BE IT RESOLVED that the meeting be closed to the public in accordance with Section 90 of the Community Charter as follows: c) labour relations or other employee relations; d) the security of the property of the municipality; e) the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure could reasonably be expected to harm the interests of the municipality; k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the Council, could reasonably be expected to harm the interests of the municipality if they were held in public AGENDA 3. Mr. Ken Barker, Vice Chairman, Canada Day Committee, re: July 2015 Canada Day Celebrations in Polson Park. B. Ms. Renee Clark, Water Quality Manager, Regional District of North Okanagan, re: Protocol Used in Switching Water Sources During Water Quality Events. C. THAT Council support the development variance permit application submitted by Serg Trinca on behalf of Yvonne Roberts to vary Zoning Bylaw #5000 Section to permit an at-grade swimming pool within the front and exterior side yards on Lot 20, Section 31, Township 9, ODYD, Plan KAP78952 (200 Harvest Court), subject to the following conditions: a) That the development plan shown as Attachment 3 in the report dated April 23, 2015 by the Planning Assistant and titled Trinca Development Variance Permit Application for Lot 20, Section 31, Township 9, ODYD, Plan KAP78952 (200 Harvest Court), be attached to and form part of Development Variance Permit #DVP00320 as Schedule 'A'; b) Replacement of one Populus spp. tree within the city boulevard shall occur to reduce the potential damage to public and private property from the root system; such tree shall be replaced with Ginko biloba or Syringa reticulate. Any damage to the boulevard area shall be restored by the applicant and except for the replacement of the specified tree, the boulevard area must not be used for the proposed construction on private property. THAT Council received the memorandum dated May 5, 2015, titled 260 Vineyard Way OCP Amendment Bylaw 5556, 2015 Input from Open House, from the Planning Assistant, and directs Administration to include this information as a submission to the Public Hearing for Bylaw 5556 scheduled for May 11, MATTERS REFERRED: COMMITTEE OF THE WHOLE AND IN-CAMERA 11. NEW BUSINESS A. Correspondence: 2015 UBCM RESOLUTION SUBMISSIONS (P. 172) BOUNDARY EXTENSION OIC#1157,2004 PROPERTIES EXCLUDED FROM FINAL SUPPLEMENTARY LETTERS PATEND (P. 175) (i) THAT Council receives the memorandum dated May 3, 2015, from the Director of Corporate Services, regarding 2015 UBCM Resolution Submissions. (ii) THAT Council receives the memorandum dated May 5, 2015, from the Director Corporate Services, regarding the Boundary Extension OIC#1157, 2004 Properties Excluded from Final Supplementary Letters Patent; AND FURTHER, directs Administration to not proceed with a new Boundary Extension application for the six excluded properties from OIC#1157, and to advise the Ministry of Community, Sport and Cultural Development accordingly.

Reports: RESTORATIVE JUSTICE SOCIETY NORTH OKANAGAN (P. 177) (i) THAT Council endorses a renewal of the funding agreement between the City of Vernon and the Restorative Justice Society North Okanagan, for an additional three years, expiring December 31, 2018, for the provision of services for the benefit of the City of Vernon residents, in the amount of $44, per year commencing 2016 through 2018; AND FURTHER, authorizes Administration to execute the agreement upon acceptance by the Restorative Justice Society North Okanagan HERITAGE RESTORATION GRANT APPLICATIONS SECOND SUBMISSION (P. 181) (ii) THAT Council approve a heritage restoration grant of $5, as applied for by Rebecca Barton to assist with the replacement of five windows and the repainting of the exterior of the heritage building located on Lots 15, 16 and 17, Blk 20, Plan 327, Sec 34, Tp 9, ODYD ( th Street); AND FURTHER, that Council approve a heritage restoration grant of $2, as applied for by Manfred and Edith Brenner to assist with the repainting of the exterior of the heritage building located on Lot 21, Blk 61, Plan 327, Sec 34, Tp 9, ODYD ( th Avenue). SHELAGH McGINN REQUEST TO LIST TH STREET ON THE VERNON HERITAGE REGISTER (P. 214) TEMPORARY ART GALLERY EXTENSION REQUEST (P. 231) (iii) THAT Council approve the request from Shelagh McGinn that Lot 3, Blk 6, Plan 467, Sec 3, Tp 8, ODYD ( th Street) be listed on the Vernon Heritage Register as the existing 1913 constructed house on the property warrants the property to be listed on the Heritage Register. (iv) THAT Council support the extension request to allow the temporary art gallery exhibition structure on Lot 1, Plan 21344, and Lot 44, Block 59, Plan 327, both of Section 34, Township 9, ODYD ( st Avenue) through to September 30, 2015 at no additional cost; AND FURTHER, that Council direct Administration to amend the licence agreement with the Regional District of North Okanagan to extend the term through to September 30, 2015 for the City owned lands legally described as Lot 1, Plan 21344, and Lot 44, Block 59, Plan 327, both of Section 34, Township 9, ODYD ( st Avenue), for use by the Vernon Public Art Gallery for a temporary art gallery exhibition, subject to Regional District of North Okanagan approval.

5 PAGE 5 REGULAR OPEN COUNCIL AGENDA MAY 11, 2015 FEE FOR SERVICE AGREEMENT FIRE INSPECTIONS AND FIRE INVESTIGATIONS (P. 240) (v) THAT Council approves the Fee for Service Agreement between the City of Vernon and the Village of Lumby, as attached to the report dated May 4, 2015, titled Fee for Service Agreement Fire Inspections and Fire Investigations, from the Fire Chief, for the provision of fire inspection and fire investigation services, for a five year term; AND FURTHER, that Council authorize the Fire Chief to utilize the Fee for Service Agreement as a template to negotiate Fee for Service Agreements with other customers requiring fire inspection and / or investigation services; AND FURTHER, that Council authorize the Chief Administrative Officer and Corporate Officer to sign Fee for Service Agreements for future fire inspection and / or investigation services. 12. LEGISLATIVE MATTERS Bylaws: ADOPTION A. THAT Bylaw #5558, Tax Rates Bylaw Number 5558, 2015 a bylaw for the levying of rates for Municipal, Hospital, Regional District and Specified Area purposes for the Year 2015, be adopted. (P. 257) FIRST, SECOND & THIRD READINGS B. THAT Bylaw #5559, Whitepoint Road Sanitary Main Extension Latecomer Charge Bylaw Number 5559, 2015 a bylaw to impose a Latecomer Charge for properties services from the sanitary main in Whitepoint Road, be read a first, second and third time. (P. 261) C. THAT Bylaw #5555, th Avenue Housing Agreement Bylaw Number 5555, 2015 a bylaw to authorize a Housing Agreement for th Avenue, be read a first, second and third time. (Jeruth Holdings) (P. 265) RESCIND THIRD READING, THIRD READING AS AMENDED D. Memo dated May 4, 2014, from the Manager, Legislative Services, re: 6092 Okanagan Landing Road Plan Vernon Amendment Bylaw Number 5317, 2011 (P. 276) 1. THAT Council rescinds Third Reading of bylaw #5317, 6092 Okanagan Landing Road Plan Vernon Amendment Bylaw Number 5317, 2011 a bylaw to amend the City of Vernon s Plan Vernon Bylaw Number 5151.

THAT Bylaw #5317, 6092 Okanagan Landing Road Plan Vernon Amendment Bylaw Number 5317, 2011 be amended to remove reference to Plan Vernon Bylaw Number 5151 and replace with reference to OCP Bylaw 5470; AND FURTHER, that Bylaw #5317 be renamed to 6092 Okanagan Landing Official Community Plan Amendment Bylaw Number 5317, (P. 277) CALL THE QUESTION ON THE AMENDING MOTION.
