1 Minutes of a Regular Meeting of County Council RED DEER COUNTY March 22, CALL TO ORDER The regular meeting of Red Deer County Council was held in the Council Chambers of the Red Deer County Centre located at Rge Rd 275, Red Deer County, Alberta, and was called to order by Mayor J.J. Wood at 10:41 a.m. PRESENT: Mayor J.J. Wood, Deputy Mayor J.M. Bota, Councillors D.B. Church, C.R. Huelsman, R.R. Lorenz, P.J.R. Massier and C. Moore. STAFF PRESENT: County Manager C. Herzberg, Assistant County Manager R. Henderson, Corporate Services Director H. Gray-Surkan, Planning and Development Services Director D. Dittrick, Operations Services Director M. Campbell, and Legislative Services Administration N. Lougheed and L. Thompson. Planning/Development administration in attendance for development applications: T. Miller, R. Barr, D. Bedford, T. March, R. Moje and L. Solberg. 2.0 APPROVAL OF AGENDA CC Moved by Councillor C.R. Huelsman to approve the agenda as submitted. 3.0 APPROVAL OF MINUTES CC Moved by Councillor C. Moore to approve the minutes of the March 1, 2016, regular meeting of County Council as submitted. 6.0 REPORTS 6.1 ALUS Partnership Advisory Committee Conservation Coordinator K. Lewis reported on the recommendation to consider an amendment to the Terms of Reference for Red Deer County s Alternative Land Use Services Partnership Advisory Committee. CC Moved by Councillor J.M. Bota to approve the new proposed Alternative Land Use Services (ALUS) Partnership Advisory Committee (PAC) Terms of Reference as presented with the new PAC Terms of Reference to come into effect with the October 18, 2016, organizational meeting of Council where appointments to Boards and Committees will occur. 6.2 Grain Rescue Training Program recommendation to provide financial support to the Canadian Agricultural Safety Association (CASA) grain rescue training program. CC Moved by Councillor C.R. Huelsman to approve Red Deer County s contribution of $10,000 in each year of 2016, 2017 and 2018 in support of the Canadian Agricultural Safety Association grain rescue program.

2 County Council Minutes of March 22, Lot 8MR, Block 4, Plan , NE (Division 6) consideration of a request received from ATCO Gas to use a portion of this property for an expansion to its existing Regulating Station facilities located on adjacent Lot 11. CC Moved by Councillor C. Moore that Red Deer County grant a License of Occupation to ATCO Gas for the use of a portion of Lot 8MR, Block 4, Plan for the proposed expansion of its existing Regulating Station facilities located on adjacent Lot 11, subject to the following conditions: (1) ATCO Gas entering into an agreement with Red Deer County that includes a provision that if the County is required to undertake any work on the lands that requires relocation of any improvements constructed by ATCO Gas, this relocation will be at ATCO Gas s expense; (2) ATCO Gas to submit detailed plans to the satisfaction of the County in relation to the proposed development; and (3) ATCO Gas to be responsible for any costs involved with the preparation of the agreement (License of Occupation) which includes any costs related to the registration of the agreement with Land Titles. 7.0 DEVELOPMENT APPLICATIONS & REPORTS 7.2 Divide Hills Area Structure Plan recommendation to give first reading to a bylaw to amend this Plan to provide the option for water and sewer services to be provided by communal services and to set the public hearing for April 26, Bylaw No. 2016/8 a bylaw to amend the Divide Hills Area Structure Plan, Bylaw No. 9/93, to provide that multi-lot subdivisions are serviced by communal water and wastewater systems, developed as a condominium, or these services may also be provided on an individual lot basis. CC Moved by Councillor J.M. Bota that Bylaw No. 2016/8 be given first reading with the public hearing to be scheduled for April 26, District 2 & 42 Major Area Structure Plan recommendation to give first reading to a bylaw to adopt the District 2 & 42 Major Area Structure Plan for lands located adjacent to the Hwy 2 and 42 interchange. Bylaw No. 2016/9 a bylaw to adopt the District 2 & 42 Major Area Structure Plan. CC Moved by Councillor D.B. Church that Bylaw No. 2016/9 be given first reading with the public hearing to be scheduled for April 26, COMMITTEE REPORTS Councillors reported on meetings they have attended on behalf of Red Deer County since March 2, Recess: 12:11 p.m. Reconvene: 1:30 p.m.

3 County Council Minutes of March 22, PUBLIC HEARINGS A listing of the persons who attended and spoke at the public hearing is attached and is considered to be a part of these minutes. The public hearing closed at 3:02 p.m. 8.1 Bylaw No. 2015/27 a bylaw to amend Land Use Bylaw No. 2006/6 by adding a Gravel Overlay District (Part 33, Schedule A), including definitions (Sections 8 and 10) relative to Gravel Extraction, and changing Gravel Extraction to a Permitted Use in the Agricultural District (Part 11) once the Gravel Overlay District has been applied to the subject lands. CC Moved by Councillor R.R. Lorenz to amend Bylaw No. 2015/27 as follows: (1) Replace Section 5, No. 3.4, with the following: Dust Control: The County will be responsible to perform dust control 200 meters along the front of each dwelling and 200 meters at each intersection along the designated haul route. Notwithstanding, the County may waive the dust control requirement for dwellings that are set back a distance of 300 meters or greater from the haul road, if it is determined that the dwelling would not be affected by dust generated from the haul. The applicant shall be required to pay to the County all costs associated with dust control performed by the County. The applicant shall be required to submit a Letter of Credit (auto renewal) for the cost of one application of calcium chloride. The applicant shall be required to perform dust control within the pit area, at their expense to the satisfaction of the County; (2) Replace Section 5, No. 3.5, with the following: Noise Control: The applicant shall provide a written plan detailing the methods intended to be used to address noise emanating from operations within the development area or on haul roads, resulting from activities. Items to be covered include but are not limited to the following: a) Prior to commencement, a Noise Impact Assessment shall be performed on all proposed pits that are located less than 800 meters from an existing dwelling (on a separate title) to pit boundary, to determine projected noise levels. b) This assessment shall identify the best location for placement of equipment within the pit boundary for sound attenuation. c) Methods to be used to reduce and address noise in situations where the gravel pit is in close proximity to urban areas, may include, but not be limited to: i. positioning the crushing equipment on the pit floor where the walls of the pit will provide extensive sound attenuation; ii. blanketing the crusher; iii. the use of straw bales in and around the crusher; iv. constructing berms along the pit boundaries; v. using alternatives to back up alarms and avoiding the use of engine brakes. d) All existing stands of trees and shrubbery outside the development area shall be preserved to the greatest extent possible for buffering and screening purposes; (3) Change the heading of Section 5, No. 3.7, to Hauling and Operations; (4) Replace Section 5, No. 3.7 (f), with the following: gravel operations (i.e. stripping, on-site sales, reclamation) shall be limited to the hours

4 County Council Minutes of March 22, of 7:00 a.m. to 7:00 p.m., 6 days per week, year round, and the gravel pit shall be closed on Sundays and statutory holidays; (5) Replace Section 5, No. 3.7 (g), with the following: hauling shall be limited to the hours of 7:00 a.m. to 7:00 p.m., 6 days per week, year round, and the hauling shall not occur on Sundays and statutory holidays. There are no restrictions for hauling on ban free roads; (6) Replace Section 5, No. 3.7 (h), with the following: crushing and/or screening shall be permitted as follows: for a pit that is less than 800 metres from an existing dwelling (on a separate title) to the pit boundary, crushing and/or screening is limited to the hours of 7:00 a.m. to 7:00 p.m., 6 days per week, to a maximum of 10 weeks per year, and crushing and/or screening shall not occur on Sundays and statutory holidays (An increase in the number of weeks may be considered if a variance is granted by MPC); and, for a pit that is greater than 800 metres from an existing dwelling (on a separate title) to the pit boundary, crushing and/or screening is permitted 24 hours per day, 7 days per week, to a maximum of 10 weeks per year (An increase in the number of weeks may be considered if a variance is granted by MPC; and (7) Add Section 5, No. 3.7 (i), that reads as follows: the County Manager has the authority to vary the hours and days of operations {listed in paragraphs 3.7 (f), (g) and (h)} under special circumstances. CC Moved by Councillor P.J.R. Massier that Bylaw No. 2015/27, as amended, be given third and final reading. 8.2 Bylaw No. 2016/5 - a bylaw to impose an offsite levy in connection with road construction improvements on the C&E Trail from Hwy 592 (north of Innisfail) to Rge Rd 275 (west of Red Deer). CC CC Moved by Councillor D.B. Church that Bylaw No. 2016/5 be given second reading. Moved by Councillor C.R. Huelsman that Bylaw No. 2016/5 be given third and final reading. 7.0 DEVELOPMENT APPLICATIONS & REPORTS 7.1 Bylaw No. 2015/28 consideration of third reading to this bylaw to amend Land Use Bylaw No. 2006/6, Section 49, Excavation and Construction Site Preparation, which will remove all references pertaining specifically to sand and gravel extraction, and to amend Section 10, Definitions, to include definitions for Site Grading and Excavation. CC Moved by Councillor C.R. Huelsman that Bylaw No. 2015/28 be given third and final reading ADJOURNMENT CC Moved by Councillor C. Moore that the County Council meeting adjourn.
