With respect to water assignments, this administrative order simply confirms the status quo. The Water Judge is appointed by the Chief Justice, and the Water Judge has the authority to make assignments in water cases.
5 5 Note 2: Judge Jovanovich will conduct a docket in Glenwood Springs on 3 Fridays per month. For Garfield County matters, he will preside over the child support enforcement docket, uncontested dissolution proceedings, replevin proceedings, and civil protection order proceedings. Throughout the District, Judge Jovanovich will preside over uncontested Rule 120 proceedings which do not require a hearing. Judge Jovanovich will preside over additional hearings and motions as his Friday calendar permits and as assigned in a particular case by the presiding District Judge. Other matters may also be assigned to Judge Jovanovich by the Chief Judge. Note 3: The CR, JV and JD dockets in Rio Blanco County shall be assigned on a rotating basis. Judge Nichols is assigned to these dockets for the period July 1- December 31, Thereafter, these dockets shall be rotated among Judges Petre, Lynch and Nichols in 6-month segments. The dockets are assigned to Judge Petre for the period January 1 through June 30, 2010; Judge Lynch for the period July 1 through December 31, 2010; Judge Nichols for the period January 1 through June 30, 2011; and the rotation shall thereafter continue in sequence. When a CR, JV or JD matter is ready to be set for a hearing or trial, the hearing or trial shall be set on the calendar of the judge in the Rio Blanco rotation at the time of the setting. Note 4: On a date to be determined, Judge Nichols will assume responsibility for all Pitkin County CR, JD, JV and Drug Court matters, and Judge Boyd will assume responsibility for Judge Nichols present portion of Garfield County CR, JD, and JV matters. Until this date is established by the Chief Judge, all new Pitkin County CR, JD, JV and Drug Court matters shall continue to be assigned to Judge Boyd; and 1 / 3 of all new Garfield County CR, JD trial and JV trial matters shall be assigned to Judge Nichols. Rio Blanco CV, DR and PR Cases: These cases will be assigned as filed on a basis to the District Judges hearing these cases. Without regard to the Judge of assignment, routine matters or short hearings which may be heard on a regular Meeker docket day shall be set on the docket day as time permits and shall be heard by the Judge then sitting in the Rio Blanco rotation. All DR matters throughout the district shall be directed initially to the family court facilitator. The family court facilitator shall continue to oversee all DR pre-hearing matters to the extent of the facilitator s authority unless otherwise directed in a particular case by the presiding judge. The Magistrate to be appointed may also hear such other matters as permitted by C.R.M. 6 and statute and as may from time to time be assigned to him by the Chief Judge.
