2 2 Introduction: The YSR Congress Party under the leadership of Sri.YS Jagan Mohan Reddy as the main opposition party in the State of Andhra Pradesh has been voice of voiceless and keeping a constant check on the illegal and unconstitutional governance of the Telugu Desam Party Government. The governance reflects disrespect to constitutional mandates resulting in bringing down of Institutions and their capacities to deliver fair and just governance to the people. The growing extra constitutional power centre in the form of Sri.Nara Lokesh Babu interfering into decision making and implementation of executive decisions brought down the democratic process to anarchy and authoritative tyranny in state of Andhra Pradesh. The main object behind such misrule is only to amass wealth by adopting hardcore corrupt practices and unconstitutional mechanisms inventing various methods. The Leader of Opposition Sri.YS Jagan Mohan Reddy and his team of Legislators have been grabbing every available opportunity to question the corrupt governance and brought to light several scams to protect the interest of people. In the process a huge Land Scam of Rs.1300 Cr relating to sale of Ac acres of Endowment Land belonging to Amarendraswamy Temple- Sri sadavarthivari Choultry, Guntur situated in Thalambur Village, Chengalpattu Taluk, Kanchipuram District, Tamilnadu was unearthed. Considering the importance of the issue, which relates to land belonging to an Endowment institution; welfare of poor Brahmins and Hindu religious importance, the President of YSR Congress Party Sri.YS Jagan Mohan Reddy constituted a Fact Finding Committee headed by Sri.Dharmana Prasada Rao to cull out the truth behind the huge Endowment land scam. The Fact Finding Team started procuring information in terms of documents and meeting several people concerned and also made a visit to the subject lands in Thalambur Village, Chengalpattu Taluk, Kanchipuram District, Tamilnadu. Having made a preliminary enquiry about the sale of lands and circumstances, the Fact Finding Committee submitted this Interim Report for consideration of the President of YSR Congress Party Sri.YS Jagan Mohan Reddy.

3 3 Amaravathi Temple & Sri Sadavarthivari Choultry: Amaralingeswara Swamy temple is located in Amararama which is one of the Pancharama Kshetras which is located at Amaravati town near Guntur City in Andhra Pradesh in southern India. Lord Shiva is known as Amareswara Swamy or Amaralingeswara Swamy here. The temple is situated on the southern bank of Krishna River. The consort of Lord Amareswara Swamy is Bala Chamundika. The Sivalinga at this place is installed and established by Lord Indra. The temple is closed between 1PM and 4PM everyday. The Sivalinga here is very tall that the archakas mount a pedestal platform, and perform the daily rituals as well as Abhisheka. The top of the Linga has a red stain on it. It is said that Sivalinga was growing up in size and to stop its growth, a nail has been hit onto the top of the Sivalinga. When the nail dug into the Linga, blood started to ooze from the Sivalinga it seems. The stain can be see even today. Sri.Vasireddy Venkatadri Naidu, King of Chintapalli and later Dharanikota, was a great devotee of Amaralingeswara. He expanded and renovated the temple. The popular legend has it that once during the course of putting down a rebellion in his land the King had to have recourse to a massacre of the Chenchus, whereupon he lost his mental peace, which he regained only when he came to Amaravati. He shifted his place from Chintapalli to Amaravati in 1796, and devoted his entire life, time and revenues to building temples for Lord Siva. He renovated the Amareswaraswamy temple here, engaged nine learned archakas for the daily archana of the Lord, and provided them with all the needs of livelihood, including 12 acres of land to each. Further he established Sri Sadavarthivari Choultry and on July 20, 1885 by a will he along with his wife Smt.Venkata Lakshmama donated Ac cents of land in Survey No.33 of Tallambur Village, ChengalpatTaluk, Kanchipuram District, Tamilnadu. The object of the Endowment is to support the education of poor Brahmin students and feeding of temple visitors etc and the same has been carved on a stone on 17 th May History of Thalambur Lands: Sri sadavarthi Choultry Charitable Trust created to feed the devotees of Amaravathi Temple and fund the Priests and Brahmin boys for their education is owned by the Heriditory Trustees of the family Late Raja Venkatadri Naidu and Late Smt.Venkata Lakshmamma. The Lands in Thalambur Village were given by will to the Choultry.

4 4 The Lands are in Old Survey No.33 of Thallambur Village of Chengalpattu Taluk, Kanchpuran district, Tamilnadu. The Lands are part of Zamindhar Estate with a total extent of Ac cents and tow civil suits O.S.No.26 of 1899 and O.S.No.33 of 1923 clearly establishes the title and possession of the Choultry and Trustees. After the demise of the Raja Vasireddi Venkatadri Naidu and Smt.Venkata Laksmamma, their legal heir Sri. Raja Vasireddy Harihara Prasad succeeded as Trustee and held both Kudivaram and Melavaram rights on the property. In 1956, Sri Raja Vasireddi Harihara Prasad filed O.P.No. 81 of 1956 before the High Court of Madras to sell away the lands and the Court ordered for public auction. However, the said auction was cancelled on the request of hereditary Trustee as the rates were too low. During the Settlement and Survey, all the Zamindhar Estates were abolished under the Estate Abolition Act 1948 and all the lands fell to the then Madras State, becoming Government Property. On July 14, 1958, the then hereditary Trustee Sri.Raja Vasireddi Bhanu Gopal filed an application for grant of Ryotwari Patta under Section 10 (1) of the Estate Abolition Act 1948 and the Assistant Settlement Officer, Chengalpattu on July 19, 1958 rejected it as time barred. On filing Revision Petition to the Board of Revenue, by ref.(p1) 5914/65 dated January 25, 1966, the Trustee was directed either to file an appeal with the Estate Abolition Tribunal or file a petition with the Revenue Authorities for assignment of very same lands outside the Estate Abolition Act as he held both Kudivaram and Melvaram rights. The Trustee Sri. RVS Bhanu Gopal opted to claim assignment of lands and filed application with DRO, Kanchipuram and the DRO forwarded his petition for enquiry to the Thasildhar, Chengalpattu by LD 18405/67 dated June 21, 1967.

5 5 The Thasidhar after due enquiry and inspection of lands submitted a Report vide RC.No.10313/67 A2 dated September 26, 1969 to the District Collector, Kanchpuram and recommended for issue of Patta. Later in 1980 s the Sri Sadavarthivari Choultry was taken over by the Department of Endowment and since then the Government of Andhra Pradesh was pursuing the matter with the Government of Tamilnadu. Meanwhile, the lands were encroached by several people and the Government of Tamilnadu granted Patta s to third parties to an extent of cents. During 1998, one Mr.Satyanarayana Reddy vide Document No.3209 dated November 17, 1963 sold acres of land and registered to Vel s group of Educational Institutions by virtue of orders in C.S. No.180/98 of High Court obtained got registered. The then Congress Ministers for Endowment of Government of Andhra Pradesh Sri.JC Diwakar Reddy and Sri.Ponnala Laksmiah followed up the matter and even had meetings with their counter parts in Government of Tamilnadu. The then Chief Minister of Andhra Pradesh Sri.K.Rosiah had a meeting with the then Chief Minister of Tamilnadu and requested the Government of Tamilnadu to remove encroachers over the land and also issue Ryotwari patta for Ac cents. A file vide No /SSI//2006 was circulated and the Special Commissioner for Land Administration, Chepauk, Chennai dealt the issue in the file K1/18550/2006. The District Revenue Officer, Kanchipuram along with RDO, Chengalpattu and Thasildhar, Chengalpattu visited Thallambur Village inspected lands on May 29, The Thasidhar submitted report vide RC.1584/2010-B dated May 31, 2010 to the RDO, Chengalpattu and certified that the lands to an extent of Ac cents originally belonged to Raja Harihara Prasad. The Revenue Divisional Officer, Chengalpattu reported that the total extent of land Ac cents belonged to the Sri Sadavarthivari Choultry but only Ac cents are available for issue of Patta as the Government of Tamilnadu issued patta s to third parties and left the matter to the government to take a decision.

6 6 Status of Lands: The total extent of Land is Ac cents and the estimated value as on date is approximately Rs.5000 Cr. A note prepared by the Secretary, Revenue Department of Tamilnadu clearly shows that Ac was assigned to several individuals; Ac censt classified as government Poramboke and Ac cents is classified as Anaadheenam lands. Now the Sri Sadavarthivari Choultry is eligible to get Patta in respect of Ac cents as per Kanchipuram DRO s Report and that of RDO, Chengalpattu s report dated May 31, Request the Government of Tamilnadu to cancel the Patta s issued to the third Parties and take steps to initiate proceedings against the encroachers. Role of Trustee s: The role of Trustee s ended the moment the Department of Endowments has taken over Sri Sadavarthivari Choultry and its properties. Whatever steps to protect the lands have to be taken, the same were done by the erstwhile Trustees. The current legal heir Trustee Raja Vasireddi Sudha Swaroop is very keen to support all the initiatives in protecting the lands. Role of Government of Andhra Pradesh: It appears prima facie that serious steps were never taken by the Government of Andhra Pradesh to protect the lands from encroachers and to obtain the Pattas from the concerned Revenue Authorities. There is a serious negligence on the part of the Commissioner, Endowments department of AP from time to time. It is also observed during the past TDP Rule, never ever any officer or Minister concerned took initiative to protect the interests of the Sri Sadavarthivari Choultry and its lands. Instead they took initiative to sell away the lands at a throw away price to their sympathisers. Whatever was done to protect was done during the regime of Late Sri.YS Rajasekar Reddy by sending his Ministers for Endowment to Chennai to pursue the issue with their counter parts. Later the

7 7 then Chief Minister Sri.K.Roasiah garu also took personal initiative to protect the lands and hence there was a movement to the files. The Government of Andhra Pradesh appears to have engaged services of a Senior Advocate Sri. Uday Kumar of High Court of Chennai and pursuing the C.S.No.89 of 2015 relating to Ac cents land registered to Vel s group. Role of Government of Tamilnadu: The Government of Tamilnadu did not deal with the issue of Patta to the Trustees of Sri Sadavarthivari Choultry and kept pending it for more than 48 years. More over the Government has issued patta s to third party treating the land as Assessed Waste and created complex situations. Now the Government has to issue Patta not only to Anaadheenam lands of Ac cents BUT also cancel Patta s issued to third parties. As on date, the issue is pending for decision with the District Collector, kanchipuram. Role of Executive Officer, Sri Sadavarthi Choultry: Generally the practise in the Endowments department is to post an officer according to the cadre suitable to the status of the institution. In the present case a person who is not eligible to be posted as Executive Officer of Sri Sadavarthivari Choultry Trust was appointed initially as In-charge and later was promoted and retained in the same position to complete the task of selling the lands belonging to trust. His conduct from the day one is suspicious in nature and having sent proposal to sell away the total extent of Ac cents, he did not realise that permission to sell Ac cents was only granted. He held meetings with Advocates Uday Kumar of Chennai and Endowments Standing Counsel of Guntur District without taking any other Trustee into confidence. The permission granted to him was to sell the lands by Tender and Public Auction method and he failed to conduct the same in a fair and transparent manner. He did not give wide publicity to the auction at National level so as to attract the Multi

8 8 National Companies, IT companies in particular so as to fetch the market rate for the lands. He is well aware that the lands are located adjacent to the Information Technology Corridor and near to OMR, the developing area of Chennai. Major campus of Tata Consultancy Services (TCS) is located just in front of the lands. One ground of land in the vicinity is about Rs.80 lakhs to Rs.1.4 Cr making one acre of land to cost Rs. 10 Cr to 20 Cr per acre. All these factors are known to the Executive Officer as he has visited and held discussions with the former President of Thallambur Village and its elders including former Revenue Offcials. The fixing of reserved price is NOT done in a scientific manner and is fixed at Rs.50 lakhs, far below the guidance value. He had spent more and active time to dispose of the lands to a particular group of people. Pending Offers from Private Parties: The Executive Officer and the Endowments Department has complete knowledge of the proposal given by Sri.E.Sambandam, Madipakkam, Chennai for grant of lands on Joint Development basis vide letter dated January 17, 2013 offering approximately square feet per acre residential space worth Rs.1.5 Cr per acre fetching Rs.120 Cr for acres of land. Tender and Public Auction Process adopted: On Aug 18, 2014 a letter was written by Sri.Kommalapati Sridhar, TDP MLA to the Hon ble Chief Minister of Andhra Pradesh Sri.N.Chnadrababu Naidu proposing sale of lands immediately. On instructions from the Chief Ministers office on Dec 29, 2014, the Executive Officer writes to the Endowment Commissioner proposing sale of lands to an extent of Ac cents. On April 06,2015 GOAP vide Memo No.28228/Endowments.2/2014 grants permission to sell the lands of Ac cents by way of public auction in as where is condition to realise the best possible revenue and avoid further litigation and stating that it is beneficial to the institution. The Commissioner Endowments on April 08, 2015 issues Notification vide Notice

9 9 RC.No.M2/7151/2015 under Section 80 of Endowments Act. The same was published in Andhra Pradesh Gazette No.35 on A series of correspondence between EO, Sri Sadavarthivari Choultry and the Commissioner, Endowments without involving the Deputy Commissioner or the Joint Commissioner of Endowments Department took place through Letters No.A2/4/2014 dated Jun 10, 2015; Letter No.A2/4/2014 dated Jun 30, 2015;Letter No.A2/4/2014 dated Sept 29,2015. On Jan 06,2016 a meeting was held between Senior Counsel Sri.S.Uday Kumar, Chennai High Court, Standing Counsel of Endowments, Guntur and Executive Officer of the Institution on the matter. The Senior Counsel Uday Kumar submitted that the DRO, Kanchipuram submitted a report to the Chief Secretary, Government of Tamilnadu. It appears that he suggested to permit the EO of the Institution for sale of Ac cents in tender cum public auction in as is where condition under the supervision of Departmental Officers subject to imposing certain conditions. The Executive Officer submitted minutes of the meeting to the Commissioner, Endowments on Jan 31, 2016 vide Office Memo No. No.M2/7151/2006. On February 10,2016, the Commissioner of Endowments department accorded permission vide Proceedings M2/7151/2006 to the EO of Sri Sadavarthivari Choultry to sell land of Ac cents in Tender Cum Public Auction mode and that wide publicity be given. It is observed that the location of lands being in the middle of IT Industry and adjacent to OMR, the publicity required is of National Level. This could have fetched the real market value for the property. However, it is said that on Mar 12, 2016 Sale Notice was published in Tamil Paper DhinaThandi and in English in Times of India only in Chennai Editions. The Committee could not procure copies of the same. It is very doubtful whether the notice as published in Times of India. The tamil Paper Dhina Thandi is of less circulation and cannot be considered to give wide publicity. The notice could have been published in at least Four Leading dailies at national level and in three States of Andhra Pradesh, Telangana and Tamilnadu. The very fact that only eight members belonging to same family and friends circle participated in auction clearly indicates that NO information was disseminated about

10 10 the auction. It appears that NO E-auction tendering process is adopted violating the GOMS No. 424 (Revenue Endowments) of The auction was conducted on March 28,2016 for sale of Ac cents lands at Haathiramji Mutt School, Royapeta High Road, Chenna by the following officers: Joint Commissioner, Estates Division, Endowments, GOAP 1) Regional Joint Commissioner, ED Tirupati 2) Deputy Commissioner, Endowments Dept, Guntur. 3) Assistant Commissioner Estates, Endowments, GOAP The following bidders participated in auction: 1) M.Sanjeeva Reddy 2) M.Sunitha Reddy 3) Chavali Murali Krishna 4) Chavali Surya Kiran Mouli 5) Pavan Kumar 6) Ch.Lakshmi Parvathi 7) R.Sivarama Krishna Kishore 8) Ch.Niranjan Babu It has come to the notice of the Committee that Ch.Lakshmi Parvathi is the wife of Chairman Kapu Corporation Sri.Chalamalasetti Ramunujayya Ch.Niranjan babu is the son of Chairman Kapu Corporation Sri.Chalamalasetti Ramunujayya. R.Sivarama Krishna is the nephew of Chairman Kapu Corporation Sri.Chalamalasetti Ramunujayya. R.Sivarama Krishna and Ch.Niranjan Babu are friends and stayed together while staying abroad. Though Rs.50 lakhs per acre is the reserved price as decided by the Endowments Department, GOAP, Rs.27,00,188/- per acre is the highest bid received in the auction. Rs.22,44,12,625/- is the total price received for total extent of Ac cents. In normal course of events the auction process would have been cancelled as

11 11 the highest bid received was only 60% of the reserved price and as such a fresh bid with wide publicity would have been resorted to. Moreover the sale was confirmed to not just the highest bidder but to all those participated in the auction revealing that all the bidders are ONE formed ring hijacking the tender to a ransom. The circumstances reveal that there is connivance between the officers who conducted the bid and the bidders. It indicates a criminal conspiracy to defraud the government and make an illegal gain causing corresponding illegal loss to the Sri Sadavarthivari Choultry. Instead of recalling the tender and causing a fresh auction, the EO vide Lr.No.A2/4/2013 dated Apr 7, 2016 reported to the Commissioner Endowments that four tenders were received and after opening the tenders, public auction was conducted and Rs.27,00,188/- per acre was secured as highest bidder i.e., M.Sanjeeva Reddy & 7 others. Based on the same the Commissioner, Endowments issued proceedings No.M2/7151/2006 dated approved the sale. Now the matter is pending for registration. Preliminary Findings: Criminal Conspiracy-The motive behind the entire episode is to make illegal gain out of sale of Ac cents lands belonging to Sri Sadavarthivari Choultry in the most developing area of Chennai. The target was to make illegal gain of Rs.1300 Cr. The circumstances indicate that the main conspirator is the Hon ble Chief Minister Sri.N.Chandrababu Naidu along with his son Sri.Nara Lokesh Babu who kept MLA Sri. Komalapati Sridhar as their mask initiating the proposal to sell the subject lands. The conspiracy is to have Sridhar as front and also the so called bidders as another shield covering the transaction up to a certain level. How come the Hon ble Chief Minister with total 12 years experience as Chief Minister did not get the approval of the Council of Ministers in accordance with the AP Government Business Rules and Secretariat Instructions of In matters related to alienation of any land relating to government, the Chief Minister has to take the approval of the Council of Ministers and the Empowered Committee has to recommend the minimum price of the lands. When the value of lands is in about Rs.1300 Cr, why the proposal to sell away the lands is not taken up to

12 12 the Council of Ministers and why the Hon ble Minister for Endowments, CCLA, Principal Secretary Revenue, Principal secretary Endowments and the Chief Secretary are avoided. The Chief Minister signed on the letter submitted by the TDP MLA Sridhar and instructions or orders of the Chief Minister on the said letter became the basis for the sale of religious institutions without taking approval from the Council of Ministers. This only indicates that there is conspiracy between the Chief Minister, TDP MLA Sridhar, Sri.Chalamalasetti Ramunujayya, Chairman Kapu Corporation to make illegal gain out of sale of the lands causing corresponding illegal loss to the Government and the beneficiaries of the Sri Sadavarthivari Choultry. The matter ought to have been placed before the Governor of Andhra Pradesh. Violation of A.P. Government Business Rules and Secretariat Instructions of On a preliminary study, prima facie it appears that there is gross violation of the AP Government Business Rules and Secretariat Instructions. The factual matrix clearly indicate that the subject lands are an issue between two states; the lands are of Rs.5000 Cr as on date; admittedly litigation, encroachments and government of TN sanctions are required; more than two departments of Government of AP are involved. That being so, the following violations are found and require a detailed study: Business Rule 11(1) (a) (i) mandates that wherever there is grant of land effecting the finances of the state, No Department shall without the previous consultation with the Finance and Planning (Finance Wing) Department authorize any orders. In this case the total value of lands of Sri Sadavarthivari Satram as on date is Rs.5000 Cr and passing orders by the Commissioner, Endowments effecting the finances of the state mandatorily require previous consultation with the department of finance. Business Rules 9, 15 r/w Item No.15 of the Second Schedule mandates that any proposal involving alienation of sale of government property exceeding value of Rs.25 lakhs shall be placed for consideration of Council of Ministers. The lands of Sri

13 13 Sadavarthivari Satram as on date value approximately Rs.5000 Cr and any proposal of alienation of sale shall be placed before the Council of Ministers and in this case the same was not done. Business Rule 26 (1) mandates that any case concerning more than one department, no order shall be issued until it has been considered by all the departments concerned. In this case of lands of Sri Sadavarthivari Satram apart from Department of Endowments, the other departments including Finance and Revenue are concerned with the alienation of sale of lands valuing Rs.5000 Cr. Hence the file ought to have been circulated to department of Finance and Revenue. Business Rule 31 clearly states that in all matters where the state government is likely to enter into controversy with any other state, the same may be brought to the notice of the Governor. In these issues of lands of Sri Sadavarthivari Satram, the Endowments department has sold the lands which are in domain of Government of Tamilnadu and is likely to create controversy as the lands are still vested with the government of Tamilnadu. Hence the issue of selling the lands of Sri Sadavarthivari Satram ought to have been brought to the notice of Governor of Andhra Pradesh. In all cases which affect the relations of the state government with any other state government, the Business Rule 32 mandates that the it shall be submitted to the Chief Minister by the Secretary through the Minister in-charge before issue of orders. Admittedly the issue of lands of Sri Sadavarthivari Satram involves relations with government of Tamilnadu and as such the Endowments Commissioner before issuing orders would have sent the proposal to the Chief Minister through the Secretary and the Minister for Endowments. It is not clear whether the same has been done? Or the what orders Hon ble Chief Minister have passed? Or what has been submitted by the Secretary or the Minister for Endowments?

14 14 Land was NOT properly cleared by Government of Tamilnadu. The Lands originally had the Zamindhar character and during settlement and survey the same was abolished under the Estates Abolition Act of 1948 and subsequently the Trustees applied for assignment Patta of the lands claiming both melavaram and kudivaram rights. That application is pending for disposal even today. Since the Government of Tamilnadu treated the lands as Assessed Waste and issued assignment patta s to third parties, the Revenue Authorities are yet to take a decision at appropriate level. Unless the assignment patta is given in the name of Raja Vasireddi Harihara Prasad and his legal heir RV Sudha Swaroop, the Sri Sadavarthivari Choultry would not get proper title to sell the lands. Instead of pursuing the matter seriously and retrieve the lands or its market value, the TDP government choose to sell away the lands at a very nominal value citing its circumstances. It is very pertinent to mention that the issue is very similar to Simhachalam Devasthanam lands issue in Visaakhapatnam. A similar decision may be taken with respect to encroachments over the land. Permission of Hon ble High Court of Andhra Pradesh is mandatory. On November 22, 2005, the Hon ble Acting Chief Justice Sri.Bilal Nazki & Hon ble Justice R.Subash Reddy in WP No of 2005 (G.Prabhakara Acharyulu Vs. GOAP) of the Hon ble High Court of AP modified its order dated 7 th June 2005 to the effect that there is no restriction imposed by the Hon ble High Court for affecting sales of Endowments Lands by way of Public Auction. But according to Rule 18 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Alienation of Immovable Property Rules 1987, No land belonging to a Temple or Math can be alienated to anyone on a permanent basis except when the object of a charitable institution or endowment became obsolete, not necessary for the present day conditions and defunct, such institutions properties may be sold out in public auction. This Rule was brought in by a notification vide GOMS.No.424 (Revenue (Endowments-I) Department dated Nov 9, Under these circumstances, when the lands are of high value and when it is

15 15 very clear that the lands cannot be sold away, the permission of the Hon ble High Court is mandatory requirement. The process adopted during the Tender cum Auction sale is devoid of fairness and transparency. The decision taken by executive is arbitrary. The facts clearly establish that the entire sale episode violated Section 80 of the Endowments Act; violated the orders of Hon ble High Court in WP No of 2005; violated Rule 18 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Alienation of Immovable Property Rules 1987; violated the AP Government Business Rules and Secretariat Instructions and Doctrine of fairness and Transparency doctrine as enshrined by the Hon ble Supreme Court of India. The executive Officer is not the authorised officer to deal with any issue of the Sri Sadavarthivari Choultry as the Institution is having a net worth is more than Rs.25 lakhs and as such the total process of sale dealt by the Executive officer is vitiated and without any jurisdiction. The Executive Officer was permitted to sell the lands by way of Tender cum Public Auction and all procedure including GOMS.No.424 (Revenue (Endowments-I) Department dated Nov 9, 2015 are to be complied with. The Tender cum Public Auction was not given any publicity at all, much less wide publicity. There is NO e-auction method adopted and conducted not in the head quarters of Sri Sadavarthivari Choultry or at the head Quarters of Endowment Department or at a prominent place in Chennai. The fact that only eight persons ( all related to each other in one way or the other) participated in the public auction speaks volumes about the bias, arbitrariness and concealed methodology adopted so that the true value of the property is not realized. All in all, there is no fairness and transparency in the total procedure adopted to sell the lands in Thallambur of Chennai City.

16 16 The sale done was against the interest of Sri Sadavarthivari Choultry and brought a loss of Rs.1300 Cr. The lands of the Choultry are located in the most prominent developing area of Chennai City. It is in the area where multinational Information Technology companies like TCS and Accenture are operating massive campus. Several residential and commercial projects have been developed and sold. The prestigious Casablanca residential development is in the vicinity. The roads and infrastructure is in place. The going rate of residential place is Rs.3500/- per square feet and that of land is also very high. The guidance value of the lands is Rs.6.5 Cr per acre and the subject lands are roughly estimated to value Rs.1300 Cr. Selling away the lands at Rs.27 lakhs per acre is fraud on the Government and Sri Sadavarthivari Choultry is a put to a loss of Rs Cr. The fixing of reserved Price is not done by scientific methods and is fixed at a very nominal price of Rs.50 Lakhs as against a guidance value of Rs.6.5 Cr in the area. This itself reflects the mind of the executive officer and endowment commissioner to ensure illegal gains to the beneficiaries and huge illegal loss to the government. The Government of Andhra Pradesh ought to have continued the steps initiated by the previous governments to first clear the issue of proper patta s to the lands valued at Rs.5000 Cr and then conduct a detailed examination to deal with encroachments etc. The Hon ble Chief Minister should explain why he has not taken steps to conduct a detailed study in a comprehensive manner and ensure maximum realization of value to the property. The Hon ble Chief Minister should explain why he has not taken the issue to the Council of Ministers, Governor of Andhra Pradesh and avoided the involvement of Principle Secretary, Endowments and the Chief Secretary of GOAP.

17 17 All in all the preliminary study strongly indicates violations of AP Government Business Rules and Secretariat Instructions, the GOMS.No.424 (Revenue (Endowments-I) Department dated Nov 9, 2015 and orders of Hon ble High Court of Andhra Pradesh. The total episode indicates conspiracy between the Hon ble Chief Minister, Sri.M.Sridhar, MLA and Sri.Ch.Ramanjaneya and other officials and the issue requires a thorough probe by CBI as it involves two governments of two states. Moreover, the Ruling TDP government not only failed to protect the properties Hindu s sentiments and their endowments made in specific public interest but on the other it is actively pursuing to eliminate the historic symbols and sentiments of Hindu s both by destruction and elimination. In the process they are taking and making illegal gains of the endowment properties. The Fact Finding Committee would continue its work and shall examine all other records and shall submit a final report in near future. The Committee acknowledges the support of all the public spirited citizens and leaders of YSRCP during its visit to the Sri Sadavarthivari Satram and Thallambur in Chennai.
