7 COMMITTEE ON WAYS & MEANS REPORT ON BILL NO. 442 BILL NO. 442: "AN ACT TO APPROPRIATE THE SUM OF FIVE HUNDRED FIFTY FIVE THOUSAND DOLLARS ($555,000) TO T H E PUBLIC UTILITY AGENCY OF GUAM FOR THE PURPOSE OF CONSTRUCTING SEWER LINES IN THE R. R. CRUZ SUBDIVISION, AGAT AREA." BACKGROUND Bill No. 442 would appropriate $555,000 from the General Fund to the Public Utility Agency of Guam for constructing sewer lines in the R. R. Cruz Subdidivision. TESTIMONY Mr. Antonio C. Babauta, Commissioner of Agat appeared at the hearing on behalf of the residents of Agat and submitted written testimony in full support of Bill No. 442 (see Exhibit A). Commissioner Babauta stated that there are fiftynine (59) families living int he R. R. Cruz and Salinas road area waiting for the appropriation and construction of the sewer lines. Commissioner Babauta urges the Chairman and other Senators to vote positively on Bill No. 442 so the people in this area can look forward to flushing their toilets in Mr. John Quidachay, Assistant Commissioner of Agat appeared a.t the hearing on behalf of the residents of Agat and submitted written testimony in full support and urged the passage of Bill No. 442 (see Exhibit B). Mr. Gregorio M. Borja, Commissioner of Santa Rita, presented testimony in support and urged the passage of Bill No oral Mr. Anthony C. Blaz, Chief Officer, Public Utility Agency of Guam submitted written testimony in support (see Exhibit C). Mr. Blaz stated in his testimony that the R. R. Cruz Subdivision is an old residential type of Agriculture Subdivision with no public sewage collection system, but 1

8 individual septic tankleachfields which are not operating at a desirable efficiency level. The project intends to alleviate this situation by providing a reliable public sewage collection system. Mr. Luces, a resident of R. R. Cruz Subdivision also appeared at the hearing and presented oral testimony in full support and urged all the Senators to vote in favor of Bill No ANALYSIS The appropriation of $555,000 will be sufficient to accommodate design and construction of sewer lines as proposed. Fiscal Note is attached (see Exhibit D). RECOMMENDATIONS The Committee on Ways & Means and the Committee on General Governmental Operations recommends that Bill No. 442 be passed by the Twentieth Guam Legislature.

HOWEVER, SINCE THAT TIME, WE HAVE INSTALLED AN ENCLOSED CULVERT ABOUT 200 FEET LONG FROM FINILE DRIVE TO GAAN RIVER FOR $25,000.00, THANKS TO SENATOR NELSON AND GOVERNOR BORDALLO, AND WE HAVE ALSO WIDEN THE DRAINAGE DITCH WITH THE MUNICIPAL FUNDS YOU PROVIDED US ANNUALLY. I FEEL THE $200, REQUEST IS EKOUGH TO CONTINUE THIS PROJECT REALISTICALLY AND SINCE IT IS NOT TOO HIGH TEE GOVERNOR MIGHT JUST RELEASE THE FUNDS, IF THIS APPROPRIATION BECOMES LAW. MR. CHAIRMAN AND SENATORS, THE PEOPLE IN FINILE WEEDS YOUR HELP IN CHANNELLING THE FLOOD WATER FRON THE HILLS, TO FINILE TO THE OCEAN. THE OPEN CULVERT SHOULD HAVE BEEN DONE YEARS AGO, HOWEVER IT IS NOT TOO LATE FOR US TO RECTIFY THE FLOODING PROBLEMS IN AGAT. MR. Blaz, Chief Officer Public Utility Agency of Guam May 5, 1989 Good morning, Mr. Chairman and members of the Legislative Committee on Ways & Means. I am here today to testify on Bill 442(LS) An Act to Appropriate the Sum of Five Hundred Fifty Thousand Dollars ($550,000) to the Public Utility Agency of Guam for the Purpose of Constructing Sewer Lines in the R. R. Cruz Subdivision, Agat Area. PUAG fully supports this and other bills that would provide financing for water and wastewater infrastructure inprovements to better serve our residents. R. R. Cruz Subdivision in Agat is an old residential type of Agriculture Subdivision with no public sewage collection system. All homes in this subdivision are being serviced by individual septic tankleachfields. Due to the age of most of these septic systems, they are not operating at a desirable efficiency level. As a result, residents are being exposed to possible health and environmental hazards from inproperly disposed wastewater. This project intends to alleviate this situation by providing a reliable public sewage collection system.

15 The passage of this legislation will not only inprove the health and environmental conditions of the project area, but will also generate additional revenue for PUAG through billing and collection of sewer services. PUAG encourges your passage of Bill 442(LS). Chief Officer
