1 Board of Commissioners Regular Meeting Minutes October 17, 2018 PUBLIC HEARINGS A. TRAFFIC IMPACT ORDINANCE B. POLITICAL SIGNS ORDINANCE The meeting was called to order by Commissioner Pitetti at the South Fayette Township Building, 515 Millers Run Road, South Fayette, PA PRESENT: SRAY, PITETTI, HOROWITZ, RODI, MALOSH ALSO PRESENT: Township Solicitor: Robert Garvin; Interim Township Manager: Butch Truitt PLEDGE OF ALLEGIANCE PUBLIC COMMENT CORRESPONDENCE CONSENT CALENDAR ITEMS A. PAYMENT OF THE BILLS It was moved by HOROWITZ and seconded by RODI to pay the September 2018 bills. All members present voted AYE to the motion. B. MONTHLY FINANCIALS It was moved by HOROWITZ and seconded by RODI to accept the monthly financials. All members present voted AYE to the motion. C. MONTHLY POLICE REPORT It was moved by HOROWITZ and seconded by RODI to accept the monthly police report. All members present voted AYE to the motion. D. QUARTERLY COMMUNICATIONS REPORT It was moved by HOROWITZ and seconded by RODI to accept the quarterly communications report. All members present voted AYE to the motion.
2 OLD/UNFINISHED BUSINESS NONE NEW BUSINESS A. DISCUSS AND CONSIDER APPROVING THE TRAFFIC IMPACT ORDINANCE It was moved by MALOSH and seconded by RODI to approve the traffic impact ordinance. All members present voted AYE to the motion. B. DISCUSS AND CONSIDER APPROVING THE TEMPORARY POLITICAL SIGNS ORDINANCE It was moved by HOROWITZ and seconded by SRAY to approve the temporary political signs ordinance. All members present voted AYE to the motion. C. DISCUSS AND CONSIDER APPOINTING LORI PALMIERI TO THE LIBRARY BOARD It was moved by HOROWITZ and seconded by SRAY to appoint Lori Palmieri to the Library Board. All members present voted AYE to the motion. D. DISCUSS AND CONSIDER REAPPROVAL OF F-05-18, INDIAN ACRES PLAN OF LOTS, REVISION NO. 1, TO ALLOW ADDITIONAL TIME TO ACQUIRE ALL THE NECESSARY SIGNATURES REQUIRED FOR RECORDING. THIS APPLICATION ORIGINALLY WAS APPROVED JULY 18. Don Housley, Township Engineer, Mitall Division of KU Resources We would like to have this plan reapproved. There is a lot of residents participating in this and it has taken a lot of time. This should be approved on the condition upon the signatures, so if it takes longer than 90 days, we don t have to come back to you. It was moved by HOROWITZ and seconded by SRAY to reapprove F-05-18, Indian Acres plan of lots, revision No. 1, to allow additional time to acquire all the necessary signatures required to recording, contingent on getting all the signatures. All members present voted AYE to the motion. E. DISCUSS AND CONSIDER APPROVING JSF MANAGEMENT LLC PRELIMINARY AND FINAL LAND DEVELOPMENT PLAN FOR SELF-STORAGE BUILDING, 111 HICKORY GRAD ROAD Bill Sittig, attorney for Johnson Development gave a presentation for the self-storage building at the site of the ole Knights Inn. Bailey Gaffney of Johnson Development described the building and development. 2
3 Mr. Housley They have utilized the old entrance that the Knights Inn used. The Planning Commission s recommendation makes it subject to my latest review letter. It was moved by SRAY and seconded by MALOSH to approve JSF Management LLC preliminary and final land development plan for self-storage building, 111 Hickory Grade Road, subject to the conditions in the latest review letter. All members present voted AYE to the motion. F. DISCUSS AND CONSIDER SHEETZ, BURSCA DRIVE SITE, PRELIMINARY AND FINAL LAND DEVELOPMENT PLAN Mr. Sittig, attorney for Sheetz Inc. We have been before the Planning Commission and the Zoning Hearing Board. Sheetz Inc. received variances from the ZHB. The Planning Commission recommended against this, but they acknowledged the use is permitted at this site. He discussed the HOP and the traffic study. David Mastrostefano, a representative of Sheetz, and H.C. (indistinguishable) of the Sheetz real estate department gave a brief overview and general layout of the proposed Sheetz. Commissioner Malosh asked about the traffic study. Jared Crosby of Wooster and Associates, the traffic consultant, spoke about the traffic impact study that was approved by the township and PennDOT. Gary Fromholzer, a resident, asked the representative from Sheetz about the customer count and was told that they can t tell customer count because they don t know how many people are in each car and that most of these customers are already on the road. It was moved by RODI and seconded by MALOSH to approve the Sheetz, Bursca Drive Site, preliminary and final land development plan, subject to the review letter. All members present voted AYE to the motion. G. DISCUSS AND CONSIDER AUTHORIZING A BOND REDUCTION FOR SOUTH FAYETTE COMMONS REDUCING THE BOND AMOUNT FROM $1,166, TO $581, Mr. Housley John Kanaskie and myself visited the site and did a very detailed reduction to quantify the request, and we do find it in order. It was moved by HOROWITZ and seconded by RODI to authorize a bond reduction for South Fayette Commons reducing the bond amount from $1,166, to $581, All members present voted AYE to the motion. 3
4 H. DISCUSS AND CONSIDER A REQUEST TO RELEASE THE MAINTENANCE BOND FOR 84 LUMBER CO. FOR THE FIELDCREST DEVELOPMENT Mr. Housley We find that bond in order. It was moved by HOROWITZ and seconded by RODI to release the maintenance bond for 84 Lumber Co. for the Fieldcrest development. All members present vote AYE to the motion. I. DISCUSS AND CONSIDER ADVERTISING PET AND KENNEL ORDINANCE Eric Newhouse, Newbury Project Manager Pet Palace, a pet resort that has locations through the Midwest and the mid-atlantic, has committed to Newbury. This is just to start the approval process, and further into the process the owner of Pet Palace will come and make a presentation on their business. This would be their first facility in Pennsylvania. The PED ordinance doesn t list this particular use. We are proposing to make those uses permitted only in PED planned commercial districts. It was moved by HOROWITZ and seconded by RODI to advertise the pet and kennel ordinance. All members present voted AYE to the motion. J. DISCUSS AND CONSIDER ADVERTISING A NEW STORMWATER MANAGEMENT ORDINANCE IN ACCORDANCE WITH THE REQUIREMENTS OF ALLEGHENY COUNTY S ACT 167 PLAN AND THE TOWNSHIP S NPDES PERMIT FOR A MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) Mr. Garvin This is just for advertising purposes. All townships and municipalities in the county are required to adopt new stormwater management plans that are compliant with the county s Act 167 plan and the NPDES permit. It was moved by HOROWITZ and seconded by MALOSH to advertise a new stormwater management ordinance in accordance with the requirements of Allegheny County s Act 167 Plan and the township s NPDES permit for a municipal separate storm sewer system. (MS4). All members present voted AYE to the motion. K. DISCUSS AND CONSIDER AUTHORIZING SENDING A LETTER TO STATE REP. ORTITAY AND STATE SEN. RESCHENTHALER OPPOSING HB2564, WHICH LIMITS LOCAL GOVERNMENT S ABILITY TO REGULATE WIRELESS POLES AND FACILITIES IN PUBLIC RIGHT OF WAYS. Mr. Garvin There is a proposed House bill that would restrict municipalities ability to regulate any wireless facilities within right-of-ways. Now if a company wants to come in and use the right-of-way for wireless facilities, we can charge them a franchise fee. The 4
5 proposed bill eliminates that and allows them to use the right-of-way for a nominal fee. Today was the end of the session, so this is meaningless. Commissioner Rodi Representative Ortitay opposes this bill. No action was taken at this time. L. DISCUSS AND CONSIDER APPROVAL TO ENTER INTO A TWO-YEAR CONTRACT WITH COMCAST FOR WIFI CAPABILITY AND INSTALLATION OF A WIFI SURVEILLANCE SYSTEM AT FAIRVIEW PARK AT A COST OF $ A MONTH, A ONE-TIME $ INSTALLATION COST, AND AN $8, CONSTRUCTION COST, OF WHICH COMCAST WILL OFFSET $8, AS PART OF THE TWO-YEAR AGREEMENT Mr. Truitt I think in the next two years we would have to pay $2, and we were asking the sports teams to pitch in. It was moved by HOROWITZ and seconded by RODI to approve entering into a two-year contract with Comcast for wifi capability and installation of a wifi surveillance system at Fairview Park at a cost of $ a month, a one-time $ installation cost, and an $8, construction cost, of which Comcast will offset $8, as part of the two-year agreement. All members present voted AYE to the motion. M. DISCUSS AND CONSIDER APPROVING REQUEST FOR $1, FROM THE SOUTH FAYETTE COMMUNITY FUND FOR A BENCH DONATION It was moved by RODI and seconded by MALOSH to approve a request for $1, from the South Fayette Community Fund for a bench donation. All members present voted AYE to the motion. N. DISCUSS AND CONSIDER RATIFYING THE PHONE VOTE OF SEPT. 24, 2018, APPROVING THE WASTE MANAGEMENT REFUSE PROPOSAL FOR COLLECTION OF MUNICIPAL WASTE IN THE TOWNSHIP. THE TERM OF THE CONTRACT IS FOR THE YEARS , AND COLLECTION SHALL BE IN ACCORDANCE WITH THE SHACOG BID SPECIFICATIONS It was moved by SRAY and seconded by MALOSH to ratify the phone vote of Sept 24, 2018, approving the Waste Management refuse proposal for collection of municipal waste in the township. The term of the contract is for the years , and collection shall be in accordance with the SHACOG bid specifications. All members present voted AYE to the motion. O. DISCUSS AND CONSIDER APPROVING THE 2019 BUDGET SCHEDULE 5
6 Commissioner Horowitz Should we maybe schedule a workshop meeting for the budget on December 5 th, 2018? Commissioner Malosh I agree. It was moved by HOROWITZ and seconded by MALOSH to add a workshop meeting on Dec. 5 th at 7:00 PM and approve the budget schedule with that change. All members present voted AYE to the motion. PUBLIC COMMENT (Undistinguishable) of 246 Union Avenue, Oakdale I am concerned about the trees on the Boys Home property directly across the street from my house. In the last three years there have been three that came down. One, in particular, would take my house down if it fell. I just wondered if the township could get a tree service in to cut some of them back. Mr. Truitt We can check it out. Gary Fromholzer, 13 Freedom Drive In light of the Sheetz going in, I would like to know if there were changes to the Frontgate Development and the building proposed and approved for that property? Have there been approvals for restaurants to move over to that site plan? Commissioner Horowitz and Commissioner Pitetti both expressed that they had not approved any restaurants for this site. There was further discussion about this comment. Mr. Housley I know the Planning Commission approved the retail facility, Bursca Frontgate, but I am not aware of any use proposed use within there at all. BOARD DISCUSSION - None MANAGER S REPORT Mr. Truitt Our 2018 resurfacing was not completed because of the rain we ve had, and we will be finishing in the spring at the same price we were quoted this year. Secondly, tomorrow we have our annual disabled hunt taking place. We have nine hunters this year. Mr. Housley - I have a couple things I asked the manager if I could interject at this point. Coming up this month we are going to have several road dedications. Pinnacle Point and Cuddy Lane, we have applications in hand. Granite Ridge s application is expected soon. 6
7 Under bond reductions, you approved South Fayette Commons; however, Newbury, Hastings, and Chartiers Bend Retirement all have requests in. I am also expecting more. Charter Homes has also asked us to sign a FEMA LOMAR, which is a Federal Emergency Management Agency, letter of map division. As you come down Mayview Road, just before the sharp bend, there is a down driveway, where their construction trailer sits. According to Gateway Engineers, that map is incorrect. They have hydrology and hydraulics on the creek and they have proven this to FEMA. We have a conference call with the township, FEMA and Gateway Engineers. I am just giving you all a heads up and John Kanaskie, our flood plain administrator, will be signing that document. I am going to ask you to add a simple item to your agenda. The Sweitzer Subdivision and Consolidation Plan, F On November 15, 2017, you approved this plan. It is a small subdivision right at the county line, part in Washington County and part in Allegheny County. It took one entire year to get the bank to approve the subdivision. He is asking for you to reapprove the plan. It was moved by HOROWITZ and seconded by MALOSH to reapprove the Sweitzer Subdivision/Consolidation Plan F All members present voted AYE to the motion. SOLICITOR S REPORT Mr. Garvin I have a personnel matter from Police Chief John Phoennik. ADJOURNMENT & EXECUTIVE SESSION It was moved by RODI and seconded by MALOSH to adjourn to Executive Session, not to return. All members present voted AYE to the motion.
