3 MINUTES St. Charles County Council Journal Budget Work Session November 13, 2012 The St. Charles County Council met in the Council Chambers, 100 North Third Street, St. Charles, Missouri, at 5:00 p.m. on Tuesday, November 13, 2012 for a budget work session of the Council. Council Members presents were: Council Member Cronin, Council Member Brazil, Council Member Matheny, Council Member Daugherty and Council Member White. County Executive Staff present: County Executive Steve Ehlmann, Director of Administration Chuck Gross, Director of Intergovernmental Affairs Don Boehmer, and Director of Finance Bob Schnur. Council Chair Matheny requested an overview of the 2013 Proposed Budget from County Director of Administration Chuck Gross. (See attached highlights.) Council Chair Matheny presented a breakdown of various departments and reviewed them with the Council Members and Administration. (See attached chart.) Council Chair Matheny requested Tom Neer, County Sheriff and Jim Ray, Finance Manager in the Sheriff s Dept. to address some concerns regarding the budget if the Council had questions. Neer explained he had requested a deputy and an EMA officer, however was only granted the deputy for Neer was supportive of the compression attention the administration is giving to the employees. Director of Administration Chuck Gross and Director of Finance Bob Schnur commented on how organized the Sheriff and his staff are when submitting the budget figures each year. Neer stated the Sheriff s budget has been providing approximately $400,000 of drug seizure money on necessary expenses and if the money is not available, the department would suffer. It was discussed that there are approximately 50 Federal prisoners under contract at the Corrections Facility where the County is reimbursed $65.00 per day per prisoner along with reimbursed medical and transportation costs. The State prisoners are only reimbursed $19.25 per prisoner per day. Also discussed was the amount of medical and dental care that is provided to the prisoners. The County provides only the minimum care under the law. Belinda Little, Human Resources Director presented a chart and breakdown on how the County was beginning to combat the compression issues with employees. (See attached chart.) Community Development was discussed regarding money in the budget for the CDBG program. The Facilities Department was discussed regarding the increase this year and it was increased

4 due to utility costs. The Counselor s office has an increase due to having to hire outside legal counsel and hiring a new attorney to work with the Juvenile office and putting money into the Self Insurance Account to cover lawsuits. The Human Resources Dept. was discussed because of the increase in training. Chuck Gross, Director of Administration stated he has stricken training for the past three years and is beginning to fund it again. Bob Schnur, Finance Director stated the Employee Assistance Fund was able to fund $75,000 in training and increase the 457 Match Program. It was noted the Personal Days and the conversion of sick days to Personal Days that was given to employees in the past is not part of the 2013 Proposed Budget. It was decided there was no need for an additional budget meeting so the 5:00 p.m. meeting that was scheduled for Monday, November 26 th has been canceled. There being no other discussion, the Work Session ended at 6:30 p.m. St. Charles County Council Journal November 13, 2012 The St. Charles County Council met in the Council Chambers, 100 North Third Street, St. Charles, Missouri, at 7:00 p.m. on Tuesday, November 13, Council Member Cronin provided the Invocation. The Pledge of Allegiance was led by Council Member White. She requested comments be limited to three minutes per speaker with alternating pro and con positions on a particular topic and that anyone who addressed the County to please fill out a speaker s card for

5 the record. Telecommunication Tower on West Meyer Road Kevin Dalton, resident on West Meyer Road stated the Council recently denied a request for a conditional use permit to allow a telecommunication tower on West Meyer Road and alerted the Council that St. Charles Tower has submitted a petition to the court suing St. Charles County regarding that tower. Dalton submitted a copy of the petition to the Council Members. Dalton suggested the County organize a group of citizens to look at the current telecommunication regulations and change the rules on the current regulations Bill No John Kjar, 808 McKinley Blvd, Alton, IL stated he was the applicant requesting a campground off of Highway C. Kjar explained he had prepared a letter and a petition to amend the current language in Bill 3906 to reduce the lots to 14 sites from 50, among many other changes. Kjar added he had received 22 signatures from surrounding property owners and citizens who would be affected by this campground showing their support of the conditional use permit. Kjar stated he has been working very closely with the Community Development Department. Drew Weber, Attorney with Hazelwood and Weber and representing Dardenne Realty Company pointed out the Planning and Zoning Commission denied this request and stated there was no site plan at this time and there are many changes to the amount of lots being requested. Weber pointed out Mr. Kjar s father owns the neighboring marina and that marina is currently in violation of several property code violations. Weber also pointed out a safety issue as there is only one road in and out of this proposed campsite. Weber concluded by saying Dardenne Realty is requesting the County Council uphold the Planning and Zoning Commission s denial. A gentleman approached the Council stating he and his family had been boating for years at the Lake of the Ozark and wanted something quieter and after searching found this spot at the marina across the street from the proposed campground and now has two boats, jet skis and enjoys everything about the area. Phil Donahue, 1200 Cactus Trailer Ct., Lot 25, St. Charles, MO stated the location is beautiful and quiet with friendly neighbors. Donahue supported the conditional use permit. Bill No Robert Held, 150 Homestead Ridge off of Highway F stated he attended the Planning and Zoning Commission meeting and is concerned with the fence next to his property which was installed by the Burke s. Held pointed out the fence is T-posts with barb wire and is not enough to keep people from crossing the property line and requested someone contact him. Editor s Note: Council Chair Matheny explained someone from Community Development would contact him. Emergency Communication Towers Greg White, an attorney hired on behalf of Dave Dempsey and other surrounding residents in the

6 Schluersburg Road area, pointed out the Emergency Radio Communications issue is a major project and he had just received some of the information regarding the Motorola contract. White pointed out a big concern of the area citizens is the lack of involvement regarding the location of the towers. Dave Dempsey 1498 Boone Woods Trail, Augusta stated their group of citizens believes there is a better solution to a 500 ft. self-supporting radio tower. Dempsey pointed out the citizens agree communication is necessary, however the beauty and environment with the winery district and historic value of the Daniel Boone family. Dempsey noted the property values in the area will dramatically drop if the tall towers are allowed to go up. Dempsey suggested the County seek a legal opinion from a separate venue and ensure it complies with UDO regulations. A citizen who stated he recently purchased a home near the tower site because of its beauty and the possibility of growing grapes. This citizen stated these types of towers can be noisy and stated he would have liked to have been on a board that made such decisions. The citizen pointed out he understood there is a Federal mandate regarding this issue and pointed out there should be other solutions. Sam Stang, 512 Schluersburg Road, Augusta, MO stated he has a glass blowing business in Augusta and lives directly next door to the proposed tower. Stang noted the bank currently owns the land this proposed tower will be installed. Stang requested the citizens be able to view the site plan and also requested the County share more information. Donald Struckhoff, 5266 Hackmann Road, Augusta, MO stated he is on the board of the Augusta Bottom Fire Protection District and explained the 800 MHz system that the County is trying to achieve according to the mandate is one that requires a line of sight. This line is easy to achieve in an urban area due to buildings and concrete that the signals can bounce off of, however in a rural area the signals do not bounce off of dirt, trees and/or leaves. So it is imperative there is a line of sight. To achieve that a tower tall enough to be taller than the area topography allows. Council Member Brazil made a motion to amend the Public Comment rules to allow him to address the audience, seconded by Council Member Cronin and unanimously approved. Council Member Brazil stated Ordinance was approved by the Council in 2011 and explained the bill is very vague and gives the County Executive the authority to purchase the land and erect the towers wherever they want with no public discussion. Brazil pointed out there is nothing in the exhibits or the contracts to the ordinance that waives the Planning and Zoning Commission rules. Brazil stated he has requested hard copies of answers to various questions and has received nothing from the Administration. Brazil pointed out the wine district should remain clear of obstructing views. Council Chair Matheny stated it has not been determined where the new towers are going to go at this point. County Counselor Joann Leykam explained the Council staff had done some research regarding tower heights in other pristine areas and also St. Louis County and clarified St. Louis County

7 does have two existing towers that are 1,000 ft. tall each along with some others already installed. Leykam pointed out St. Louis County has to install eight or nine additional towers and their height are around 200 ft. Leykam concluded by saying Jefferson County s towers will all be roughly 500 ft. in height due to their topography. There being no additional speakers, Public Comments ended at 7:45 p.m. and Council Chair Matheny recessed for 5 minutes to allow the audience to file out of the chambers. ORAL REPORT FROM THE COUNTY EXECUTIVE County Executive Ehlmann had no Oral Report. THE CONSENT AGENDA Council Chair Matheny asked if anyone had any items to be removed from the Consent Agenda. Council Member Cronin made a motion to remove the Parks & Recreation bid and the Correction s Department bid from the agenda, seconded by Council Member Brazil and unanimously approved. Council Member White made a motion to approve the Consent Agenda as modified, seconded by Council Member Brazil and unanimously. 8 Domestic Violence Board Funding Recommendations for 2013-$90,000. to Bridgeway Behavioral Services ITEMS REMOVED FROM THE CONSENT AGENDA Parks & Recreation Youth Activity Park Monument Sign w/electronic Message Board/Piros Signs/$41, Councilman Cronin questioned Bettie Yahn-Kramer, Parks & Recreation Director on the necessity of this sign when there is a bill on the agenda to change the park fees. Yahn-Kramer explained when the park was first built, there was not much development in the surrounding area and the park was easily found and now there is so much around the park, it is difficult for new people to find it. Also Yahn-Kramer added, it allows the Parks Department to market and advertise the current events at the park. Yahn-Kramer noted it was comments received from the citizens suggesting a bigger sign. Yahn-Kramer also noted they had approached the City of Dardenne Prairie with this sign because Highway N is in the city limits and they have no issues with it. Yahn-Kramer explained the fees in the bill that is on the agenda is being changed to allow family and individual memberships to the parks because of the increased amount of people who visit the park many times throughout the year. Cronin stated $42,000 on a sign is a lot and requested it stay tabled for him to gather more information. Corrections Medical doctors, registered nurses, dentists & dental assistants to the adult detention facility/correctional Healthcare Companies/$613, Councilman Cronin stated he had read the feedback from the various counties on this bid and questioned Larry Crawford, Director of Corrections on what is allowed for when providing care to inmates. Also Cronin questioned if under the Affordable Healthcare Act, would the Federal government provide funding to care for local inmates. Crawford replied he would review the possible funding under the Affordable Healthcare Act and explained there are two standards of healthcare. One is the Correctional Standard and the other is the Community Standard. Community Standard is what most people have. Correctional Standard is the care that is required for inmates and that is just the basics of healthcare. Discussion was held regarding charging inmates for healthcare and currently St. Charles County charges inmates with a co-pay. There being no other discussion, Council Member Cronin made a motion to accept the Corrections bid as presented, seconded by Council Member Brazil and unanimously approved. BILLS FOR FINAL PASSAGE Bill No Sponsored by Nancy Matheny An Ordinance authorizing execution of Grant Award Agreement BHD-12 between the Missouri Foundation for Health and St. Charles County Department of Community Health for receipt of grant funds of $25,000 for basic support funding to supplement Health Department expenses to better serve the Community

9 There being no discussion, Council Chair Matheny requested the following roll call vote: Council Member Cronin yes, Council Member Brazil yes, Council Member Matheny yes, Council Member Wynn absent, Council Member Hollander absent, Council Member Daugherty yes, Council Member White yes. Bill No was approved. BILLS FOR INTRODUCTION Bill No Sponsored by Joe Brazil An Ordinance granting Conditional Use Permit for a bed and breakfast residence to Edward F. and Katrena R. Burke Council Member Brazil stated he has no opposition however did have some questions regarding the fence between the property owners. Brazil stated the Conditional Use Permit recommends a fence with no other details and questioned if the Council can make it more specific. Council Member Cronin, who sits on the Planning and Zoning Commission, stated the question on what type of fence should be installed was brought up at the Commission meeting and a T- post with barb wire was sufficient. Cronin pointed out the neighboring property owners can paint their tree line with a small purple square every 100 ft. which is sufficient to say No Trespassing. Cronin pointed out because the Burke s asked what type of fence was required, it would not be fair to change it now. Bill No Sponsored by Jerry Daugherty An Ordinance granting Conditional Use Permit for a campground to J.O.K. s L.L.C. Council Member Daugherty stated he and Wayne Anthony, Director of Community Development have reviewed this issue and met with the property owner. Daugherty stated the applicant wishes to amend the bill to only allow 14 campsites. Daugherty summarized this by saying the first application was withdrawn and now is being reapplied for. Daugherty pointed out Two Branch Marina which is owned by the applicant s father has property code issues, however it is not fair to penalize another person or application. Daugherty explained he has spoken to all of the surrounding property owners except Dardenne Realty Co. and everyone is agreeable for this bill to move forward with amendments. Anthony reviewed many amendments from the list below: 1 Right of Entry - The County shall have the power to enter at reasonable times for the purpose of inspecting and investigating conditions relating to the enforcement of this onditional Use Permit. 2. Each RV site within the RV Park is for seasonal lease only (180 days per calendar year) and not to be leased for transient use. Each RV site shall be marked with a site number in a manner that it is identifiable to emergency providers. 3. Location of the RV sites and size of individual RV sites shall be in accordance with the application submitted and amended by the petitioner. 4. The recreational vehicle must be currently licensed and ready for highway use. 5. The recreational vehicle must either have a self-contained water and sewage disposal system

10 or be connected to an external water and sanitary sewage system approved by the St. Charles county division of Building Code Enforcement. 6. Water Supply a. a pressurized water system, adequate to serve all anticipated needs, shall be provided. b. Water supplies shall meet all current requirements of the Department. They shall be properly located, constructed, and protected to exclude surface contamination and to minimize the potential of contamination from sanitary hazards. All portions of the water system located in the campground shall be easily accessible for maintenance. The ownership of all portions of the water system serving the campground shall be made a matter of record to the Department. 7. Sewage Disposal - The proposed method of sewage disposal shall have the approval of the director of Building Code Enforcement prior to the commencement of any construction and shall comply with all appropriate state laws and local regulations. The method must provide individual RV site connections to a waste water disposal system (i.e. septic tank and field) or an RV Recreational Vehicle Waste Disposal Station. Waste hauling tickets/receipts shall be made available to the County for inspection upon request. 8. Solid Waste Disposal shall be provided: a. All garbage and refuse shall be stored in a durable, watertight, rodent-proof, fly-proof containers with tight-fitting covers. All containers shall be maintained in a state of good repair, and shall be kept clean. b. Collection and disposal of garbage and refuse shall be in an approved manner, and of such frequency as to prevent a nuisance or health hazard to campers or adjacent areas. c. An adequate number of containers shall be provided for the depositing of garbage and refuse. d. Containers for garbage and refuse shall be supported in such a manner as to minimize tipping or spillage and the area around such containers shall be kept clean. 9. Maintenance - The campsite and the premises shall be maintained in a clean and orderly manner. 10. Additional Vehicles stored at each RV site shall not exceed two trailers or recreational equipment and such trailers shall be road ready or capable of being loaded on a road ready trailer or other vehicle. 11. No more than one RV may occupy a RV site. 12. Each RV site shall be designed to provide one parking space for the occupant of the RV. 13. Supervision - The person to whom a permit for a RV Park is issued shall at all times operate the campground in compliance with this regulation and shall provide adequate supervision to maintain the campground, its facilities, and equipment in good repair and in a clean and sanitary conditions at all times. 14. A site plan must be submitted to and approved by the St. Charles County Community Development Department. 15. The maximum number of campsites is limited to A six inch thick gravel drive 16 foot in width shall serve the campsites. 17. A six foot tall privacy fence or dense landscaped buffer shall be provided along any property

11 line where the adjacent land use is a single-family residence and where a campground lot is within 100 feet of the property line. 18. No conditional use shall be in active use until such time as all conditions of approval have been met. 19. In any case where a conditional use is not in place and in active use within two years from the date of granting, and/or in accordance with the terms of the conditional use originally granted or subsequently amended, then, without further action by the Planning and Zoning Commission and/or the County Council, the conditional use, or authorization thereof, shall be null and void. Bill No Sponsored by Joe Brazil An Ordinance granting Conditional Use Permit for a nursery to Gail Sims Council Member Brazil stated this was close to Highway N on Hopewell and there are lots of vacant homes in the area and he has not received any complaints. Council Member Cronin stated the neighbors supported the request for this nursery. Bill No Sponsored by Nancy Matheny An Ordinance amending Ordinance granting Conditional Use Permit 9491 for boat rental to Joseph T. and Kelly Brazil County Counselor Joann Leykam explained Councilman Brazil would need to recuse himself from the dais and sit in the audience if there were to be any discussion. Bill No Sponsored by Joe Brazil An Ordinance amending Sections , , , and of the Unified Development Ordinance of St. Charles County, Ordinances of St. Charles County, Missouri, and enacting a new Section of the Unified Development Ordinance, to authorize a new Agricultural Tourism District Council Member Brazil explained this bill was from discussions that were held by the Master Plan Review Committee and the Community Development Department within the past year. Brazil commended Wayne Anthony, Director of Community Development on a tremendous job. Brazil noted this allows the wineries more in terms of adding structures to their business, but with being very strict on what is allowed. Brazil stated the Community Development has design criteria which is available in their department. Bill No Sponsored by Council as a Whole An Ordinance approving execution of an intergovernmental agreement with the Missouri Highways and Transportation Commission for Phase III/Missouri Route 364 Council Member Brazil questioned the administration on what was the outcome of a meeting with Dardenne Prairie regarding the design. County Executive Steve Ehlmann explained this is a Design-Build type of bid where there are now 4 teams chosen to produce a design. The good thing about this type of bid is you get more for your money; however the downfall is you have no say in what is chosen. Ehlmann pointed out this is a MoDOT project and they have the last word. Ehlmann noted the main concern for St. Charles County Government is that this roadway go all the way to Highway 64. Don Boehmer, Director of Intergovernmental Affairs pointed out

12 MoDOT was able to free up some monies and this bill is to allow that money to be used for this project. Council Member Cronin noted it would be a tremendous asset for the driving community to have access to Highway 364 from Highway 70 without utilizing 94 and all of the stop lights. Bill No Sponsored by Nancy Matheny An Ordinance amending Section of the Ordinances of St. Charles County, Missouri, relating to fees at County Parks Council Member Cronin had some questions regarding the fees and stated he would ask them before the next meeting from the Parks & Recreation Director. Council Chair Matheny requested whatever is asked and replied to please forward the information to the other Council Members. Bill No Sponsored by Nancy Matheny An Ordinance authorizing the County Executive to execute a renewal of the License Agreement the AmerenUE for County communications equipment on the Sioux Power Plant Smoke Stack at a cost of approximately $3, per year Bill No Sponsored by Nancy Matheny An Ordinance authorizing the County Executive to sign a consent to annexations as requested by the City of St. Charles for annexation of a portion of South Main Street and as requested by the City of O Fallon for annexation of a portion of Mexico Road from the east right of way line of Guthrie Road east to the north right of way line of the Norfolk and Southern Railway BILLS REMOVED FROM THE TABLE Council Member Daugherty made a motion to remove Substitute Bill No from the table, seconded by Council Member Brazil and unanimously approved. Substitute Bill No Sponsored by Jerry Daugherty An Ordinance amending Section of the Unified Development Ordinance of St. Charles County, Ordinances of St. Charles County, Missouri Council Member Brazil stated he thought this bill was to increase government interference, when in actuality, it is not. Brazil stated he was in support of this bill. Wayne Anthony, Director of Community Development reviewed the current language and the proposed language just to clarify any confusion. Council Member Cronin stated he has county subdivisions that would allow this next to city residential areas and wanted to review it with the neighboring mayors. Council Member Daugherty made a motion to call the question, seconded by Council Member Brazil and unanimously approved.

13 There being no further discussion, Council Chair Matheny requested the following roll call vote: Council Member Cronin no, Council Member Brazil yes, Council Member Matheny yes, Council Member Wynn absent, Council Member Hollander absent, Council Member Daugherty yes, Council Member White yes. Substitute Bill No was approved by a vote of 4 aye to 1 nay. ANNOUNCEMENTS AND MISCELLANEOUS Council Chair Matheny congratulated everyone who was successful in their election and expressed her condolences to Council Member Daugherty for his run for re-election to District 6.
