I request that the Legislature change the funding source from the General Fund to the Tourist Attraction Fund for the projects set forth in Sections I and 4. The General Fund is seriously overburdened at this time whereas over Ten Million Dollars ($10,000,000) are available in the Tourist Attraction Fund for these needed improvements in our village recreational facilities. 4 HE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAR.1: Section 1. Two Hundred Thirty-Two Thousand Dollars ($232,000) are hereby appropriated from the General Fund to the Department of Parks and Recreation for certain infrastructure improvements in the municipality of Yigo. The amount appropriated shall be allocated as follows: (a) Sixty Thousand Dollars ($60,000) for upgrading the Yigo baseball field with fencing, repair to the dug-out, a batting cage, and practice wall; (b) Ninety Thousand Dollars ($90,000) for resurfacing the basketball courts, for additional bleachers, and to upgrade the lighting facilities for the basketball courts in Yigo and Agafa-Gumas; and (c) Eighty-Two Thousand Dollars ($82,000) to establish a Yigo recreational area, to include playground equipment, picnic facilities and landscaping. Section 2. The Mayor of Yigo and the Municipal Planning Council of Yigo shall coordinate the implementation of the projects set out in Section 1 of this Act with the Department of Parks and Recreation and other appropriate government agencies. Section 3. Two Hundred Ten Thousand Dollars ($210,000) are hereby appropriated from the General Fund to the Department of Public Viorks for certain infrastructure improvements in the municipality of Barrigadti. The amount appropriated shall be allocated as follows: (a) Two Hundred Thousand Oollars ($200,000) for the renovation of the Mayor's Office and to build a public restroom at the Community Center; and (b) Ten Thousand Dollars ($10,000) for street signs. Section 4. One Hundred Forty Thousand Dollars ($140,000) are hereby appropriated from the General Fund to the Department of Parks and Recreation for certain other infrastructure improvemerlts in the municipality of Barrigada. The amount appropriated shall be allocated as follows: (a) Fifteen Thousand Dollars ($15,000) to repair the lights of the tennis and basketball courts; and (b) One Hundred Twenty-Five Thousand Dollars ($125,000) to install lighting facilities at the baseball field.

5 Section 5. Fifty Thousand Dollars ($50,000) are hereby appropriated from the General Fund to the Guam Power Authority to install streetlights in the nlunicipality of Barrigada at Canada, Leyang and Route 16 from the "Cool Spot" intersection to the lower base of Macheche Hill. Section 6. The Mayor of Barrigada and the Municipal Planning Council of Barrigada shall coordinate the implementation of the projects set out in Sections 3, 4 and 5 of this Act with the respective government agencies set out in such sections. Section 7. (a) Subpart C, 1 of Part XLIV (Superior Court of Guam) of Section 1 of Chapter I1 of the General Appropriations Act for Fiscal Years (the "Act") is amended to read: ( 1 ) Personnel Services 2,657,869 2,657, FTE 79.0 FTE" (b) The "TOTAL" of Subpart C of Part XLVI (Superior Court of Guam) of Section 1 of Chapter I1 of the Act is amended to read: "TOTAL 3,806,857 3,806,857" (c) The "GRAND TOTAL" PART XLIV (Superior Court of Guam) of Section 1 of Chapter I1 of the Act is amended to read: "GRAND TOTAL 8,875,154 8,875,154" (d) The "TOTAL" of Subpart E of Part XLIV (Superior Court of Guam) of Section 1 of Chapter I1 of the Act is amended to read: "TOTAL 1,448,804 1,448,804." Section 8. A new subsection (c) is added to of Title 11, Guam Code Annotated, to read: "(c) The tax imposed by this Article shall not apply on admissions charged by a local producer of a 'performing arts or circus presentation1, which is defined as the presentation before a live audience of drama, dance, music or a circus.'i

12 JOINT REPORT OF THE COMMITTEE ON WAYS AND MEANS AND THE COMMITTEE ON GENERAL GOVERNMENTAL OPERATIONS ON BILL NO. 730 AN ACT MAKING APPROPRIATIONS FOR INFRASTRUCTURE IMPROVEMENTS IN THE MUNICIPALITY OF YIGO. [Attachment 11 Introduced by Senators Carl T.C. Gutierrez, Ted S. Nelson, and Joe T. San Aqustin PREFACE : The Committee on General Governmental Operations, together with the Committee on Ways and Means, to which was referred Bill No. 730, "An act making appropriations for infrastructure improvements in the municipality of Yiqo, " conducted a public hearing on Wednesday, June 21, 1989 at 11:30 a.m. in the Legislative Session Hall. [Attachment 21 Committee members present were Senator Ted S. Nelson, Chairman, Committee on General Governmental Operations, and Senator Herminia D. Dierking, Vice-Chairperson, Committee on Ways and Means. Also present were Senators Tommy V.C. Tanaka, Gordon Mailloux, J. George Bamba, John P. Aguon, and Eddie R. Duenas. [Attachment 31 NOTIFICATION: Letters [Attachment 41 of notification were sent to: the Acting Governor; Commissioner of Yigo; the Director, Bureau of Planning; the Director, Bureau of Budget and Management Research; the Director, Department of Public Works; and to the Commissioners Council. TESTIMONY : First to appear before the Committee was Mr. Raymond S. Laguana, President of the Commissioners Council of Guam. Mr. Laguana informed the Committee that as President, he fully supports the passage and enactment of Bill No Next to appear was Mr. John F. Blas, Commissioner of Yigo. [Attachment 51 Commissioner Blas testified that inasmuch, as he and members of the Planning Council would like to repair and upgrade the facilities, the current fundinq provided is inadequate to meet the cost of such repairs and renovations. Bill No. 730, said Commissioner Blas, would adequately address the community needs of Yigo.

13 At this time, Commissioner Blas elaborated on the various appropriation items contained in Bill No The $60,000 to upgrade the baseball field is a welcome relief said Commissioner Blas. Presently, the field is being utilized by both the Babe Ruth and the Arnetuer Baseball teams on a daily basis. He went on to say that aside from baseball, there are several softball teams also utilizing the field. Because of the maximum utilization of the field, Commissioner Blas told the Committee that it is all the more reason to work toqether to upgrade this facility. With respect to the Yigo basketball court, Mr. Blas testified that there was a time when the Yigo basketball court was the liveliest spot to be. He elaborated saying, it was the home court of the famous Yigo Jokers. However, after a while, maintenance of the court decreased and presently it is being used as a parking lot for the baseball field. Commissioner Blas also stated that he has instructed the maintenance workers to replace the existing backboards at both the Yigo and Agafa-Gumas courts until such time that funding is approved to do a complete renovation of both courts. With Yigo's ever increasing population, there exists a need to identify and establish a park within the municipality. This would provide Yigo and visiting residents a place to relax and enjoy the company of family and friends. At this time, Commissioner Blas concluded his testimony saying that he grateful to the main sponsors and urged that the Committee act favorably on Bill No When querried by Senator Tommy V.C. Tanaka, whether Bill No. 730 addresses all the concerns of the municipality. Commissioner Blas responded saying that there are other projects in Yigo that need to be addressed, he is satisfied with the appropriation contained in Bill No Commissioner Blas assured the Committee that they will, in the near future, be receiving additional funding requests for other projects in Yigo. He also said that there are eighteen (18) other municipalities that have improvement needs that need to be addressed, and for these reasons the Commissioner accepts Bill No He concluded saying its better to spread the wealth than to channel everything into one and in the end nobody get anything. There being no further questions from the members, the Chairman adjourned the hearing on Bill No COMMITTEE FINDINGS: The Committee on General Governmental Operations, together with the Committee on Ways and Means, finds, that: 1. The total appropriations containd in Bill No. 730, amounts to Two Hundred Thirty Two Thousand Dollars ($232,000). This amount is to he appropriated from the General Fund.

A closer look at how the amount is to be spent shows that: $60,000 is to be used for upgrading the Yiqo baseball field; $90,000 is to be used for resurfacing of the Yigo basketball court, the purchase of additional bleachers, and upgrading of the lighting facilities; and $82,000 is to used for the estabishment of a Yiqo recreational area, which includes playground equipment, picnic facilites and landscaping. 3. To insure that the projects enumerated in Bill No. 730 are properly implemented, the Commissioner is charged with the responsibility of coordinating the projects with the Department of Parks and Recreation and other government agenices. 4. Bill No. 730, as substituted, be supported and passed by the Legislature. SECTION ANALYSIS: Please refer to Page 4, "Profile on Substitute Bill No. 730." The sum of Two Hundred Thirty Two Thousand Dollars ($232,000) is hereby appropriated from the General Fund to the Department of Parks and Recreation for certain infrastructure improvements in the Municipality of Yigo. The amount appropriated shall be allocated as following: (a) Sixty Thousand Dollars ($60,000) for upgrading the Yigo baseball field with fencing, dug-out repair, a batting cage, and practice wall; (b) Ninety Thousand Dollars ($90,000) for resurfacinq of the basketball court, additional bleachers, and to upgrade the lighting facilities for the basektball courts in Yigo and Agafa-Gumas; and (c) Eighty Two Thousand Dollars ($82,000) to establish a Yigo recreational area which would include playground equipments, picnic facilities and landscaping.

Blas, Commissioner of Yigo. I am here this morning to submit favorable testimony on Bill No. 730 "AN ACT MAKING APPROPRIATIONS FOR INFRASTRUCTURE IMPROVEMENTS IN THE MUNICIPALITY OF YIGO," Mr. Chairman and members of the Committee, I am sure that you are well aware of the conditions of the existing recreational facilities in the village of Yigo. These facilities are reaching the point of being more hazardous to our youth than beneficial. As much as I and the members of the Planning Council would like to repair and upgrade these facilities, the funding provided by Public Law is inadequate to meet the cost of such repairs. Bill No. 730, if approved by this august body, would address the needs of the community's recreational facilities, Section 1 (a) provides $60, to upgrade the baseball field. At the present time, the field is being utilized by both the Baberuth and the Amatuer baseball teams on a daily basis. Aside from baseball, we also have softball teams using the field for practices. Because the field is being utilized to its maximum potential, it is all the more reason to work together to upgrade this facility for not only the youth of Yigo, but for the public at large. With respect to Section 1 (b), there was a time when the Yigo basketball court was the liveliest spot to be in the village, It was also the home court of the famous "Yigo Jokersgf. After a while, maintenance of the court started to decrease and at the present time it is being used as a parking lot for the baseball field. As a band-aid solution, I have instructed my maintenance staff to replace the existing backboards at both the Yigo and Agafa-Gumas courts until such time that we have the funding to implement a complete renovation. Last but not the least section l(c). Should this section pass, this playground area will be the first for Yigo. I strongly feel that if we can establish a park within the

Mr. Chairman and members, that concludes my testimony.
