1 Big Thunder Muntain Railrad: Engine N. 4 Paper Mdel License Agreement By dwnlading this file and the accmpanying Licensed Materials, the end user ("Licensee") agrees t cnfrm t this License Agreement (this "Agreement") with Rbert Nava, the Disney Experience website [ ("Licensr"). I. Cntent f Licensed Materials; Grant f License The materials that are the subject f this Agreement shall cnsist f the Big Thunder Muntain Railrad: Engine N. 4 Paper Mdel in electrnic and physical frm (hereinafter referred t as the "Licensed Materials"). Licensee acknwledges that the cpyright and title t the Licensed Materials and any trademarks r service marks relating theret remain with Licensr and/r its suppliers. Licensee shall nt have right, title r interest in the Licensed Materials except as expressly set frth in this Agreement. Licensr hereby grants t Licensee nn-exclusive use f the Licensed Materials in accrdance with this Agreement. II. Access f Licensed Materials t Licensee Licensr will prvide the Licensed Materials t the Licensee in the fllwing manner: File Transfer. Cpies f the Licensed Materials will be prvided t the Licensee thrugh the Disney Experience website at the sle discretin f the Licensr. III. Fees Licensee is required t make n payment t Licensr fr use f the Licensed Materials. IV. Authrized Use f Licensed Materials Authrized Uses. Licensee may make all use f the Licensed Materials as is cnsistent with the Fair Use Prvisins f United States and internatinal law. Nthing in this Agreement is intended t limit in any way whatsever Licensee's rights under the Fair Use prvisins f United States r internatinal law t use the Licensed Materials. The Licensed Materials may be used fr purpses f research, educatin r ther nn-cmmercial use as fllws: Archival/Backup Cpy. Upn request f Licensee, Licensee may create ne (1) cpy f the entire set f Licensed Materials t be maintained as a backup r archival cpy during the term f this Agreement. V. Specific Restrictins n Use f Licensed Materials Unauthrized Use. Licensee shall nt knwingly permit anyne ther t use the Licensed Materials. Mdificatin f Licensed Materials. Licensee shall nt mdify r create a derivative wrk f the Licensed Materials withut the prir written permissin f Licensr. Remval f Cpyright Ntice. Licensee may nt remve, bscure r mdify any cpyright r ther ntices included in the Licensed Materials. Distributin Rights. Licensee has n rights t transfer, hst, r re-distribute the Licensed Materials r its derivatives under any circumstances r by any means available nw r in the future. 2 Cmmercial Purpses. Other than as specifically permitted in this Agreement, Licensee may nt use the Licensed Materials fr cmmercial purpses, including but nt limited t the sale f the Licensed Materials r bulk reprductin r distributin f the Licensed Materials in any frm. VI. Licensr Perfrmance Obligatins Availability f Licensed Materials. Licensr shall make the Licensed Materials available t Licensee at his/her discretin. Ntificatin f Mdificatins f Licensed Materials. Licensee understands that frm time t time the Licensed Materials may be added t, mdified, r deleted frm by Licensr and/r that prtins f the Licensed Materials may migrate t ther frmats. Cmpleteness f Cntent. Where applicable, Licensr will infrm Licensee f instances where nline cntent differs frm the print versins f the Licensed Materials. Where applicable, Licensr shall use reasnable effrts t ensure that the nline cntent is at least as cmplete as print versins f the Licensed Materials, represents cmplete, accurate and timely replicatins f the crrespnding cntent cntained within the print versins f such Materials, and will cperate with Licensee t identify and crrect errrs r missins. Withdrawal f Licensed Materials. Licensr reserves the right t withdraw frm the Licensed Materials any item r part f an item fr which it n lnger retains the right t publish, r which it has reasnable grunds t believe infringes cpyright r is defamatry, bscene, unlawful r therwise bjectinable. VII. Licensee Perfrmance Obligatins Prtectin frm Unauthrized Use. Licensee shall use reasnable effrts t prtect the Licensed Materials frm any use that is nt permitted under this Agreement. In the event f any unauthrized use f the Licensed Materials by an Authrized User, (a) Licensr may terminate such Authrized User's access t the Licensed Materials, (b) Licensr may terminate the access f the Internet Prtcl ("IP") address(es) frm which such unauthrized use ccurred, and/r (c) Licensee shall terminate such Authrized User's access t the Licensed Materials upn Licensr's request. Licensr shall take nne f the steps described in this paragraph withut first prviding reasnable ntice t Licensee and cperating with the Licensee t avid recurrence f any unauthrized use. VIII. Early Terminatin In the event that either party believes that the ther materially has breached any bligatins under this Agreement, r if Licensr believes that Licensee has exceeded the scpe f the License, such party shall s ntify the breaching party in writing. The breaching party shall have 1 week frm the receipt f ntice t cure the alleged breach and t ntify the nnbreaching party in writing that cure has been effected. If the breach is nt cured within the 1 week, the nn-breaching party shall have the right t terminate the Agreement withut further ntice. Upn Terminatin f this Agreement fr cause nline access t the Licensed Materials by Licensee and shall be terminated. Authrized cpies f digital Licensed Materials must be destryed immediately. IX. Perpetual License Except fr terminatin fr cause, Licensr hereby grants t Licensee a nnexclusive, ryalty-free, perpetual license t use any Licensed Materials that were accessible during the term f this Agreement. Such use shall be in accrdance with the prvisins f this Agreement. The means by which Licensee shall have access t such Licensed Materials shall be in a manner and frm substantially equivalent t the means by which access is prvided under this Agreement. Warranties Subject t the Limitatins set frth elsewhere in this Agreement: Licensr warrants that it has the right t license the rights granted under this Agreement t use Licensed Materials, that it has btained any and all necessary permissins frm third parties t license the Licensed Materials, and that use f the Licensed Materials by Authrized Users in accrdance with the terms f this Agreement shall nt infringe the cpyright f any third party. XI. Limitatins n Warranties Ntwithstanding anything else in this Agreement: Neither party shall be liable fr any indirect, special, incidental, punitive r cnsequential damages, including but nt limited t lss f data, business interruptin, r lss f prfits, arising ut f the use f r the inability t use the Licensed Materials. Licensr makes n representatin r warranty, and expressly disclaims any liability with respect t the cntent f any Licensed Materials, including but nt limited t errrs r missins cntained therein, libel, infringement f rights f publicity, privacy, trademark rights, mral rights, r the disclsure f cnfidential infrmatin. Except fr the express warranties stated herein, the Licensed Materials are prvided n an "as is" basis, and Licensr disclaims any and all ther warranties, cnditins, r representatins (express, implied, ral r written), relating t the Licensed Materials r any part theref, including, withut limitatin, any and all implied warranties f quality, perfrmance, merchantability r fitness fr a particular purpse. Licensr makes n warranties respecting any harm that may be caused by the transmissin f a cmputer virus, wrm, time bmb, lgic bmb r ther such cmputer prgram. Licensr further expressly disclaims any warranty r representatin t Authrized Users, r t any third party. XII. Assignment and Transfer Neither party may assign, directly r indirectly, all r part f its rights r bligatins under this Agreement withut the prir written cnsent f the ther party, which cnsent shall nt be unreasnably withheld r delayed. XIII. Gverning Law This Agreement shall be interpreted and cnstrued accrding t, and gverned by, the laws f Califrnia, excluding any such laws that might direct the applicatin f the laws f anther jurisdictin. The federal r state curts lcated in Califrnia shall have jurisdictin t hear any dispute under this Agreement. XIV. Entire Agreement This Agreement cnstitutes the entire agreement f the parties and supersedes all prir cmmunicatins, understandings and agreements relating t the subject matter heref, whether ral r written. XV. Amendment N mdificatin r claimed waiver f any prvisin f this Agreement shall be valid except by written amendment signed by authrized representatives f Licensr and Licensee. Scissrs Printing Guidelines: When printing with Adbe Reader,, it is imprtant t use prper printing settings fr crrect alignment and scaling. Click the Print Tl buttn. In the Print settings dialg bx, set Page Scaling t Nne, and enable the Aut-Rtate Rtate and Center ptin. Unless yu are a prfessinal mdeler, yu shuld print n 8 ½ by 11 (U.S. Letter) sheets, and shuld uld nt change the recmmended print settings. Instructins: When printing these instructins, yu shuld print n bth sides f the sheets t save paper. Yu can als print in black & white t save clr ink/tner. Sme peple prefer nt t print, referencing the instructins frm their ir cmputer mnitr. Mdel Parts: If yu shuld need t re--print selective mdel parts, yu can use the Snapsht Tl in Adbe Reader. Click the icn nce, then click-drag drag a bx arund the area that yu want t print. The selected area will flash nce (a snapsht ), and yu re ready t print. In the Print settings dialg bx, yu will see a preview f the dcument. In the preview, nly the snapsht appears and willl be printed. This saves yu frm printing the whle page, thus saving ink/tner. Trubleshting Files: Files If yu feel that the mdel parts are nt printing prperly, yu can use the alignment bx in the lwer-right lwer crner f the mdel part sheets. Hld tw r mre sheets t a light surce, and cmpare bth the psitin and sizes f the alignment bxes. Smetimes PDF files can becme crrupted while dwnlading. This is nt uncmmn, cmmn, and is n cause fr alarm. Delete the bad files, and try re-dwnlading dwnlading them. Anther cmmn errr is that yur versin f Adbe Adbe Reader is ut-f-date. Please visit the Adbe Web site te and dwnlad the latest versin f the sftware. This typically slves 90% f users file prblems. Cnstructin Guidelines Read these instructins and study the illustratins t knw what/where t cut/fld. Befre gluing, always dry-fit dry the pieces t ensure nsure they fit prperly. Be aware that paper pape will absrb misture frm watery glue, and it may expand. When fllwing these instructins, d nt take the illustratins t literally. In many cases, pieces will be simplified (i.e. n tabs). Other times, pieces r entire sectins may be missing that were previusly displayed. This des nt mean yu shuld ever eve disassemble yur mdel (unless instructed t d s). Mst mdel parts have numbered tabs.
