1 Prison Number 4: Baggha Prison Inspection Report Date Timing - 11 am to 02:40 pm. Name of Jail Superintendent - Mr Manoj Kr. Chaudhary Name of Assistant Superintendent Mr. A.K.Singh Capacity of Prison (456 male +25 females) No of inmates on the date of inspection (294 male +11 females) I visited the prison with Sub-Judge 2 Shri Rajesh Singh and Judicial Magistrate First Class Shri R.K.Singh. No board showing the number of inmates, number of convicts and the number of under trials there. CCTV cameras not functioning and video conferencing has not started in the prison yet. Li Fang Thing Foreign National Prisoner. Chinese citizen. Inmate for 9 months. Accused under Sec 14 of the Foreigner's Act. Doesn't know any language except Chinese. Has not been convicted yet. Immediate proceedings of repatriation needs to be initiated. Observation on New building Construction: New construction of a building consisting of 4 wards has been going on for around 10 years. Yet the construction is incomplete. Report to the IG, on the status of the construction, has been submitted recently on A copy of the relevant part of the report is attached herewith.
2 I feel there is no requirement for the new building due to substantial decrease in the number of inmates in prison. The number of inmates in the prison is below the capacity. In the existing strength of inmates already 4 wards are empty. Moreover, the construction is going on for 10 years and still it is not complete. It's a two story building but no stairs have been constructed for going on the roof. So the roof is already cracking by now. Also, on one hand a new building is being constructed, and on the other hand constant depreciation of the construction is happening. No steps are taken for maintenance of existing structure. The under construction building is already in a dilapidated condition. Status of Legal Aid: 47 inmates out of 307 inmates didn t have lawyers needed legal aid lawyers. Legal Aid Clinic Legal aid clinic running in prison, but due to lack of space no Legal aid clinic in the Court premises. Although legal aid is provided to the needy persons. Name of 25 lawyers have been forwarded to BSLSA for legal aid panel and has been approved.
3 2 lawyers have been deputed for legal aid clinic in prison. Legal aid clinic is operated once a week on Sunday and one of the two lawyers visits. Two PLVs from among the inmates, namely Parsuram Mishra and Chandan Mahto have been appointed and they assist the lawyers in identifying cases and drafting petitions. Women's Wing 11 inmates, 3 children. 1 fan, working. Toilet there for night use, no running water. Open drainage chamber behind the ward, needs to be repaired urgently. There are 8 toilets outside for day use, but all of them are dysfunctional. o Urmila Devi - Inmate for 1 year. Accused under Sec 302. No lawyer. Needs Legal Aid Lawyer. Her 3 year old child is with her in the prison. For the child she gets 1 kg milk powder. o Kusum Devi - Inmate for 10 months. Co-accused of the above mentioned accused. No lawyer. Medical Facility There is no hospital in the prison. There are no permanent doctors or doctors on deputation posted here. Dr. S. N. Mahto visits on call. The medical screening of the Aamad prisoners is conducted by compounder. The pro forma which has to be filled with the information about the medical condition of the inmates, requires a lot of tests to be done, whose facility is not available in the prison. No HIV/Hepatitis kit, pregnancy kit etc. available. Only BP instrument, thermometer and Glucose Sugar kits and government supply medicines are available. Other Issues Infrastructure Wiering of the whole prison is damaged and breaks down regularly. Transformer is also damaged and needs replacement. The generator of the prison is also damaged and needs replacement. The number of barracks is less compared to the number of guards. Application has been sent for this by the prison authorities.
