1 Council Journal, , Page 1 St. Charles Council Journal July 13, 2015 The St. Charles County Council met on Monday, July 13, 2015 at 7:00 p.m., in the County Council Chambers, 100 North Third Street, St. Charles, Missouri. Council Chair Brazil introduced Kevin Kolb with Grace Baptist Church who provided the invocation. Council Member Hollander then led the Pledge of Allegiance. The following roll call was taken by the Clerk: Council Member Joe Cronin present Council Member Joe Brazil present Council Member Mike Elam present Council Member Dave Hammond present Council Member Terry Hollander present Council Member Mike Klinghammer present Council Member John White present County Executive Staff present: Steve Ehlmann, County Executive Joann Leykam, Director of Administration Jennifer George, Assistant Director of Administration Harold Ellis, County Counselor PUBLIC COMMENTS Council Chair Brazil opened public comments and announced that anyone who wanted to address the Council on any topic to come forward with their comments. He requested comments be limited to three minutes per speaker with alternating pro and con positions on a particular topic. Miscellaneous A.C. Dienoff, requested again a response on his request to hire a special prosecutor to investigate the potential conflicts in the filling of the vacancy on the Community College District Board. Dienoff also noted his concerns regarding several bids on the Consent Agenda pointing out the need to purchase from vendors in St. Charles County. MO Rides Deana Dothage, with Boonslick Regional Planning Commission, 111 Steinhagen, Warrenton, MO thanked the County Council and Executive for their continued support for MO Rides which is a transportation referral service for residents in surrounding counties including senior citizens and citizens with disabilities. Dothage explained her position and requested if anyone is in need of transportation to please contact her at Dispatch & Alarm renewal of annual CAD software support A citizen from the audience approached the Council and explained his field is in IT and noted the bid for software support for $146, for Dispatch & Alarm was extremely high and the Council should be concerned with the price.

2 Council Journal, , Page 2 Bill No Brad Goss, attorney representing the residents in opposition of this bill presented some slides of the area and pointed out concerns of declining property values, highway safety, sanitation issues and erosion and water runoff from the proposed soccer fields. Goss pointed out it is the responsibility of the applicant to ensure the surrounding areas are preserved and not impede on the residents. Mike Woijeck applicant for the CUP and is associated with the MO Thorns stated these soccer fields are for young boys and girls to begin their path to soccer scholarships and possibly professional soccer. Woijeck explained they are proposing seven (7 fields with two (2 of them being synthetic made from coconut husks. Woijeck also explained the easements and the lighting system. Amy Kartmann, 52 Stealey Road, Wentzville, MO stated she is a resident and landowner of property directly across Highway Z from the proposed soccer fields and noted it would deminish their property values. Kartmann also pointed out various neighbors who have either put their home up for sale or have stopped construction to see what the outcome of this CUP application is. Kartmann also pointed out safety concerns at the intersection of Highway Z and Sprock Road and also drainage concerns. Gregory Geyer with the MO Thorns explained his history as a certified real estate appraiser and real estate agent and presented the Council with statistics that show the increased property values of residential areas near new soccer fields. Rob Jorgenson homeowner nearby stated he has stopped construction on his home to see what the outcome of this application is. Jorgenson stated he cannot put more money into his property if he is not going to see the benefits of increased property values. Jorgenson urged the Council to keep this area rural and to keep safety issues along the Highway a priority. There being no further speakers, Council Chair Brazil closed public comment at 7:27 p.m. ORAL REPORT FROM THE COUNTY EXECUTIVE No oral report was presented. CONSENT AGENDA Council Chair Brazil requested consideration of the consent agenda and questioned if there were any items to be removed. Council Member Cronin made a motion to remove the Police Department s bid for the Nissan Van and also the Community Development s bid for Housing Affordable for Renters, seconded by Council Member Elam and unanimously approved. Council Member Klinghammerr made a motion to approve the remaining consent agenda as modified, seconded by Council Member Elam and unanimously approved by all members. The following items were approved: Approval of Journal of the previous meeting ( Approval of Bids Parks and Recreation two ( John Deere Utility Vehicle Carts/W.M. Nobbe & Co./$34, Facilities Management provide & install modifications to the Executive Building fire protection systems/simplex Grinnell/$25, Dispatch and Alarm Renewal of annual CAD software support/tritech Software Systems $146,045.35

Cronin pointed out the Nissan van has a tall roof and is available right away versus building one from the chassis up which would take longer. Cronin stated he was in support of the Nissan van. Community Development Housing Affordable for Renters/Professional Healthcare Services, LLC/ $60,000 Council Member Cronin said he has met with Planning and Zoning Division Director Robert Myers and Director of Administration Joann Leykam and requested this item be tabled to allow for more research. Council Chair Brazil clarified the approval of the Nissan van bid and the tabling of the Housing Affordable for Renters bid. There being no further discussion, Council Member Cronin made a motion to approved the Nissan bid and table the Housing Affordable for Renters bid, seconded by Council Member Elam and unanimously approved. Council Members Klinghammer and Hammond congratulated Scott Drachnik on his appointment as the Director of Workforce Development and noted his work ethic is outstanding and his history with the Economic Development will benefit both that office and Workforce Development s office. BILLS FOR FINAL PASSAGE Bill No Sponsored by Joe Brazil An Ordinance authorizing the County Executive to execute an agreement with municipalities for inspections and assessments of damage caused by flooding or other disasters There being no discussion, Council Chair Brazil requested the following roll call: Council Member Cronin yes, Council Member Brazil yes, Council Member Elam yes, Council Member Hammond yes, Council Member Hollander yes, Council Member Klinghammer yes, and Council Member White yes. 4 Council Journal, , Page 4 Bill No Sponsored by Joe Brazil An Ordinance granting Conditional Use Permit CUP for a nursery and lawn care service to Robert Shatro Council Chair Brazil asked if the applicant was in the audience and commented there has been a nursery there before and according to Robert Myers, Planning and Zoning Division Director this is an expansion of the nursery that is on the property adjacent to this application. Bill No Sponsored by Joe Brazil An Ordinance granting Conditional Use Permit CUP for athletic fields to Mike Woijeck Council Chair Brazil invited Brad Goss and Mike Woijeck to the podium to explain their views on this issue and also advised them to talk with the neighbors and try to come to an agreement to allow the athletic fields. Goss pointed out the need to put specific conditions in the bill to insure compliance and Woijeck stated he has been working with the neighbors and would continue to do so. Items of concern were; no specific plan showing details, lighting issues, sanitation issues, erosion runoff, gravel dust, easement setbacks and safety along Highway Z turning onto Sprock Drive. All of the Council Members made comments on working with the neighbors and to possibly table the bill to allow for more time to have the various meetings. Some of the Council Members did comment that the athletic fields are good for the economy. County Executive Steve Ehlmann questioned why the applicant did not purchase ground in the flood plain where most athletic fields are located and the applicant replied that the turf fields made from coconut husks do not withstand flood waters and the cost is too high to take the risk. Bill No Sponsored by Council as a Whole An Ordinance enacting Chapter 203, Ordinances of St. Charles County, Missouri ( OSCCMO, relating to communications equipment placement on County Facilities Council Chair Brazil questioned Joann Leykam, Director of Administration about this bill. Leykam stated since the towers have been put up for the Emergency Communications needs, the various commercial vendors are interested in putting their equipment on the County s towers and buildings. Leykam pointed out it was necessary to have these rules in place. Bill No Sponsored by Joe Brazil An Ordinance amending Section A (C and (H, Ordinances of St. Charles County, Missouri, a section of the Food Code of St. Charles County, Missouri ( OSCCMO, relating to late fees and prorated fees for permits and amending Section A of the Aquatic Code relating to late fees for permits Joann Leykam, Director of Administration explained the changes are from a request from a Council Member to allow for 30 days versus 14 days as it relates to late fees and to also mirror the Aquatic Code to the Food Code. Bill No Sponsored by Council as a Whole An Ordinance enacting Section 234, Ordinances of St. Charles County, Missouri ( OSCCMO relating to lodging establishments Council Member Hammond stated he has reviewed the State requirements for inspecting lodging establishments and noted a lot of it pertains to fire codes. Hammond questioned if the Community Health Department will utilize the Building Division s inspectors. Hope Woodson, Director of Community Health

5 Council Journal, , Page 5 stated the inspectors on staff at Community Health have been through training and have just been re-certified for inspections. Hammond stated he would like to review some of the rules with Woodson before the end of the month. Bill No Sponsored by Joe Brazil An Ordinance 1 authorizing the County Executive to execute an amendment to Contract #ERS with the Missouri Department of Health and Senior Services for Women, Infants and Children (WIC Local Agency Nutrition Services Program, 2 authorizing the County Executive to execute an agreement with the Missouri Department of Economic Development Division of Workforce Development for Temporary Assistance for Needy Families, PY 2015 and the Division s related subaward of $200,123.68, and acknowledgement of the Missouri Department of Economic Development Division of Workforce Development s subaward related to a grant for receipt of up to $200, for Temporary Assistance to Needy Families (TANF, and 3 amending the 2015 budget adopted by Ordinance by authorizing a Supplemental Appropriation for the Department of Workforce Development accepting such grant in the amount of $200, Bill No Sponsored by Joe Brazil An Ordinance amending the 2015 budget adopted by Ordinance to add one (1 additional detective, Pay Grade 12, within the St. Charles County Police Department Drug Enforcement Fund and authorizing an amended fund balance in the Drug Enforcement Fund in the amount of $33,700 Bill No Sponsored by Joe Brazil An Ordinance amending Ordinance , which authorized execution of an amended contract for the establishment of a Multi-Jurisdictional Drug Task Force to be known as the St. Charles County Regional Drug Task Force, by authorizing execution of an addendum to that contract in order to add the City of Cottleville as a party Council Chair Brazil questioned Sheriff Scott Lewis if everything is now accurate with regard to this bill. Lewis responded it was accurate. Joann Leykam, Director of Administration clarified when the bill was approved last month, Cottleville was not included in the bill strictly by oversight and it was the City of Cottleville that brought it to the County s attention. TABLED BILLS There were no bills removed from the table, however, Council Member Klinghammer questioned if Ameren UE was difficult to work with because of the current tabled bill dealing with a franchise agreement. After some discussion, it was explained that Ameren UE has had some personnel changes and an agreement would be coming soon. ANNOUNCEMENTS & MISCELLANEOUS Council Chair Brazil stated publicly that the various parties involved in getting Augusta Parkway opened for traffic is getting closer and thanked everyone who has been involved in this process. Council Member Elam congratulated Scott Drachnik on his appointment as the Director of Workforce Development. Elam stated he has worked with Drachnik on the Shop Local issue and commended him on his hard work. There being no further business before the Council, Council Member Klinghammer made a motion to adjourn, seconded by Council Member Elam and unanimously approved. The meeting adjourned at 8:27 p.m.
