Call to Order: Chairman Whitted called the Public Hearing of May 11, 2011, to order at 7:00 p.m. in the City Council Chambers. Invocation: Commissioner Papasodora-Cochrane offered the Invocation for the evening. Pledge of Allegiance: Commissioner Hutchinson led in the Pledge of Allegiance to the United States Flag. PLANNING COMMISSION ACTION: MINUTES for the April 13, 2011 Public Hearing were APPROVED. (8 0; Small/Johnson, Van Laethem excused) Commissioner Small moved that the MINUTES for the April 13, 2011 Public Hearing be APPROVED. Commissioner Johnson seconded the motion. The motion was carried by a vote of 8-0. Commissioner Van Laethem was excused. ITEM FOR WITHDRAWAL: UP PROJECT: B & D Business Center APPLICANT: Steve Wilson and Chris Nelson PROPOSAL: A conditional use permit for a computer based gaming establishment. ZONE: B-2, General Business District LOCATION: 445 Battlefield Boulevard North SIC CODE: 7999 TAX MAP SECTION/PARCEL: BOROUGH: Washington PLANNING COMMISSION ACTION: WITHDRAWN. No action necessary. Mr. Nielson stated that no action was necessary.

(8-0; Hutchinson/Johnson, Van Laethem excused) Mrs. Hanson read UP into the record for Commission review and action. Staff Presentation: Mrs. Hanson stated that based on sound planning practices, Planning staff recommended UP be APPROVED as listed in the official agenda. Proponent: Tequila Hill-Phillips, 1001 Hill Street, Chesapeake, Virginia, appeared before the Commission on behalf of UP representing South Hill. Steven Terry, Trustee, 4125 Old Virginia Road, Chesapeake, Virginia, appeared before the Commission on behalf of UP representing Deliverance Tabernacle Church. Opponent: Andy Joyce, 1649 Chesapeake Drive, Chesapeake, Virginia, appeared before the Commission in opposition to UP representing South Norfolk Civic League. Greg McCracken, 2101 Parks Avenue, Suite 300, Virginia Beach, Virginia, appeared before the Commission in opposition to UP representing Joseph Sawyer.

4 Page 4 Those who spoke in opposition were concerned about the encroachment on the adjacent property owners land which was currently under litigation, increased traffic, parking, noise, drainage and flooding issues. Commissioner Hutchinson moved that UP be APPROVED as listed in the official agenda and as recommended by staff. Commissioner Johnson seconded the motion. The motion was carried by a vote of 8-0. Commissioner Van Laethem was excused. CP A Resolution to amend the policies and maps of the 2026 Comprehensive Plan to expand the Public Utility Franchise Area to include real property fronting on Battlefield Boulevard, South, and identified on Chesapeake tax maps as parcel number (Continued from the April 13, 2011 Public Hearing) PLANNING COMMISSION RECOMMENDATION: Planning Commission recommends that CP-11-02, version dated March 22, 2011, be APPROVED. (8-0; Hutchinson/Johnson, Van Laethem excused) Mrs. Hanson read CP into the record for Commission review and action. Staff Presentation: Mrs. Hanson stated that based on sound planning practices, Planning staff recommended CP be APPROVED version dated March 22, 2011 as listed in the official agenda. Proponent: Nickey Rigdon, 2021 Emmett Drive, Chesapeake, Virginia, appeared before the Commission on behalf of CP representing New Beginnings Church. Commissioner Hutchinson moved that CP be APPROVED version dated March 22, 2011 as listed in the official agenda and as recommended by staff. Commissioner Johnson seconded the motion. The motion was carried by a vote of 8-0. Commissioner Van Laethem was excused.
