1 MINUTES ELKHART COUNTY BOARD OF COMMISSIONERS MEETING December 4, 2017 President Mike Yoder called the meeting to order at 9:00 a.m. in room 104 in the County Administration Building, 117 North Second Street, Goshen, Indiana. The other two (2) Board members, Frank Lucchese and Suzie Weirick, were also present. Others present were Pauline Graff, County Auditor; Craig Buche, County Attorney; Tom Byers, County Administrator and Anita Mock Executive Assistant. On a motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved the Minutes of the November 20 th and November 27 th meetings and placed them on file. carried, the Board approved the Allowance of Claims as presented by the County Auditor s office. BUSINESS ITEMS: County Administrator, Tom Byers, requested approval of an Independent Contractor Agreement with Blake Eckelbarger for maintenance on the Courthouse Clock at a cost of $ per month. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. (Page 420) County Highway Manager of Transportation, Jeff Taylor, requested approval of Traffic Control Recommendation for Tarman Road from Wysong Street to County Road 23 and Oak Street from Maple Avenue to Tarman Road. On motion made by Suzie Weirick, seconded by Frank Lucchese and unanimously carried, the Board approved this request. (Page 421) County Highway Manager of Transportation, Jeff Taylor, requested approval of Initial Subdivisions Acceptance, Winding River Estates Phase Two. 2 County Highway Manager of Transportation, Jeff Taylor, requested approval to publish notice to bidders on December 6 and December 13, 2017 for replacing the superstructure of Bridge 141 on County Road 3 over Baugo Creek. Bids will be accepted on January 5, Construction is expected to begin April 1, 2018 and completed by August 1, On motion made by Suzie Weirick, seconded by Frank Lucchese and unanimously carried, the Board approved this request. County Attorney, Craig Buche, requested approval of an Ordinance Amending the Elkhart County Code in Chapter 70: Traffic Regulations of the Title VII Traffic Code. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. (Page 423) County Attorney, Craig Buche, requested approval of the re-newel of the Third Addendum To Real Estate for the Prosecutor Building Lease. 3 AUDIENCE ITEMS: David Ostergren discussed his concerns about approving the ICE DETENTION CENTER. Andy Kaethbe discussed his concerns about approving the ICE DETENTION CENTER. David Shenk expressed several questions that he had in regards to the ICE DETENTION CENTER. He asked what the steps were to build such a center. County Highway Manager of Transportation, Jeff Taylor, recommended the approval to award a bid to Selking Inc for dump truck chassis and body upfit for a total cost of $116, On motion made by Suzie Weirick, seconded by Frank Lucchese and unanimously carried, the Board approved this request. County Highway Manager of Transportation, Jeff Taylor, requested the approval of a contract with INDOT for Community Crossings Grant. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. BUSINESS ITEMS: Planning and Development, Jason Auvill, requested that the request for approval for D Afton Development & Rose Hill Capital, LLC, represented by Abonmarche Consultants for a Secondary approval of a 15 lot major subdivision to be known as WINDING RIVER ESTATES PHASE THREE West side of County Road 37, 1,200 feet South of County Road 10, in York Township be tabled. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board tabled this request. Planning and Development, Mae Kratzer, requested approval for SGL Holdings, LLC, represented by Abonmarche Consultants for Secondary approval of a 14 lot major subdivision to be known as WESTGHATE RIDGFE East side of County Road 1, 2,200 feet North of County Road 4, in Cleveland Township. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. Planning and Development, Kevin Williams, requested approval of a Proposal for Demolition of County Road 29, Goshen, Indiana. 7 County Health Officer, Dr. Daniel Nafziger, requested approval of Health Officer Contract by and between the Elkhart County Board of Health and Lydia Mertz, M.D. This will be a 4-year contract beginning on January 2, On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. (Page 432) County Highway Manager of Transportation, Jeff Taylor, requested approval of Independent Contractor Agreements for Snow Plowing Services. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. (Page 433) County Highway Manager of Transportation, Jeff Taylor, requested approval for accepting the Elkhart County 2017 Mileage Certification for newly constructed subdivision streets. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. County Highway Manager of Transportation, Jeff Taylor, requested approval of Initial and Final Subdivision Acceptance into the Elkhart County Highway System. On motion made by Suzie Weirick, seconded by Frank Lucchese and unanimously carried, the Board approved this request. (Page 434) County Highway Manager of Transportation, Jeff Taylor, requested approval of Walter Avenue, south of County Road 16 and West of Shore Avenue be designated as nonmaintained, unimproved right of way. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. (Page 435) County Highway Manager of Transportation, Jeff Taylor, request approval of placement of School Bus Stop Warning Signs according to the recommendation of the County Engineer. 8 County Administrator, Tom Byers, requested the approval of the Joint Resolution Town of Middlebury Tax Sale Certificate. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. (Page 436) County Attorney, Craig Buche, requested the approval of the Restricted Address Policy. On motion made by Frank Lucchese, seconded by Suzie Weirick and unanimously carried, the Board approved this request. (Page 437) County Commissioner, Suzie Weirick requested to move forward with the proposal for the Quaker Trace County Road 8 Bike/Pedestrian Path. Establishing the path to be on the North side of County road 8 with curb on the outside of the path, option 2A, minimizing the need for right of way. Funding options for the design and construction to be sought at a later date. On motion made by Suzie Weirick, seconded by Frank Lucchese and unanimously carried, the Board approved this request. AUDIENCE ITEMS: Richard Aguirre discussed his concern of approving the ICE DETENTION CENTER. Tim Osburn discussed his concern over traffic safety at the corner of County Road 24 and County Road 105. He requested to have a guardrail put up in front of his house on Honeysuckle Lane. Jeremy Freesen discussed his concern over possibly approving the ICE DETENTION CENTER.
