1 EGG HARBOR TOWNSHIP COMMITTEE MEETING WEDNESDAY, APRIL 26, :30 PM MUNICIPAL BUILDING, BARGAINTOWN ROAD EGG HARBOR TOWNSHIP, NEW JERSEY MINUTES Deputy Mayor Glassey call the Meeting to Order at 5:34 pm. Deputy Township Clerk Tedesco read the Opening Statement pursuant to the Open Public Meetings Act. ROLL CALL: John Carman, Jr.-present Stanley Glassey-present Paul Hodson-present John Risley-present James J. McCullough-absent Deputy Mayor Glassey announced that Mayor McCullough is expected to arrive momentarily. Also in attendance were Township Administrator Miller, Township Engineer Mott, Solicitor Friedman, Deputy Administrator Goodreau and Deputy Township Clerk Tedesco. TAXICAB DRIVERS LICENSE HEARING (5:30 PM) Deputy Mayor called upon Joseph White who indicated he was unsure of the reasons for his denial of a taxicab driver s license since he was issued a license last year. Administrator Miller referred to the April 13, 2006 Notice of Hearing from the Township Clerk s Office which states the basis for denial to issue license was for conviction of Title 39 Chapter 4-50 (DWI), extensive history of motor vehicle accidents, moving violations and prior criminal arrests. 5:36 pm Mayor McCullough arrived. Solicitor Friedman noted the DWI charge is from Detective Chambers stated he followed the mercantile guidelines in reviewing Mr. White s driving abstract. His driving history is nine pages and contains multiple motor vehicle accidents, license suspensions and criminal convictions. Solicitor Friedman stated various suspensions have been restored, the several MVA s listed did not result
2 in convictions, points have been removed since 2001 and the most recent issues are speeding and careless driving within the past six years. Overall, the DMV abstract indicates Mr. White is in good standing. Administrator Miller asked Mr. White how many times he has lost his license. Mr. White replied, once for drunk driving. Administrator Miller asked if Mr. White operated from the Atlantic City International Airport. Mr. White replied, no. Committeeman Risley inquired about information on for any prior criminal record. Detective Chambers indicated he did not have that information available at this time. Mayor McCullough advised the Township Committee will consider this matter further and will advise Mr. White in writing within ten days. The Mayor also asked Detective Chambers to provide additional information to the Township Committee as soon as possible. MEETING WITH TOWNSHIP ENGINEER 2007 DOT Municipal Aid Program Engineer Mott reported the annual application for 2007 DOT Municipal Aid is due next month and recommended Tremont Avenue between the Black Horse Pike and Reega. Mr. Mott said the following year, the Township should consider applying for Tremont Avenue between Eagles Glen towards Mill Road. Township Committee agreed to act upon a resolution at the May 10, 2006 Township Committee meeting. NEW BUSINESS Chapter 217 Water Service and Connection Amendments Administrator Miller explained that Ordinance # is listed for introduction later this evening. The deletion of Article I and II of Chapter 217, Water Service and Connections is a housekeeping matter as these articles are specific to Anchorage Poynte and Price s Pit. Article III was subsequently adopted and covers the entire municipality. Following a brief discussion, Township Committee agreed to act upon this matter later in the meeting. Political Sign Regulations Administrator Miller advised he circulated a memo to Township Committee earlier this week regarding political signs. Ordinances from several New Jersey municipalities known for their high level of politics are included as attachments. The Administrator requested Township Committee to review and provide direction. Solicitor Friedman suggested the governing body also consider commercial signs as well.
3 Committeeman Risley stated his only concern is with the placement of political signs at the entrance to a school property. Mr. Risley felt that both parties have acted responsibly in the past removing their political signs in a timely fashion. Recreation Committee Re-Appointment Administrator Miller stated one of the individuals listed for re-appointment later this evening has chosen not to complete his financial disclosure form. However, he advised the Recreation Commission is meeting tonight and will advised if the member has reconsidered providing required financial information. School Budget Administrator Miller advised that since Question No. 2 on the School Board ballot for the establishment of a lacrosse team and resurfacing of tennis courts failed, the governing body must notify the school board within 10 days of their intentions. The Township Committee has the options of not making any changes, re-inserting funds into budget or anything in-between. Mr. Miller advised it is not necessary for the governing body to meet with the School Board and that a letter outlining their decision will suffice. Motion Risley second Carman to uphold the will of the voters regarding Question #2 from the April 18, 2006 School Election. Vote: All voted-yes. CLOSED SESSION Motion Risley second Glassey that RESOLUTION #171A-2006 Authorizing the Township Committee to convene into a Closed Executive Session to discuss matters involving Litigation; South Jersey Builders League v EHT, Atlantic County Trades Council Agreement and Personnel; Taxi Hearing - Joseph White, Recreation Commission Appointment, Finance Clerical Vacancies, Firefighter Jerry Johnson, be adopted. Roll call vote: Carman-yes Glassey-yes Hodson-yes Risley-yes McCullough-yes VIDEO BROADCAST/TELEVISION STATEMENT Deputy Township Clerk Tedesco read the Video Broadcast/Television Statement and reconfirmed the roll call, all Committee Members present. PLEDGE OF ALLEGIANCE Mayor McCullough led the Pledge of Allegiance. PRESENTATION(S) Mayor McCullough called upon Janice Hetrick, Environmental Commission Chairwoman and presented th a Proclamation proclaiming Friday, April 28, 2006 as the 134 anniversary celebration of Arbor Day in the Township of Egg Harbor.
4 Chairwoman Hetrick explained that the Environmental Commission annually conducts a poster contest among the Third Grade students at the Joy Ann Miller School. Also, this Friday, they will be dedicating a tree in honor of Arbor Day at 11:00 a.m., Veterans Memorial Park. Mayor McCullough, Committeeman Carman and Chairwoman Hetrick called upon the winners of the Environmental Commission Poster Contest. Mayor McCullough called upon Tribhuvan Singh, President and CEO of Hi-Tec Systems, Inc. and presented him with a proclamation recognizing him as the U.S. Small Business Administration s 2006 New th th Jersey Small Business Person of the Year and proclaiming April 9 through April 15, 2006 as Small Business Week in the Township of Egg Harbor. Mr. Singh thanked the Mayor and Township Committee for this recognition. Mr. Singh also commended his family, friends and co-workers for their support and efforts. Mr. Singh stated he looks forward to a long term business relationship with Egg Harbor Township. ORDINANCE PUBLIC HEARING ORDINANCE # An Ordinance to Amend the Code of the Township of Egg Harbor, Chapter 111, Fire Prevention. Purpose: Establishing an application fee of $40 for a certificate of smoke detector compliance. Public Comment: No one came forward. Motion Glassey second Hodson to close the Public Hearing. Roll call vote: Hodson-yes Risley-yes McCullough-yes Carman-yes Glassey-yes Motion to Glassey second Hodson to adopt Ordinance # Roll call vote: Glassey-yes Hodson-yes Risley-yes McCullough-yes Carman-yes ORDINANCE INTRODUCTION Motion Carman second Glassey to introduce ORDINANCE # An Ordinance to amend the Code of the Township of Egg Harbor, Chapter 217 thereof entitled Water Service and Connections, by deleting and Repealing Articles I & II. Ordinance # to be published in The Mainland Journal on May 3, 2006 for further consideration at a Public Hearing to be held on May 31, Roll call vote: Carman-yes Glassey-yes Hodson-yes Risley-yes McCullough-yes Purpose: Deleting and repealing Article I entitled, Anchorage Poynte Connections and Article II entitled, Public Water Supply Extension.
5 GENERAL PUBLIC DISCUSSION Steve Fernandez, Jefferson Avenue publically thanked the Township Committee members for the recent installation of three fields at Childs Kirk Park recently. Mr. Fernandez stated they were very much needed and look great. Robert Beyer, 205 Leap Street, a twenty year resident, complained about the poor road condition of Leap Street. Mr Beyer said the street contains numerous pot holes which are continually patched and uncovered. He said they are a hazard to motorists. He also indicated that he is having a problem with the clean-out in front of his home and has not been able to resolve the matter through the Municipal Utilities Authority (MUA). Engineer Mott advised Leap Street will be paved within the next six weeks and that he will personally contact the MUA about his sanitary sewer issue. Committeeman Glassey stated he would contact the MUA as well. Mr. Beyer said the noise from vehicles striking the pot holes is also a nuisance to himself and neighbors. Committeeman Glassey said that problem will be resolved upon final paving. Nancy McCrosson, Normsdale Trailer Park said her mobile home park is a disgrace. She complained of constant sewer overflow and rats living under trailers. Ms. McCrosson has contacted the Department of Environmental Protection and Atlantic County Department of Health to no avail. Committeeman Glassey advised he spoke to Administrator Miller regarding this matter. The DEP notified the County Department of Health to contact the owner to set up a timetable to resolve. Ms. McCrosson said she will return to a future meeting to keep abreast of this situation. Motion Carman second Risley to close the public portion. Vote: All voted, yes ENGINEER'S REPORT Engineer Mott reported sod will be installed on the soccer fields at Tony Canale Park tomorrow and the fields will be ready for use in the Fall. Mayor McCullough stated the ballfields at Childs Kirk look great. RESOLUTIONS (CONSENT CALENDAR) RESOLUTION # Expressing support for the Bay Waters Alliance of Costal New Jersey.

RESOLUTION # Awarding a contract to Vital Services Group for Real Estate Assessment/Database software services. RESOLUTION # Awarding a contract to Professional Property Appraisers, Inc. for real estate assessment appraisal services. RESOLUTION # To amend Resolution No. 19 passed January 1, 2006, entitled Appointing a Municipal Public Defender for the Year RESOLUTION # Authorizing refund of overpaid taxes. (Countrywide Tax Service, Resorts LID Inc., Abco Federal Credit Union). RESOLUTION # Authorizing refunds from Developers Escrow Accounts. 8 Committeeman Risley announced Community Pride Day will be held, Saturday, May 6, 2006 starting at 8:45 a.m., Castle Park. Committeeman Risley urged all residents to participate and noted that lunch will be provided to all participants. Committeeman Carman advised the Atlantic County Utilities Authority (ACUA) chose Egg Harbor Township as the recipient of the 2005 Outstanding Recycling Award. Committeeman Carman said the efforts of our residents earned this recognition which also provide a tax savings and is good for the environment. Deputy Mayor Glassey advised that he and Mayor McCullough attended the recent ACUA Earth Day activities at their Delilah Road location. The Deputy Mayor urged all citizens to attend future ACUA activities and said it was an educational experience. He also commended everyone for their recycling efforts. Committeeman Hodson recognized the Arbor Day poster contestants and encouraged the public to attend both Arbor Day and Community Pride Day activities. Motion Glassey second Carman to approve 2006 Taxi Drivers license for Joseph White with the condition that if any moving violation summons is imposed of two points or more or any criminal conviction is imposed upon individual, it will result in his license being revoked.
