SHANNON JOHNSON, CITY ATTORNEY SUBJECT: REQUEST FOR ALLOWANCE OF ADDITIONAL CONCERTS AT KEIZER ROTARY AMPHITHEATRE KRA LLC and the City entered into that certain Keizer Rotary Amphitheatre Management Agreement for City Sponsored Concert/Live Theatre/Movie Series on March 17, Section 3(A) of that agreement states that the City would sponsor no less than eight and no more than twelve concert/theatre/movie series each year without Council s approval. In addition, no more than eight of the dates may be on a Saturday. There are a total of twelve events currently scheduled, with ten of the dates being on a Saturday. See attached list. Clint Holland (KRA) is requesting approval from the Council to allow two additional dates be on a Saturday and to add two additional concerts. This matter is before the Council to consider the request and determine if it is appropriate to allow additional Saturday concerts and to add additional concerts. The KRA agreement specifies that the use fees are waived for the City sponsored series, but KRA shall pay the application fee and a refundable security deposit. RECOMMENDATION: The City Council needs to consider the matter and make a minute motion in connection with the request. Council may choose to allow two additional Saturday concerts and to add the requested events to the 2018 City sponsored series at the Keizer Rotary Amphitheatre, to deny the additional Saturday concerts and the two additional concerts, of any combination it deems appropriate. If the Council wishes to stay consistent with previous actions, the motion would be to allow the additional events to be added to the free concert series, require only the application fee and deposit for the events. However, Council may choose to handle the fees in a different manner as it deems appropriate.

PROCLAMATION National Foster Care Month COMMITTEE REPORTS MINUTES KEIZER CITY COUNCIL Monday, May 7, 2018 Keizer Civic Center, Council Chambers Keizer, Oregon Mayor Clark called the meeting to order at 7:00 pm. Roll Call was taken as follows: Present: Staff: Cathy Clark, Mayor Chris Eppley, City Manager Marlene Parsons, Councilor Shannon Johnson, City Attorney Kim Freeman, Councilor Nate Brown, Community Amy Ryan, Councilor Development Director Laura Reid, Councilor Bill Lawyer, Public Works Roland Herrera, Councilor Director Bruce Anderson, Councilor John Teague, Police Chief Absent: Tim Wood, Finance Director Youth Councilor Samuel Hernandez Tracy Davis, City Recorder Mayor Clark led the pledge of allegiance. Jackie Franke, representing Catholic Community Services and Marion County Children and Families Commission Family Preservation Action Team praised foster parents for all they do and provided sobering statistics about the overwhelming need for foster care. She extended an invitation to a Department of Human Services event which would be an opportunity for the community to thank foster parents. Foster parents Jason and Kim White, shared information about themselves and the children in their care. Mayor Clark read the proclamation and presented it to Jackie, Jason and Kim. Matt Lawyer, Keizer, Claggett Creek Watershed Council, announced the Saturday orchard cleanup at Keizer Rapids Park, reported on the Soggy Day in the Park event, and provided information about a story map project that the CCWC is working on in partnership with Salem, Oregon State University, Willamette University, Western Oregon University and Chemeketa. 8 PUBLIC TESTIMONY None PUBLIC HEARINGS Mayor Clark opened the Public Hearing. a. Neighbor Hood Market #7 Liquor License Application ADMINISTRATIVE ACTION a. Request for Revision to Park Management Agreement with Keizer Little League City Manager Chris Eppley reported that an application was submitted for a new Liquor License for Neighbor Hood Market #7, Keizer, Oregon. A public hearing was scheduled, notice published, necessary notification given, a background check was done, and Keizer Planning Department found the location of the establishment to be properly zoned and had no comment on the application. Staff recommends that following a public hearing, Council recommend approval of the application. With no testimony, Mayor Clark closed the Public Hearing. Councilor Parsons moved that the Keizer City Council recommend approval of the application for a liquor license for Neighbor Hood Market #7 under the guidelines as established by ORS and the Ordinances of the City of Keizer and to forward this recommendation to the Oregon Liquor Control Commission for final approval. Councilor Freeman seconded. Motion passed unanimously as follows: AYES: Clark, Reid, Parsons, Ryan, Freeman, Herrera and Anderson (7) NAYS: None (0) ABSTENTIONS: None (0) ABSENT: None (0) City Attorney Shannon Johnson reviewed his staff report and provided details. He pointed out documents that were included in the packet that provided requested information and asked that, following review, Council provide direction: (1) Should the agreement be amended to split concession and tournament revenues 50/50 instead of 100% going to field maintenance; and (2) What should be done with last year s revenues that were not used in compliance with the contract. Ryan Walsh, President of McNary Youth Baseball, expressed support for the proposed 50/50 change but voiced concern that $12,000 was not put back into the fields last year. Clint Holland, Keizer Little League Board member provided information regarding the extensive work that has been done at the fields, grants received and volunteer efforts and fielded questions regarding finances, management and field maintenance. City Manager Chris Eppley explained that net revenues for the concession last year were $24,000 and KLL chose to separate it out and put $12,000 into the complex and $12,000 into the program. However, over the course of the year they have put more of the program (over $12,000) funds back into the fields. He agreed that technically they broke the letter of the contract and he would be concerned if the fields didn t Keizer City Council Regular Session Minutes Monday, May 7, Page 2

9 look good, but the contract is to have the fields taken care of so kids can play baseball. He voiced the desire that someday an independent third party would manage the complex, tournaments, and concessions with no field slot rates so that Keizer teams can play on the fields without having to pay outside of the program. The City would assist with major projects and would develop a series of goals/expectations for the complex and, as long as those goals are met, it would be unnecessary to submit financials for City review. And kids could just play ball. Councilor Parsons moved that the Keizer City Council direct staff to come back with an amendment for the 50/50 split for the concession stand and tournament revenue as requested. Councilor Anderson seconded. Discussion followed regarding the lack of information presented to support this change, the agreement of both organizations, tournament revenues and scheduling, and long-term sustainability of the complex. Motion passed unanimously as follows: AYES: Clark, Reid, Parsons, Ryan, Freeman, Herrera and Anderson (7) NAYS: None (0) ABSTENTIONS: None (0) ABSENT: None (0) Council agreed by consensus that when the contract is brought to Council for approval, financial information should be included from Keizer Little League regarding the complex revenue and expenditures. Motion passed as follows: AYES: Clark, Parsons, Freeman, Reid, Ryan, Anderson and Herrera (7) NAYS: None (0) ABSTENTIONS: None (0) ABSENT: None (0) Councilor Anderson announced the upcoming Chamber Board meeting and County Commissioner Breakfast and thanked everyone who covered for him while he attended his daughter s graduation. Councilor Herrera commended the Community Development Department on the Revitalization event on the 26 th, announced Teacher Appreciation Week, the First Annual Latino Graduation Celebration, the Fire District 70 th Anniversary celebration and the Mother s Day Breakfast, and clarified that Cinco de Mayo is not Mexican Independence Day. 10 Councilor Parsons wished Councilor Freeman a happy birthday and reported on the recent Keizer Festival Advisory Board meeting. Councilor Reid shared information about the McNary sports program and participants, praised the recent Word Slam event, Home Grown Theater production, State Choir competition, and Keizer Community Band concert, thanked Tim Wood for his work related to the City Budget, and announced upcoming events and meetings. Councilor Freeman thanked everyone who participated in the Budget Committee meetings, announced upcoming meetings and openings on various city committees. She reminded everyone of the Iris Festival noting that volunteers are still needed for that event. Councilor Ryan commented on the Budget Committee meetings, praised the Mayor s Prayer Breakfast, reported that she had attended the Volcanoes ribbon cutting event, announced upcoming meetings and events, and wished everyone happy Mother s Day. Mayor Clark reported on research being done regarding broad band, and meetings/events she had attended including the Brooklake Interchange I-5 Transportation Study, Career Technical Education Center quarterly meeting, Salem-Keizer Area Transportation Study, Mid-Willamette Homeless Initiative Steering Committee, the Oregon Metropolitan Planning Organization Consortium, the Keizer Heritage Center Volunteer Appreciation event, Word Slam and McNary Jazz Night. She announced the St. Monica s dedication which is part of the Father Taft Home and the Salem Keizer Coalition for Equality luncheon, thanked Councilors for covering various events for her and thanked Councilor Freeman for chairing the Budget Committee this year. OTHER BUSINESS Shannon Johnson referred to an and supporting documents which he had left on the dais for their information and provided an explanation of same. Council had no questions.
