-half training organised in partnership with the Association of European Administrative Judges (AEAJ) and focused on constructive solutions to conflicts between national and European law in the application of fundamental rights and freedoms. The training will be carried out by leading academics and practitioners and will cover topics as diverse as potential conflicts between judicial and administrative decisions and fundamental rights, conflicts between primary and secondary EU law, and between the former and the European Convention on Human Rights (ECHR). This training will combine theoretical lectures with practical workshops based on specialised case-studies and will serve as a forum for the exchange of knowledge and best practices between judges from across the EU. 15 INSOLVENCY LAW CI/2018/ APRIL 2018 BARCELONA, SPAIN 15 JANUARY 2018 The added value of the two day-long training consist of delivering in-depth insights on highly specialized topics pertaining to diversified aspects of Cross-border Insolvency. Cross-border insolvency (sometimes called international insolvency) regulates the treatment of financially distressed debtors where such debtors have assets or creditors in more than one country. Typically, cross-border insolvency is more concerned with the insolvency of companies which operate in more than one country rather than the bankruptcy of individuals. Like traditional conflict of laws rules, cross-border insolvency focuses upon three areas: choice of law rules, jurisdiction rules and enforcement of judgment rules. However, in relation to insolvency, the principal focus tends to be the recognition of foreign insolvency officials and their powers. The training will be carried out by leading academics and practitioners, expert speakers will be called to expand upon such aspects as jurisdiction, applicable law, EU instruments, recognition and enforcement of decisions and cooperation in matters relating to the subjects of the seminar. This training will combine theoretical lectures with practical workshops based on specialised case-studies and will serve as a forum for the exchange of knowledge and best practices between judges from across the EU. 16 JUDGECRAFT TM/2018/ APRIL 2018 LJUBLJANA, SLOVENIA 28 FEBRUARY 2018 Following four very successful European Judgecraft courses in 2016 & 2017, EJTN is running a series of three further such courses in The courses will cover topics such as judicial conduct and ethics, judicial resilience, unconscious bias and the practice of Judgecraft skills in the courtroom. These three courses will be highly focused upon the skills and abilities that are common to all judges at every level, whatever their jurisdiction, within Europe. They are intended to be training the trainers courses allowing judicial trainers and educators to return to their home jurisdictions and to there develop and adapt the ideas they will see and discuss during the courses. The three courses will be substantially the same as each other. 17 APPLICABILITY AND EFFECT OF THE EU CHARTER ON FUNDAMENTAL RIGHTS IN NATIONAL PROCEEDINGS HFR/2018/ APRIL 2018 VIENNA, AUSTRIA 1 FEBRUARY 2018 : The added value of this one-and-a-half-day long seminar, organised by EJTN in cooperation with the Fundamental Rights Agency of the EU (FRA) consists of providing a general overview on the CFREU, and its importance in the protection of fundamental rights in the EU. Expert speakers will be called to expand upon such aspects as introduction to the CFREU and the mission of the FRA, applicability issues, effects of the CFREU at national level, and the protection of specific fundamental rights at the light of the CFREU. In order to combine the theoretical knowledge with a more practical approach, workshop sessions will also be organised in order to provide participants the possibility of applying the Charter and the applicable caselaw of the CJEU in practical cases, and facilitate the exchange of best practices. It aims at developing both legal and linguistics skills of the participants by combining legal information and language exercises in a practical and dynamic way. The Project aims to: Promote a forum of discussion on European and International Law subjects. Promote exchanges of experiences between the participants. Obtain and spread interesting and useful theses on the chosen subjects. Encourage the development of the critical thinking and communication skills. Promote and foster relationships among participants from across the European judiciaries represented in the competition TARGET GROUP The project beneficiaries are trainees from all training institutions and schools who are members of EJTN or observers. 26 GATHERING AND ADMISSIBILITY OF EVIDENCE IN COUNTER-TERRORISM: CHALLENGES AND BEST PRACTICES CR/2018/ MAY 2018 KRAKOW, POLAND APPLICATION 9 MARCH 2018 Specialised day-and-a-half training focused on the practical evidentiary challenges involved in the investigation, prosecution and trial of terrorism cases. This training will gather judges and prosecutors from different EU Member States to exchange views and best practices on the treatment of terrorism cases, the gathering and use of evidence from third States and conflict zones, the use of intelligence as evidence, and the use of evidence from social media and other online platforms. Participants will be divided into breakout groups to discuss practical cases and investigative approaches to complex files. Through plenary and roundtable discussions, practitioners will exchange views with other experts in this field and share their own national experience in dealing with foreign fighters and home-grown terrorism. 30 THE PROTECTION OF THE FINANCIAL INTERESTS OF THE EU CR/2018/ JUNE 2018 RIGA, LATVIA 26 MARCH 2018 The protection of EU public money against all forms of criminal conduct, including fraud and the effective and equivalent legal action throughout the Union has to become a priority for the national authorities. To investigate, prosecute and bring to justice those who commit criminal offences affecting the Union s financial interests is a key goal where judicial training has a role to play. For the first time, the EJTN is organizing a seminar to make judges and prosecutors aware on how to counter all forms of illegal activity affecting the EU financial interests and to detect the misuse of the EU budget. Day-and-a-half training aimed at providing the participants with the information on international legal framework with regard to protection of EU financial interests and measures taken at EU level to protect the EU s financial interests. The role of the European Anti-Fraud Office (OLAF) especially in those cases with a cross-border dimension and the new Regulation setting up a European Public Prosecutor s Office will be examined in the seminar. 31 THE EUROPEAN PRELIMINARY RULING PROCEDURE AD/2018/ JUNE 2018 LUXEMBOURG 19 MARCH 2018 : Day-and-a-half training led by practitioners, academics and EU Court of Justice (CJEU) officials on key issues surrounding the EU Preliminary Ruling Procedure. This training is a repetition of the 2017 EU Preliminary Ruling Procedure and it will be based on practical workshops and framework lectures addressing the instances warranting referral of questions to the CJEU, the practical drafting and formulation of questions, the interpretation and implementation of CJEU s judgments, and the latter s views on the best practices in this field.
