1 CITY OF CALLAWAY BOARD OF COMMISSIONERS REGULAR MEETING MINUTES APRIL 25, : 00 P. M. The Callaway Commission met in workshop session with Bob Pelletier, Mayor, Pamn Henderson, Mayor Pro tem, and Commissioners Melba Covey, Ron Fairbanks and Joseph Townsend in attendance. Also present was Tim Legare, City Manager; Kevin Obos, City Attorney; Janice L. Peters, City Clerk; Bill Frye, Zoning & Code Enforcement; David Joyner, Fire Chief; and Oscar Martinez, Public Works Director. The meeting was called to order by Mayor Pelletier, followed by an invocation and the Pledge of Allegiance. PRESENTATIONS Employee of the Month Jamie Kirkland City Manager Legare read the letter of recommendation in which Mr. Kirkland the City' s Building Maintenance Technician, was commended on the work he has completed in his new position. Commission presented Mr. Kirkland with the Certificate of Recognition. 20- Year Service Plaque Robert Dohanyos Mayor Pelletier read the award, presenting the plaque in appreciation of 20- years of service to the City of Callaway and commending Mr. Dohanyos on his service. 30- Year Service Plaque Robert Piercy Mayor Pelletier read the award, presenting the plaque in appreciation of 30- years of service to the City of Callaway and commending Mr. Piercy on his service. Municipal Clerk' s Week Mayor Pelletier read the Proclamation designating May 7-13, 2017, as Municipal Clerk' s Week. Council on American- Islamic Relations in Florida Ms. Hiba Rahim was not in attendance but had rescheduled for the May meeting. Code Enforcement Board Report Commissioner Covey requested that reports from all divisions, including the Sheriff' s Office report be provided in advance and added to the Consent Agenda for review monthly. Bill Frye, Code Enforcement Officer, reviewed open cases. Commissioner Covey asked about the Garden Cove case, which Code Enforcement Officer Frye advised it is an ongoing case and he will provide an update to the City Manager. 2 Mayor Pelletier asked City Attorney Obos about an abandoned home that already has had a couple of liens and asked if the liens can be accelerated. City Attorney Obos advised once abated the process starts again. The process was further discussed. CEO Frye advised the problem is getting bids to abate that are within the range the city can pay. Commissioner Townsend requested a list of just the open cases. Commissioner Covey referenced trash, furniture and debris on her street that has been there a while. CEO Frye advised they will concentrate on that issue. Bay County Sheriffs Office Report Cpt. Branning reviewed statistics for the month of March as follows: Miles Patrolled 22, 638 Traffic Stops 166 Calls for Service 1, 380 Citations Issued 117 Arrests Made 82 Traffic Crashes 45 Commissioner Covey referenced speeding and loitering on Seneca. Cpt. Branning advised they will do additional enforcement in that area. Mayor Pelletier called for changes to the agenda. City Attorney Obos asked that the CARE issue be moved to the Public Hearing section of the agenda. Consensus of Commission was to table the following Items 7 and 8: Res. No Personnel Manual Adoption Res. No Comprehensive Emergency Management Plan Commissioner Townsend asked that the Fire Department salary issue be added to the agenda for discussion. Motion was made by Commissioner Townsend and seconded by Commissioner Fairbanks to add Fire Department Salary for discussion. Motion failed 3-2 with Commissioner Covey, Commissioner Henderson, and Mayor Pelletier voting in opposition. Commissioner Henderson asked that the Item 13, the discussion of the additional officer be moved to after the Consent Agenda to accommodate Cpt. Branning. given. Consensus was PUBLIC PARTICIPATION Paul Bohac, 7010 Mike Lane, was in support of an additional Police Officer for the City, as well as health insurance payments and salary raises. 3 Carl Finch, 4701 Alameda Street, advised their garbage collector picks up before 5: 00 a.m. every Wednesday, which is in conflict with the City' s ordinance regarding collection. Mayor Pelletier advised all the garbage collectors are contracted and asked that the City Manager look into the issue. Code Enforcement Officer Frye advised he is aware and is working on the issue. David Agosta, 6609 Pridgen Street, spoke about improving the city' s the possibility of acquiring should be done as the money is received. infrastructure and a bond, which he was not in favor of. He felt the projects Jean Champoux, 621 S. Berthe Avenue, asked for an explanation of the interview process and the actual deadline for receiving applications. Mayor Pelletier reviewed that Commission had decided that any qualified applicants received after the April 20th Special Meeting, but before the 5: 00 p. m. deadline on Friday, April 21St, they would be interviewed. One qualified applicant submitted before the Friday deadline and will be interviewed. Commissioner Covey further elaborated. Motion carried unanimously upon roll- call vote. CONSENT AGENDA Financial Update " Budget- in- Brief' Budget Transfers Motion was made by Commissioner Henderson and seconded by Commissioner Fairbanks to approve the consent agenda. Motion carried unanimously. Mayor Pelletier reminded all that Commissioner Covey had requested departmental reports to be added to the Consent Agenda going forward, which will be discussed during Commission Comments. OLD BUSINESS Ground Storage Tank Cleaning/Painting Bid This item was for Commission approval of the cancellation of the contract with North Florida in favor of Precon for noncompliance by North Florida. 4 Motion was made by Commissioner Henderson and seconded by Commissioner Fairbanks for cancellation of the contract with North Florida and award to Precon. Motion carried unanimously. Law Enforcement Officers Commissioner Henderson reviewed her request for an additional Law Enforcement Officer to be considered during the budget discussions. Capt. Branning elaborated on the need and the asset it would be to the City to have an extra Officer. This would provide extra patrols and improve the officer to resident ratio. Commissioner Covey was not in favor of adding an additional officer as the population has not grown and he was not in favor of a curfew as discussed last month. She also asked for confirmation that there is an Administrative person in their office. Captain Branning confirmed and advised the statistics provided last month regarding the curfew was based upon the ages of the people they had interactions with, which were not juveniles. Commissioner' s Fairbanks and Townsend were happy with the service provided and in favor of adding another officer. Commission consensus was to add to the budget for further discussion during the budget process for FY2017/ 18. PUBLIC HEARING CARE, Inc. - Request for Conditional Zoning Use at 6109 Cherry Street Mayor Pelletier advised the letter received regarding CARE was not from a CARE employee but a resident of Panama City. 5 The following citizens spoke in favor of the facility: Paul Bohac, 7010 Mike Lane Francis Faust, 119 Hill Drive Reverend Adkinson, representing CARE, thanked Commission for the opportunity to have the dialog. He further reviewed facts surrounding the facility, versus perception of the public. Motion was made by Commissioner Covey and seconded by Commissioner Townsend to deny the request for CARE' s conditional zoning change. Motion carried unanimously. Commissioner Henderson clarified that even though she personally was in favor of the facility she had to vote on the wishes of the citizens. Resolution No Budget Amendments City Attorney Obos read Resolution No by title as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CALLAWAY OF BAY COUNTY, FLORIDA, AMENDING THE FINAL BUDGET FOR THE TWELVE- MONTH PERIOD BEGINNING OCTOBER 1, 2016, AND ENDING SEPTEMBER 30, 2017; AND PROVIDING FOR AN EFFECTIVE DATE. Motion was made by Commissioner Covey and seconded by Commissioner Townsend for approval of Resolution No Motion carried unanimously upon roll-call vote REGULAR AGENDA Res. No Regions Banking Signatures City Attorney Obos read Resolution No by title as follows: A RESOLUTION OF THE CITY OF CALLAWAY, FLORIDA, AUTHORIZING SIGNATURES FOR CHECKING ACCOUNTS WITH REGIONS BANK; REPEALING ALL RESOLUTIONS IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. Motion carried unanimously upon roll-call vote. GAC Contractors Change Order No. 1 Kimbrel Avenue Project Motion was made by Commissioner Henderson and seconded by Commissioner Covey for approval of the change order for the not-to- exceed amount of $9, Motion carried unanimously upon roll- call vote. Half-cent Sales Surtax Mayor Pelletier advised the City Manager and Dewberry will return with a projects. list of Health Insurance Premiums Commission was given to move forward with two health insurance plans, with the City paying a set amount. This will be included in the budget. Wellness Program Commissioner Henderson asked that $ 50 be put in the budget for wellness incentive. No consensus was given. 7 COMMISSION COMMENTS Joseph Townsend, Commissioner, Ward IV NAACP Banquet Commissioner Townsend advised he attended the NAACP Ball and had a blast. Commission Illness Commissioner Townsend asked that when one of Commission is ill or in the hospital that the remainder of Commission be notified by the City Clerk. Code Enforcement Grids Commissioner Townsend asked City Manager Legare if the issue of the grids will be enforced. City Manager Legare advised it will. Active Shooter Workshop Commissioner Townsend felt it would be a good idea to send someone from the City, maybe the Fire Department to the workshop. Ron Fairbanks, Commissioner, Ward III Commissioner Fairbanks thanked citizens for attending the meeting. Pamn Henderson, Commissioner, Ward II West Florida Regional Planning Council ( WFRPC) Commissioner Henderson reviewed the last meeting of the WFRPC and their plans to establish other offices local to Destin, Pensacola and Bay County. She advised they can be used for studies and other services, which are free or minimal cost. Melba Covey, Commissioner, Ward I NAACP Banquet Commissioner Covey advised she also attended the NAACP Ball and commended Leisure Services on setting up the event. Departmental Reports Commissioner Covey requested monthly reports from all departments be provided to Commission on a monthly basis via the Consent Agenda, to include the Police Department. City Manager Legare answered questions regarding the Leisure Services report. Fire Department Training Commissioner Covey asked if there are certifications given for their training in Lynn Haven. Chief Joiner advised it is part of their annual ISO training for accreditation and that is the facility they use. The Chief and Lieutenants certify that qualifications are met. 8 Personnel Manual - Page 20 - Nepotism Commissioner Covey requested something be added regarding coworkers who date or cohabitate, prohibiting work in the same department. City Attorney Obos advised that situation would not rise ethically to the level under state statutes but Commission can be more stringent. Commission consensus was given and the City Manager and City Clerk will get with the City Attorney for verbiage. April Paint-up Clean- up Fix-up Month Commissioner Covey asked if anything happened in Callaway during this time. City Manager Legare reviewed how much yard debris was picked up. He didn' t know of any efforts to get volunteers to help the elderly. Commissioner Covey would like to see this happen. Resolution No Master Meters She stated it was not in the resolution to charge per door flat rate fees for master metered properties. City Manager Legare advised all master meters are being charged flat rate fees per door. Invitations Commissioner Covey reviewed invitations she received. Tim Legare, City Manager Letter of Appreciations City Manager Legare advised the letter of appreciation had been mailed to the Bay County Sheriff for the inmate labor program. GovDeals He advised $ 1, 160 was received for the asphalt trailer, a Z-mower sold for $ and another mower that sold for$ 330. More items are going to be listed soon. CDBG Grant City Manager Legare advised he met with Dennis Dingman and a site visit will take place in May and the application process is moving along. Evaluations He advised HR provided him with a list of evaluations and there are a couple that are behind. These will be brought current as soon as possible. Bay Alert He indicated 1, 694 Callaway residents are signed up for the service. Mayor Pelletier did not care for the letter from Bay County indicating waste spill notices will be issued via Bay Alert. Vault System City Manager Legare advised he has received quotes and will be bringing something back to Commission. The current process was discussed in comparison to the vault system. 9 Property Insurance He advised Bob Bell had provided updated information on property values and coverages for the city' s buildings, which will result in an increase of$ 1, 100 for the remainder of the fiscal year. Mayor Pelletier pointed out that the rates were to be locked in for 2 years and felt insurance premiums should be rebid. Discussion ensued. He asked City Manager Legare to look at the contract and consider going out for rebid. Bob Pelletier, Mayor Utility Account Write- offs Mayor Pelletier noted that $ 1, sewage bill is being written off and asked City Manager Legare if there are any other accounts that need to be turned off for nonpayment. City Manager Legare advised there are five for under $ 200 and notices have been sent in February but no follow- up has been done. Mayor Pelletier recommended locking out the sewage account and sending a letter to the business owner as well as the Health Department. City Manager Legare advised a lot of the amount that was written off was late fees and he will look into the current delinquent accounts. Budget Mayor Pelletier recommended the City Manager refer to the audit and prior budget when working on the next fiscal year' s budget. Unemployment Benefits Mayor Pelletier asked who approves the benefits and felt that if an employee resigns they should not receive unemployment benefits. He asked if any are ever disputed and asked for documentation. ANNOUNCEMENTS Mayor Pelletier read the announcements as well as the schedule and process for the City Manager interviews. City Clerk Peters recommended the interview process not be live streamed but made available on- demand after the last interview. Commission agreed.
