This decision has been based on the continued discussions that been brought to the commission table and via correspondence regarding the impact of certain special events, specifically the New Year s Eve Celebration and Thunder by the Bay. 2 ADDITIONAL EXPLANATION: AGENDA REQUEST As background, in 2014 a moratorium for use of Main Street (Orange Ave. to Gulfstream Ave.) was approved by the City Commission. The City Commission exempted Parades, New Year s Eve and Thunder by the Bay from the moratorium. Many of these special events require extensive planning and request for sponsor support well in advance of the event date along with the need by the City to evaluate the impact and availability of staff resources. Staff would also like to bring to the attention of the City Commission that in the upcoming months/years there will be a number of construction activities within the downtown core that together with some of these special events that require street closures will cause traffic and pedestrian challenges (see Current and Future Development and Infrastructure Project map). This may result in complaints from the public. Resource allocations (public safety, public works, etc.) and frequency of events have proven to be much of a challenge, in of itself, that may lead to denial of special events permits if these events cannot be adequately staffed by the City or other entities. For this reason staff is seeking Commission direction as to the future of special events within and around the downtown core, but more specifically, if the Commission supports continued use of Main Street for New Year s Eve and Thunder by the Bay Events. Both Events, as well as others, have already made their request for dates and locations for 2016/17. Included in this package are: Current Ordinances and Resolutions for Special Events, Current Map and description of the Downtown Core, Identification of Event Zones with and surrounding the Downtown Core, Listing of Events for 2016 noted with event zone; number of days for the event (including set up and tear down); if street closure is required and proposed categorization of event. 16 RESOLUTION N0.14R-2419 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SARASOTA, FLORIDA, REVISING THE SPECIAL EVENT FEE SCHEDULE FOR THE USE OF CITY PARKS, URBAN AREAS AND LINEAR SPACES; PROVIDING FOR READING BY TITLE ONLY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Sarasota City Code Section calls for special event permit fees to be established by resolution of the City Commission; and WHEREAS, the City Commission previously adopted Resolution No. 14R-2392 and an attached Special Events Fee Schedule, effective January 1, 2014; and, WHEREAS, the City Commission has determined that it was in the best interest of City taxpayers for users of City parks, open urban areas and linear spaces to pay a larger share of the costs to operate and maintain these public assets; and WHEREAS, the City Commission, at its June 29, 2015 Budget Workshop for the 20 15/2016 fiscal year, determined that it was in the best interest of the City to provide an onsite event monitor for special events; and WHEREAS, the office of special events has determined that in order to cover the costs of an onsite event monitor an increase in various fees is necessary to cover increased personnel and administrative expenses; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SARASOTA, FLORIDA: Section 1. The City Commission previously determined that a Special Event Fee Schedule is the best method of providing for greater user participation in costs associated with the use of City parks, open urban areas and linear spaces. Section 2. The City Commission hereby adopts the City of Sarasota Special Event Fee Schedule, effective October 1, 2015, attached hereto as Exhibit "A." Section 3. This Resolution shall take effect on October 1, Page13 of 38

18 Exhibit A City of Sarasota Special Event Fee Schedule Effective as of October 1, 2015 Fee Schedule General: The fee charged to the applicant/sponsor shall include the time needed for setup and teardown of their event or other use. The sponsor/representative shall be present for the duration of the usage period. Overage of allotted time shall result in additional charges. Application Fee: A non-refundable $50.00 fee is due at time of submission to review all Special Event Request applications. Restricted Events or those with a For-profit Sponsor: Special Events that include the restriction of the public into an event (public must pay a fee to attend the event), or are sponsored by a for-profit organization, will be charged a permitting fee of $33.00 per hour per 10,000 Square Feet of event space, or $415.00, whichever is greater. Wedding Fee: A wedding permit shall be available to permit the act of performing a wedding in a public space for $250. Park Permit Fee: A park permit shall be available for $50. Sound Permit Fee: A sound permit that grants a waiver of City Ordinance # shall be available for $50. Exemption from Special Event Permitting Fees: The City Commission resolves to designate six (6} annual community events as permanently exempt from Special Event permitting fees as follows: The Dr. Martin Luther King, Jr. March, The Memorial Day Parade, The Veterans' Day Parade, The Holiday Night of Lights in St. Armands Circle, The Downtown Holiday Parade and National Night Out. Sales Tax: Applicable sales tax may apply and must be added to the fees for Event Sponsors. Security Deposit: A Security deposit for Public Works and Police services is due 31 days prior to event. The Amount of the deposit ($500-$10,000) will be determined by the size of the event and the activities included in the event. Security deposit will be refunded upon payment of city services. Non-Refundable Reservation Fee: City of Sarasota Parks and Urban Spaces Reservation Form and License Agreement must be accompanied by a non-refundable $ Reservation Fee to secure a date and location. However, if an applicant sponsors four (4} or more events during a calendar year, they may keep a rolling $1, deposit to cover all of their events with the understanding that if they cancel any event they shall forfeit $ The $ shall be replenished immediately or the deficit in the rolling deposit shall be a basis for revocation of the permit. Late Filing Fee: Special Event applications that are received less than 90 days prior to the event date will be charged a $ Late Filing fee. Page16 of 38

20 Change Order Fee: Revisions made to the Special Event application after the date of submittal will be charged a $50.00 Charge Order fee. Cancellations and Refunds: Cancellation of a Scheduled Special Event will be allowed a full refund minus the $ Reservation Fee when occurring 30 days or more prior to the event date. Cancellation of a scheduled Special Event will not be provided a refund of any fees when occurring less than 30 days prior to the event date. WHEREAS, the City special events office issues permits for various special events held throughout the year within the right of way of Main Street from Orange Avenue to Gulfstream Avenue; and, WHEREAS, on April 21, 2014, representatives of the special events office appeared before the City Commission to recommend a temporary moratorium on street closures for this segment of Main Street commencing after the Fourth of July weekend and continuing through September 2015 due to numerous construction projects taking place during that time period including the State Street municipal parking garage; and, WHEREAS, construction of the State Street parking garage is currently underway and has resulted in the loss of 139 surface parking spaces; and, WHEREAS, the parking shortage resulting from the loss of these 139 parking spaces would be exacerbated by the closure of Main Street, thereby depriving patrons of downtown businesses the ability to park on Main Street; and, WHEREAS, the list of construction projects presently scheduled to occur during the period of the recommended moratorium presented to the City Commission on April 21, 2014 has been appended to this Resolution as Exhibit "A"; and, WHEREAS, the ability of vehicles to travel on Main Street while these projects are ongoing would facilitate traffic circulation downtown when various other streets will be closed during the construction of the projects listed on Exhibit "A"; and, WHEREAS, the special events office has recommended that the closure of Main Street for parades be exempted from this moratorium; and, WHEREAS, the special events office has recommended that the closure of Main Street to accommodate the annual Downtown New Year's Eve event and the annual Thunder By the Bay event be exempted from this moratorium because these events are Page18 of 38

22 unique in Sarasota and have a more beneficial economic impact than other events which require the closure of Main Street; and, WHEREAS, by adoption of this Resolution the City Commission is not seeking to discourage special events downtown and encourages the sponsors of special events formerly held on Main Street to consider alternative locations in the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SARASOTA, FLORIDA: Section 1. The Main Street right of way between Orange Avenue and Gulfstream Avenue shall be kept open and shall not be closed to vehicular traffic in order to accommodate special events during the period commencing on July 7, 2014 and ending on September 30, Except as provided in Section 2, the City special events office shall not issue any permits for special events to be conducted within this segment of Main Street during this period of time. Section 2. Exceptions to the above prohibition on the closure of Main Street for special events are hereby authorized for the New Year's Eve event and for the Thunder By the Bay event. Section 3. 24 RESOLUTION NO. 1 SR-2508 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SARASOTA, FLORIDA, DECLARING A MORATORIUM ON STREET CLOSURES FOR MAIN STREET BElWEEN ORANGE AVENUE AND GULFSTREAM AVENUE COMMENCING OCTOBER 2015 AND CONTINUING THROUGH SEPTEMBER OF 2016 IN ORDER TO MITIGATE THE IMPACT OF VARIOUS DOWNTOWN CONSTRUCTION PROJECTS; PROVIDING FOR EXEMPTIONS; PROVIDING FOR READING BY TITLE ONLY; AND PROVIDING FOR AN EFFECTIVE DATE. 27 ORDINANCE NO AN ORDINANCE OF THE CITY OF SARASOTA, FLORIDA AMENDING THE SARASOTA CITY CODE, BY CREATING A NEW CHAPTER 29.6, TO BE ENTITLED "SPECIAL EVENT PERMITS"; PROVIDING FOR THE ISSUANCE OR DENIAL OF SPECIAL EVENT PERMITS IN ACCORDANCE WITH THE TERMS HEREOF; PROVIDING FOR SPECIAL RESTRICTIONS AND REQUIREMENTS FOR SPECIAL EVENTS IN ST. ARMANDS CIRCLE PARK; AMENDING CHAPTER 22 OF THE CITY CODE; ARTICLE II, PARK PERMITS, IN ORDER TO BETTER DISTINGUISH "PARK PERMITS" FROM "SPECIAL EVENT PERMITS"; AMENDING THE SARASOTA CITY CODE, CHAPTER 30, "STREETS, SIDEWALKS, AND OTHER PUBLIC PLACES", ARTICLE II, "RIGHT-OF-WAY PERMITS AND FEES", SECTIONS AND 30-23; PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR READING BY TITLE ONLY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the office of special events is responsible for the processing and issuance of special event permits, and, WHEREAS, the City has historically permitted special events though an administrative process, and, and, WHEREAS, special events occur both in City owned parks and right-of-ways, WHEREAS, the City desires to codify the administrative rule requiring two-thirds (2/3) approval of impacted property representatives for street closures less than seventy-two hours for special events occurring once per year, and, WHEREAS, due to the increasing frequency and complexity of special event permit requests, the City desires to codify the special event permitting process, and, WHEREAS, the City Commission wishes to codify uniform standards for the approval or denial of special event permits, and, WHEREAS, the City Commission finds that there are ample alternative locations available during peak tourist season to justify a temporary moratorium on events in St. Armands Circle Park; and, Page24 of 38

28 WHEREAS, the City Commission finds that the unique location of St. Armands Circle Park on a barrier island, surrounded by a traffic circle in the Commercial Tourist Zone District warrants special criteria applicable to the issuance of special event permits in St. Armands Cirde Park. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SARASOTA, FLORIDA: Section 1. The Sarasota City Code, Chapter 22, "Parks and Recreation," Article II, "Park Permits," Sections through 22-23, is hereby amended to provide as follows: (New text is indicated by underline. Deleted text is indicated by strikethro1:jgh.) Sec Definitions. As used in this chapter, the following terms shall have the following meanings: City Manager means the City Manager of the City of Sarasota, or his or her designee. GovernmeRtal agency means any federal, state, county, municipal, district, board or separate 1:Jnit of go-. emment created or established by law and shall include but not be limited to the State of Florida, Sarasota County, the City of Sarasota, the Sarasota Bradenton Airport Authority and the School Board of Sarasota County. Office of special events means the City employee or employees designated by the City Manager for the processing of requests for special event permits and park permits and requests for right-of-way usage permits when necessary to conduct a special event. Person means the state or any agency or institution thereof, a municipality, political subdivision, public or private corporation, individual, partnership, association or other entity, and includes any officer, employee, agent or governing or managing body of any municipality, political subdivision or public or private corporation. Public park means a park or parks, or beach owned, operated or maintained by the City. Sec Permits-Required. {a) Except for events of a governmental agency, a special event A park permit shall be required for any public assembly, picnic or other event in any public park involving seventy-five (75) or more individuals or to use a public park during hours it is open pursuant to article Ill of this chapter. Persons seeking to reserve park facilities or amenities for events to be 2 Page25 of 38

29 attended by fewer than seventy-five (75) people that do not require city services or commercial vending may do so on a first-come. first-served basis by contacting the office of special events. Such reservation shall not require a special event permit or a park permit. (b) (c) {d) A person may seek a special event park permit from the City Manager office of special events by submitting, on a form provided by the City Manager, a fully completed special event park permit application. A special event park permit may only be issued for a specified limited period of time and shall set forth such conditions or requirements as shall be deemed necessary to mitigate potential adverse effects upon the public park and neighboring properties and to otherwise ensure that the public health, safety and general welfare is protected. The City Manager may adopt administrative rules, as he or she deems necessary, to implement the pro>asions of this seotion. The City Manager office of special events shall grant or deny an application for a special event park permit within fifteen (15) days from the date of the filing of a fully complete application. If no decision has been made, upon the expiration of the fifteenth day, or if the fifteenth day is a Saturday, Sunday, or holiday, upon the following working day, the application shall be deemed to be granted. The City Manager office of special events may deny an application for a special event park permit if the applicant, or the person on whose behalf the application for permit was made, has on a prior occasion made a material misrepresentation regarding the nature or scope of an event or activity previously permitted by a special event park permit, or, who has previously violated the terms of a prior special e 1ent park permit, issued to or on behalf of the applicant. An application for special event park permit may also be denied on any of the following grounds: (1) The application for a special event park permit (including any required attachments and submissions) is not fully completed and executed; (2) The applicant has not tendered the required application fee, if any, with the application or has not tendered the required user fee, indemnification agreement, insurance certificate, or security deposit, if any, within the times prescribed by the City Manager office of special events; (3) The application contains a material falsehood or misrepresentation; (4) The applicant is legally incompetent to contract or to sue or be sued; 3 Page26 of 38

30 (5) The applicant or the person on whose behalf the application for the special event park permit has been made has on prior occasions damaged City property and has not paid in full for such damage, or has other outstanding and unpaid debts to the City; (6) A fully executed prior application for a special event park permit for the same time and place has been received, and a special event park permit has or will be granted to the prior applicant, authorizing uses or activities which do not reasonably permit multiple occupancy of the particular public park or part thereof; (7) The use or activity intended by the applicant would conflict with previously planned programs organized or conducted by a go 1emmental agency person and previously scheduled for the same time and place; (8) There are alternate locations available, within the public park, or at another public park, where the event may reasonably be located without creating the type or degree of potentially adverse effects it is anticipated would result at a site for which the special e 1ent park permit is requested; (9) The proposed use or activity is inconsistent with the classification or uses of the public park, as set forth by administrative rule adopted by the City Manager to implement the prov~sions of this section pursuant to Sarasota City Code Sec (10) The use or activity intended by the applicant would present an unreasonable danger to the health or safety of the applicant, or other users of the public park, of government employees or of the public; (11) The applicant has not complied or cannot comply with applicable licensure requirements, laws, ordinances or regulations of the state, the county or the City concerning the sale or offering for sale of any goods or services; or (12) The use or activity intended by the applicant is prohibited by state or federal law or by ordinances or regulations of the county or the City. (e) Grant or denial of an application for special e 10nt park permit. (1) The City Manager office of special events shall grant the application for special event park permit, with or without special conditions, and 4 Page27 of 38

31 shall issue the special event park permit, unless grounds exist which require denial. (2) The speoial e\<ent park permit, if granted, shall state on its face the name and address(es) of the person or persons to whom it is granted, the period of time in which it is valid, the location applicable to the special event park permit and any special conditions or requirements imposed thereby. The special e11ent park permit may not be transferred to any other person or location. (3) The office of special events shall approve. approve with conditions. or deny any request for a park permit. based upon the standards contained in this section. In the event of a denial. or an approval with conditions. the office of special events shall specify which standards under this section that the decision was based upon. These findings shall be provided in writing. with specificity. to the applicant. The office of special events. where feasible. shall propose measures to cure the defects in the application and/or suggest alternative times or places. (f) Appeal. ( 1 ) An appeal of a decision of the City Manager office of special events may be made by the applicant, in writing to the City Auditor and Clerk, within thirty (30) fifteen (15) days of the rendition of the decision, to the special master for a hearing de novo. A decision of the City Manager office of special events shall be deemed to have been rendered on the date of a letter prepared by the City Manager office of special events notifying the applicant of the decision of the City Manager.:. (2) The special master assigned to hear the appeal shall conduct a hearing thereon within fifteen (15) days of the filing of the notice of appeal, and shall make a final administrative decision, based upon the limitations and criteria set forth in sections 22-22(a) (c), inclusive, within seven (7) days thereafter. In addition, the special master shall consider the administrative rules, if any, adopted by the City Manager pursuant to section 22 22(a). (3) The special master shall make findings of fact that the criteria set forth in section 22-22(-6) have or have not been satisfied by the applicant for a speoial park permit. (4) In the event the special master grants the appeal park permit, the special permit issued thereby shall be issued for a specified limited period of time and shall set forth such conditions or requirements 5 Page28 of 38

32 as shall be deemed necessary by the special master to mitigate potential adverse effects upon neighboring properties and to otherwise ensure that the public health, safety and general welfare is protected. (5) Action taken by the special master to grant or deny the appeal permit shall be documented in a final order. The final order shall be filed with the City Auditor and Clerk. (6} An appeal of the decision of the special master may be made to the Twelfth Judicial GCircuit GCourt for taesarasota GCounty by filing a petition for writ of certiorari as provided for under the Florida Rules of Appellate Procedure. A decision of the special master shall be deemed to have been rendered on the date the final order is filed with the City Auditor and Clerk. (7) When an appeal of a denial of a park permit at St. Armands Circle Park is filed with the City Auditor and Clerk. the office of special events shall provide a copy to the St. Armands Residents Association. St. Armands Circle Association. and St. Armands Business Improvement District via . (g) (h} A special event park permit issued pursuant to this section shall be readily available for inspection during the permitted activity and shall be presented for inspection to any City officer or other City employee upon request. Any violation of any conditions imposed upon the granting ta of the special evert park permit shall be deemed a violation of this chapter. Sec Prohibitions. It shall be unlawful for any person to participate or engage in any public assembly, picnic or other event in any public park involving seventy-five (75) or more individuals for which evert a special event park permit, as required by the chapter, has not been granted by the City Manageroffice of special events. Notwithstanding the above. spontaneous events such as public assemblies that occur without planning and organization by an identifiable person or persons and that unknowingly result in an assembly of more than seventy-five (75) people shall not be considered unlawful absent a threat to the public health, safety or welfare. Section 2. The Sarasota City Code, Chapter 29.6, "Special Event Permits," Article I, Sections through , is hereby created and shall provide as follows: (New text is indicated by underline. Office of special events means the City employee or employees designated by the City Manager for the processing of requests for special event permits. park permits. and right-of-way usage permits when necessary to conduct a special event. Person means the state or any agency or institution thereof. a municipality, political subdivision. public or private corporation. individual. partnership, association or other entity, and includes any officer. employee. agent or governing or managing body of any municipality. political subdivision or public or private corporation. Public park means a park or parks. or beach owned. operated or maintained by the City. Special event means any organized activity occurring on City-owned property or within City maintained right-of-ways for which the organizer requests the use of City services above and beyond the ordinary everyday use. or which requires a commercial vending permit. pursuant to Section Special event request means the forms provided by the office of special events in order to apply for a special event permit. Special event reservation request means a form provided by the office of special events requesting that a date{s) be reserved for a specific event. Sec Permit Required. (fil No person or persons shall conduct a special event without first having obtained a special event permit from the City's office of special events. Sec Permit Application. lli) A person may seek a special event permit from the office of special events by submitting a fullv completed special event request. A special event permit may only be issued for a specified limited period of time and shall set forth such conditions or requirements as shall be deemed necessary to 7 Page30 of 38

34 mitigate potential adverse effects upon the event location and neighboring properties and to otherwise ensure that the public health. safety and general welfare is protected. (Q} {fil (Q} A special event request must be received by the office of special events at least ninety (90) days in advance of the event date. No special event reservation request will be accepted more than threehundred sixty-four (364) days in advance except that events that were permitted in the previous year may submit a special event reservation request no more than three-hundred seventy-four (374) days in advance. No special event reservation request will be accepted without payment of a non-refundable reservation fee. ~ Special event reservation requests received prior to the adoption of this ordinance shall be processed according to the City's policies in place at that time. Sec Fees. Special event permit fees shall be established by Resolution adopted by the City Commission. Sec Standards for Approving. with or without Conditions. or Denying the Special Event Permit..(fil A request for special event permit may be denied on any of the following grounds: ill The special event reservation request was submitted more than three-hundred and sixty-four (364) days in advance. or if the event was permitted the previous year. the reservation request was submitted more than three-hundred and seventy-four days (374) days in advance. ~ The special event request was submitted less than ninety (90) days prior to the event date: Q} The applicant has not tendered the security deposit, flat rate permit fee. or certificate of liability insurance thirty-one (31) days in advance of the proposed event date: (1} The special event request (induding any required attachments and submissions) was not fully completed and executed: 8 Page31 of 38

A special event reservation request for the same time and place has been received. and a special event permit has or will be granted to the prior applicant. authorizing uses or activities which do not reasonably permit multiple occupancy of the particular location or part thereof: The use or activity intended by the applicant would conflict with a previously planned event scheduled for the same time and place;.(11) There are alternate locations available where the event may reasonably be located without creating the type or degree of potentially adverse effects it is anticipated would result at a site for which the special event permit is requested; ml The proposed use or activity is inconsistent with the classification or uses of the permit area or surrounding area: ~ The use or activity intended by the applicant would present an unreasonable danger to the health or safety of the applicant. government employees. or the general public; il.1} The applicant has not complied or cannot comply with applicable licensure requirements. laws. ordinances or regulations of the state. the county or the City concerning the sale or offering for sale of any goods or services: ilfil The use or activity intended by the applicant is prohibited by state or federal law or by ordinances or regulations of the county or the City; 9 Page32 of 38

Restrictions and Requirements for Special Event Permits for events in St. Armands Circle Parl<. ill The office of special events shall not issue special event or park permits for events to be held during the time period from February 1st through April 30 01,( } During the remainder of the year. no more than one special event shall be permitted in St. Armands Circle Park per weekend and no more than two (2) special events per month shall be pennitted in St. Armands Circie Park except for the months of January and October. when no more than three (3) events per month shall be No activities associated with the event (including set up and removal) shall take place in the park prior to 7:00 am or after 11 :OO pm. (1} Storage of materials and equipment for the special event shall not occur more than one day prior to the commencement of the event and all materials and equipment placed in the park for the event must be removed no later than one day after the event..(fil {fil No special event shall cause the closure of lanes of traffic on St. Armands Circle or shall re-direct traffic from its normal flow around the Cirde. When a reservation request for a special event in St. Armands Circle Park is filed with the special events office. notification shall be given to the St. Armands Residents Association, St. Armands Circle Association and the St. Armands Business Improvement District via that the request has been filed. 37 that the notice of the reservation request was ed to the aforementioned parties..!..} The office of special events shall approve, approve with conditions, or deny any request for a special event permit. based upon the applicable standards contained in this section. In the event of a denial. the office of special events shall specify the particular standards under this section that the decision was based upon. These findings shall be provided in writing. with specificity. to the applicant. Sec Granting. with or without Conditions, or Denying a Request for Special Event (Q} If the conditions precedent to a timely special event request have been met. the office of special events shall approve. with or without special conditions. or deny a request for a special event permit by the thirtieth (30th) day prior to the proposed event. If no decision has been made. uoon the expiration of the thirtieth (30th) day, or ifthe thirtieth (30tti) day is a Saturday. Sunday. or holiday, upon the following working day, the permit shall be deemed to be granted. The special event permit. if granted. shall state on its face the name and address( es) of the person or persons to whom it is granted. the period of time in which it is valid. the location applicable to the special event permit and any special conditions or requirements imposed thereby. The special event permit may not be transferred to any other person or location. Sec Presentation of permit. A special event permit issued pursuant to this section shall be readily available for inspection during the permitted activity and shall be presented for inspection to any City officer or employee upon request. In the event that an applicant desires to conduct a special event within the City right of way that will not occur more frequently than once during a calendar year and will last seventy-two (72) hours or less, then the applicant must obtain signatures from two thirds of the impacted property owners, neighbors and businesses representatives indicating no objection to the proposed street closure. Impacted property representatives are those persons who own property, conduct a business or reside on a section of street proposed for closure; or those on a street which has its sole ingress and egress on a section of street proposed for closure: or whose private parking access is on a section of street proposed for closure. In the event that a signature is obtained from an impacted property representative who conducts a business. then the signature shall be obtained from a proprietor or manager of the business establishment. A list of impacted property representatives mav be obtained from the office of special events. Where impacted residents are members of a condominium association. an association representative shall sign on behalf of the residents. Each impacted property representative whose signature is obtained must be provided with a "Notice of Proposed Street Closure". The applicant shall bear the sole cost of obtaining the required signatures which shall be presented to the office of special events for verification..(ql Special event that will occur more frequently than once per year. In the event that the applicant desires to hold a special event that will require a street closure on a recurring basis more frequently than once during a calendar year then notice shall be provided in accordance with subparagraphs (b) and (c) (1) and (2) below. (For purposes of this paragraph, if one organization holds multiple events, these events shall be treated as separate events (even though they may be similar), and if one organization holds a single event over a number of days, the event shall be treated as a single event. fb) ill Written notice of the application for right of way usage permit shall be mailed by the office of the city auditor and clerk to the owners of all properties within five hundred feet (500 ft.) of the segment of the public street that is requested to be closed. When commercial or business properties are known to be occupied by tenants, the applicant shall provide notice to tenants as well, and the applicant shall execute an affidavit that a reasonable effort was made to notify all tenants within the aforesaid area. The written notice shall also be provided to impacted neighborhood associations, property owners' associations or merchants' associations as the case may be. The applicant shall be responsible for the cost of mailing the required notices. {G) 0 The notice required by subparagraph fb) ill above shall be entitled 11 Notice of Proposed Street Closure" and shall identify the street or segment of the street that is the subject matter of the request for closure and shall further identify the applicant, the nature of the special event for which the street closure 12 Page35 of 38

39 is requested and the dates, times, duration and frequency of the street closures requested. The Notice of Proposed Street Closure shall advise all recipients that a decision on the application for a right of wav usage permit to allow the street closure will be made by the City Manager office of special events unless the Office of the City Auditor and Clerk receives written requests from at least five (5) recipients requesting that the application be decided by the City Commission at a public hearing within fourteen (14) days after receipt of the Notice. In the event that the Office of the City Auditor and Clerk receives five timely written requests that the application for a usage permit be considered by the City Commission, then the City Auditor and Clerk shall place the application for a usage permit on a City Commission agenda to be heard at a legislative public hearing. AA.Q} The provisions of subparagraphs (b) and (c) (1) and (2} above shall apply only to those applications for usage permits to allow street closures to accommodate special events that will occur more frequently than once a year. The provisions of subparagraphs (b) and (c) (1) and (2) above shall not apply to the Saturday morning Farmers' Market currently operated by the Downtown Partnership of Sarasota, Inc. SFMV. Inc.. on Lemon Avenue and shall not apply to any renewals of the Usage Permit for the Farmers' Market at the time and place where it is currently permitted. The provisions of subparagraphs (b) and (6) (1) and (2) above shall likewise not apply to the Saturday morning Newtown Open Air Market currently operated by the Greater Newtown Community Redevelopment Corporation on Washington Court adjacent to Fredd "Glossie" Atkins Park and shall not apply to any renewals of the usage permit for the Newtown Open Air Market at the time and place where it is currently permitted..(qi Notice of Proposed Street Closure The notice required by paragraphs (a) and (b) above shall be entitled "Notice of Proposed Street Closure" and shall identify the street(s} or segment of the street(s) that are the subject matter of the request for closure and shall further identify the applicant. the nature of the special event for which the street closure is requested and the dates. times. duration and frequency of the street closures requested. If the street closure is approved. then no material alteration to the nature of the special event. dates. times. duration or frequency may be made thereafter. Section 4. Ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 5. Severability. Should any section, sentence, clause, part or provision of this ordinance be held or declared invalid or unenforceable by a court of 13 Page36 of 38

40 competent jurisdiction, the same shall not affect the validity of this ordinance as a whole, or any part thereof, other than the part held or declared to be invalid. Section 6. This Ordinance shall take effect immediately upon second reading.
