Mike Lawlor, Jared Fraser, Heidi Fraser, Sandy Clark, Quinton Beaumont, Christa Cornelssen, Rick Green and Dennis Nelson joined the meeting. Introductions were made. AGENDA APPROVAL Moved by Councillor Grover that the agenda for the May 14, 2014 Regular County of Stettler No. 6 Council Meeting be approved with the following additions: 1. Waste Management Site at SE ¼ W4M 2. Scenic Sands Community Association 3. Resource Road RE: Paving MINUTES APPROVAL Moved by Councillor Stulberg that the April 9, 2014 Regular County of Stettler No. 6 Council Meeting minutes be approved as amended to correct the spelling of Mike Lowler to Lawlor Moved by Councillor J. Gendre that the April 23, 2014 Regular County of Stettler No. 6 Council Meeting minutes be approved as presented. DELEGATION Mike Lawlor RE: Stettler Skate Park Association: Mike Lawlor joined the meeting and indicated that they have received an additional $16,000 in funding and that a letter has been enclosed with the Town s water bill with a great response resulting in additional donations. 2 CAO Tim Fox indicated that he has contacted the contractor and all inkind work will be guided by them. It was noted that County of Stettler in-kind work would be influenced by timelines depending on County of Stettler s equipment/workers present schedules. OLD BUSINESS Stettler Skate Park Association s Request for Funding: Moved by Councillor J. Gendre that the County of Stettler No. 6 approve funding to the Stettler Skate Park Association in an amount up to $30,000 representing cash and/or in-kind for their Skate Park project (Phase 1). In Favour: Councillors E. Gendre, Jackson, Grover, Stulberg, J. Gendre and Reeve Nixon Opposed: Councillor Nibourg Mike Lawlor, Jared Fraser, Heidi Fraser and Sandy Clark left the meeting at 10:16 a.m. NEW BUSINESS Senior s Week June 2 to 8, 2014: Moved by Councillor Nibourg that the County of Stettler No. 6 proclaim June 2 to 8, 2014 as Seniors Week. Stacey Lavallie joined the meeting at 10:22 a.m. Larry Mulgrove, Dale Nixon, John Cassidy, Ryan Nixon and Teresa Walker joined the meeting at 10:25 a.m. Additional Budget Allocation Municipal Reserve Encroachments at Old Bolin Subdivision: Moved by Councillor J. Gendre that the County of Stettler No. 6 approves the costs associated with the survey to correct the Old Bolin Subdivision encroachments estimated to be $88, Delegation continued... Larry Mulgrove/Dale Nixon RE: Dust Control for Township 39-2 and Range Road 19-3: Larry Mulgrove, as spokesman, joined the meeting and explained that the road allowance on Township 39-2 which was oiled last summer is breaking-up in a few places and in a matter of time this may destroy the whole road, that near the fertilizer business, trucks are pulling over too far and road graders with large tires are damaging the shoulders. Asked if there are any funds available for dust control on the two miles to the south and as this is a Resource Road requested that funding be made available in order to control the dust. Businesses in the area have a large number of employees/trucks which also increases traffic. A Traffic Control count was included in the package. It was also noted that the Calcium product used for dust control only holds up for 2 to 3 weeks then becomes a dirty dust. In summary Mr. Mulgrove requested that if there are funds available that they be put toward dust control on Township 39-2 and Range Road May 14, 2014 Page 2 of 12

3 Tim Fox noted that two years ago there was a one-time motion that the County cover 50% of the cost of dust control which could be considered again. Major discussion took place on road costs, products available, products history, road structure, possible solutions, resource road description and grants. Sharon Larsen joined the meeting at 10:48 a.m. Larry Mulgrove noted that the option to oil in front of yards for dust control seemed to last considerably well, however, as soon as a pot hole exists, the road starts to break-up. This method seemed to be more effective and cost efficient. Rick Green explained the life span and goals of products and solutions to try to retain the product for longer periods of time. It was requested that residents be given an option of cost sharing before any dust control is placed Moved by Councillor J. Gendre that the County of Stettler No. 6 supply free of charge Calcium Chloride Dust Control, for the 2014 year to all individuals who cost shared in Dust Control during the 2013 year on Township 39-2 and Range Road In Favour: Councillors E. Gendre, Jackson, J. Administrative Policy 1.11 Primary Road and Limited Access Road Dedication and Upgrades and Subdivision Registration: A revised policy was made available in the Council Meeting Additions to package Moved by Councillor Stulberg that the County of Stettler No. 6 approves the County of Stettler No. 6 Policy and Procedure Manual s Administrative Policy Road Dedication and Upgrades and Subdivision Registration, as amended, and attached and forming part of these minutes. Public Works Policy 5.9 Road Specifications: Moved by Councillor J. Gendre that County of Stettler No. 6's Policy and Procedure Manual Public Works Policy Road Specifications be amended to include 1½ an inch to read All gravel roads to have a minimum of 450 tonne (276 m3 or 360 yrd3) of 1½ an inch crushed gravel..... Gendre Donalda and District Agricultural Society Request for Funding: Councillor Stulberg indicated that there are funds available for emergency repairs to the Donalda Hall in the operating reserves to be used in situations of this nature Moved by Councillor Gendre that the County of Stettler No. 6 approve funding to the Donalda and District Agriculture Society to replace the Donalda Community Hall s furnace, with funds drawn from the Operating Recreation Reserve Moved by Councillor Nibourg that resolution be amended to include the cost of the water tank. In Favour: Councillors E. Gendre, Jackson, Grover, Nibourg, Stulberg and Reeve Nixon Opposed: Councillor J. Gendre Motion be amended to read: that the County of Stettler No. 6 approve funding to the Donalda and District Agriculture Society to replace the Donalda Community Hall s furnace and hot water heater in the amount of $6,043.00, with funds drawn from the Operating Recreation Reserve. In Favour: Councillors E. Gendre, Jackson, Grover, Nibourg, Stulberg and Reeve Nixon Opposed: Councillor J. Gendre Write Off Taxes: Sharon Larsen indicated that on these accounts the oil companies have disappeared rather than being taken over by a new company and explained the expenses/protocol that are required of companies when drilling wells. Bylaw Amend Land Use Bylaw (Close, Rezone and Dispose of Lot 3MR Block 14 Plan for less than the Market Value). PUBLIC HEARING Call To Order: Wayne Nixon as Chairperson opened the Public Hearing for: 1. Bylaw Amend Land Use Bylaw to Rezone a portion of NE W4M (new lot number Lot Block Plan 142 ) from CR-A Country Residence Agricultural District to I Industrial District and 2. Bylaw Amend Land Use Bylaw (Close, Rezone and Dispose of Lot 3MR Block 14 Plan for less than the Market Value). Purpose of Public Hearing: To hold a Public Hearing for: 1. Bylaw Amend Land Use Bylaw to Rezone a portion of NE W4M (new lot number Lot Block Plan 142 ) from CR-A Country Residence Agricultural District to I Industrial District. 2. Bylaw Amend Land Use Bylaw (Close, Rezone and Dispose of Lot 3MR Block 14 Plan for less than the Market Value). Chairperson Wayne Nixon reviewed the meeting agenda and stated the Rules of Conduct to be followed during the Public Hearing. Verbal Presentations: In Support: None In Opposition: Gordon McLellan expressed a concern with the property being given for a lesser value and asked why is it not being tendered? Rich Fitzgerald, Garth Ennis and Stephan Weninger joined the meeting at 1:12 p.m. Mr. McLellan feels that funds are being lost that could be used for other items. Council questioned how many other lands are sold at true value and asked for the lot size. Presentations from Resource Person(s): Jacinta Donovan reviewed the application. Reeve Nixon asked if there were any questions from Council: Councillor Gendre referred to the Erskine Concept Plan and indicated that with the changes this lot s use would become practical. Councillor Grover asked if any others may have interest in the land? Adjournment: Reeve Nixon declared that the Public Hearing for: 1. Stephan Weninger noted that they have combined the Erskine and Red Willow request for proposals, explained the proposals that have been received and answered questions. Award Contract for Erskine/Red Willow Truck Fill Station: Moved by Councillor Nibourg that the County of Stettler No. 6 awards the Contract for the Erskine Reservoir to Timcon Construction (1988) Ltd., Red Deer, Alberta in the amount of $1, plus GST and Red Willow Truck Fill to Klassen Construction, Stettler, Alberta in the amount of $290,000 plus GST Revised Budget: Christa Cornelssen and Yvette Cassidy presented the Revised 2014 Budget. It was noted that a deficit was projected and looking for Council s input as the presented budget needs to be balanced prior to approval. 9 2014 Revised Budget: Moved by Councillor Grover that the County of Stettler No. 6 approve the Budget as presented with a transfer of $123,503 from reserves to create a balanced 2014 Budget. Teresa Walker left the meeting at 2:35 p.m. New Business continued... RDRMUG/RDRWA Workshop Connecting Through Water Day: Moved by Councillor Stulberg that the County of Stettler No. 6 authorize Councillor J. Gendre to attend the RDRMUG/RDRWA Workshop Connecting Through Water Day on Friday, June 13, 2014 in Red Deer Alberta. Waste Management Site at SE ¼ W4M: Councillor Grover indicated that there is still a concern with blowing garbage, etc. from the privately owned/operated landfill, therefore, request that the issue be addressed Moved by Councillor Grover that the County of Stettler No. 6 direct administration to draft a letter from the Reeve to the owner/operators of the Waste Management Site at SE ¼ W4M requesting that issues related to blowing garbage be addressed. Gendre suggested that new standards be placed in policy to give clearer direction regarding the profile of the road. Major discussion took place on where responsibilities lie Moved by Councillor J. Gendre that the County of Stettler No. 6 direct Public Works and Administration to draft a County of Stettler No. 6 Policy and Procedure Manual Public Works policy stating that all roads are to be graveled have a profile to the County s standards set out in Policy 5.9 as to the 3% crown slope, without shoulder lips and excepting out roads identified in Policy 5.9 #11 as limited access and agreed to by the local Councillor. Sharon Larsen and Christa Cornelssen left the meeting at 2:52 p.m. Bylaw Amend the Municipal Development Plan Bylaw No Minimum Number of Parcels in a Multi-lot Subdivision and CFO s: Due to selection of Option 2 as the preferred Bylaw, the description of the Bylaw changed accordingly Moved by Councillor Jackson that the County of Stettler No. 6 give first reading to Bylaw amend the Municipal Development Plan Bylaw No subdivision of additional private titles in the Agricultural District and rewording of Policies for Confined Feeding Operations (CFO s) and set a Public Hearing for June 11, In Favour: Councillors E. Gendre Moved by Councillor Jackson that the County of Stettler No. 6 enter into an in- camera session at 3:10 p.m. to discuss land and legal issues. Lisa Joy and Landin Chambers left the meeting Moved by Councillor Grover that the County of Stettler No. 6 Council exit out of in-camera at 4:05 p.m. Chip Seal Award: Moved by Councillor Nibourg that the County of Stettler No. 6 authorize administration to enter into a contract with Ant Construction, Red Deer, Alberta, for the Graded Aggregate Seal Coat project including Schedule A sites: 1. Twp. Rd. 37-0; 2. Rge. Rd. 20-3; and 3. Rge Rd and Schedule B: 4. Rge. Rd. 19-3; 5; Rge. Rd. 19-3A; and Twp. Rd. 39-1; and 6. Rge.
