1 District of Coldstream Council - Regular Meeting Minutes - May 8, 2017 CALL TO ORDER: PRESENT: STAFF: ALSO PRESENT: Mayor Garlick called the meeting to order at 6:00 pm Councillors Cochrane, Dirk, Enns, Kiss, McClean and Taylor T. Reiley, Director of Development Services 1 member of the media 55 people in the gallery 1. AGENDA 1.a. Motions to Add or Delete Agenda Items None 1.b. Approval of the Agenda as Presented or Amended Moved by McClean, seconded by Taylor, THAT the agenda be approved as presented. No. REG DELEGATIONS 2.a. Lavington May Day Representatives Edith Thoreson introduced the 2017 Lavington May Day Representatives: Alisha Semkiw, May Day Queen; Brennan McMorran and Ava Durand, Senior Ambassadors and Olivia Lorentz, Junior Ambassador. Each representative asked and answered questions of Council. The May Queen invited Council and members of the public to attend the May Day celebrations scheduled to be held at the Lavington Community Park on May 18, 2017 at 12:30 pm. 2.b. Coldstream Greenways Initiative Tera Mezynski, representing Greenways Coldstream Active Transportation, provided a presentation to Council and requested that: Council direct staff to update the Bicycle Master Plan to include separated multi-use paths; establish a committee of residents and staff to move the plan forward; and that Council consider annual funding in the budget from multi-use trails from the exiting tax base or a tax increase.
2 3. PUBLIC OPPORTUNITY TO ADDRESS COUNCIL 3.a. Re: Item 7.a. Development Variance Permit No DVP (Summertree) Rick Jones, representing Summertree Strata, spoke in favour of the application and indicated that the plans to expand the dock had been consideration for approximately three years. He noted that the strata was interested in creating a comprehensive boat management plan in order to ensure all boats were stored safely. He explained that the dock was designed to be in deeper water which would provide protection of fish habitats near the shore. He also confirmed that all boat slips were assigned to the owner of each property and that Summertree Strata Bylaws did not allow for rentals, nor would boat slips be permitted for rental to third parties. Neil Wooliams, representing the Mackie Lake House Foundation, noted that the Foundation had only been made aware of the application on May 4, 2017, which had not left very much time for the Foundation Board to gather and review the application. Mr. Wooliams was concerned that the boat slips on the south side of the proposed dock design would not be set back enough from the swim area in front of the Mackie Lake House and Sovereign Park. He suggested that a 20 foot boat would not be safely navigable into a slip where the setback was only 6 metres from the swim area as the proposal appeared to show. He also noted that swimmers enjoy a quiet and serene area to swim and that an expansion of the dock would increase boat traffic and consequently, the noise. Sharon Lawrence, of Coldstream, indicated she was not in favour of increased boat traffic on Kalamalka Lake. She expressed concern with respect to further degradation of the lake, noting it is a drinking water source, and the safety of swimmers in the area. She suggested that motorized boats/watercraft should be restricted on Kalamalka Lake. Lorna Eng, of Nexus Dock & Marina, advised that other configurations for the dock design were considered. She noted that the proposed design was chosen since it had met environmental requirements to mitigate any damage to fish habitats. She also confirmed that the boat slips were 20 feet long. J. Bruin, of Vernon, indicated that she frequented Sovereign Park and the beach area for swimming in particular because of the quiet setting. She was not in favour of increasing boat traffic in the area. Lee Bliss, of Coldstream, indicated that he had lived in the Summertree development for the past 20 years. He noted that he had also witnessed the condition of Kalamalka Lake change over the years, but wanted to stress that the dock expansion proposal would not increase boat traffic. Rather, he explained, the proposal was to store and manage existing boats properly. He further explained that since there were not enough boat slips for each property owner, boats were being tied to mooring buoys. He noted that prolong use of mooring buoys presented environmental and safety issues. He also advised that the proposal intended to use boat lifts at each slip so that boats could be stored out of the water when not in use. Mr. Bliss also stated that the proposed dock expansion, into the deeper water, would actually slow boats down as they approached the area, thereby making it safer for swimmers closer to the shore area. 3 Neil Wooliams asked if the District's park staff would be placing buoys to delineate the swimming area from the boating area. The Mayor indicated that the intention would be to do just that. Brian Butt, of Coldstream, indicated that boat docked in the water do not look as large or have as negative a visual impact as boats stored on boat lifts. He noted that a 20 foot boat on a lift would look the size of a small building. He suggested that many boaters use off-site storage companies to store boats when not in use and perhaps this was something residents of Summertree could consider instead of using boat lifts. 4. District of Coldstream Tax Rates Bylaw No. 1695, 2017 Bylaw No. 1695, a bylaw to establish the tax rates upon real property for the District of Coldstream and to provide for the payment of taxes for the year 2017 Moved by Enns, seconded by Kiss, THAT "District of Coldstream Tax Rates Bylaw No. 1695, 2017" be adopted. No. REG b. Mobile Food Vendor Policy and Business Bylaw Amendment Report from the Director of Development Services dated May 2, 2017 Bylaw 1696, a bylaw to amend the Business Bylaw 1021 to update definitions and provide for mobile businesses and farmers' markets Bylaw 1697, a bylaw to delegate the authority of Council to issue a temporary Licence of Occupation Bylaw 1698, a bylaw to amend the Miscellaneous Fees and Charges Bylaw 1541, to provide for Licence of Occupation fees for mobile businesses and farmers' markets on District property Policy PLD36, a policy to establish appropriate procedures and requirements for the use of District property for mobile vendors and farmers' market associations Page 3 of 11
4 Moved by Enns, seconded by Kiss, THAT "District of Coldstream Business Licence Bylaw no. 1021, 1990, Amendment Bylaw No. 1696, 2017, Amendment No. 6" be read a first, second and third time by title only; AND THAT "District of Coldstream Temporary Licence of Occupation Delegation Bylaw No. 1697, 2017" be read a first, second and third time by title only; AND THAT "District of Coldstream Miscellaneous Fees and Charges Bylaw No. 1541, 2008, Amendment Bylaw No. 1698, 2017, Amendment No. 4" be read a first, second and third time by title only; AND FURTHER THAT proposed District of Coldstream Policy PLD36, Mobile Businesses and Farmers' Markets on District Property be approved with and amendment deleting the Kalavista Park vending site from the list of potential vending sites. No. REG REPORTS UNFINISHED BUSINESS 6.a Lavington Park Capital Works Report from the Director of Infrastructure Services dated May 2, 2017 Moved by McClean, seconded by Taylor, THAT Council direct staff to proceed with Option 1, Do Nothing. No. REG Council indicated that the capital works for Lavington Park will be revisited at a future meeting. 7. REPORTS NEW BUSINESS 7.a. Development Variance Permit Application No DVP (Summertree) Report from the Planning Technician dated May 2, 2017 Moved by Cochrane, seconded by McClean, THAT Development Variance Permit No DVP (Summertree) be approved and issued to the owners of Strata Lots 1-50, Section 14, TP 9, ODYD, Strata Plan KAS512, for the Crown Foreshore fronting Strata Plan KAS512, to vary District of Coldstream Zoning Bylaw No. 1382, 2002, Dock and Boatlift Regulations, for expansion of an existing marina to forty- nine (49) slips, as follows: Page 4 of 11
5 a) Section a., dock length, is varied from 40 metres to 93 metres; and b) Section c., L or T length, is varied from 10 metres to 52 metres. AND THAT the dock layout conforms, substantially, to Drawing No. AM16, Proposed Summertree Fixed Dock Layout (Modified), by Nexus Dock and Marina, dated November 17, 2016, except that the southerly setback between the proposed dock and the northern boundary of the District's Licence of Occupation fronting the Mackie Lake House be increased to a minimum of 8 metres; AND THAT all work complies with the Environmental Impact Assessment (EIA) for Proposed Moorage Changes to Summertree Marina, Coldstream, BC, dated June 13, 2016, by Triton Environmental Consultants; AND FURTHER THAT signs displaying best practices are installed at the marina providing information on these matters: 1) refuelling and spill prevention/clean up, 2) ensuring the safety of marina users and 3) for minimizing potential aquatic impacts; and include the following advisories: Soap or other emulsifiers are not used to make fuel disappear as it increases the potential for intake contamination by increasing the hydrocarbon concentrations in the water column; All fuels are free of additives as they pose a greater risk to drinking water than boat fuel; All wake boats empty their ballasts prior to return to the marina for moorage. No. REG Kiss opposed 7.b. Building Official's Report for the Month of April 2017 Report from the Building Official dated May 1, 2017 Moved by Taylor, seconded by McClean, THAT the report from the Building Official dated May 1, 2017, regarding Building Official's Report for the Month of April 2017, be received for information and filed. No. REG c. Proposed Log House Property Interpretive Centre Improvements Report from the Director of Development Services dated May 2, 2017 Moved by Cochrane, seconded by Kiss, THAT SPrKL be advised that interpretive signage can be installed at the Log House property at 8505 Kalavista Drive; AND THAT all expenses incurred in the manufacturing and installation of signage be at the sole expense of SPrKL; Page 5 of 11
6 AND THAT prior to the signage being manufactured, District staff review the messaging to ensure it meets District standards with respect to content; AND FURTHER THAT the installation of the interpretive signage be done by SPrKL with any volunteer workers being insured under the Society's policy. Coldstream Greenways Initiative Moved by Kiss, seconded by McClean, THAT the presentation from Greenways Coldstream Active Transportation (GCAT), dated May 8, 2017, be referred to staff so they may prepare a report to Council with respect to the requests from Greenways Coldstream Active Transportation for consideration by Council at a future meeting. No. REG COMMITTEE RECOMMENDATIONS None 10. REPORTS FROM COMMITTEES & COMMISSIONS 10.a. Greater Vernon Advisory Committee Mayor Garlick reported that at the recent meeting of the Greater Vernon Advisory Committee the Committee received a delegation from the Pickleball Club regarding dedicated playing courts. 7 11. RESOLUTION TO ADJOURN TO IN CAMERA 11.a. Reminder: late additions to the in-camera agenda must be indicated in the resolution to adjourn. Moved by McClean, seconded by Dirk, THAT Council adjourn to an in-camera meeting to discuss issues related to the following paragraph(s) under Section 90(1) of the Community Charter: (l) discussions with municipal officers and employees respecting municipal objectives, measures and progress reports for the purposes of preparing an annual report under section 98 [annual municipal report]. No. REG The meeting recessed at 8:10 pm and reconvened at 8:24 pm. The Directors of Development Services, Financial Administration and Infrastructure Services were no longer present. 12.
