2 41 EX/Decisions - page 2 ITEM 1 - OPENING OF THE SESSION ITEM 2 - ADOPTION OF THE AGENDA The agenda was adopted as shown in this report. ITEM 3 - APPROVAL OF THE MINUTES OF THE FORTIETH SESSION The minutes of the 40th session were approved. (41 EX/SR. 1) ITEM 4 - REPORT BY THE DIRECTOR-GENERAL ON THE ACTIVITIES OF THE ORGANIZATION SINCE 11 DECEMBER 1954 (document 41 EX/27), having heard an oral report by the Director-General, requested him to make available the text of his statement. After discussion, the Board took note of the report (document 41 EX/27). (41 EX/SR. 1, 11) ITEM 5 - ORGANIZATION AND METHODS OF WORK OF THE GENERAL CONFERENCE (document 41 EX/2 and Add. ) Considering resolution I adopted by the General Conference at its eighth session, concerning the organization and methods of work of the General Conference, Noting that only a few Member States were able to forward their comments and suggestions on this subject, as requested by resolution I. 2. 2, in time for their consideration by the Executive Board at its 41st session, Appoints a special committee, composed of the following members: Dr. Veronese (Chairman), Professor Carneiro, Mr. Haguiwara, Professor Laugier, Professor Nielsen, Dr. Raadi, Sir Ben Bowen Thomas, with the following tasks: (a) during the course of the 41st session, to draw up, on the basis of document 41 EX/2, a memorandum including a series of questions to be addressed to Member States and National Commissions by the Director-General with the request that they arrange their comments as far as possible in the form of answers to these questions; (b) at a meeting to be held at least six weeks before the 42nd session of the Board, to study the comments received from Member States (which shall have been previously analysed by the Director-General) and to prepare recommendations for consideration by the Board; the committee s recommendations shall be communicated to members of the Board at least 30 days before the opening of the 42nd session. (41 EX/SR. 6) ITEM 6 - QUESTIONS CONCERNING THE EXECUTIVE BOARD 6. 1 Consideration of possible amendments to the Rules of Procedure Having considered the proposals (41 EX/24 and 41 EX/24 Add. rev. ) submitted to it by its Bureau in accordance with the request made at the 40th session (40 EX/Decisions, 2), Approves the following amendments to its Rules of Procedure: * Note - for revised text of Rules of Procedure, see document EX/14 rev. 2.

3 Rule 1 - for ordinary sessions read regular sessions. 41 EX/Decisions - page 3 Rule 3 - for extraordinary session read special session. Rule 5 (1) - for twenty days read thirty days. Rule 8 - to read: The Board may amend or add new items to the agenda so adopted if so decided by a majority of the members present and voting. Subject to the provisions of Rule 21 (3), such new items shall not be discussed until 48 hours after their inclusion in the agenda, unless otherwise decided by the Board. Rule 9 Const. V. 1 - to read: (1) shall be elected by the General Conference from among the delegates appointed by the Member States and shall consist of twenty-two members, each of whom shall represent the Government of the State of which he is a national. Const. V. 12 Const. V. 1 (2) Although the members of the Executive Board are representative of their respective governments they shall exercise the powers delegated to them by the General Conference on behalf of the Conference as a whole. (3) The President of the General Conference shall sit ex officio in an advisory capacity on the Executive Board. (4) Members of the Board may be accompanied at meetings of the Board by advisers or experts, subject to the provisions of Rule 28. Rule 11 - to read: Rule 21 - to read: (1) A member of the Board may, after consultation with his Government, designate in writing a deputy for a session or for a meeting or series of meetings of the Board or its commissions or committees if he is unavoidably prevented from attending. (2) In such cases, the member shall inform the Chairman in writing of the reasons for his absence and the qualifications of his deputy. If the Chairman raises no objection, the deputy shall sit with the right to vote. (1) The proposed programme and budget to be submitted to the General Conference in its working languages shall be distributed to members of the Executive Board at least thirty days before the opening of the session of the Board at which it is to be considered. (2) Documents relating to items on the provisional agenda of each session of the Executive Board shall normally be distributed to members in the working languages of the Board at least thirty days before the opening of the session. Exceptions to this rule may be made only if the permission of the Chairman has been previously obtained. (3) Unless the Executive Board decides otherwise, it shall not discuss any items, except the reports of commissions and committees until at least 48 hours after the distribution of the relevant documents in its working languages to members present.

4 41 EX/Decisions - page 4 Rule 22 (1) - to read: A summary record of all meetings of the Board and its commissions shall be prepared by the Secretariat. A provisional text shall be submitted to members for correction as soon as possible but shall not be made public. Rule 25 - to read: The Director-General shall communicate all documents and final summary records of the Board and its report on the work of each session to Member States, National Commissions, the United Nations and the Specialized Agencies immediately on issue. Rule 26 - to read: (1) At meetings of the Board the quorum shall consist of twelve members or duly appointed deputies, of whom at least seven shall be titular members. (2) At meetings of commissions and committees the quorum shall consist of a majority of the members appointed to the body in question, of whom not more than half may be represented by deputies. (3) The Board shall not decide on any matter unless a quorum is present. Rule 27 to read: The meetings of the Board shall, unless the Board decided otherwise, be held in public. Rule 29 (2) to read: Observers of Member States, non-member States, intergovernmental or non-governmental international organizations and other qualified persons may be invited by the Board to address it on matters within their competence. Rule 40 to read: During the discussion of any matter, a member may move the closure of the debate, whether or not any other member has signified his wish to speak. After the motion has been seconded, permission to speak against the closure may be accorded to not more than two speakers. The Chairman shall then put to the vote any motion for closure and, if the Board is in favour, he shall declare the closure of the debate. Rule 48 (1) to read: (1) All elections of officers, appointments of replacements for members deceased or resigned, and the nomination of the Director-General shall be decided by secret ballot. Rule 49 to read: (1) When a single elective place is to be filled, any candidate obtaining in the first ballot an absolute majority (i. e. more than half) of the votes cast shall be declared elected. (2) If no candidate obtains an absolute majority in the first ballot, further ballots shall be taken. Any candidate obtaining an absolute majority of the votes cast shall be declared elected.

5 41 EX/Decisions - page 5 (3) If, after four ballots have been taken, no candidate has obtained an absolute majority, a final ballot shall be taken, restricted to the two candidates who obtained the most votes in the fourth ballot. (If necessary in order to determine the two candidates to participate in this ballot, an eliminating ballot may be taken restricted to the candidates having obtained the same number of votes in the fourth ballot. ) The candidate obtaining a majority of the votes cast shall be declared elected. (4) If, in the final ballot or an eliminating ballot, two or more candidates obtain the same number of votes, the Chairman shall decide between them by drawing lots. Rule 59 - to read: No member of the Board shall be eligible for appointment by the Director- General to any post in the Secretariat during the period for which he was elected by the General Conference to membership of the Board. Decides to defer until its 42nd session, decisions on the changes proposed by the Bureau concerning Rules 28 and 53 and on the proposal made by Professor Carneiro concerning Rule 55 and the Annex to the Rules. 6 41 EX/Decisions - page Appointment of members of the Board to sit on (a) the Unesco-IBE Joint Committee and (b) the International Advisory Committee on Monuments (document 41 EX/3) (a) Unesco-IBE Joint Committee Considering that Article I of the Agreement between Unesco and the International Bureau of Education provides for a joint committee of the two organizations on which Unesco shall have three representatives, assisted by the Director of the Department of Education, Decides to appoint Dr. M. Awad, Mr. T. Haguiwara and Dr. J. R. Martinez Cobo as representatives of Unesco for (41 EX/SR. 1) (b) International Advisory Committee on Monuments Decides that it does not wish to appoint one of its members to participate in the work of any committee set up to advise the Director-General, Requests the Director-General to make the necessary consequential modifications in the statutes of the International Advisory Committee on Monuments, retaining the present number of members. (41 EX/SR. 1, 7) 6.4 Reduction in the number and length of sessions of the Executive Board (document 41 EX/4) Consideration of this item was deferred to the 42nd session. ITEM 7 - EXECUTION OF THE PROGRAMME 7.1 Aid to Member States: consideration of procedures and criteria for the granting of aid (document 41 EX/5) Considering that the General Conference at its eighth session adopted a number of resolutions authorizing the Director-General to extend aid to Member States, upon their request, in different fields, Having examined document 41 EX/5 setting forth draft procedures and criteria for the granting of aid to Member States, Approves the policy directives and criteria for the granting of aid and the statement of the obligations of Member States receiving aid as proposed by the Director-General in document 41 EX/5, section A, Decides to keep under continuing review the procedures and criteria for the granting of aid to Member States in the light of the operation of this programme, Requests the Director-General to bring these directives and conditions to the attention of all Member States, Requests the Director-General to submit to future sessions of the Board a progress report on the aid programme. 7 41 EX/Decisions - page Education Unesco Institutes in the German Federal Republic (document 41 EX/6 and Add. ) Taking note of document 41 EX/6 and Addendum concerning the present situation and future prospects of the Unesco Institutes in the German Federal Republic, Reaffirming its interest in this novel form of international co-operation in the fields of youth, education and social sciences, Considers that it is desirable to ensure the financing of the three Institutes and the effective continuation of their activities in , Requests the Director-General: (1) to submit to it, at its next session, formal proposals for the co-ordination of the work of the three Institutes among themselves and with the normal programme of the Organization and also for the regular financing of their activities; (2) to consult the Governing Boards and Directors of the three Institutes on the best means of achieving this co-ordination and of effecting certain economies as regards the operation of the Institutes; (3) and to consult experts on the work of the three Institutes and to obtain an evaluation of the work of these Institutes with particular reference to the objectives for which they were established. (41 EX/SR. 13, 14) Conference on vocational and technical education in the Arab States (document 41 EX/7) Considering the report (document 41 EX/7) presented by the Director-General on consultations with the International Labour Organization and the Food and Agriculture Organization concerning the proposed study conference on vocational and technical education in the Arab States to be held in execution of resolution of the programme for , Authorizes the Director-General to extend assistance along the lines defined in document 41 EX/7, paragraph 8, to an Arab State willing to call and organize on its own responsibility a conference on vocational and technical education in the Arab States. (41 EX/SR. 7, 16) Regional conference on free and compulsory education in Latin America (document 41 EX/8) Considering the resolution adopted at its 40th session (40 EX/Decisions, 5) authorizing the Director-General to pursue consultations with the Organization of American States regarding the possibility of associating the regional conference on the extension of free and compulsory education in Latin America, provided for under resolution 1.214, with the conference of Ministers of Education planned by the Organization of American States, Noting the Director-General s report (document 41 EX/8) and a further oral report on consultations with the Organization of American States,

8 41 EX/Decisions - page 8 Authorizes the Director-General: (1) to continue negotiations with the Organization of American States regarding the calling of Unesco s conference concurrently with that of the Organization of American States; (2) to invite or have invited to Unesco s Conference the following: (a) Member States of Unesco which are members of the Organization of American States; (b) Member States of Unesco which are members of the United Nations Economic Commission for Latin America; (c) Associate members of Unesco in the Western hemisphere Revised agreement between Unesco and UNRWA (document 41 EX/9 and Add. ) (41 EX/SR. 10, 16) Noting the Director-General s report (document 41 EX/9) and further oral statements on collaboration between Unesco and the United Nations Relief and Works Agency, 1. Expresses its gratification at the highly satisfactory relations existing between the two organizations and the very valuable results achieved in the education of Arab refugee children in the Middle East, constituting one of the major operations in the field of education carried out by international organizations; 2. Approves the revised agreement between Unesco and UNRWA as contained in document 41 EX/9 Addendum Annex with the modification set out in paragraph 2 of this document; 3. Approves the principle stated in paragraphs 8 and 9 of document 41 EX/9 Add. to govern Unesco s future collaboration with UNRWA; 4. Authorizes the Director-General in partial application of this principle from 1 July 1955: (i) to increase the number of the education officers to be made available to the Director of UNRWA, at his request, up to a total cost of approximately $90,000 for each year; (ii) to release the necessary sums, when needed, from the funds of the Department of Education, or to obtain them by transfers of funds within the framework of the budget for , such transfers to be submitted for the approval of the Executive Board at its 42nd session. (41 EX/SR. 11) Natural Sciences Peaceful use of atomic energy (document 41 EX/l0) Notes with satisfaction the action taken so far by the Director-General, Requests him to take further steps in association with other Specialized Agencies to see that Unesco s co-operation with the United Nations along the lines suggested in document 41 EX/l0 is continued in an effective manner. (41 EX/SR. 10) 7.5 General Resolutions Draft international covenants on human rights (document 41 EX/13) Having examined the Director-General s report (document 41 EX/13) on the draft international covenants on human rights, Considering resolution IV adopted by the General Conference at its eighth session, Invites the Director-General to call to the attention of the competent organs of the United Nations the observations on the draft international covenants made by the Executive Board at its 29th and 36th sessions, and to emphasize the importance attached by the General Conference of Unesco, to the speediest and fullest possible implementation of human rights in matters of education and culture. (41 EX/SR. 10) 7. 6 Expanded Programme of Technical Assistance for economic development Progress report on Unesco s participation in the United Nations Expanded Programme of Technical Assistance (1 June January 1955) (document 41 EX/14, Add. 1, 2 and 3, and Corrigendum) Takes note of the Director-General s report on Unesco s participation in the United Nations Expanded Programme of Technical Assistance from 1 June 1954 to 15 January 1955, Invites the Director-General to take into account in the execution of the programme and in the preparation of future reports the various comments made by members of the Board in the course of the discussion. (41 EX/SR. 8) Technical assistance programme and budget for 1955 and projections for 1956 (document 41 EX/15 and Corr. ) Considering resolution IV adopted by the General Conference at its eighth session, Notes the information contained in document 41 EX/l5 concerning activities to be undertaken by Unesco in 1955 under the Expanded Programme of Technical Assistance, as approved by the Technical Assistance Board and the estimates of expenditure involved, Authorizes the Director-General to transmit to the Technical Assistance Board the programme of assistance requested by Member States for (41 EX/SR. 9)

10 41 EX/Decisions - page 10 ITEM 8 - EXTERNAL RELATIONS Relations with the United Nations and Specialized Agencies Report on seventh session of the United Nations Sub-Commission on the Prevention of Discrimination and the Protection of Minorities (document 41 EX/16) Considering the resolution on co-operation with the United Nations Sub- Commission on Prevention of Discrimination and the Protection of Minorities adopted by the Board at its 37th session (37 EX/Decisions, ), Having examined the Director-General s report (document 41 EX/16) on the seventh session of the Sub-Commission, Takes note of the resolution adopted by the Sub-Commission and in particular of the hope expressed by it that Unesco may find it possible to augment the assistance given to the Sub-Commission s special rapporteur by other means within its existing facilities and resources, Reaffirms its willingness to assist the Sub-Commission in its work in accordance with the resolution adopted at the 37th session, Authorizes the Director-General to continue to provide the special rapporteur with the assistance specified in the Board s earlier resolution and to make him a further grant of $10, 000 for the year 1955, subject to the same conditions as apply to subventions granted by Unesco to international non-governmental organizations. (41 EX/SR. 2,3) Relations with the Trusteeship Council: procedure for presentation by Unesco of comments on the reports of administering authorities (document 41 EX/l7) Considering that the Trusteeship Council, by resolution 47 (IV), has requested Unesco to study the annual reports of Member States administering trust territories and to submit observations and proposals with a view to facilitating the Council s work, and that the General Conference at its fifth session instructed the Director-General to continue to co-operate with the Trusteeship Council in this way (resolution 31.3), Noting with satisfaction the Director-General s report (41 EX/17) on the development of this co-operation, Reaffirms its belief in the importance of the part which is played by Unesco in this respect, Noting however that the period allowed for the preparation of Unesco s comments is often short and that the date at which these comments must be presented does not always coincide with the dates of sessions of the Executive Board: Resolves (1) Whenever the time-table of its sessions permits, the Board will itself examine the draft comments prepared by the Director-General; (2) When such examination by the Board is not possible, the draft comments shall be communicated by the Director-General to all members of the Board in so far as time permits and subsequently examined on behalf of the Board by a special committee which shall take into account all comments received at the time of its meeting from other members of the Board;

11 41 EX/Decisions - page 11 (3) The special committee shall consist of Dr. Raadi (Chairman), Dr. Bender, Professor Carneiro, Professor Laugier, Sir Ben Bowen Thomas. (41 EX/SR. 2) Request from the Secretary-General of the United Nations for Unesco s co-operation with the United Nations Committee on South West Africa (document 41 EX/12) Considering the request for Unesco s co-operation with the United Nations Committee on South West Africa transmitted on behalf of the Committee by the Under-Secretary for Trusteeship and Information from Non-Self-Governing Territories in his letter dated 8 February 1955, Authorizes the Director-General to send to the Secretary-General of the United Nations, for the use of the Committee, a descriptive list of the services which Unesco is in a position to render towards the social, economic and educational advancement of the inhabitants of territories with characteristics similar to those of South West Africa, upon request of the responsible authorities. (41 EX/SR. 3) Relations with the International Labour Organization regarding improvement of living and working conditions for indigenous populations in independent countries (document 41 EX/18) Takes note of the Director-General s report (41 EX/18) on collaboration with the International Labour Office regarding the improvement of living and working conditions for indigenous populations in independent countries, Authorizes the Director-General to continue this co-operation, Invites the Director-General to make available to the members of the Board copies of the information, observations and comments on this subject sent by Unesco to the International Labour Office. (41 EX/SR. 3) Re-examination, at the request of the General Conference, of proposed amendments to the directives concerning relations with international non-governmental organizations (document 41 EX/19) Considering resolution III adopted by the General Conference at its eighth session, Considering the report of its External Relations Commission (document 41 EX/29), Requests the Director-General to send to Member States and National Commissions, at the same time as the documents referred to in paragraph 3 of resolution III. 3. 3, the questionnaire proposed by the External Relations Commission in its report, inviting them to provide answers to these questions together with any other comments they may wish to forward regarding the proposed amendments to the directives on relations with international non-governmental organizations, Requests the Director-General to submit to it at its next session an analysis of the comments received from Member States and National Commissions. (41 EX/SR. 3, 14; 41 EX/CX/SR. 1)

12 41 EX/Decisions - page Proposed subventions to international non-governmental organizations for 1955 (document 41 EX/20 (Add. )) Approves an additional subvention for 1955 of $5, 000 to the International Council for Philosophy and Humanistic Studies as set out in document 41 EX/20, Annex I; Considering the report of the Finance Commission (document 41 EX/28), Approves an additional subvention for 1955 of $15, 000 to the Special Committee for the International Geophysical Year as set out in document 41 EX/20 Add., it being understood that the necessary funds can be found within the Natural Sciences chapter without sacrificing other programme items. (41 EX/SR. 4,12; 41 EX/CF/SR. 1) Proposed modifications of the terms of subventions granted in 1954 and 1955 (document 41 EX/21 (Add. )) Approves the modifications, as proposed in document 41 EX/21 and Addendum, of the terms of subventions granted for 1955 to: Council of International Organizations of Medical Sciences International Sociological Association International Union of Biochemistry and the request for permission to utilize in 1955 funds unobligated from the subvention granted in 1954 to: International Union of Scientific Psychology (41 EX/SR. 4, 16) ITEM 9 - FINANCIAL AND ADMINISTRATIVE QUESTIONS 9.1 Proposed transfers within the budget for 1955 (document 41 EX/22) 1. Considering the report of the Programme Commission (document 41 EX/30), Approves the transfer proposed in document 41 EX/22, section I to give effect to the merging of the Unesco Bulletin and the Unesco Newsletter, on the understanding that all the essential information contained in the Bulletin will continue to appear in the new publication; 2. Approves the transfer proposed in document 41 EX/22 section II, to make additional provision for language services in Spanish and Russian. (41 EX/SR.4, 12; 41 EX/CP/SR. 1) 9. 2 Report on financial status of the Publications Fund at 31 December 1954 (document 41 EX/23) Notes with satisfaction the Director-General s report (document 41 EX/23) on the financial status of the Publications Fund at 31 December 1954 and in particular, the evidence contained therein of increased sales of Unesco s publications. (41 EX/SR. 4)

13 41 EX/Decisions - page Appropriation of funds received from a national agency for the administration of fellowships (document 41 EX/25) Having approved at its 36th session a proposal that Unesco should charge a small fee from National Agencies on whose behalf it administers fellowships (36 EX/Decisions, ), Noting that an agreement has been negotiated with the Campanha Nacional de Aperfeicoamento de Pessoal de Nivel Superior (CAPES) of Brazil whereby Unesco will administer, in conformity with standards accepted by the donor and by Unesco, a number of fellowships to be financed by CAPES, Authorizes the Director-General to appropriate funds received from CAPES for this purpose to Part II, Chapter 6 of the Budget, Exchange of Persons, to cover the cost of additional and other expenses incurred in the administration of these fellowships. (41 EX/SR. 4) 9.4 Acceptance of a gift offered by the Belgian National Commission for assistance to victims of Greek earthquakes (document 41 EX/26) Considering Article IX. 3 of the Constitution, Authorizes the Director-General to accept the gift of 300,000 Belgian francs offered by the Belgian Committee of the United Nations Children s Fund for assistance to child victims of the civil war or earthquakes in Greece, Expresses its sincere gratitude to the Belgian Committee for this generous gift. ITEM 10 - OTHER QUESTIONS (41 EX/SR. 4) 10.1 Calendar of major stages in the preparation and consideration of the programme and budget for agreed to the following schedule for preparation and consideration of the programme and budget for : 1. would meet as follows: 42nd session: 9-30 November 1955; 43rd session: March-April 1956 (2 or 3 weeks) (subject to a final decision on the date of this session being taken at the 42nd session); 44th session: 20 August-14 September 1956 (see below as regards the dates); 45th session: shortly before ninth session. 2. For the 42nd session the Director-General would present to the Board members one month in advance of the session, a discussion paper on the general lines of the programme, the major projects, and tentative budget totals. The Board s discussion would provide basically important guidance to the Secretariat in the preparation of the proposed programme and budget. 3. Copies of the proposed programme and budget would be distributed to members of the Board on 30 March 1956 but would not be discussed at the 43rd session. Copies would be sent at the same time to the Member States, who would be asked to provide their comments by 1 July The Director-General will study the possibility of advancing these dates and, in consequence, the dates of the Board s 44th session.

It would have before it an analysis of comments and recommendations received by the Secretariat from Member States. The Director-General would inform the Executive Board of the changes he proposed to introduce in the proposed programme and budget in response to suggestions made by Member States and the Board, by preparing a corrigendum. would at this session prepare its comments to the General Conference on the proposed programme and budget. 5. The corrigendum would be sent to Member States a few days prior to the opening of the ninth session of the General Conference, and to the members of the Executive Board in time for the 45th session. 6. It is assumed in the above schedule that the General Conference will begin on 1 November 1956, which is deemed desirable Private meeting (41 EX/SR. 12) held a private meeting on Friday, 25 March 1955, at 10 a.m. during which the Board was consulted by the Director-General on various staff questions. In particular, the Board requested the Director-General to present at the 42nd session a report on the problem of geographical distribution of the personnel Legal study of status of members of the Executive Board requested the Director-General to have prepared in good time for consideration at the 42nd session a legal study of the status of members of the Executive Board as it results from the Constitution as amended by the General Conference at its eighth session.
