Arunabai Shivsingh Pardeshi had filed a Petition, under affidavit, before the Commission on 29 April, 2013 seeking legal action under Sections 67(4), 142 and 149 of Electricity Act, 2003 (EA, 2003) for non-compliance with the provisions of Electricity Act, and MERC Order Case No. 60 of 2013 Page 1 of 13

2 Regulations made there under, and for non-payment of compensation while laying down transmission line in view of the liberty granted to the Petitioner to move the Commission in Case No. 11 of The Prayers of the Petitioner are as under: a) That it be declared the tower No.18 erected and installed by respondents in the land Gut No.101 of village Mahuli, Tq. Gangapur, Dist Aurangabad as illegal installation as it is installed without following due procedure of the law. b) That the respondents be also further ordered and directed to remove / demolish the said tower No. 18 at their own costs and risks within specified period. c) That the respondents be directed and ordered to pay the compensation amount of Rs.10,00,000/- (Rupees ten lakhs only) with penal interest of 18% to the Petitioner for the losses incurred since so many years and mental harassment caused from the date of installation of tower i.e. December d) The land used for the tower has not only finished the commercial potential of the said property but also agricultural productivity forever and in view thereof the petitioner prays that the monthly rent of Rs.30,000/- may be allowed to the petitioner till the tower remains in field. The petitioner also prays this amount may be paid to the petitioner from the date of installation of the tower i.e. from December e) While erecting and installation of the tower No. 18 the well of the petitioner has been damaged and destroyed and is dilapidated. It is also dangerous to install tower near a well, it being high tension line. It may lead to any accident. Considering the losses MSETCL should pay Rs.90,000/- as compensation with 18% interest from the date of installation of tower i.e. December 2010 for Damage of well. f) Forcefully entering in Petitioners land on with huge machinery with hundreds of workers and spoiled the land status. The illegal action of MSETCL also spoiled our image in the society, an amount of Rs.80,000/- may be granted as a onetime penalty. g) That the respondents be penalized for non compliance of regulations and provisions of law u/s 142 and 149 of the Electricity Act,2003 for the wrongs and illegal acts committed by them while installing and erecting of the tower in the land Gut No.101 of village Mahuli, Tq. Gangapur, Dist. Aurangabad knowingly and intentionally. h) That the petition may be allowed with costs and the respondents be ordered to pay costs of Rs.45,000/- (Forty five thousand) to the petitioner as she has incurred the legal fees expenses toward making application to MERC (2times) & District Magistrate Aurangabad. i) The Petitioner may be allowed additional penal compensation u/sec 67(5) of the EA, 2003 and approach towards affected persons. j) The Punitive cost may be levied to the MSETCL for their conduct. 3 3. The Petitioner made the following submissions: a) The Petitioner is a land owner and is in possession of an agricultural land bearing Gut No. 101 of village Mahuli, Tal - Gangapur, Dist. Aurangabad. The Respondent MSETCL had installed high voltage transmission line through his land, for the project known as 132 kv line from 132 kv Gangapur to 132 kv Vaijapur substation. b) The Petitioner further submitted that the Respondent MSETCL had violated the following provisions under EA, 2003 and caused loss to the Petitioner. i. Before execution of line work, MSETCL has not issued any notice/communication to the Petitioner that tower No. 18 of said line is to be erected on the land of the Petitioner. ii. After finding out from other farmers that the tower of transmission line is planned to be erected in (Gut No. 101) on Petitioner s land, before and after completion of the work, Petitioner had sent various legal notices to the Respondents through her Advocate and requested not to erect the tower on her land without prior consent and before the payment of compensation. iii. Respondent No.1 neither paid compensation nor replied to the notices and also damaged a well during the execution of the work. iv. Respondent No.1 had sent various letters with misleading facts to Gangapur Police Station and Superintendent of Police, Aurangabad which further caused inconvenience and harassment to the Petitioner. v. Erection of the Tower No.18 completed during the month of November /December, 2010 and stringing of conductor carried out with police protection on 10 June, 2011 without Petitioner s consent. c) As per the directives given by the Commission vide Order dated 27 March, 2012 in Case No. 11 of 2012, the Petitioner filed an application on 17 April, 2012 before the District Magistrate, Aurangabad. d) The District Magistrate heard the Petitioner but did not pass any Order with regard to compensation due to the Petitioner or against the actions of the Respondent, MSETCL. Hence, being aggrieved, the Petitioner filed the present Petition before the Commission. 4. Thereafter, the Commission vide Notice dated 14 May, 2013 scheduled a hearing in the matter on 28 May, 2013 and directed the Petitioner to serve a copy of the Petition to authorized Consumer Representatives. 5. As scheduled a hearing was held on 28 May, 2013 wherein the Commission heard both the parties. The Respondents submitted their replies, under affidavit, to the contentions made by the Petitioner which are summarized as under: i. The Respondent MSETCL is a valid licensee under Section 14 of the Electricity Act, 2003 which has been mandated with the work of erection and maintenance of EHV substations and lines for better transmission of the power and to improve the voltage profile. 4 ii. The Government of Maharashtra(GOM) vide Order No. 280 dated 24 August,2006 issued by the Secretary to Govt. of Maharashtra, Industries, Energy and Labour Dept. Mumbai conferred the powers of Telegraph Authority as per provision of Indian Telegraph Act, 1885 under Section 164 of the Electricity Act 2003 to the Respondent for laying of transmission lines. iii. The board of directors of the Respondent had sanctioned the scheme for construction of 132 kv Gangapur-Vaijapur transmission line vide MBR No. 34/4 on 4 October, 2008 and the said work was awarded to to private agency M/s KEC International Ltd. iv. After the detailed survey of fixing the lay out, the Right of Way proposal demonstrating the indicative Gut numbers that would be affected was submitted to the District Magistrate, Aurangabad on 27 December, v. The sanction of the Gangapur-Vaijapur 132 kv line was published in the official gazette on 30Augest, vi. Before staring the work on the transmission line, MSETCL s officer personally approached the Petitioner s husband on 27 September, 2009 and on 16 October, 2010 respectively. The Respondent and the husband of the Petitioner were present at the site of tower location No. 18 at (Gut No.101). vii. As per the request of the Petitioner, proposed location of the tower was shifted to the corner of the land and away from the well and Petitioner s husband agreed for erection of the tower only after the MSETCL agreed to use their resources to clear the piles of the rock at the site. Accordingly, Respondent removed the debris from the land of the Petitioner and after consent; foundation work started on 20 October, 2010 and was completed on 1 November, Subsequently, erection work of tower started on 6 November, 2010 and was completed the next day, 7 November, viii. The compensation demand raised by the Petitioner through notices was exorbitant and against the provision of the law and is not justifiable. ix. As per the Works of Licensee Rules 2006 Clause (2) Where any difference and dispute arises as to the amount of the compensation determined under the sub clause (1) the matter shall be determined by the appropriate Commission. Therefore, the Petitioner has no right to file this Petition before the Honorable Commission unless and until the matter is decided by the District Magistrate. x. The work of the erection of the tower was carried out with the consent of the Petitioner s representative and thereafter, the Petitioner opposed the work of the stringing of the conductor, hence the Respondent had taken the help of the police to complete the balance of work with permission of the concerned police officer. xi. As per the directives of the Commission in the Order dated 27 March, 2012 in Case No. 11 of 2012 Respondent No. 1 filed an application for determination of the amount of compensation before the Sub Divisional Magistrate (SDM or Dy. Collector), Vaijapur. Thereafter, on 9 May, 2012, SDM, Viajapur, vide Order no. 2012/406, decided the compensation for damages as per the directives of the Government of Maharashtra Resolution No dated 1 November, 2010, wherein the SDM is the competent authority to decide compensation for the category of dry, non-irrigated agricultural land. The compensation amount for damages decided by the SDM as per the said Government MERC Order Case No. 60 of 2013 Page 4 of 13

5 rules was Rs.2293/- taking into account 0.84sq.m of land at the rate of Rs per sq.m. as notified by the Government. xii. Thereafter, the Executive Engineer, MSETCL, EHV Construction Division, Aurangabad (Respondent No.1) vide letter No dated 11 May, 2012, issued the cheque No dated 10 May, 2012, of Rs. 2293/- as a compensation for the damages. xiii. However, the Petitioner refused to accept the said cheque for the compensation amount decided by the SDM, issued by the Respondent No. 1. Therefore, the Petitioner is not entitled to pray for compensation. xiv. The Respondent No.1 had carried out the works as per the powers conferred under Indian Telegraphic Act 1885, which are delegated by the Government of Maharashtra to the Respondent MSETCL, hence the Prayers of the Petitioner mentioning that the works carried out is illegal, not following the provisions of the Acts, forceful entry in the field/farm and caused losses, are invalid. 6. After hearing the parties and considering the material placed on record, the relevant factual aspects are clear from the following: i. MSETCL s Letter dated 18 April, 2011 addressed to Sub-Divisional Magistrate, Vaijapur in pursuance of determination of compensation is attached as an Annexure A (in Marathi & translated in English) ii. Considering the importance of the work, Sub Divisional Magistrate, Vaijapur instructed through its letter dated 28 April, 2011 Tahsil Magistrate, Gangapur and Police Inspector, Police station, Gangapur to provide police protection to carry out the works with a copy of letter to the District Magistrate, Aurangabad. The same is attached as Annexure B (in Marathi & translated in English) iii. In pursuance to the directives of the Commission in its Order dated 27 March, 2012 in Case No. 11 of 2012, Respondent No. 1 had once again approached to the Sub-Divisional Magistrate for determination of compensation to be paid by MSETCL to the Petitioner. iv. As per the directives of the Government of Maharashtra Resolution No dated 1 November, 2010 SDM is the competent authority for determination of the Compensation for agriculture land other than irrigation (dry land) and irrigated land. v. The Extract of the Government of Maharashtra Resolution elaborating the guidelines and the competent authority to determine the compensation amount is attached as Annexure C for ready reference. vi. On the basis of Government of Maharashtra resolution and rates provided by the Sub Registrar, Sub-Divisional Magistrate, Vaijapur through its Order dated 09 May, 2012 has decided the compensation. The Order is attached as a Annexure D (in Marathi & translated in English) 7. The Hon ble High Court of Judicature at Bombay, Nagpur Bench held in Writ Petition No. 256 of 2012 and others by its order and judgment dated 22 March, 2012 that once an authorization has been granted to a licensee under Section 164 of the Electricity Act, 2003, no consent or permission of the owners and occupiers are required to be obtained. 6 Hon ble High Court held that it is obvious that after such authorization under Section 164 of the Act 2003, the transmission company is bound to exercise the powers of a Telegraph Authority in respect of placing telegraph lines and posts for the purpose of erecting an electric line for the transmission of electricity. These powers are found in Part III of the Indian Telegraph Act, 1885 vide Sections 10 to 16. None of these provisions provide for obtaining consent of an owner or occupier of the land. 8. The Respondent has submitted that Government of Maharashtra ( GoM ) vide Order No. 280 dated 24 August, 2006 issued by the Secretary to Govt. of Maharashtra, Industries, Energy and Labour Dept. Mumbai conferred the powers of Telegraph Authority as per provision of Indian Telegraph Act, 1885 under Section 164 of the Electricity Act, 2003 on the Respondent MSETCL for laying of transmission lines. Hence, the Commission does not find any merit in the prayer of the Petitioner that a) That it be declared the tower No.18 erected and installed by respondents in the land Gut No.101 of village Mahuli, Tq. Gangapur, Dist Aurangabad as illegal installation as it is installed without following due procedure of the law. No consent was required to be obtained by the Respondent from the Petitioner as Section 164 of Electricity Act, 2003 authorization does not require such consent to be obtained. Accordingly, the prayer made to remove / demolish the said tower No. 18 is also dismissed. Consequently, the prayers to seek penal action u/s 142 or 149 are also dismissed. As regards compensation, in the present case a compensation amount of Rs 2293/- has been determined by the SDM in accordance with the aforesaid GoM Resolution No 0210 dated 1st November The Commission does not find the same to be inadequate or unlawful. Hence, the Commission is not inclined to interfere in the matter of the quantum of compensation granted. In view of the above, Case No 60 of 2013 stands disposed of. Sd/- Sd/- Sd/- (Smt. Subject :- Assessment and determination of the Compensation for the loss caused to the farm land due to erection of the MSETCL tower. Reference: 1) Govt. Resolution No Misc.210 / CR No. 29/Energy -4/ Dated 01/11/2010 2) LOA No. MSETCL/CO/CE/TR.TROJ/EPC/LL1-B/11697 Date 27/08/2009 Sir, With reference to the above subject, this is to inform you that the work of the 132kv line connecting the 132kV sub-station at Gangapur and 132kV sub-station at Vaijapur is in progress. The tower No 18 of the same line is erected in field of the Mrs. Arunabai Shivsing Pardeshi R/o of Mahuli, Tal. Gangapur in the farm Block No All the lines at this place are elongated for the stringing purpose. Some part of the land in Block No. 101 in the gala between tower No 18 to 19 is in possession of the Mrs. Sangitabai Dilipsing Pardeshi and no electric tower is erected in her land. Only over head lines are going to pass over the land through the above Tower. Even then she is strongly opposing this work. No loss is caused to the crop during erection work of the tower or stringing of the lines because the tower is at a place where there is no crop. At the time of the stringing of the lines, crop in the span between 18 to 19 was removed. You are, therefore, requested to inspect and evaluate loss caused to the farm land of the said farmer due to erection of the tower and evaluate the loss as per the Reference No. 1, so that compensation can be paid to the farmer easily. If the appropriate action is taken expeditiously in the above matter, the work will not be blocked in the ensuing rainy season. Hence, you are requested to take the action in the matter without delay.
