Donrde May/ Resident Orange River Blvd. Levi McCoUum/ Lee Tran Agenda Itemffl, ' 'Call to Order, Introductions and Review of Agenda: Don Mayne, Chair/ called the meeting to order at 3:00 p.m., asked for introductions and welcomed guests. Al Giacalone requested to move agenda item 5: Public Comments before item 3, and add 25 minutes to item 4c, onto David Wagley's time to discuss the BPAC Resolution and BPAC Project List. Keith Kibbey moved to approve the amended agenda, Al Giacalone seconded the motion. The motion carried unanimously. Agenda Item #2: ^Approval of the October 21, 2015 Meeting Minutes: Al Giacalone moved to approve the October 21,2015 meeting minutes as written, Keith Kibbey seconded the motion. The motion carried unanimously. Agenda Item #3, Public Comments: Orange River Boulevard Sidewalk Request Carol Duffy, Doimie May and Gary Eidson/ of the Orange Eiver Boulevard Sidewalk Acdon Committee/ spoke about combining all phases of their initial sidewalk request into one project. After committee discussion, Al Giacalone suggested we remove Project #22 (sidewalk from Oasis Park to Lorrame Drive) from the BPAC list and add the entire expanded sidewalk project for Orange River Boulevard from Palm Beach Blvd to Lorraine Drive to the project list. Ms. Sisson expressed that the ORB sidewalk committee did an excellent job in getting the community involved for this request and also voiced her concern that this expanded project may take away 'the spot' from other projects that have been waiting on the list for years or in need. Other members felt there is an adequate system in place by using the point scoring for prioritizmg projectst BPAC Meeting November 18,2015 Page 1

2 Al Giacalone moved to approve and add the entire sidewalk project on the south side of Orange River Boulevard from Palm Beach Boulevard to Lorraine Drive and remove Project #22 (Oasis Park to Lorraine Drive) from the BPAC list, Keith Kibbey seconded the motion. The motion passed; six ayes, 2 nays, one abstained. New Business Agenda Item #4a: Tine Road Sidewalk Request: Ms. Gumpert explained how difficult it is for pedestrians and school children to walk on the narrow road. Pictures were distributed showing school duldren standing in the street waiting for the school bus and letters were written by residents. Mr. Kevin Johnson/ a resident of Pine Road and owner of the day care center at the end of Pine Road, also said that it is unsafe and difficult for pedestrians/school children to walk along the narrow road. Ms. Gumpert explained that two developers will be building homes down Pine Road; Coconut Cove and Hideaway Cove. The developer for Coconut Cove went before the Hearing Examiner to try to deviate from building a sidewalk at their frontage of Pine Road. There was an initial motion by Ueana Sisson to add the Pine Road sidewalk request to the BPAC project Ust and to object to sidewalk waivers. David Grogan seconded the motion. In discussion, staff said waivers are based on the Land Development Code and Administrative Code and it is too late to for this discussion to be considered for the Coconut Cove public hearing. There was discussion by the committee to have one motion for adding Pine Road/ and a second separate motion on developer deviations. The initial motion was withdrawn. Ileana Sisson moved to add a sidewalk on the south side of Pine Road to the BPAC project list, David Grogan seconded the motion, the motion carried unanimously. Ileana Sisson moved that BPAC committee members should express their concerns with approval to the Board of County Commissioners regarding the zoning case and developers who request waivers from building sidewalks in the Lee County communities. Dave Grogan seconded the motion. The chairman called the question and asked for a show of hands. The motion failed with three in favor and six opposed. The committee asked staff to apply point scoring to Fine Road, staff indicated it ranked 41st at that time. Damon Shelor made a motion for BPAC to draft a letter to the Board of County Commissioners expressing their concerns about developers not adding sidewalks that are needed in Lee County at a Public Meeting. Keith Kibbey seconded the motion/ there was further discussion for the letter to be general, not specific to a particular development. Staff said further Land Development Code and Administrative Code changes would be needed. The motion passed with eight ayes, one opposed. Don Mayne offered to draft the letter for review at the next meeting. There was discussion by Ileana Sisson that developers in Lee County should be responsible to contribute to the community by adding sidewalks or shared paths to the areas they are developing and to contribute by setting aside land within their development for community parks and or natural wildlife areas. According to Ms. Sisson's recollection, areas within Orange County have seen these principles successfully implemented for many years. In addition, Ms. Sisson indicated that developers should not be allowed waivers by County Commissioners or other County entities which would be counterproductive to the future of our communities. Staff will bring Land Development Code and Administrative Code language for committee review. BPAC Meeting November 18,2015 Page 2

3 Agenda Item #4b. Centennial Boulevard Sidewalk Request: This item has been tabled by Damon Shelor until December's meeting. Agenda Item #4c, December BPAC Meeting: The committee agreed to meet in December. Old Business Agenda Item #5a. Tiger V Grant Update: Design plans are complete, but yet to be constructed and bike lanes will be added on Corkscrew November 30th. There might be a surplus of funds to expand the overall project/ tbd. Agenda Item #5b. Fatality Report: None at this time. The MPO wiu report at December's meeting. Agenda Item #5c, BPAC Resolution Update and Review the BPAC Project List: BPAC Resolution: County Administration and Senior Management are reviewing the BPAC Resolution. Road Resurfacing Projects: Staff mentioned that the Coimty-Wide Road Resurfacing Project is under review and once the list is finalized, staff will have this committee review it for bike/ped retrofits. Due to admmistrative changes/ the Internal Complete Streets Team and CSAC (Community Sustaimbility Advisory Committee) committees have been dissolved. Mr. Warren Baucom, from the Economic Development Department was introduced to members today and was on the CSAC committee and will assist BPAC as well. Some of the BPAC members were astonished that the two committees were dissolved and expressed their apprehensions given that they have depended extensively on these committees for input and guidance and felt they were a cmdal part of the plan. Ms. Sisson expressed that she wanted it recorded that she is dissatisfied that the two committees were dissolved and that BPAC was not informed beforehand, or consulted and that BPAC found out by happenchance. Ms. Sisson expressed misgivings on these decisions and is highly concerned that the BPAC committee may experience the same outcome and be extinguished. Ms. Sisson stated that input from these two committees was important as they were the eyes and ears of BPAC and that BPAC continues to be an important representation and voice of the dtizens of Lee County and should not be disbanded. Staff and Members Reviewed the BPAC Priority List - the following recommendations made: #1: Remains on the BPAC list as is: Bonita Beach Rd from I 75 to Bonita Grande Dr, side^clalk gap on north side. Daniels Pkzm/from approximately 650' west of Commerce Lakes Dr to SR 82, shared use path gap on north side. Estero Blvd from Hickory Blvd to Big Carlos Pass, shared use path on west side (excluding bridges). Pine Island Road from Stringfelloiu Road to Veterans Parhuay - shared use path FDOT scheduled PD&'Efor FDOT FY 2020/2021 -leave as is. #2: Remains at bottom of BPAC List (in case no funding from FDOT): On FDOT District 1 Draft Tentative Work Program Report Tice St from New York Dr to Lynneda Ave Waverly Ave from Tice St to SR 80 New York Dr from Glenwood Ave BPAC Meeting November 18,2015 Page 3

The motion carried unanimously. Agenda Item #6, Public Comments: as noted above Agenda Item #7, Member comments: Damon Shelor shared that the East County Water Control District is now called Lehigh Acres Municipal Services Improvement District (LA MSID). There will be a workshop in January to discuss sidewalks and bike paths m LeMgh. The Murudpal Services district wiu have sdpulations and will look at services the County is currently providing. More information wul fouow. Al Giacalone reminded members to not speak out of turn and to be called upon by the Chair to make it clear on motions and for the minutes of the meeting. * Ueana Sisson inquired about the rules for changing a vote on a previous topic and members explained once it's over you cannot change the vote.
