1 WASECA COUNTY BOARD OF COMMISSIONERS NOVEMBER 6, 2018 The Waseca County Board of Commissioners met in regular session on Tuesday, November 6, 2018, in the boardroom, 300 North State Street, Waseca, Minnesota. Members present were Chair Blair Nelson, Doug Christopherson, Brian Harguth, Richard Androli and Daniel Kuhns. Others present were Jessica Beyer, County Administrator; Tammy Spooner, Auditor-Treasurer; Brenda Miller, County Attorney; Brad Milbrath, Sheriff; Nathan Richman, County Engineer; Nicole Grams, Drug Court Coordinator; Jane Hardwick, MnPrairie; Kevin Venenga, MnPrairie; Kathy Skogen, Mn Prairie; Liz Bushaw, Planning & Zoning Specialist; Mark Leiferman, Planning & Zoning Administrator; Mike McQuery, Half Pint Brewery; Audra Veroeven; Laurel Remund; Judge Leuning; Shannon Asselin, Court Administrator; Christopher Hinton, Veteran s Services Director; Denise Wright, Emergency Management Director; Heather Jellum; Brian Borglum; Brian Tomford, Buildings & Grounds Maintenance Director; Dana Melius, news reporter; Megan Kirby, Health Coordinator; Sarah Berry, Public Health Director; and Leota Lind, South Country Health Alliance. Chair Nelson called the meeting to order at 9:30 a.m. Roll call was taken and the Pledge of Allegiance was recited. Harguth moved and Christopherson seconded to approve the amended agenda as presented. The agenda was amended to removel item g. Public Safety Lease from the Consent Agenda; move the Off-Sale portion of item h. for Half Pint Brewing Company to an action item, and to update the Human Resources Agenda. Motion carried unanimously. Kuhns moved and Androli seconded to approve the Minutes from September 18, 2018 Commissioner Meeting; October 2, 2018 Commissioner Meeting; and October 16, 2018 Commissioner Meeting. Motion carried unanimously. Kuhns moved and Christopherson seconded to Consent Agenda as amended. Motion carried unanimously. a. Approval of Bills b. South Central Drug Investigation Unit Federal Equitable Sharing MOU f. Medical Examiner Annual Contract g. Public Safety Lease h. Approve On-Sale and Off-Sale Liquor License for Half Pint Brewing Co. County Attorney, Brenda Miller, outlined the process for the Public Hearing for an Off-Sale Liquor License for Half Pint Brewery. The meeting was opened for Public Comment at 9:37 a.m. Mike McQuery, Half Pint Brewing, commented that he is ready to 543

2 open his business and now needs his liquor licenses. There were no additional Public Comments. The comment period of the public meeting was closed at 9:39 a.m. Kuhns moved and Androli seconded to approve the Off-Sale Liquor License and the Sunday Off-Sale Liquor License. Motion carried unanimously. Judge Leuning, District Court Judge, gave a presentation on Veterans Courts, outlining assistance available for Veterans. Leota Lind, South Country Health Alliance, gave a presentation on Opioid Case Management. Members have been very receptive to changes and this has provided an opportunity to intervene and educate about the risks of opioid addiction or misuse. Holly Glaubitz, Minnesota Department of Health, presented a Breastfeeding Friendly Health Department Award at a gold level designation to Waseca County. Megan Kirby, Health Coordinator, accepted the award on behalf of the County. Brian Tomford, Buildings & Grounds Maintenance Director, gave an update regarding the courthouse restoration project. On October 26 th, Brian met with the state historical preservation for an onsite inspection, which went very well. The estimated completion of the project is anticipated to be the end of November. Brian Tomford, Buildings & Grounds Maintenance Director, updated the Board on the Veterans Memorial. The project has begun with excavation on the east side of the courthouse. There have been weather related setbacks with the concrete work which was put on hold until spring The Memorial Committee is hoping for a ceremonial opening by Memorial Day Denise Wright, Emergency Management Director, presented an All Hazard Plan, requesting to accept the plan by adoption of Resolution # Androli moved and Harguth seconded to adopt the following resolution. Motion carried unanimously. RESOLUTION NUMBER ADOPTING THE WASECA COUNTY ALL-HAZARD MITIGATION PLAN WHEREAS, Waseca County has participated in the hazard mitigation planning process as established under the Disaster Mitigation Act of 2000, and WHEREAS, the Act establishes a framework for the development of a multijurisdictional County Hazard Mitigation Plan; and WHEREAS, the Act as part of the planning process requires public involvement and local coordination among neighboring local units of government and businesses; and WHEREAS, the Waseca County Plan includes a risk assessment including past hazards, hazards that threaten the County, an estimate of structures at risk, a general description of land uses and development trends; and 544

3 WHEREAS, the Waseca County Plan includes a mitigation strategy including goals and objectives and an action plan identifying specific mitigation projects and costs; and WHEREAS, the Waseca County Plan includes a maintenance or implementation process including plan updates, integration of the plan into other planning documents and how Waseca County will maintain public participation and coordination; and WHEREAS, the Plan has been shared with the Minnesota Division of Homeland Security and Emergency Management and the Federal Emergency Management Agency for review and comment; and WHEREAS, the Waseca County All-Hazard Mitigation Plan will make the county and participating jurisdictions eligible to receive FEMA hazard mitigation assistance grants; and WHEREAS, this is a multi-jurisdictional Plan and cities that participated in the planning process may choose to also adopt the County Plan. NOW THEREFORE BE IT RESOLVED that Waseca County supports the hazard mitigation planning effort and wishes to adopt the Waseca County All-Hazard Mitigation Plan. Jane Hardwick, Executive Director of MnPrairie County Alliance, gave a quarterly update on services and budget. Mark Leiferman, Waseca County Planning and Zoning Administrator, provided the details of the Natural Resources Block Grant (NRBG) Application and Resolution for funds to administer the Local Water Management, Wetlands Conservation Act, DNR Shoreland, MPCA SSTS and MPCA Feedlot Plans and Programs to the County Board in a board memorandum. After some discussion, motion was made by Commissioner Androli, seconded by Commissioner Kuhns for authorization to enter into a grant agreement with the State of Minnesota to receive NRBG Funds in the amount of $64,575.00, with $14, in matching funds, to authorize the Waseca Board Chair to sign said application materials and related reports and to adopt the following resolution authorizing application, match and signatures. Motion carried 4-0. (Nelson stepped out of the meeting briefly.) RESOLUTION NO RESOLUTION AUTHORIZING NRBG APPLICATION AND GRANT WHEREAS, Waseca County may assess a levy under its general levy authority to match such grants by the Board of Water and Soil Resources pursuant to Minnesota Statutes. NOW, THEREFORE, BE IT RESOLVED, that the Waseca County Board of Commissioners authorizes the County of Waseca to enter into a Grant Agreement with the State of Minnesota to receive state funds for the implementation of its comprehensive local water plan, the administration of the 545

4 wetland conservation act, administration of the Department of Natural Resources Shoreland Program, the Minnesota Pollution Control Agency Subsurface Sewage Treatment System (SSTS) program and the Minnesota Pollution Control Agency Feedlot Permit Program, under the terms of the Grant Agreement and applicable statutory requirements. BE IT FURTHER RESOLVED, the Waseca County Board of Commissioners authorizes the expenditure of a cash match in the sum of $15,611 from the County funds to match the Natural Resource Block Grant of $64,575 as specified in the Grant Agreement. BE IT FURTHER RESOLVED, that the Chair of the Waseca County Board of Commissioners and the County Auditor are authorized to execute the Grant Agreement together with all related documents. Mark Leiferman, Planning & Zoning Administrator, presented a request from Pinnacle Foods for an Amendment to a Conditional Use Permit dated October 21, Pinnacle Foods would like to add spray fields to the plan on the following parcels: and , located in Sections 11 and 12 of St. Mary Township. Criteria was previously reviewed by the Board and they chose to dispense with the formal reading. Conditions were outlined by Mr. Leiferman. Kuhns moved and Harguth seconded to approve the criteria as presented. Motion carried unanimously. Harguth moved and Kuhns seconded to approve the Amendment to the Conditional Use Permit. Motion carried unanimously. (A full copy of the Amendment, with the criteria and conditions, is on file in the Planning & Zoning Office.) Mark Leiferman, Planning & Zoning Administrator, gave an update on the Residential Tax Abatement Program, which is set to sunset December 31, Jessica Beyer, County Administrator, presented the Human Resources Agenda. Androli moved and Harguth seconded to approve the HR Agenda as presented. Motion carried unanimously. a. Internal offer of employment to Joette Breck, Paralegal with a starting salary of $25.79 per hour (grade 7) b. Recruitment initiated for Witness Protection Coordinator (grade 6: $ $26.43). c. Resignation of Molly Conley, Public Health Nurse effective November 5, d. Recruitment initiated for Public Health Nurse (grade 9: $ $29.14) or (grade 8: $ $27.51). Discussion was held regarding a Local Option Transportation Sales Tax Proposed Project List and scheduled meetings to discuss the topic with the local jurisdictions.
