1 Purnea Central Prison Visit Report Date: Visit by Ms. Smita Chakraburtty along with CJM Sri Satyandra Pandey. Jail Superintendent: Mr. Jawaharlal Prabhakar Prison Entry Time-1:00 pm Prison exit-19:05 pm Capacity of Prison Strength on the date of inspection- Board showing the number of inmates, number of convicts and the number of under trials present. In the office of the superintendent: On the last Saturday of every month report on Sec-436 A CrPC is sent by the prison authority to the CJM. Court production of remand prisoners are done by video conferencing and under trials go to the court for their production. There is one Foreign National convicted prisoner. This Central Jail was constructed in 2010, deep cracks found in the walls of women ward and a long deep crack in the watch tower was observed. The cracks were caused due to the earthquake. The watch Tower had also tilted to a certain extent thus the sipahi wasn t climbing up on it. Watch tower outside Male Wing gate cracked and tilted due to earthquake. 15 CCTV cameras are installed but none is functional, leaving the entire security establishment in the central jail totally manual. In the jail premises there is a metal detector but that too was non functional. Prison Hospital The medical screening form was not updated, it was the old form. The tests mentioned in that screening form are asked orally from the inmates. There are few test kits available here, for an example blood samples are collected from prison. But mostly tests are referred to the city hospital. There were no medical kit available for pregnancy test, hepatises test, malaria test, diabetic test and TB test.

2 It is recommended that if the tests written on the screening form cannot be performed in the prison hospital, they must be removed from the list. TB ward is available but there is no TB patient in the prison There is no mentally ill inmates ward and the prison does not have a psychiatrist and is not attached to any mental asylum. The mentally ill inmates are sent to city hospital but they are sent back to the prison from the hospital. The X-ray room was found non operational. Equipments have depreciated and become dysfunctional because of no maintenance. There was no assistant either to operate the machine. Medical examination of Aamad inmates: o X- Ray machine defected. So inmates sent to district hospital, if need of X-Ray there. o Pathology there with the facility to do Blood Sugar test. No Blood Sugar kit present. o No HIV/Hepatitis kit there. If the doctor feels the need then blood sample is sent to hospital. o Pregnancy test kit not there. o The pro forma which has to be filled with the information about the medical condition of the inmates, requires a lot of tests to be done, whose facility is not available in the prison hospital. Hospital has three convicts working as dressers. No pharmacist is there. Medicine supplied by the government provided to the inmates. No separate ward to mentally ill inmates. No attachment with any mental asylum to send the mentally ill inmates. Hospital Ward-1 20 beds, 1 toilet, no running water, 10 fans all working. Special cases: o Shivnath Mehta - Inmate for 19 months. Convicted for murder. 85 years old. Frail, suffering from arthritis, walks with great difficulty. o Upendra Mehta - Inmate for 19 months. Convicted for murder. 80 years old. Can't speak or walk. o Abdul Gaffar- 87 years of age, 7 years conviction in dowry death, 16 months in prison, pain in the body

3 o Thanak Lal Chowdhary-2 years in prison in dowry death cases. Despite having a lawyer, he desired to have a government lawyer. Needs Legal Aid Lawyer, since private Lawyer does not meet him in court or comes to visit him in prison so he has no idea of lawyer. Md. Taufique-3 years in prison accused of terrorism activities, mentally ill. handcuffed and tied to the bed because of his violent behaviour. Bangladeshi National. 4. Hikmad Ali-5 months in prison, accused of terrorist activities, mentally ill 5.Lalu Mahto- Mentally Ill, 4 years in prison under dowry death charges 6. Tetar Hrishi-9 years in prison for assault and fighting charges, in the hospital for 2 years after a violent fight in the prison, bed ridden since then. Hospital Ward-2 15 beds. 2 fans, working. 1 toilet, no running water. Special cases: o Hasibar Rehaman - Inmate for 3 months. Mentally ill. o Md. Aziz - Inmate for 2 months. 90 years old. o Krishna Mahto - Inmate for 4 1/2 years. Mentally ill. o Noor Alam - Inmate for 3 years. Mentally ill. 1.Ganeshi Mandal transferred from Madhipura jail for months back years old 20 years conviction under 302IPC Bail rejected by the high court. 2. Shukru Sharma 9 months in total in prison Has no lawyer. Needs Legal Aid Lawyer. Medicines are brought from home for healing of Burnt skin. 3. Devanand Paswan 4 years in purnea prison, 8 years in total in prison in dowry death case Has no lawyer and has not applied for the same. Desired to have a lawyer in the HC (HC Appeal).

4 Kitchen All store rooms were well cemented. Threat of mice infewstation only from outside and the open ventilations. Blankets were said to be made by the inmates, but the prison clothes come from Bhagalpur Prison. WOMEN WARD CCTV was installed but all are damaged. 5 wards. o Ward 1-4 inmates, 2 fans. o Ward 2-8 inmates, 2 fans. o Ward 3-9 inmates, 2 fans. o Ward 4-6 inmates, 2 fans. o Ward 5-7 inmates, 2 fans. Toilet for night use in every ward, with running water. 12 toilets for day use with running water. 2 lady guards during day hours, 1 lady guard during night. 1 high security cell there. Solitary cell has no toilet for night use, no light or fan. No inmate was currently lodged in it. No crèche for children. Total: 33 inmates and 6 children. No separate van for female inmate for court production. They go with the male inmates and sometimes at different timings, but with the male police constables. 1. Dhura Devi-75 years of age, 2 years and 4 months in prison under 302 IPC, has a lawyer 2. Pramila Devi-1 and half years in prison. under 302. Has a government lawyer but he never meets her. Needs Legal Aid Lawyer. 3. Khushbu Khartoom-20 years conviction in 302 IPC. Desired to have a government lawyer at the HC Appeal. 4. Aasima Khartum- 20 days in prison, no idea of case. No court production, only signed and returned. 5. Lalita Devi Fainted when earthquake happened, has been constantly fainting since then. May be a case of epilepsy

Iliyas-1 and half months in prison, X-ray is written by the doctor but he is not taken for the same because of unavailability of guards. But no action has been taken rather they have received no response as of now.

Sarju Yadav - Aged 80 years. Convicted for murder. Inmate for 7 years. Needs Lawyer for High Court Appeal. The 2 wards 17 and 18 where most of the aged prisoners were lodged were over crowded. When we entered ward there was a power cut but the inmates so could not verify if the fans were functioning. But inmates complained that fans are very old and are very slow, they are as good as having no fans. Aged inmates require more attention and better living condition. High Security Prison 10 solitary cells. No light or fan. Toilet inside but no running water. Currently 3 inmates are lodged in it: o Mirza Khan - As per jail authorities he is Afghan citizen. The inmate claims that he has Indian citizenship. Inmate for 6 years. He was sentenced to 3 years in prison, but couldn't be released as he is a foreign national. In solitary confinement for past 6 years. o Munna - In solitary confinement for past 1 year and 5 months. He ran away from prison. So as a punishment is lodged there. o Md. Shakeel - Inmate for 8 years. In solitary confinement for the whole period. Accused of murder. Jail authorities claim that he is mentally ill and becomes violent so lodged

20 there. He has no track of time. He couldn t understand what was asked and did not respond. Kitchen Food provided three times in a day: chana- gur in the morning, chawal-daal sabji at 10 am and 4 roti, sabji & daal at 5 in the evening. Tea is provided at 7 am and 3 pm. Preparation of roti starts at 8 am in the morning and the same is given at 5 in the evening for dinner. 22 inmates work in the kitchen.
