1 BOROUGH OF LAVALLETTE (minutes) CAUCUS/REGULAR MEETING OF THE MAYOR AND COUNCIL LAVALLETTE MUNICIPAL BUILDING COUNCIL CHAMBERS July 12, :00 pm CALL TO ORDER: Mayor Walter G. LaCicero, presiding ROLL CALL: Council Members Borowski, Zalom, Lamb, Stogdill, Horan and Filippone Also present: Christopher F. Parlow, Borough Administrator/Municipal Clerk Philip George, Borough Attorney Donnelly Amico, Deputy Municipal Clerk READING OF THE OPEN PUBLIC MEETINGS ACT STATEMENT: Notice of this meeting complies with the Open Public Meetings Act. Public Notice was given to the Ocean County Gazette and was published in the Ocean Star on January 8, Notice was also posted on our Municipal Website and the Municipal bulletin board. MOMENT OF SILENCE: Mayor LaCicero asked for a moment of silence for all the troops lost in Afghanistan and for the troops that are still fighting. PLEDGE OF ALLEGIANCE: Councilwoman Filippone led us in the Salute to the Flag MAYOR S WELCOMING STATEMENT: Mayor LaCicero welcomed everyone to the meeting. COMMENTS FROM PUBLIC (Items not listed on agenda / not staying for remainder of meeting) Mayor LaCicero opened the floor to anyone who wished to comment on any items that were not on the agenda and did not wish to stay for the remainder of the meeting. Beverly Cleary, 2100 Grand Central Avenue stated that she would like to see Council support an ordinance to ban smoking on our Lavallette beaches in an effort to protect our beaches and promote a healthy environment for our town. Mayor LaCicero asked Ms. Cleary where she thinks this area should be from the street end to the boardwalk or further to the beach. Mrs. Cleary stated that some municipalities have designated certain beaches and areas as nonsmoking for a healthier environment. Mayor LaCicero stated that this issue has come up before and it did not get the needed support from the governing body at that time. 1

2 Council President Zalom stated that she is the beach captain for the beach sweeps and the first year she was involved cigarette butts were the number one item of debris collected. She stated that she contacted Phillip Morris and they provided the Borough with disposable ashtrays as a courtesy to hand out to smokers on the beach. She stated that she is happy to say that each year the cigarette butts that we picked up were less and less and now the number one on our list is water bottle caps. PRESENTATION FROM THE BEAUTIFICATION COMMITTEE- Patricia Marrone, President stated that the Beautification Committee wishes to donate snowflake decorations to attach to utility poles in town for the winter season. She reported that the committee wishes to call the theme of the decorations Winterfest instead of holiday decorations and would like to have the lights turned on the day after Thanksgiving until sometime in January. The decorations have LED lighting with white bulbs. There are three different types of snowflakes that will be used. The Committee has received a quote for $7,800 and that will pay for 23 snowflakes. The plan calls for a total of 28 snowflakes for the poles but right now the committee can only afford to pay for 23. She would also like to open this up to the businesses who have expressed an interest in purchasing some for the town. These decorations will reduce our carbon footprint as well as updating our look during the winter/holiday season. Council President Zalom questioned if they were going to be put on our new street lights in our downtown district. Mrs. Marrone stated that these would only be attached to the utility poles. Council President Zalom questioned if we would need permission to attach them to the poles. Mr. Parlow stated that the decorations are placed on poles owned by the Borough of Lavallette. Mayor LaCicero questioned what the decorations are made of. Councilman Horan stated that they are made of powder coated steel. Councilwoman Filippone questioned what length of time do we keep our Holiday decorations up. Mr. Parlow stated that he believes that we put them up right after Thanksgiving and remove them after New Years. Councilwoman Filippone stated that these snowflakes would be up roughly three weeks more. She also questioned whether we were going to still do the holiday swags. Mrs. Marrone stated that the Heritage Committee donated four swags last year and she does not think they were LED lights and we would prefer that our winter snowflake decorations not be put along with the swags. 2

3 Councilwoman Filippone stated that those swags were donated last year from the Heritage Committee and they are brand new so we cannot just get rid of them or not put them up. She stated she is not in favor of wasting a $4, donation and just not putting them up. Mrs. Marrone stated that there are more swags than just those four new ones and the other ones are very shabby and old and really need to be replaced and the Beautification Committee would ask that you not incorporate our snowflakes with the older decorations. Councilman Lamb questioned why the two different types of lights would not look good together. Mayor LaCicero stated that we all understand that the older swags are very old and probably need to go but there would be no reason why the newer swags can not go up along with the snowflakes. APPROVAL OF CLERK S MINUTES Regular Meeting of June 21, 2010 Executive Session Meeting of June 21, 2010 A Motion was made by Council President Zalom to adopt the Minutes. The Motion was seconded by Councilman Horan. Vote: Council Members Borowski, Filippone, Zalom, Horan and Lamb voted Yes. Councilman Stogdill abstained. The Motion Passed. REPORTS: a) Police Report for June-Councilwoman Filippone-read report b) Planning Board Report for June-Councilwoman Filippone-She reported that there was only one planning board case that was approved. c) Public Affairs Report for June-Council President Zalom- She reminded all not to forget to pick up your monthly calendars. We had the movie Greetings From the Shore shown to us on July 8 th down at the bayfront and it was so nice to see Lavallette on the big screen. The fireworks display was fantastic and everyone raved about how great it was. She thanked all of the businesses in town for their donations towards our display. We had the sandcastle contest on July 9 th and we had ten teams participating. The Breast Cancer Walk is scheduled for August 2 nd. The Municipal Alliance is holding two bust trips to the Blue Claws on July 31 st and August 15 th. d) Municipal Court Report for June-Councilwoman Filippone-read report e) Zoning Report for June-Councilwoman Filippone-read report f) Construction Report for June-Councilwoman Filippone-read report. Our current Construction Official has given his resignation as of July 14, We have hired a new Construction Official and Plumbing Inspector who has started as of today so there will not be any lapse in time. g) Animal Control Report for June-Councilwoman Filippone-read report h) Beach Badge Revenue for June-Councilman Lamb-read report-as of today, the revenues are up approximately $30,000 from last year even with last year being a record high. Also, we need to keep advising people that they need to check the ramp first to make sure they can launch their watercraft or boat because we do not have a refund policy. 3

4 i) Revenue Transaction Report for May-Chief Financial Officer j) Tax Account Status Report for June-Tax Collector A Motion was made by Councilman Horan to approve the Reports. The Motion was seconded by Councilman Stogdill. Vote: Council Members Borowski, Filippone, Zalom, Stogdill, Horan and Lamb voted Yes. The Motion passed. PUBLIC COMMENT ON CONSENT AGENDA/OFF CONSENT AGENDA, AND VOUCHERS: RESOLUTIONS ON CONSENT: appointing Robert Kadeg as interim Animal Control Officer for a period commencing July 15, 2010 through July 26, 2010-Mayor LaCicero questioned if this resolutions is being adopted to cover a scheduled vacation. Mr. Parlow stated that that was correct authorizing the Lavallette Environmental Committee to submit an application for the Sustainable Jersey Grant accepting the retirement of Ronald Wojton and authorizing payment of unused sick and vacation time accepting the donation of seven new benches from the Lavallette Beautification Committee authorizing the electric collector to remove an electric account due to a conversion from a two family to a one family at 4 Kerr Avenue appointing three summer seasonal workers for the Public Works Department commencing June 24, appointing four lifeguards for the 2010 summer season commencing July 2, awarding a contract to D Erasmo Excavating in the amount of $8, for Relocation of a fire hydrant located on Pershing Boulevard, West Point Island authorizing the Treasurer to issue a check in the amount of $20, to FNA Jersey Lien Services, LLC for the redemption of a tax lien authorizing submission of the application of the Lavallette Municipal Alliance Grant for the year 2011 in the amount of $21,000-Council President Zalom stated that she thinks this is a wonderful amount for this grant and we use this money on wonderful programs for the residents accepting the resignation of Hans Warnebold as the Construction Code Official and 4

5 Plumbing Subcode Official as of July 14, A modifying the rules and regulations for the operation of the Lavallette Goose Patrol in accordance with Chapter 6-9D of the Code of the Borough of Lavallette-Mr. Parlow stated that Dr. Morris had contacted him and stated that the school would prefer that the Patrol would not use the school grounds B appointing Joan Macrina as a temporary part-time telecommunicator trainee for the Lavallette Police Department at an hourly rate of $10.00 A Motion was made by Councilman Horan to approve the Consent Agenda. The Motion was seconded by Council President Zalom. The Mayor opened the floor for public comment on the consent agenda and asked if anyone wished to comment on the consent agenda or the bills list. No one wished to comment on the consent agenda and the bills list. The Mayor closed the floor to public comment and asked Council for a vote on the consent agenda. Vote: Council Members Borowski, Filippone, Zalom, Stogdill, Horan and Lamb voted Yes. The Motion Passed. RESOLUTIONS-OFF CONSENT: APPROVAL OF VOUCHERS: Bills List in the amount of $927, A Motion was made by Council President Zalom to approve the Bills List. The Motion was seconded by Councilman Stogdill. Vote: Council Members Borowski, Filippone, Zalom, Stogdill, Horan and Lamb voted Yes. The Motion passed. ORDINANCES ON FOR INTRODUCTION/FIRST READING ORDINANCE NO (1087) AN ORDINANCE OF THE BOROUGH OF LAVALLETTE ESTABLISHING SALARIES AND WAGES OF OFFICERS AND EMPLOYEES OF THE BOROUGH OF LAVALLETTE, COUNTY OF OCEAN, STATE OF NEW JERSEY Mr. Parlow stated that in order to hire a part time line worker we need to establish the salary range for that position in the salary ordinance. A Motion to Introduce Ordinance (1087) was made by Councilman Horan. The Motion was seconded by Councilwoman Filippone. 9 g) Lavallette Elementary School/Dr. Peter Morris/requesting the use of our basketball courts for their summer basketball camps from July 19 th through 23 rd and August 2 nd through 6 th /Received July 2, 2010-Mayor LaCicero stated that this is an annual request. Council President Zalom stated that there are no nets on the baskets just the rims and the paint is very faded. Mr. Parlow stated that he will talk to Public Works. UNFINISHED BUSINESS: Councilman Lamb stated that he doesn t think the new hours of the tennis courts are working out. He stated that he drives by there before 8pm and the gates are locked and people are climbing over the fences to play. He also stated that the lights are on until 10 pm. Mr. Parlow stated that he advised Public Works that the lights did not need to be on at all because it is still light out at 8 pm when the gates get locked up. Councilman Lamb stated that maybe someone should come back at 10 pm and lock them up for the nights. Mr. George stated that the liability occurs when you state that the hours are from 7am to 8pm but the gates are locked before the 8pm lockup. If people are climbing over fences to get in before 8pm that liability will rest with the Borough. Councilman Lamb stated that maybe the courts should not get locked up at all. Mr. Parlow stated that the main reason we were locking them up was because of the skate boarding and we just had the courts resurfaced. Mayor LaCicero stated that the courts can not be locked up before 8pm under any circumstances and we should advise the attendants of this. Council President Zalom stated that the pedestrian crossing has become a big problem in town. She stated that we may need to think again about getting some signs out there to slow them down. She knows the DOT commented that we were the first municipality to ask for signage for the pedestrian crossing. Mr. Parlow stated that the Chief has been in contact with the DOT and they stated that there are no plans to rescind the current regulations. The Chief was provided a list of signaling hardware that can be utilized on the highway to make it safe for pedestrians. We have a lot of intersections without traffic lights so it becomes a big problem. The DOT suggested the placement of two large barrels on the edges of the highway along with the device that sits in the middle of the roadway. Councilman Horan stated that Public Works had received a letter from a homeowner who wanted to thank the Electric Department for going above and beyond the call of duty. Council Horan read the letter in a loud. Mayor LaCicero stated that this letter will be put into their personnel files. 9

10 NEW BUSINESS: 2 nd Quarter Public Works Report-Councilman Borowski read the report. Mayor LaCicero requested that the Public Works quarterly report be included with the other monthly reports and he asked that Mr. Parlow be notified when the report would be submitted. Mayor LaCicero stated that even with the Public Works Department being down three full time employees they have managed to still keep the town looking fantastic. Councilwoman Filippone commented that the all boardwalk entrances were painted with No Bikes Allowed after 10am. She stated she thought the Public Works Department is doing a great job. Councilman Lamb stated that he has requested their help on a few items that needed repairs at the beach and they have taken care of them already. They are doing a very good job. Councilman Stogdill stated that the ball field looks good. Every thing is taken care of promptly. COMMENTS FROM THE PUBLIC: Clem Boyers, 20 Kerr Avenue questioned how many beach wheels we have. Mr. Parlow stated that he believes there are five. Mr. Boyers questioned if we had the facility to store them okay. Mr. Parlow stated that they we have no problem storing them. Joe Palinsky, 122 Washington Avenue stated that he believes that the decorations in this town should be holiday looking with multi colored lights and not just with the white lights. The older looking swags are very worn looking and with all the white lights we are going to look like one giant parking lot. Pat Marrone, 11 Elizabeth Avenue, Beautification Committee stated that Toms River Township has these snowflakes and they look beautiful and it does look very attractive. Arlene Maglionico, 117 Camden Avenue stated that included in the monthly reports she would like to see reports from the First Aid and the Fire Department and see what they did for the month. They are volunteers and we should see how much they do for the town. Councilman Borowski stated that he will bring them for the next reporting meeting. 10

11 Joe Palinsky, 122 Washington Avenue stated that in Toms River the lights are only placed in the downtown County area. We do not have that type of area in Lavallette where it is very business like. Susan Koch, 124 Camden Avenue stated that she has been seeing a lot of bicyclists riding the wrong way. She thinks that they should be ticketed or warned that they have to ride with the traffic. COMMENTS OF THE MAYOR AND COUNCIL MEMBERS: Council President Zalom stated that there is nothing better than to hit Lavallette in the winter holiday time and see all these beautiful decorations and then in the summer with all the flags aligning the highway it just looks beautiful. Councilman Borowski stated that he has to agree with Council President Zalom. He stated that he thinks the swags are beautiful and make the town very festive. Councilman Stogdill stated that last month they had the eighth grade graduation and that three eighth grade kids gave speeches and they were spectacular. He stated that you would have thought they were college kids graduating college; they were that good. He congratulated the Lavallette Elementary School for their efforts. Councilman Horan stated that there is a Public Power meeting on July 16 th at the Borough Hall. Mr. Parlow stated that the Best Day Foundation, which is a non-profit organization who helps with special need children, has requested to use our beach wheels at the Brick Beach to take the kids on the beach this weekend. If none of the wheels are reserved he would like to let them have at least two of the beach wheels. Mayor LaCicero asked if Council had any objections to this. None of Council objected. EXECUTIVE SESSION: Mr. George stated that there is a need to go into Executive Session for contractual personnel matters. We are going to be discussing the following resolutions with action to be taken: Resolution Resolution Resolution Resolution Amending the Teamsters Local 469 Contract Appointment of the Electric Supervisor Appointment of the Construction Code Official Appointment of the Plumbing Subcode Official A Motion was made by Councilman Lamb to adjourn to Executive Session.
