6 NHRC notices to Centre, states over charges of exploitation of Indians in Bangladesh By PTI 4 Aug, 2015, 10.38PM IST NEW DELHI: The NHRC has issued notices to Home and External Affairs Ministry as well as West Bengal and Assam state governments asking them to enquire into the allegations of exploitation of Indians residing in Indian enclaves of Bangladesh. In a statement here today, the National Human Rights Commission (NHRC) has said that many of them have allegedly not been included in Census for land compensation, and women are being "captured and sexually exploited". All the authorities concerned have been given four weeks' time to submit a detailed report in the matter. "The Commission noted that the "Text of Exchange of Letters on Modalities for Implementation of India-Bangladesh Land Boundary Agreement 1974 and Protocol of 2011 to the Land Boundary Agreement" specify the modalities for implementation of the Land Boundary Agreement of 1974 and Protocol of 2011 to the Land Boundary Agreement," an NHRC statement said. Therefore, it is observed that if the allegations of the complainant are true, these incidents amount to violation of not only human rights but also the agreement between the two nations," the Commission said. According to the complaint, received from the Indian Enclaves People's Committee and Kuchlibari Sangram Committee, represented by Ashwani Kumar Roy, the members of these committees are the affected persons in the Land Boundary Agreement between India and Bangladesh. The complainant has alleged that most of the residents -- Indians of the Bangladeshi Enclaves in India and Indian Enclaves in Bangladesh -- have not been counted in the Census conducted in the years 2011 and 2015 "There are 30,000 such persons," the complainant said.

7 04 August, 2015 Alleged exploitation of Indians residing in Indian Enclaves of Bangladesh: NHRC issues notice National Human Rights Commission (NHRC) has issued notices to the Secretaries of Union Home Ministry and External Affairs Ministry, Chief Secretaries of West Bengal and Assam and District Magistrates of Cooch Behar and Jalpaiguri, West Bengal requiring them to enquire into a complaint alleging that the Indians residing in the Indian Enclaves of Bangladesh are being denied basic amenities. Many of them have not been included in Census for land compensation and women are being captured and sexually exploited. All the concerned authorities have been given four weeks' time to submit a detailed report in the matter. The Commission noted that the "Text of Exchange of Letters on Modalities for Implementation of India-Bangladesh Land Boundary Agreement 1974 and Protocol of 2011 to the Land Boundary Agreement", specify the modalities for implementation of the Land Boundary Agreement of 1974 and Protocol of 2011 to the Land Boundary Agreement. The Clause 1(iv) of the letter dated June 06, 2015, signed by Foreign Secretary, Ministry of External Affairs, Government of India and Clause 1(iv) of the letter dated signed by Foreign Secretary of Government of People's Republic of Bangladesh states that both Governments shall facilitate orderly, safe and secure passage to residents of enclaves along with their personal belongings and moveable property to the mainland of India or Bangladesh, as the case may be, including through provision of travel documents. "Therefore, it observed that if the allegations of the complainant are true, these incidents amount to violation of not only human rights but also the agreement between the two nations," said NHRC in a statement. The National Human Rights Commission (NHRC) has issued notices to the central and state departments after receiving complaints of atrocities on Indians living in the Indian enclaves in Bangladesh. The notice, sent to secretaries of Union Home Ministry and External Affairs Ministry, Chief Secretaries of West Bengal and Assam, and District Magistrates of Cooch Behar and Jalpaiguri, has also recommended that an inquiry be ordered to probe the complaints, which it had received from Kuchlibari Sangram Committee (KSC), a people s organisation established in 1974 by nationalist forces and the RSS in the interest of national security. The rights commission has given the authorities four weeks time to submit a detailed report. Earlier, KSC had complained to the commission, saying that the Indian enclave dwellers residing across the border have been denied basic amenities and have not been included in the land compensation census. A release from the NHRC said that as per the specified modalities in the Land Boundary Agreement, governments of India and Bangladesh should facilitate orderly, safe and secure passage to enclave residents along with their personal belongings and movable property, including through provision of travel documents. The complainant, Sadhan Kumar Pal, alleged that people living in the Indian enclaves in Bangladesh have been subjected to several atrocities. Women have been sexually assaulted, houses have been burnt, he said. Pal added that the committee believes that most of the 30,000 people in Indian enclaves were not included in the census and therefore are not eligible for compensation. We demand that the Centre send security forces to rescue these Indians and bring them back, Pal said. He added that the committee wrote to the NHRC after its letters to the Prime Minister s office and to West Bengal Chief Minister fell on deaf ears.

9 NHRC writes to violations SNS Siliguri, 05 August, 2015 govt, officials over enclave rights The National Human Rights Commission (NHRC) on Tuesday issued notices to the secretaries of the Union home and external affairs ministries, the chief secretary of West Bengal and Assam and district magistrates, including that of Cooch Behar, over allegations of exploitation of "Indians residing in Indian enclaves" in Bangladesh. The NHRC has asked the officials to enquire into a complaint that alleged that the "Indians residing in the Indiann enclaves," which were incorporated in Bangladesh on 1 August 2015, are being denied basic amenities. "Many of them have not been included in the census for land compensation and women are being captured and sexually exploited. All authorities concerned have been given four weeks' time to submit a detailed report on the matter," the NHRC said in a Press release posted on its website on Tuesday. It may be noted that the Indian Enclaves People's Committee and the Kuchlibari Sangram Committee represented by Ashwani Kumar Roy, and the affected persons have alleged that several people (30,000) were not included in the census conducted in 2011 and They apprehend that they will be deprived and they want a new process to count them in. They also alleged that a group of land mafia had played a key role since many days in the Indian enclaves to keep control of farmlands and they allegedly even drove out many people from there. In an appeal to the NHRC, the complainants also alleged that they had approached the Prime Minister and Chief Minister seeking deployment of Indian forces there during the census, "but the authorities did not do the needful."
