1 CITY OF CITRUS HEIGHTS CITY COUNCIL MINUTES Special/Regular Meeting of Thursday, August 24, 2017 City Hall Council Chambers 6360 Fountain Square Drive, Citrus Heights, CA CALL SPECIAL MEETING TO ORDER The special council meeting was called to order at 5:30 p.m. 1. Roll Call: Council Members present: Bruins, Daniels, Fox, Miller, Slowey Council Members absent: None Staff present: Boyd, Rivera, Van, Ziegler and department directors. PUBLIC COMMENT None CLOSED SESSION 2. CONFERENCE WITH LEGAL COUNSEL Anticipated Litigation Significant Exposure to Litigation Pursuant to Government Code Section (d) (2) 1 Case. Council Member Fox did not participate in closed session. There was no reportable action from the closed session. STUDY SESSION 3. Review and Discussion of a Proposed History and Arts Project Delivery Model Development Specialist Cooley presented an analysis of the operations of the History and Arts Commission and different ways to deliver this type of service to the residents of Citrus Heights. She gave a summary on how the Commission was formed and how it is adminstered. Staff recommended an alternative project delivery model in place of the Commission such as a competitive grant program. PUBLIC COMMENT Porsche Middleton stated she was very excited to get the community more involved and engaged in history and arts projects. Teena Stern suggested an advisory body to help make recommendations related to the competitive grant.
2 Evie Turner, History and Arts Commission Vice Chair stated that she supports the project delivery model. Larry Fritz, History and Arts Commissioner stated that it has been an honor to serve on the Commission and supported the project delivery model. Council questions and comments followed. By consensus the Council directed staff to bring back a proposed project delivery model for a competitive grant program in place of the History and Arts Commission. ADJOURNMENT Mayor Slowey adjourned the special meeting at 6:27 p.m. CALL REGULAR MEETING TO ORDER The regular council meeting was called to order at 7:00 p.m. by Mayor Slowey. 1. Flag Salute was led by Council Member Fox. 2. Roll Call: Council Members present: Bruins, Daniels, Fox, Miller, Slowey Council Members absent: None Staff present: Anderson, Boyd, Cooley, Neilson, Piva, Rodriguez, Rivera, Van, Ziegler and department directors. 3. The video statement was read by City Clerk Van. APPROVAL OF AGENDA ACTION: On a motion by Council Member Bruins, seconded by Council Member Fox, the City Council approved the agenda. PRESENTATIONS 4. City of Citrus Heights 20 Year Celebration Top 20 Presentation Development Specialist Rodriguez presented the list of Top 20 Facts about Citrus Heights. She highlighted some facts such as in 1910 a real estate developer changed the name from Sylvan to Citrus Heights ; the 14 Mile House was constructed in 1949, during the Gold Rush before Statehood in She mentioned that Sylvan Corners used to be a vineyard, crime has gone Page 2 of 10
3 down 30% since inception of the Citrus Heights Police Department in 2006, and that Sunrise Mall was once the largest mall in the region. COMMENTS BY COUNCIL MEMBERS AND REGIONAL BOARD UPDATES Council Member Bruins encouraged citizens to attend the Community Marching Band semiannual garage sale. She mentioned the League of California Cities Conference and this year s conference packet, which includes a resolution that implements strategies to reduce negative impacts of recent changes to criminal laws. She stated unless there is an objection by the rest of the council, consistent with our past practice, the Mayor or appropriate staff person will send a letter stating the Citrus Heights City Council s support of the League s resolution. Council Member Fox mentioned he and other City staff attended the remodel and grand opening of Buffalo Wild Wings. Council Member Daniels gave an update from the Sacramento Metropolitan Air Quality Management Board. Vice Mayor Miller provided a summary from the Regional Transit Board meeting, and he attended the Sacramento Regional Mayor s Quarterly lunch. He promoted the 8 th Annual Veteran s Picnic at Rusch Park and warned citizens of heavy traffic and lane closures due to raising the walls for the medical office building. Mayor Slowey reiterated the Veteran s Picnic and the lane closure on Greenback. He asked the City Manager and Chief of Police to keep the Council informed on SB 10 Bail: pretrial release. PUBLIC COMMENT Tara Alcione urged Council to take action on the transient problem within the City. CONSENT CALENDAR 5. SUBJECT: Approval of Minutes RECOMMENDATION: Approve the Minutes of the Special/Regular Meeting of August 10, SUBJECT: Second Reading - Zoning Code Amendment Wireless Telecommunication Facilities STAFF REPORT: C. McDuffee / A. Bermudez RECOMMENDATION: Adopt Ordinance No ; An Ordinance of the City of Citrus Heights to Amend Certain Sections of the Zoning Code in Regard to Wireless Telecommunications Facilities 7. SUBJECT: Annual AB 1600 Development Fee Report STAFF REPORT: S. Daniell Page 3 of 10

Rivera RECOMMENDATION: Adopt Resolution No ; A Resolution of the City Council of the City of Citrus Heights, California, Recognizing the Citrus Heights Non - Sworn Police Employees Association (NSPEA) Name Change to Citrus Heights Police Employees Association (CHPEA) ACTION: On a motion by Council Member Daniels, seconded by Vice Mayor Miller, the City Council adopted Consent Calendar Items 5, 6, 7 and 8. PUBLIC HEARING 9. SUBJECT: 2017 Community Development Block Grant (CDBG) Action Plan Amendment STAFF REPORT: R. Sherman / K. Cooley / N. Piva RECOMMENDATION: Adopt Resolution No ; Resolution of the City Council of the City of Citrus Heights, California Adopting the Amended 2017 Action Plan and Authorizing the City Manager to Execute Contracts to Implement the Amended 2017 Action Plan Grants and Housing Program Technician Piva informed the Council that the U.S. Department of Housing and Urban Development (HUD) requires the City to hold a public hearing when there is a change to the Action Plan. Staff recommended the reallocation of $5,221 of the declined public service funds to the Sacramento Self Help Housing renter s hotline, and set aside $10,000 of Planning and Admin funding to prepare a federally required fair housing document. City Council questions and comments followed. Mayor Slowey opened the public hearing at 7:30 p.m., hearing no speakers he closed the public hearing. ACTION: On a motion by Council Member Bruins, seconded by Mayor Slowey, the City Council adopted Resolution No ; Resolution of the City Council of the City of Citrus Heights, California Adopting the Amended 2017 Action Plan and Authorizing the City Manager to Execute Contracts to Implement the Amended 2017 Action Plan. SUBJECT: Ordinance Amending Chapter 18 of the City of Citrus Heights Municipal Code by Setting Forth an Expedited, Streamlined Permitting Process for Electric Vehicle Charging Stations STAFF REPORT: G. Anderson / R. Sherman RECOMMENDATION: Introduce for a First Reading Ordinance No ; and Waive the Reading of the Entire Ordinance An Ordinance of the City of Citrus Heights Amending Chapter 18 of the Citrus Heights Municipal Code Buildings and Building Regulations By Adding Article XVII Electric Vehicle Charging Station Permits to Provide for an Expedited, Streamlined Permitting Process for Electric Vehicle Charging Stations Chief Building Official Anderson said the ordinance sets forth an expedited, streamlined permitting process for electric vehicle charging stations. He stated that this process includes the establishment of a checklist containing objective requirements for the installation of an electric vehicle charging station and a process for electronic submittal of permit applications. He explained that Assembly Bill 1236 amends Government Code Section , and requires jurisdictions with a population less than 200,000 residents to establish a procedure for this process. City Council questions and comments followed. ACTION: On a motion by Vice Mayor Miller, seconded by Council Member Daniels, the City Council introduced for a first reading Ordinance No ; and waived the reading of the entire Ordinance an Ordinance of the City of Citrus Heights amending chapter 18 of the Citrus Heights Municipal Code Buildings and Building Regulations by adding Article XVII Electric Vehicle Charging Station Permits to provide for an expedited, streamlined permitting process for electric vehicle charging stations. 11. SUBJECT: Update Broadband Ranges STAFF REPORT: R. Rivera / S. Neilson RECOMMENDATION: Adopt Resolution No ; Resolution of the City Council of the City of Citrus Heights Approving Adjustments to the Broadband Ranges Human Resources/City Information Director Rivera gave a summary on the City s five broadband ranges. The broadband structure is brought back to the City Council due to the Page 5 of 10
6 growing classifications and salary changes. Staff recommended adjustments in the broadband structure. City Council questions and comments followed. ACTION: On a motion by Council Member Bruins, seconded by Council Member Fox, the City Council adopted Resolution No ; Resolution of the City Council of the City of Citrus Heights Approving Adjustments to the Broadband Ranges. 12. SUBJECT: City Manager Compensation Adjustment STAFF REPORT: R. Ziegler RECOMMENDATION: Adopt Resolution No ; A Resolution of the City Council of the City of Citrus Heights Approving a Compensation Adjustment for the City Manager City Attorney Ziegler stated the recommendation is to increase the City Manager s salary effective October 1, 2017 and also to increase the City s health care benefit contribution effective January 1, Mayor Slowey stated this item is a recommendation to approve an increase to the City Manager s salary by 2% effective October 1, 2017, and an increase in the City s health care benefit contribution by $100 per month effective January 1, The total annual estimated cost is $5,300. City Council comments followed. ACTION: On a motion by Council Member Bruins, seconded by Council Member Fox, the City Council adopted Resolution No ; A Resolution of the City Council of the City of Citrus Heights Approving a Compensation Adjustment for the City Manager. AYES: Bruins, Fox, Miller, Slowey NOES: Daniels 13. SUBJECT: Adjustment to Executive Management Group Compensation for the City of Citrus Heights STAFF REPORT: C. Boyd RECOMMENDATION: Adopt Resolution No ; A Resolution of the City of Citrus Heights Adopting FY 17/18 Adjustment to Executive Management Group Compensation City Manager Boyd stated the recommendation is to adjust the compensation for the Executive team. 7 Mayor Slowey stated this item is a recommendation to approve an increase to Department Directors salary by 2% effective October 1, 2017, and an increase in the City s health care benefit contribution by $100 per month effective January 1, The changes affect compensation for the following five positions: Community/Economic Development Director, Finance Director, General Services Director, Human Resources/City Information Director, and Police Chief. The total annual estimated cost is $17,000. ACTION: On a motion by Council Member Fox, seconded by Council Member Bruins, the City Council adopted Resolution No ; A Resolution of the City of Citrus Heights Adopting FY 17/18 Adjustment to Executive Management Group Compensation. 14. SUBJECT: Resolution Adopting the Amended Payrate Schedule for the City of Citrus Heights STAFF REPORT: R. Rivera / S. Neilson RECOMMENDATION: Adopt Resolution No ; A Resolution of the City Council of the City of Citrus Heights Adopting the Amended Payrate Schedule Human Resources/City Information Director Rivera stated that California Code of Regulations and CalPERS law requires the governing body to approve the salary schedule. City Council questions and comments followed. ACTION: On a motion by Council Member Bruins, seconded by Vice Mayor Miller, the City Council adopted Resolution No ; A Resolution of the City Council of the City of Citrus Heights Adopting the Amended Payrate Schedule 15. SUBJECT: Alleged Inconsistency Relating to the City Council s Appointment of Albert Fox to Fill a Council Vacancy STAFF REPORT: A. Van RECOMMENDATION: Staff Recommends that the Council Adopt a Motion: (a) Indicating that the City Council will not use Similar Methods to Gauge Council Preferences in Future Matters; (b) Ratifying the Appointment of Albert Fox as a Member of the City Council; and (b) Directing Staff to Respond to the Demand in Writing. 8 City Clerk Van recommended that each Council Member identify his or her initial candidate preferences for the Council vacancy, which were provided to the City Clerk on May 26, She stated that staff recommends to adopt a motion that City Council will not use similar methods to gauge Council preferences in future matters; ratify the appointment of Albert Fox as a City Council Member; and direct staff to respond to the demand in writing. Mayor Slowey stated on May 26, 2017, the City Council unanimously appointed Albert Fox to fill a vacancy on the City Council. The meeting was noticed and open to the public. The City Council interviewed nine candidates. Then to identify the Council s initial preferences to fill the vacancy, each Council Member wrote two candidates names on a slip of paper and the City Clerk tallied the names to gage initial preferences. In an open and public forum, after that, the City Council unanimously voted to appoint Albert Fox to fill the vacancy. The City received a cure and correct demand under the Brown Act because there was some question whether or not the Council had conducted a secret ballot. The Council will consider how to respond to the demand this evening. He asked if there were any public comments on this item. Mayor Slowey stated one of the options for Council consideration would be to rescind the appointment of Albert Fox and reappoint him; however it won t work because it would mean that the City Council would be removing a Council Member which it doesn t have the authority to do. He asked the City Attorney to please clarify. City Attorney Ziegler stated California law has a specific procedure that involves filing a very specialized type of lawsuit with the Attorney General first to get permission. It is a type of lawsuit called quo warranto and it is the method recognized under California law to remove a sitting official, council member, school board member, etc. from office. That is not the item before the Council and that is not the discretion you have as Council Members. Mayor Slowey asked each Council Member to identify their initial candidate preferences from the May 26, 2017 meeting as follows: Mayor Slowey: Albert Fox, Porsche Middleton Vice Mayor Miller: Albert Fox, Porsche Middleton Council Member Daniels: Jim Monteton, Marcel Weiland Council Member Bruins: Albert Fox, Marcel Weiland ACTION: On a motion by Council Member Bruins, seconded by Vice Mayor Miller, the City Council accepted staff s recommendation that they will not use similar methods to gauge Council preferences in future matters; ratified the Appointment of Albert Fox to City Council; and directed staff to respond to the demand in writing. Boyd RECOMMENDATION: Introduce for a First Reading, Read by Title Only, and Waive the First Full Reading of Ordinance , An Ordinance of the City of Citrus Heights Amending the Citrus Heights Municipal Code Regarding the City Manager s Authority to Designate Individuals to Perform Specific Functions Human Resources/City Information Director Rivera reported staff recommends cleaning up the language within the Citrus Heights Municipal Code and update the definition that certain specific positions are delegated authority by the City Manager to perform specific functions. City Council comments followed. DEPARTMENT REPORTS 17. SUBJECT: Sacramento Area Construction Marketplace Update DEPARTMENT: General Services Department Acting General Services Director Fallbeck gave an update on the Sacramento construction marketplace. He stated that contractors are very busy and construction bids for projects are running 20-30% higher. The General Services Department will have several capital improvement projects that will be ready to bid soon. He stated that the strategy will be to bid the projects in December and January and start the projects in the spring. City Council questions and comments followed. CITY MANAGER ITEMS City Manager Boyd reminded the public of the different smart phone applications that are available to connect with the City, such as the Police Department application.
