1 ORDER DECLARING UNOPPOSED CANDIDATES ELECTED TO OFF'ICE AND CANCELING ELECTION THE STATE OF TEXAS COLINTY OF HARRIS NORTH HARzuS COUNTY REGIONAL WATER AUTHORITY V/HEREAS, the North Harris County Regional Water Authority (the "Authority") is a governmental agency and body politic and corporate of the State of Texas created pursuant to Chapter 1029 (H ), Acts of the 76th Texas Legislature 1999, amended by Chapter 1296 (H ), Acts of the 77th Texas Legislature 2001, amended by Chapter 381 (S.B. 1725) and òhapter 24S (H ),.Acts of the 78th Texas Legislature 2003, amended by Chapter (S. B. 3934, Acts of the 83'o Texas Legislature 2013, (collectively referred to as the "Act"), to accomplish the purposes provided by Section 59, Article XVI, Texas Constitution; V/HEREAS, Radcliffe Bobbitt Adams Polley PLLC ("RBAP"), general counsel and designated agent for the Authority, is the authority responsible for having the official ballot prepared for the Authority's November 8,2016 Directors Election (the "Election"); and WHEREAS, the filing deadline for placement on the ballot was 5:00 p.m. on August22, 2016 and the deadline for the list of approved write-in candidates for the Election was 5:00 p.m. on August 26,2016; and WHEREAS, pursuant to the provisions of Section 2.052, Texas Election Code, as amended, RBAP has certified in writing to the Board of Directors (the "Board") of the Authority that the candidates for Director of Single-Member Voting District Nos. 3, 4 and 5 to be listed on the ballot for such Election are unopposed; only one candidate's name will appear on the ballot for that position and no candidate's name will be placed on an approved list of write-in candidates for the office of Director of Single-Member Voting District Nos. 3, 4 and 5; and WHEREAS, pursuant to the provisions of Section 2.053, Texas Election Code, as amended, the Board has the authority to declare unopposed candidates elected to office. NOV/, THEREFORE, BE IT ORDERED BY THE BOARD OF DIRECTORS OF THE NORTH HARRIS COI]NTY REGIONAL WATER AUTHORITY THAT: Section 1: The Board of the Authority hereby declares the following unopposed candidates to be elected to the office of Director of Single-Member Voting District Nos. 3, 4 and

2 Jim Pulliam District No. 3 Alan J. Rendl District No. 4 Kelly P. Fessler District No. 5 The candidates declared elected to office shall serve until the biennial directors election in the year 2020, or until their successors have been duly elected or appointed and have qualified. Section 2: The candidates declared elected to office under this Order shall enter into the duties of their office and shall begin to serve their term of office after the November 8,2016 election date, and upon posting bond in the amount of 10,000, taking the constitutional oath of office, and acceptance of the bond and oath of office by the Authority's Board. Section 3: Pursuant to the provisions of Section 2.053(b), Texas Election Code, as amended, the Election for Director of Single-Member Voting District Nos. 3, 4 and 5 shall not be held pursuant to the requirements of the Texas Election Code. A copy of this Order shall be posted on Election Day at each polling place that would have been used in the Election for Director of Single-Member Voting District Nos. 3, 4, and 5.
