"This meeting is a meeting of the Board of Education in public for the purpose of conducting the School District's business and is not to be considered a public community meeting. There is a time for public participation during the regularly scheduled meeting as indicated on the agenda." 1. Call to Order and Roll Call AGENDA The New Richmond Exempted Village School District Board of Education met in regular session at 6:30 p.m. on September 21, 2015, at 212 Market Street, New Richmond, Ohio with the following members present: Kim Hayden, President ; Kevin Walriven, Vice-President ; Kristin Bennett, Member, Tim DuFau, Member ; and, Tony Farmer, Member. Also present were: Adam Bird, Superintendent and Michael Mowery, Interim Treasurer. Pledge of Allegiance 2. Executive Session It is recommended that the Board of Education enter into executive session for the purpose of consideration of the appointment, employment, dismissal, promotion, demotion or compensation of a public employee; in accordance with Ohio Revised Code (1). Approval of Minutes It is recommended that the Board of Education approve the minutes of the August 17, 2015 Regular meeting and the August 22, 2015 Special meeting. B. Approval of Financial Report It is recommended that the Board of Education approve the financial report which includes: receipts, cash position, expenditures and investments for the month ending August 31, 2015, as per attached. C. Acceptance of Donations $25 from Target Corporation to New Richmond Elementary School $50 from Michele Flood to the NRHS Faculty Scholarship fund $50 from Elizabeth Hannah to the NRHS Faculty Scholarship fund $50 from Richard Mahan to the NRHS Faculty Scholarship fund $50 from Will Shoemaker to the NRHS Faculty Scholarship fund D. Disposal of Equipment It is recommended that the Board of Education dispose of items per attachment number 9.D. E. 2015/16 Appropriations It is recommended that the Board of Education approve appropriations for the 2015/16 fiscal year as per attachment number 9.E. F. Depository Contract It is recommended that the Board of Education approve a depository contract with RiverHills Bank as per attachment number 9.F. G. Voluntary Life Insurance Program It is recommended that the Board of Education authorize offering a voluntary life insurance program through McGohan Brabender and Sun Life Financial.
4 H. Class of 2019 It is recommended that the Board of Education approve the establishment of Fund to account for the financial activities of the Class of I. Red Tree Investments Approve an Investment Management Agreement with Red Tree Investment Group as per attachment number 9.I. 10. Approval of Turnaround Additions It is recommended that the Board of Education approve additional turn arounds as presented in attachment number First Reading of 2016/2017 SY Calendar First reading of the 2016/2017 SY calendar as presented in attachment number First Reading of Policy Revision First reading of revision to Policy Equivalent Education Outside the Schools (Homeschooling) as presented in attachment number 12.

Contract Agreement It is recommended that the Board of Education approve a contract agreement between the Board of Education and Clermont County Board of DD for special education services for the 2015/2016 SY, as presented in attachment number Resolution Opposing Issue 3 It is recommended that the Board of Education adopt the following Resolution. WHEREAS, Ohio voters are being asked to consider State Issue 3, a proposed constitutional amendment that would legalize the use of marijuana in the state of Ohio; and WHEREAS, the New Richmond Exempted Village School District Board of Education shares the concerns of Ohio s doctors, hospitals, children s health advocates, civic leaders, parents, farmers, other business people, chambers of commerce, law enforcement personnel, addiction counselors and faith leaders; and WHEREAS, the proposed constitutional amendment allows a private organization to acquire exclusive rights to grow, manufacture and sell marijuana and marijuana-infused edible products to Ohioans for recreational and medical use; and WHEREAS, the proposed constitutional amendment will allow for more than 1,100 retail stores focusing on the sales of recreational marijuana in the form of marijuana cigarettes, liquids, sprays, and edibles to be located near Ohio s schools; and WHEREAS, the allowance for large quantities of recreational marijuana combined with the lack of oversight and control make it very likely that marijuana would fall into the hands of our students; THEREFORE BE IT RESOLVED, that we, the elected members of the New Richmond Exempted Village School District Board of Education, on behalf of the children and community we serve, do hereby express our opposition to State Issue 3, a constitutional amendment legalizing marijuana; and
6 BE IT FURTHER RESOLVED, that the treasurer be directed to record this resolution in the minutes of the board of education and that copies of the resolution be forwarded to members of the local press for distribution to the community. 15. Resolution Calling on New Richmond Exempted Village School District Legislative Representatives to Sponsor and Promote Override Legislation to the Gubernatorial Veto of PUTPP Reimbursements for FY17 It is recommended that the Board of Education adopt the following Resolution. WHEREAS, New Richmond Exempted Village School District once derived more than 8.1 million dollars per year from the PUTTP component of our tax base; and WHEREAS, The State of Ohio, in recognition of the fact that a local tax was, is fact, confiscated, committed to reimburse school districts for the value of that tax; and WHEREAS, As of FY15, The State of Ohio was still reimbursing New Richmond Exempted Village School District a reduced amount of approximately 7.1 million dollars per year; and WHEREAS, The Ohio House of Representatives and Representative Doug Green voted to maintain a PUTPP supplement to total state aid for FY16 and FY17 in HB64, the Biennial Budget; and WHEREAS, The Ohio Senate, and Senator Joe Uecker voted to maintain a PUTPP supplement to total state aid for FY 16 and FY 17 in HB64, the Biennial Budget; and WHEREAS, The Ohio House and the Ohio Senate confirmed their intentions by voting for the Conference Committee Report; and WHEREAS, The Governor of the State of Ohio revoked the intended funding via the Line Item Veto provision of the Ohio Constitution; and WHEREAS, The Ohio Constitution allows for the legislature to override gubernatorial vetoes through the legislative process. NOW, THEREFORE, BE IT RESOLVED, that the New Richmond Exempted Village School District Board of Education calls on our primary legislative representation, Representative Doug Green and Senator Joe Uecker to introduce and sponsor legislation to override the gubernatorial veto and restore the PUTPP reimbursement hold harmless provision for FY17; and
7 BE IT FURTHER RESOLVED, that the New Richmond Exempted Village School District Board of Education will send a copy of this Resolution to the President of the Board of Education and Treasurer of similarly situated school districts materially harmed by the line item veto; and BE IT FURTHER RESOLVED, that our Representatives introduce legislation in their respective chambers that will allow New Richmond Exempted Village School District and similarly situated districts to capture the losses associated with the confiscation of the PUTPP tax in permanent law. 16. Health Stipend Memorandum of Understanding with NREA It is recommended that the Board of Education approve a Memorandum of Understanding with the New Richmond Education Association relative to Section of the negotiated contract as per attachment number Acceptance of Resignations It is recommended that the Board of Education accept the following resignations: A. Resolution to Non-Renew Treasurer s Contract WHEREAS, Ms. Teresa Napier ( Ms. Napier ) was automatically reemployed as Treasurer of schools for the New Richmond Exempted Village School District under a one year contract which expires on July 31, 2016; and
10 WHEREAS, during her time of employment with the School District, Ms. Napier has been evaluated in accordance with procedures established by the New Richmond Exempted Village School District Board of Education ( Board of Education ); and WHEREAS, the Board of Education has considered Ms. Napier s evaluations, among other things, in determining whether to renew the employment contract of Ms. Napier; NOW, THEREFORE, BE IT RESOLVED by the New Richmond Exempted Village School District Board of Education, pursuant to O.R.C , as follows: Section 1. Section 2. Section 3. The Board of Education does not intend to renew Ms. Napier s contract when it expires on July 31, The Board of Education through its President and in accordance with O.R.C shall notify Ms. Napier in writing on or before March 1, 2016 that the Board of Education does not intend to renew her contract when it expires. It is found and determined that all formal action of this Board concerning or related to the adoption of this Resolution was adopted in an open meeting of this Board, and all deliberations of this Board and any of its committees that resulted in such formal actions were adopted in meetings open to the public, in compliance with all applicable requirements of the Ohio Revised Code. 20.
