1 Administration and Projects Committee STAFF REPORT Meeting Date: June 4, 2015 Subject State Route 4 (SR4)/Bailey Road to Railroad Avenue (Project 1403) Authorization to Execute No. 18 to Agreement No. 107 with URS Corporation (URS) for On-Call Right-of-Way (ROW) Engineering Services Summary of Issues Recommendations ROW engineering services and deliverables by the consultant for the project are complete. The project ROW title transfer from Contra Costa County to the State will require formal acceptance by the California Department of Transportation (Caltrans). During the acceptance process, the consultant needs to be available to answer any potential questions or provide any other needed deliverables. The current term of the consultant agreement will expire before the formal acceptance process occurs. A term extension to Agreement No. 107 is required to retain the consultant until Caltrans accepts the project ROW. Staff seeks authorization for the Chair to execute No. 18 to Agreement No. 107 with URS to provide on-call assistance for potential follow-up questions or deliverables requested by either Contra Costa County or Caltrans during the ROW transfer acceptance process. This amendment will extend the agreement termination date from June 30, 2015 to June 30, 2016 with no increase in budget. Financial Implications None Options Attachments The Authority could elect to modify or not approve this request; however, Caltrans requires the consultant be available to answer potential questions until the project ROW transfer has been accepted. 2 Administration and Projects Committee STAFF REPORT June 4, 2015 Page 2 of 2 Background URS provided ROW engineering services for the SR4/Bailey Road to Railroad Avenue Project under consultant Agreement No Contra Costa County, Real Property Division, acquired the necessary project ROW on behalf of the Authority. ROW services provided by URS included preparation of ROW Appraisal Maps, Record Maps, legal descriptions, plat maps, utility easement documents, freeway boundary monumentation, Record of Survey, and general ROW engineering support for the County s acquisition and project title transfer activities. All project ROW activities by URS and the County are complete except for the delivery of an updated project title report to Caltrans. The County is currently waiting for an updated title report from the title company. After the updated title report is provided to Caltrans, the formal project ROW transfer acceptance process can be completed. During the Caltrans acceptance process, the consultant needs to be available to answer any potential questions that may arise or provide any other needed deliverables to facilitate the formal acceptance of the project ROW. The current term of Agreement No. 107 expires on June 30, Therefore, a term extension to Agreement No. 107 is required to retain the consultant until Caltrans formally accepts the project ROW. 5-2
3 AMENDMENT No. 18 Agreement No. 107 With URS Corporation for State Route 4 Widening - Bailey Road to Railroad Avenue Design Services During Construction and Right-of-Way Engineering June 17, 2015 WHEREAS, the Contra Costa Transportation Authority and MK Centennial (subsequently Washington Infrastructure Services, subsequently Washington Group International, Inc., subsequently Washington Division of URS Corporation, and currently URS Corporation by contract, but now known as AECOM) entered into Agreement No. 107 on June 14, 1999; and WHEREAS, the parties, on September 19, 2001, extended the term of the Agreement through June 30, 2003; and WHEREAS, the parties, on November 21, 2001, increased the Total Agreement Value from $275,000 to $325,000 to include right-of-way monumentation, record map, record of survey, noise measurements, computer modeling, sound wall analysis, public meetings, geotechnical borings, compaction tests, and geotechnical summary reports as eligible activities; and WHEREAS, the parties, on June 18, 2003, transferred all rights and obligations under this Agreement from MK Centennial to Washington Infrastructure Services, increased the Total Agreement Value from $325,000 to $425,000 to include revisions to right-of-way appraisal maps, monumentation, record of survey, preparation of legal descriptions, Record Map, ancillary closeout activities, retrieval of specific CADD files for construction As-Builts, a Letter of Memorandum for the north sound wall, and an Initial Site Assessment (ISA) for the Rifle Range parcel exchange; and WHEREAS, the parties, on June 16, 2004, transferred all rights and obligations under this Agreement from Washington Infrastructure Services (the subsidiary) to Washington Group International, Inc. (the parent company), an Ohio corporation, increased the Total Agreement Value from $425,000 to $472,000 to include out-of-scope right-of-way activities, and extended the term of the Agreement through June 30, 2005; and 5-3
4 WHEREAS, the parties, on July 20, 2005, increased the Total Agreement Value from $472,000 to $532,000 to include additional revisions to right-of-way appraisal maps, hard copy maps, record map, record of survey, plat maps, and legal descriptions as a result of modifying the Rifle Range Road right-of-way parcel exchange strategy, and extended the term of the Agreement through March 31, 2006; and WHEREAS, the parties, on February 15, 2006, extended the term of the Agreement through December 31, 2006; and WHEREAS, the parties, on December 20, 2006 extended the term of the Agreement through December 31, 2007; and WHEREAS, the parties, on December , increased the Total Agreement Value from $532,000 to $584,843 to include additional activities, agreed to the transfer of all rights and obligations from Washington Group International, Inc. to Washington Division of URS Corporation, and extended the term of the Agreement through December 31, 2008; and WHEREAS, the parties, on December 17, 2008, extended the term of the Agreement through December 31, 2009; and WHEREAS, the parties, on December 16, 2009, extended the term of the Agreement through December 31, 2010; and WHEREAS, the parties, on November 17, 2010, extended the term of the Agreement through December 31, 2011; and WHEREAS, the parties on January 19, 2011, increased the Total Agreement Value from $584,843 to $607,568 to include additional right-of-way close-out activities and transfer all rights and obligations under the Agreement from Washington Division of URS Corporation to URS Corporation; and WHEREAS, the parties on November 16, 2011, extended the term of the Agreement through December 31, 2012; and WHEREAS, the parties on April 18, 2012 amended the Agreement to increase the scope of services and increase the Total Agreement Value by $19,000 from $607,568 to $626,568 for additional right-of-way closeout activities to facilitate the right-of-way transfer acceptance by Caltrans; and WHEREAS, the parties on December 19, 2012, extended the term of the Agreement through December 31, 2013; and WHEREAS, the parties on December 18, 2013, extended the term of the Agreement through June 30, 2014; and 5-4
5 WHEREAS, the parties on July 16, 2014, extended the term of the Agreement through June 30, 2015; and WHEREAS, the parties now wish to further extend the term of the Agreement for on-call right-of-way closeout services during the title transfer acceptance process by Caltrans; therefore be it MUTUALLY AGREED: (1) That Article II of the Agreement is amended to extend the term to June 30, 2016; and (2) That all other items and conditions of the Agreement shall remain in effect.
