1 City Council Regular Meeting July, Minutes of the regular meeting of the Fairfax City Council on July, 0, at :00 p.m. in Council Chambers at Fairfax City Hall Annex. Call to Order: Mayor Silverthorne called the meeting to order at :00 p.m. Members Present: Mayor Silverthorne and Councilmembers DeMarco, Greenfield, Loftus, Meyer, Miller, and Schmidt. Members Absent: None. Presentations and Proclamations. None. Presentations by the public on any item not subject to a public hearing. None. Adoption of the agenda. Councilman Greenfield moved to adopt the agenda. Councilman Meyer seconded the motion, which carried unanimously by voice vote. (Councilmember Loftus was absent.) Consent agenda. Councilman Greenfield moved to adopt the following consent agenda: #a. Consideration of an extension of the contract with Superior Paving Corporation for an estimated amount of $,,0.00 for milling and paving of City streets for FY ; #b. Consideration of an Extension of the contract with A & M Concrete Corporation for an estimated amount of $,00.00 for Concrete and Brick Repairs for FY ;

Consideration of a resolution authorizing the city manager to sign the FY agreements between the City and the Virginia Department of Transportation (VDOT); #e. Consideration of a task order in the amount of $, to Rinker Design & Associates for final plan development, public involvement, right of way acquisition services and construction administration for the Chain Bridge Road sidewalk project; #f. Consideration of an award of contract for phase one of the Old Town drainage improvements; #g. Consideration of an award of contract to Oak Grove Restoration Company for mechanical, electrical, and plumbing work including new HVAC system at the Blenheim house; #h. Consideration of a resolution setting the allocation percentage for personal property tax relief (PPTR) in the City of Fairfax for the 0 Tax Year at.0%; and #i. Consideration of a Boundary Line Adjustment between certain parcels of real property at and adjacent to Old Town Square owned by the City and the City s Economic Development Authority. Councilman Meyer seconded the motion. The Mayor called the vote to approve consent agenda items a-e and h-i, which carried unanimously by a voice vote. (Councilmember Loftus was absent.) Public hearing and Council action on a Supplemental Appropriation Resolution in the amount of $,0. for the transfer of NVTA 0% monies from the Transportation Tax Fund to the Downtown Fund to fund preliminary engineering and traffic analysis for modifications to University Drive. This public hearing was properly advertised in the July and, 0, issues of The Washington Times. Wendy Sanford, Transportation Director, gave the staff report which was incorporated into the record. She stated that this item pertains to approval of a supplemental appropriation resolution in the amount of $,0. for the transfer of NVTA 0% monies from the Transportation Tax Fund to the Downtown Fund to fund preliminary engineering and traffic analysis for potential modifications to University Drive. She stated that in an effort to improve
3 City Council Regular Meeting July, multimodal connectivity between George Mason University and Old Town, one of the recommendations from the November charrette was to repurpose the pavement on University Drive to provide bicycle lanes. This would be accomplished by providing three travel lanes instead of four (one lane in each direction plus a center turn lane), and bicycle lanes. She stated that the proposed supplemental appropriation would provide funding to develop preliminary designs and associated traffic operations analyses. The study area includes a portion of University Drive between Armstrong Street and Sager Avenue only. She stated that a final decision on whether to repurpose the pavement will occur once the design and traffic analysis are complete. The Mayor asked if a public hearing was necessary for this item. Ms. Sanford stated that the NVTA monies are set aside for the City and are not project specific. She stated that in the future staff will request a higher dollar amount supplemental appropriation which will cover smaller dollar projects. The Mayor asked if staff could handle smaller dollar amount projects administratively without seeking approval each time from the Council. Ms. Sanford stated that was correct. Councilmember Schmidt asked if the lane striping on University Drive is on hold until after this study is completed. David Summers, Public Works Director, addressed the City Council and stated that the study is for Main Street to Armstrong Street and that temporary tape will be used for the striping in that area. Councilman Greenfield stated that he thought the study was for the section of University Drive, between South Street and Armstrong Street. He asked if staff had revised the section of University Drive for this project. Mr. Summers stated that staff is waiting in case there is a transition in the lane markings that would result in the final design stage. Councilman Greenfield asked if the transition would occur between South Street and Sager Avenue. Ms. Sanford stated that staff is examining the entire block because the actual location for the transition remains undecided. Ms. Sanford stated that the transition area would occur prior to Main Street to ensure there are four lanes of traffic. Councilman DeMarco requested staff supply the Council with information on the existing bicycle lanes along with the proposed ones for consideration as part of the report in September.

Public hearing and Council action on a Supplemental Appropriation Resolution in the amount of $0, for the transfer of NVTA 0% monies from the Transportation Tax Fund to the Capital Fund to fund construction for the Fairfax Boulevard Kamp Washington to Fairchester Roadbed Reconstruction Project. This public hearing was properly advertised in the July and, 0, issues of The Washington Times. Wendy Sanford, Transportation Director, gave the staff report which was incorporated into the record. She stated that this item pertains to approval of a supplemental appropriation resolution in the amount of $0, for the transfer of NVTA 0% monies from the Transportation Tax Fund to the Capital Fund to fund the remainder of the construction cost for the Fairfax Boulevard Roadbed Reconstruction Project from Kamp Washington to Fairchester Drive. She stated that there is $,00 available for this project and in order to fully fund the construction total of $,,, the City must supplement the approved funding with $0, in 0% NVTA funding. The Mayor opened the public hearing. The Mayor closed the public hearing after hearing no testimony. Councilman Greenfield moved to approve a supplemental appropriation in the amount of $0, for the transfer of NVTA 0% monies from the Transportation Tax Fund to the Capital Fund to fund construction for the Fairfax Boulevard Roadbed Reconstruction Project from Kamp Washington to Fairchester Drive. Councilmember Schmidt seconded the motion.

This public hearing was properly advertised in the July and, 0, issues of The Washington Times. Wendy Sanford, Transportation Director, gave the staff report which was incorporated into the record. She stated that this item pertains to approval of a supplemental appropriation resolution in the amount of $,000 for funding awarded to the City for paving of Primary Extension Roadways. This funding is fully reimbursable by the state. She stated that based on a legislative change that was effective July, 0, Section.- provides that primary extensions maintained by municipalities can receive a portion of the reconstruction and paving allocations previously only distributed to interstates and primary roads with a combined condition index of less than 0. She stated that the Commonwealth Transportation Board (CTB) approved a new program to address this Code change and developed an application process to allow municipalities to apply for this funding for qualifying projects. She stated that the City applied for this funding in FY but did not receive funding, and therefore reapplied in FY and has been awarded funding for six qualifying roadways. Councilman DeMarco asked staff to explain aspects of the condition index. Ms. Sanford stated that it is a rating system database used by VDOT to assess the condition of roadways in Virginia and those roadways that earn a score of less than 0 qualify for this funding. David Summers, Public Works Director, addressed the City Council and stated that the rating system is based on 0-0 and a road in good condition would earn 0 or more and a score of 0 would be for roads in fair condition. The Mayor opened the public hearing. The Mayor closed the public hearing after hearing no testimony. Councilman Meyer moved to approve a supplemental appropriation in in the amount of $,000 for funding awarded to the City through VDOT s FY Primary Extension Paving Program. Snyder Trail project. This public hearing was properly advertised in the July and, 0, issues of The Washington Times. Cathy Salgado, Parks and Recreation Director, gave the staff report which was incorporated into the record. She stated that this item pertains to approval of a supplemental appropriation resolution in the amount of $0,000 for the transfer of NVTA 0% monies from the Transportation Tax Fund to the Capital Fund to fund the George T. Snyder Trail Project. She stated that the project consists of 00 feet of asphalt trail from the west side of Plantation Parkway heading west on the southern side of the north fork of the Accotink Creek and terminating inside the Boulevard Marketplace. She stated that some sidewalk improvements, signage and a cross walk are included in the project and the project is funded with appropriated proffer funds in the Capital Budget and VDOT revenue sharing fund match. The Mayor asked when the dedication of the trail would occur. Ms. Salgado stated that staff is waiting for the signs to be completed and installed but that the dedication should occur within a month. The Mayor opened the public hearing. The Mayor closed the public hearing after hearing no testimony. Councilman Greenfield moved to approve a supplemental appropriation in the amount of $0,000 for the transfer of NVTA 0% monies from the Transportation Tax Fund to the Capital Fund to fund the George T. Public hearing and Council action on an ordinance amending Section - of the Code of the City of Fairfax, Virginia, pertaining to state motor vehicle laws.

Brian Lubkeman, City Attorney, gave the staff report which was incorporated into the record. He stated that Section - of the Code of the City of Fairfax, Virginia, is amended periodically to incorporate by reference any amendments to the state motor vehicle laws, and related statutes, enacted by the General Assembly. He stated that the purpose of incorporating these state code provisions by reference into the City Code is to ensure that the City receives fines levied against defendants for violations of these state code provisions. The Mayor opened the public hearing. The Mayor closed the public hearing after hearing no testimony. Councilmember Loftus arrived at : p.m. Councilmember Schmidt moved to approve an ordinance amending and reenacting Section -, Article, Chapter, of the Code of the City of Fairfax, Virginia, to incorporate by reference into the City Code certain state code provisions relating to the state motor vehicle laws, driving motor vehicles while intoxicated, and disposition of such cases for juveniles. Councilmember Miller seconded the motion. vote. Consideration of a task order to A. Morton Thomas and Associates, Inc. (AMT) in an estimated amount of $,0.00, for project inspection and oversight consultant services for Fairfax Boulevard (Route 0) reconstruction and paving from Kamp Washington to Fairchester Drive. Wendy Sanford, Transportation Director, gave the staff report which was incorporated into the record. She stated that this item pertains to approval of a task order to A. Morton Thomas and Associates, Inc.(AMT) for project inspection and oversight consultant services for Fairfax Boulevard (Route 0) reconstruction and paving from Kamp Washington to Fairchester Drive. This task will be issued under the Basic Ordering Agreement (on-call) contract with A. Morton Thomas and Associates, Inc. Councilmember Loftus asked if project inspection and oversight are normally handed by a third party instead of staff. David Summers, Public Works Director, addressed the City Council and stated that these projects require people to test the asphalt and ensure that the site is tidy and safe at all times.

Morton Thomas and Associates Inc. for project inspection and oversight consultant services for Fairfax Boulevard (Route 0) reconstruction from Kamp Washington to Fairchester Drive in an estimated amount of $,0.00 Councilmember Schmidt seconded the motion. vote. Consideration of an award of contract to Fort Myer Construction Corporation for an estimated amount of $0,.0 for the reconstruction of Fairfax Boulevard from Kamp Washington to Fairchester Drive. Wendy Sanford, Transportation Director, gave the staff report which was incorporated into the record. She stated that this item pertains to awarding a construction contract for the reconstruction of Fairfax Boulevard from Kamp Washington to Fairchester Drive. She stated the City advertised this project for construction in May 0 and received three bids. Fort Myer Construction Corporation was the lowest bidder at $0,.0 and staff requests authorization to award the contract to Fort Myer Construction Corporation. Councilmember Schmidt moved to authorize the City Manager to award a contract for an estimated amount of $0,.0 to Fort Myer Construction Corporation for the reconstruction of Route 0 from Kamp Washington to Fairchester Drive. Councilmember Miller seconded the motion. vote. Approval of minutes. Councilman Greenfield moved to approve the regular meeting minutes of June, 0. Councilman Meyer seconded the motion. vote. (Councilmember Schmidt abstained.) Councilman Greenfield moved to approve the special meeting minutes of July, 0. Councilman Meyer seconded the motion.

The Mayor recessed the regular meeting to go into a work session at : p.m. The Mayor reconvened the regular meeting at : p.m. Closed meeting to discuss appointments to Boards and Commissions and to consult with legal counsel for legal advice. The Mayor moved that the City Council convene a closed meeting under Section.-.A. to discuss appointments to Boards and Commissions and Section.-.A. for consultation with legal counsel for legal advice. The Mayor called for a vote, which carried by a voice vote of -0 recorded as follows: In favor, Mayor Silverthorne and Councilmembers DeMarco, Greenfield, Loftus, Meyer, Miller, and Schmidt; opposed, none. The Council went into a closed meeting at :0 p.m. and reconvened the meeting at : p.m. The Mayor and City Council concluded its closed meeting to discuss appointments to Boards and Commissions and to consult with legal counsel for legal advice. The Mayor moved each member of the City Council certify, to the best of each Councilmembers knowledge, (i) only public business matters lawfully exempted from the open meeting requirements in the Virginia Freedom of Information Act, and (ii) only public business matters identified in the motion convening the closed meeting were heard, discussed or considered. The Mayor called for a vote, which carried by a voice vote of -0 recorded as follows: In favor, Mayor Silverthorne and Councilmembers DeMarco, Greenfield, Loftus, Meyer, Miller, and Schmidt; opposed, none. Councilmember Loftus moved the appointment of Kevin Connors to the Board of Architectural Review for the remainder of a three-year term extending through October, 0. Councilmember Miller seconded the motion.

Councilman Greenfield moved the appointment of Michael O Brien to the Economic Development Authority for the remainder of a four-year term extending through October, 0. Councilman DeMarco seconded the motion. The Mayor called for a vote on the motion which carried unanimously by voice vote. Councilman Meyer moved the reappointment of Gary Bottorff to the George Mason University Fairfax Campus Advisory Board for a two-year term extending through July, 0. Councilman Greenfield seconded the motion. The Mayor called for a vote on the motion which carried unanimously by voice vote. Council Comments. Councilmember Schmidt announced that the City of Fairfax Band Children s Concert is on July, 0 at City Hall and she urged the community to come out and be part of the event. Councilmember Loftus announced that the upcoming performance of Hairspray, through the City of Fairfax Theater Company, will be held on July - and July - at Lanier Middle School and she invited the community to attend the production.
11 City Council Regular Meeting July, Councilmember Miller thanked the Independence Day Celebration Committee and staff for a great Fourth of July celebration. She wished the Council a happy summer during their summer recess. The Mayor announced that the former Kmart site will be demolished in the upcoming weeks and the construction of the new Lowe s store will commence shortly thereafter. The Mayor announced that the new Aldi store is now one of the top fifty revenue contributors for the City and congratulated them on their success. The Mayor announced that Sharon Cavalier recently passed away. He stated that Ms. Cavalier was very active in the business community, specifically with the auto dealer locations. On behalf of the Council, he offered their sincere condolences to her family. The Mayor announced that this is the last meeting prior to the August recess for the Council.
