AGENDA TEM #2(b) - PRESENTATONS Ms. Terry Dow Toursm Coordnator was n attendance to announce the wnners for the 2010 Santa Claus Parade floats and bands categores to present them wth ther awards. The wnners are: Best Marchng Band - Burlngton Teen Tour Band Best Band - PK Hummngbrd Steel Drum Band Best Commercal Float- Fascnaton Dance Studo Best Thorold Entry - Protecton Host Company # 1 Best School - Prnce of Wales Elementary School and Best Non-Thorold Entry - Nagara Shrne Club. The Mayor extended thanks and congratulatons to all the wnners. AGENDA TEM #2(c) - DELEGATONS 1. Henry D'Angela Regonal Councllor Regonal Muncpalty of Nagara was n attendance to provde hs regonal report;. Councllor D'Angela congratulated the new Councl on wnnng seats and looks forward to workng closely wth them over the next four years. Councllor D'Angela provded Councl wth nformaton on the many commttees he and Mayor Lucan wll be sttng on and these nclude Polce and Housng Servces Boards.. Councllor D'Angela also provded an update on the 2011 Regonal Budget exercse. At ths tme the tax levy s 1.15% wth a 1.4% growth the regonal tax levy s 0.25% tax levy after growth (unapproved at ths tme). Councllor D'Angela advsed of all the ssues they wll be facng n terms of polce servces board budgets and other boards ncreases. There s a provncal upload whch wll assst to keep the levy down.. Councllor D'Angela provded an nformaton update from the Arteral Road Revew Report. Merrtt Road (a secton) St. Davds Road from Hghway 58 to Coller Road and Ormond Street are beng uploaded to the regon as well staff have been workng on ths however t wll take tme before ths transfer occurs. Street lghtng s an ssue for these areas that wll be addressed. A stop sgn on Tupper Drve Barbcan Tral and St. Davd's Road was an ssue for a resdent; unfortunately t s not a regonal road therefore Councl may want to consder ths. For Councl's nformaton at ths tme there are plans for a proposed walkway on St. Davd's Road.. Councllor Tmms dd not menton amalgamaton nor dd he menton forced amalgamaton. He talked about a new governance model. He wll provde an update to Councl ths evenng. Councllor D'Angela does support a model such as ths but does not support amalgamaton. C11/02 February

Councl wll ask staff to prepare a report. 3. Bruce Tmms Regonal Councllor Regonal Muncpalty of Nagara was n attendance to dscuss the ssue of regonal government reform whch would further ntegrate Muncpal and Regonal governments by re-consderng a moton that went before Regonal Councl last year (Councllor Wlson's) to revew the Halton Model of governance whch provdes for Councllors 'dong double duty' at both Regonal and Muncpal meetngs. Accordng to Councllor Tmms ths would provde a transton and ntegraton of both levels of government that at present does not exst. Councllor Tmms responded to questons from CouncL. For the purpose of ths By-law: Part 1- Defntons 1.1 "Agent" means a Person authorzed by the Corporaton to provde servces on behalf of the Corporaton; or a Person authorzed by an Owner to provde servces on behalf of the Owner as applcable. 1.2 "Appurtenance" means the apparatus or equpment that s an accessory to the Sewer Works system or to the Dranage Works system ncludng Muncpal Laterals and ther components or an accessory to Prvate Laterals or to Prvate Sewage Collecton Systems or to a prvate Dranage or Stormwater Management system. 1.3 "Backflow" means flow reversal from the ntended normal drecton of flow. 1.4 "Backflow Preventon Devce" means a valve or other apparatus whch allows flow n one drecton but prevents flow n the opposte or return drecton. 1.5 "Blank" or "Blankng" means the temporary or permanent decommssonng of a ppe by means of pluggng cappng or other method approved by the Engneer. 1.6 "Buldng".means any permanent structure traler or other coverng whch s located on a parcel of and havng frontage or whch abuts on a publc hghway and/or the Sewer Works and/or the Dranage Works and whch: a) contans or s requred by any other by-law regulaton or statute to contan any permanent sleepng eatng or food preparaton facltes; or b) contans or s requred by any other by-law regulaton or statute to contan any washng or tolet or cleanng facltes; or c) s connected or s requred by any other by-law regulaton or statute to be connected to a water supply system or a sewage collecton system or to the Water Works and/or the Sewer Works and/or the Dranage Works; or d) s a source of Sewage; or e) s habtable. 1.7 "Buldng Dran" means the lowest horzontal ppng ncludng any vertcal offset that conducts Sewage by gravty to a Buldng Sewer. 1.8 "Buldng Sewer" or "Prvate Sewer Lateral" means the ppes and Appurtenances ncludng the nspecton Tee provdng a connecton to the Sewer Works located between the property lne or the nspecton Tee and one (1.0) metre from the outer faæ of the Buldng foundaton; or between the propert lne and a Prvate Sewage Collecton System. 1.9 "Catch Basn" or "Catch basn" means a receptacle nstalled to collect surface water from an open area for Dranage nto the Dranage Works and to trap solds by means of a sump wthn the Catch Basn "Chef Buldng Offcal" means a chef Buldng offcal and such nspectors as are apponted by the Corporaton necessary for the enforcement of The Buldng Code Act and any other statutes referred to n ths By-law and all Persons authorzed at the drecton of the Chef Buldng Offcal for the purposes of exercsng the power and dutes of the Chef Buldng Offcal under ths By-law "Combned Sewer" means a Sewer nended to functon smultaneously as a Santary Sewer and a Storm Sewer "Connect" means to nstall a Sewer Servce Connecton or a Dranage Servce Connecton ncludng laterals and lateral Appurtenances "Consumer" means the occupant of the Premses suppled wth muncpal Sewer collecton servces or muncpal Storm Water Dranage servces under the jursdcton of the Corporaton "Corporaton" means The Corporaton of the Cty of Thorold "Corporaton Standards" or "Standards of the Corporaton" means all applcable desgn manuals techncal standards drawngs specfcatons and gudelnes of the Engneerng and Publc Works Department and the Pannng and Buldng Servces Department adopted by the Corporaton from tme to tme governng the constructon admnstraton operaton mantenance repar replacement and/or rehabltaton of the Water Works Sewer Works and Dranage Works. 3

63 "Cost" means the expenses and costs of work done on and for the Sewer Works or Dranage Works and n the makng nspectng mantanng reparng or replacng a Servce Connecton ncludng: a) permts and approvals b) desgn c) materals d) abour e) restorng any propert dsturbed or damaged f) supervson and nspecton of any work. g) studes evaluatons and nvestgatons and ncludng the amount of fees and expenses charged by the Corporaton to the Owner when the Corporaton makes a Servce Connecton at the expense of the Owner "Councl" means the Muncpal Councl of the Corporaton of the Cty of Thorold "Customer" means any Person Owner frm busness corporaton nsttute or dentty that enters nto a verbal or wrtten contract or agreement wth the Corporaton to receve Santary Sewer collecton servces or Storm Water collecton servces "Drector of Fnance" or "Treasurer" means the Drector of Fnance for the Corporaton or any Person or Persons apponted or desgnated by the Corporaton from tmeto tme for the purposes of exercsng the powers ór dutes of the Drector of Fnance under ths By-law "Dscharge" means to release or emt Sewage or other waste lqud or Storm Water or Dranage water "Dtch" or "Dranage Dtch" means a constructed open channel desgned to convey Storm Water or Dranage Water from tme to tme; and where constructed as part of a roadway desgned to dran the road sub-base "Dran" means a Dtch Swale channel water course ppe and/or Storm Sewer that collects and carnes storm ground surface or subsurface water or any of them or part thereof ether contnuously or ntermttently and ncludng Appurtenances such as Manholes Catch Basns culverts and nterceptors "Dranage" or "Dranage System" means a natural or constructed means of nterceptng collectng and removng Storm Water or surface or subsurface Dranage Water usually by gravty flow "Dranage Servce" means a system of ppes and/or Dtches and/or Drans and requred Appurtenances of the Dranage Works desgned to collect and transmt Storm Water and water to an approved Dranage Outlet 1.25 "Dranage Servce Connecton" means a Muncpal Dranage Lateral and connected Prvate Dranage Lateral ncludng requred Appurtenances connected to and dschargng nto the Dranage Works; or a ppe connectng a prvate Storm Water collecton or management system to the Dranage Works "Dranage Watet' means water orgnatng from ran storm or ground sources or from the meltng of snow or ce that s drawn off or away from a Buldng and the lands on whch the Buldng s bult to the Dranage Works or to an approved Outlet "Dranage Works" means any and all storm Sewers Buldngs structures equpment Appurtenances devces conduts underground ppelnes Muncpal Dranage laterals Dtches watercourses and Muncpal Drans and Outlets created under the Dranage Act and related nstallatons and other works of the Corporaton desgned for the collecton and transmsson of Storm Water or Dranage Water; and ncludes lands over whch an easement or consent has been granted or lands approprated for such purposes and use. 4

64 ; 1.28 "Engneer" means the Drector of Engneerng and Publc Works or the Person or Persons apponted or desgnated by the Corporaton from tme to tme for the purposes of exercsng the powers or dutes of the Engneer under ths By-law; or the Engneer's duly authorzed representatve or as the stuaton or context may requre all Persons authorzed at the drecton of the Engneer to exercse the powers and dutes of the Engneer under ths By-law. _ 1.29 "Extraneous Flow" or "nflow and nftraton" means the undesrable nfltraton of groundwater and/or the undesrable uncontrolled nflow of Dranage or Storm Water nto a Santary Sewer Servce Connecton or nto a prvate Sewer Collecton System or nto the Sewer Works "Foundaton Dran" means Dranage ppng nstalled below the surface of the ground to collect and convey water away from a Buldng foundaton nspecton" or "Complance nspecton" means any physcal or vsual audt or examnaton survey samplng and testng test or nqury "nspecton Tee" means a vertcal ppe connecton to ground level placed on a Prvate Sewer Lateral at or near the propert ne and provded wth a removable cap at ground level constructed for the purpose of nspectng and evaluatng the Sewage flow n the Sewer Servce Connecton "nterceptor" means a receptacle nstalled to collect and prevent ol grease. petroleum products grt sand and/or other materals from passng nto the Sewer Works or Dranage Works "Leachate" means water contamnated by dssolved or suspended materals as a result of- percolaton through contamnated ground sol and/or sold waste or ndustral waste "Man" means any ppe collectng and transmttng Sewage as part of the Sewer Works or Dranage or Storm Water as part of the Dranage Works under the jursdcton of the Corporaton and/or the Regonal Muncpalty of Nagara and ncludes all Appurtenances exclusve of Servce Connectons "Mantenance Hole" means a juncton chamber for Mans and for Servce Connectons of the Sewer Works or Dranage Works or of a Prvate Sewage Collecton System or Prvate Dranage System desgned to permt access for nspecton and mantenance purposes and for the takng of Sewage or Storm Water or Dranage Water samples "Multple Resdental Dwelng" or "Multple Resdence" or "Multple Resdental Premses" means a Buldng or Premses havng four (4) or more lvng unts or sutes or apartments "Muncpal Dran" means a constructed watercourse created by by-law of the Corporaton under the Dranage Act for the purposes of Dranage of lands desgnated by the establshng by- law "Muncpal Dranage Lateral" means the ppes and Appurtenances of the Dranage Works located wthn the Rght-of-Way and stuated between the Man and the property lne provdng the connecton of a Prvate Sewer Lateral to the Dranage Works "Muncpal Lateral" means the ppes and Appurtenances of a Muncpal Sewer Lateral or a Muncpal Dranage LateraL "Muncpal Sewer Lateral" means the ppes and Appurtenances of the Sewer Works ocated wthn the Rght-of-Way and stuated between the Man and the propert lne; or up to but not ncludng the nspecton Tee "Operatot' means a Person or Persons who s the manager and/or admnstrator or Agent responsble for use actvty or process wthn a Buldng or faclty or Premses servced by the Sewer Works or Dranage Works "Outlet" or "Dranage Outler means a locaton at whch Storm Water or Dranage Water s dscharged nto a Storm Water Management System watercourse or natural stream or lake "Owner" means any Person or Persons who or any frm busness corporaton or nsttute that s the regstered Owner of land or a Buldng or Buldngs or Premses under consderaton or any Agent or Contractor or Bulder thereof or a Person enttled to a lmted estate n the propert a trustee n whom the propert s nvested an executor an admnstrator and a guardan to whom the context apples. 5

65 !! 1.45 "Person" or "Consumet' means any ndvdual frm corporaton partnershp Owner Customer or Operator "Premses" means a Buldng or faclty ncludng assocated lands or lands abuttng on a Rght-at-Way wthn whch a Man or Dtch or Dran s constructed "Pnvate Dran" means a Dran located on prvate property; a Dran whch s prvately owned "Prvate Lateral" means a Prvate Sewer Lateral or a prvate Dranage Lateral "Prvate Dranage Lateral" means the Dranage ppes and Appurtenances provdng a connecton to the Dranage Works located between the propert lne and one (1.0) metre from the outer face of the Buldng foundaton or between the property lne and a Prvate Dranage System "Prvate Dranage System" means a prvately owned network of Storm or Dranage Water Dtches Swales collecton ppes Mantenance Holes nterceptors and Catch Basns and Appurtenances dschargng to the Dranage Works or other approved Outet "Prvate Sewage Collecton System" means a prvately owned network of Sewage collecton ppes Mantenance Holes nterceptors and Appurtenances servcng two or more Buldngs dschargng to the Sewer Works "Prvate Sewer Lateral" or "Buldng Sewer" means the ppes and Appurtenances ncludng the nspecton Tee provdng a connecton to the Sewer Works located between the property lne or the nspecton Tee and one (1.0) metre from the outer face of the Buldng foundaton: or between the propert lne and a Prvate Sewage Collecton System "Prvate System" means a Prvate Sewage Collecton System or a prvate Dranage System "Rates" means those Rates leves rents or charges for the supply and/or use of muncpal water or Sewers so descrbed and temzed n by-laws enacted by the Corporaton from tme to tme "Regonal Man" means a ppe transmttng Sewage Dranage or Storm Water under the jursdcton of the Regona Muncpalty of Nagara and ncludes all assocated Appurtenances exclusve of Sewer Servce Connectons "Rght-of-Way" means ands acqured for or devoted to a publc hghway lane or easement n whch a Man s located "Santary Sewet' means a system of ppes Mans and Appurtenances of the Sewer Works for the collecton and transmsson of Sewage; and nto whch Storm Water Dranage Water and ground water are not ntentonally dscharged or admtted 1.58 "Santary Sewer Master Plan" means the latest verson of the strategc plan governng the management and development of the Sewer Works approved by and as amended by Councl from tme to tme "Servce Connecton" means a Muncpal Servce Lateral and the connected Prvate Servce Lateral and requred Appurtenances formng a dscharge connecton to ether the Sewer Works or the Dranage Works "Sewage" or "Wastewatet' means anyone of or a combnaton of domestc santary Sewage and/or water borne waste and/or non-domestc santary Sewage and/or water borne waste dscharged from resdences busnesses recreatonal facltes nsttutons or ndustry "Sewer" means a Santary Sewer or ppe or Man of the Sewer Works; or a Storm Sewer or a ppe or Man of the Dranage Works "Sewerman" means a Sewage collecton and transmsson ppe or Man of the Sewer Works "Sewer Servce Connecton" means the Muncpal Sewer Lateral and the connected Prvate Sewer Lateral or a ppe connecton from a Prvate Sewage Collecton System to the Sewer Works. 6

66 1.64 "Sewer Works" means any and all Buldngs structures equpment Appurtenances devces conduts underground ppelnes Muncpal Sewer Laterals Outlets and related nstallatons and other works of the Corporaton desgned for the collecton and transmsson of Sewage and ncludes lands over whch an easement or consent has been granted or lands approprated for such purposes and use "Sludge" means Sewage of hgh concentraton a heavy thck depost sedment or mass or the precptate from a Sewage or septc tank "Storm Dran" means a condut ppe Dtch Swale or watercourse constructed to carry away Storm Water or surface water or Dranage water by gravty flow to a stonn Sewer or Outlet "Storm Sewet' means a Storm Water and/or Dranage water collecton and transmttal Man ppe Dtch and/or watercourse or combnaton thereof ncludng Appurtenances formng part of the Dranage Works UStorm Water" or UStormwate( means surface or ground water from ranfall or snowfall or other natural precptaton or from the meltng of snow or ce; naturally occurrng water collected and carred n the Dranage Works "Stonn Water Leadet' or "Downspout" means a ppe or system of ppes nsde or outsde a Buldng that conveys Storm Water from a roof of a Buldng or structure to an approved place of dscharge "Storm Water Management" means dranage control practces and constructed works mplemented to protect propert and natural or constructed watercourses and recevng waters from SlormWater mpacts "Storm Water Master Plan" means the latest verson of the strategc plan governng the management and development of the Dranage Works as approved by and as amended by Councl from tme to tme "Swale" means a vegetated open channel desgned to control the transport treatment and storage of Storm Water or Dranage water "Uncontamnated Watet' means potabe water as suppled by the Corporaton's Water Works or untreated water wth a level of qualty typcal of potable water as defned by regulatons under the Safe Water Drnkng Act "Watercourse" means an open channel Swale or Dtch constructed as or resultng from the constructon of a work n whch a flow of Storm Water or Dranage Water occurs ether contnuously or ntermttently ncludng roadway Dtches and ncludng naturally' occurrng depressons channels or streams Dranng nto any such open channels Swales or Dtches whether formng part of or connected to the Corporaton's Dranage Works or formng part of a prvate Dranage or Stormwater Management System; and ncludng Appurtenances "Water Servce Connectonn means the ppes conveyng potable water to a Buldng or Premses from the Water Works or a prvate source of water "Water Works" means any and all Buldngs structures equpment Appurtenances devces conduts underground ppelnes muncpal water laterals Outlets and related nstallatons and other works so desgned for the dstrbuton of water and ncludes lands over whch an easement or consent has been granted or lands appropnated for such purposes and uses. 7

67 2.1 GENERAL Part - Admnstraton Ths By-law apples to the constructon management and use and to the operaton mantenance repar and rehabltaton of the Sewer Works and Dranage Works under the jursdcton of the Corporaton Santary Sewer servce areas and Storm Sewer servce areas covered under ths bylaw are as dentfed n the Corporaton's Offcal Pan and supportng nfrastructure Master Plans and area specfc servcng plans as approved by Councl through by-law adopton from tme to tme The Corporaton shall manage and mantan the Sewer Works and the Dranage Works n accordance wth the provsons ths Bylaw and the provsons of the Muncpal Act the Ontaro Water Resources Act the Dranage Act the Federal Fsheres Act the Ontaro Buldng Code and regulatons standards and gudelnes establshed under these Acts from tme to tme and any other applcable law or regulatons. 2.2 ADMNSTRATVE RESPONSBLTES Admnstratve responsbltes are as follows: a) The Engneer has overall responsblty for the enforcement of ths By-law and for admnstraton operaton mantenance repar and rehabltaton of the Sewer Works and Dranage Works n accordance wth ths By-law and all other applcable legslaton. b) The Chef Buldng Offcal s responsble for the enforcement of the Ontaro Buldng Code and the ssuance of any plumbng permts or orders related to the constructon mantenance operaton repar and renovaton of any part of the BUldngs and facltes served by Sewer Works Dranage Works and Water Works; and for the nspecton of work done under plumbng permts or orders. 2.3 PRNCPLES The followng prncples shall apply to managng and operatng the Sewer Works and the Dranage Works: a) Although best efforts wl be made to provde adequate servces the Corporaton does not guarantee the collecton of Sewage or Dranage water and falure to provde Sewage or Dranage Water collecton servces shall not be construed as neglect on the part of the Corporaton. The Corporaton shall at no tme be held lable for the nadequaces of such servces or for restrctng the provson of such servces or for refusng to provde such servces. b) Through the effectve management of the Sewer Works and the Dranage Works the Corporaton wl endeavor to ensure the health and safety of the publc to protect propert from damage to provde polluton preventon and control and to protect the envronment. c) Ths By-law shall govern and regulate the management and operaton of the Sewer Works and the Dranage Works and connectons thereto and shall be consdered to form an ntegral part of the servce contract between the Corporaton and any Owner Operator or Customer for the provson of such Sewage collecton servces or Dranage servces. Every Owner Operator or Customer by applyng for and acceptng the provson of servces from the Corporaton shall be deemed to have expressed hs/her consent to be bound by the provsons of ths By-law. d) Recommendatons contaned n the latest revson of the Santary Sewer Master Plan and he Storm Sewer Master Plan and area specfc servcng plans as adopted by the Counc by by-law from tme to tme shall be mplemented as approprate subject to resources lmtatons through the annual budgetng process. 8

68 ! : The followng crtera shall be consdered when determnng and/or evauatng the prortes of captal projects for the Sewer Works and Dranage Works: a) Defcences n satsfyng regulatory requrements;.e. Santary Sewage leakage Sewage overfow restrctons Dranage Water qualty crtera. b) Defcences due to physcal defects and condtons;.e. frequency of repar repar cost hstory hgh level of nnow and/or nftraton matera condton utlty locaton. c) Defcences due to nadequate capacty;.e. nablty to handle exstng or predcted flows repeated occurrences of floodng. d) Defcences n supportng development opportuntes;.e. unable to servce potental commercal/ndustral customers economcally vable expanson of the customer base. e) Defcences n other assocated muncpal nfrastrcture;.e. road water dstrbuton system defcences ntatves should be deveoped and mplemented to reduce Extraneous Flows. 2.4 DESGN AND CONSTRUCTON Combned Sewers are prohbted All extensons rehabltatons and replacements to the Sewer Works and the Dranage Works shall be desgned and constructed n accordance wth current standards and gudelnes establshed by the Ontaro Mnstry of the Envronment and by the Corporaton unless otherwse approved n wrtng by the Engneer Sewage collecton servces and Storm Water Management and Dranage system servces for new subdvsons shall be planned desgned and constructed n accordance wth the current verson of the corporate standards unless othewse approved n wrtng by the Corporaton The Engneer n consultaton wth the Chef Buldng Offcal and staff of the Operatonal Plannng and Development Servces Department shall establsh and perodcally update standards gudelnes and specfcatons governng the desgn. constructon operaton mantenance repar and rehabltaton of the Sewer Works and Dranage Works. 2.5 CRTCAL OCCURRENCES Where a crcumstance or condton arses that threatens the health and safety of the publc. or threatens prvate or publc property. the envronment the Sewer Works and/or Dranage Works the Engneer shall take all remedal measures necessary to expend the necessary resources to protect publc health prvate or publc propert the envronment and/or the Sewer Works and/or Dranage Works and shall report to Councl on the actons taken and.the resources utlzed as soon as practcable. 9

69 Part - Santary Sewer and Dranage Servce COnnectons 3.1 APPLCATON FOR SERVCE No excavaton shall be undertaken no ppe shall be connected to or provded from the Sewer Works or the Dranage Works; and no ppe shall be replaced relocated dsconnected or removed from the Sewer Works or the Dranage Works wthout the pror wrtten approval of and under the supervson of the Engneer All Servce Connectons to the Sewer Works and the Dranage Works and all replacements to relocatons of dsconnectons or removals from the Sewer Works or Dranage Works requre pror approval through wrtten applcaton and the ssuance of a permt therefore by the Corporaton An Owner shall pay all appcabe fees and charges for the supply nstallaton. replacement relocaton or dsconnecton of Santary Sewer Servce Connectons and Dranage Servce Connectons as prescrbed by CouncL The applcaton and permt referred to n Subsecton shall be n the form as may be prescrbed by the Corporaton from tme to tme n order to be granted a permt to connect to the Sewer Works a Budng Premses or faclty must be wthn a Sewer servce area as defned by the Offcal Plan of the Corporaton as amended and must have frontage or t1ankage abuttng a Sewerman of the Sewer Works n order to be granted a permt to connect to a storm Sewer of the Dranage Works a Buldng Premses or faclty must be wthn a storm Sewer servce area as defned by the Offcal Plan of the Corporaton as amended and must have frontage or flankage abuttng a Sewerman of the Dranage Works Connecton to the Sewer Works or to the Dranage Works shall ony be permtted where n the opnon of the Engneer there s suffcent capacty to handle the predcted peak flow. 3.2 OBLGATON TO CONNECT TO THE SEWER WORKS Every Buldng wthn a servced area as defned by the Offcal Pan as amended frontng or flankng on a Santary Sewer of the Sewer Works shall be connected to the Sewer Works; and Sewer servce Rates and fees prescrbed by Councl shall apply despte the Buldng beng servced by a separate pnvate Sewer system unless otherwse approved by the Chef Buldng OffcaL Where Santary Sewers have been nstalled wthn a road Rght-of-Way or easement whch abuts the properl of an exstng Buldng the affected Owner shall connect to the completed Santary Sewer at hs or her expense wthn twelve (12) months of the date of notce requrng the connecton to be made provded to the Owner by the Corporaton va regstered mal at the Owner's ast known address f any properl Owner fals to connect to a newly constructed abuttng Santary Sewer as requred by Subsecton the Corporaton shall commence blng the properl Owner for Santary Sewer servces one (1) month after the requred connecton was to be made at the monthly rate establshed by Councl for Santary Sewer servces through by-law adopton from tme to tme Where a drect Connecton s made to the Sewer Works n complance wth ths By-law any septc tanks cesspools and smlar Pnvate Sewage dsposal facltes shall be cleaned and flled or removed or destroyed wthn a perod ten (10) calendar days after the connecton to the Sewer Works to the satsfacton of the Chef Buldng OffcaL Where specfc health hazards exst an Owner shall connect all santary facltes wthn an exstng Buldng to the Sewer Works n accordance wth the Buldng Code Part 7 wthn sxt (60) calendar days of recept of a regstered notce to make such connecton from the Corporaton and/or from the Medcal Offcer of Health to the satsfacton of the Chef Budng OffcaL. 10

70 3.3 EXTENSON TO THE SEWER WORKS OR DRANAGE WORKS No extenson of an exstng Sewerman shall be made unless the annual revenue to be derved from Consumers beneftng from such an extenson s at least ten percent (10%) of the total nstallaton cost of such extenson unless funded under development charges or local mprovement provsons or unless t s n the best nterests of the Corporaton as determned by Councl to-make such extenson Notwthstandng Subsecton on the recommendaton of the Engneer Counc may consder an applcaton by any Owner wshng to have any propert served by the Sewer Works or Dranage Works provded: a) Such Owner agrees to pay all assocated costs of extendng a Santary Sewer or a storm Sewer so that t abuts the frontage or flankage of the property to be served. Where Budng deveopment s expected to contnue along a Rght-of- Way the extenson of the Santary Sewer or storm Sewer shall be across the entre frontage or flankage of the sad propert: b) Such property s located wthn the servced area boundares as defned by the Corporaton's Offcal Plan; c) Any and all relevant governmental approvas are sought and obtaned at the expense of such Owner; and wthout restrctng the generalty of the foregong ncludng the Ontaro Mnstry of the Envronment approva pursuant to the provsons of the Ontaro Water Resources Act; d) The Owner makes applcaton for the Servce Connecton or connectons; and for Sewer Servce Connectons obtans a plumbng permt from the Corporaton; and e) The Owner provdes the actual cash or adequate securty n substtuton therefore as approved by the Drector of Fnance for the entre cost of extendng the Sewer Works and/or Dranage Works; and such cash or other securty to be deposted wth the Corporaton pror to any such work beng effected by the Corporaton or by the Owner as approved by the Corporaton. 3.4 NSTALLATON REQUREMENTS Each Buldng shall be provded wth a separate Sewer Servce Connecton and a separate Dranage Servce Connecton unless otherwse authorzed by the Engneer Dranage Servce Connectons shall be made to a storm Sewer where provded or to a Dranage Dtch or Storm Water management system of the Dranage Works at a locaton and n a manner approved by the Engneer Sump pumps shall connect to and dscharge to the Dranage Works by means of a Prvate Dranage Lateral at a locaton and n a manner approved by the Engneer f no Dranage Works are avaable to whch to dscharge sump pumps shall dscharge to the lands of the Buldng from whch the sump pump dscharge emanates as specfed by the Corporaton's Lot Gradng and Dranage Polcy to the satsfacton of the Chef Budng Offca All plumbng and Dranage nstallatons Prvate Sewer Laterals and Prvate Dranage Laterals and alteratons thereto servng a Buldng or prvate property or prvate Premses and all ppes fttngs attachments Appurtenances method of nstallaton mantenance use repar renovatons to and removals of any Prvate Sewer Lateral or Prvate Dranage Lateral shall be pursuant to as requred by and n complance wth the Ontaro Budng Code Part 7 the current Corporaton Standards and ths By-law All Muncpal Sewer Laterals and Muncpal Dranage Laterals shall be nstalled by the Corporaton or ts Agent under the supervson of the Engneer at the expense of the Owner. Only on the pror wrtten approval of the Engneer the Owner or the Owner's Agent may undertake the nstallaton of a Muncpal Sewer Lateral and/or a Muncpal Dranage LateraL The Corporaton shall be responsble for the cost of mantanng Muncpal Sewer Laterals and Muncpal Dranage Laterals and for keepng the same n operaton and repar. 11

71 3.4.8 Prvate Sewer laterals from and ncludng the nspecton Tee and Prvate Sewage Collecton Systems and Prvate Dranage Laterals and prvate Dranage systems shall be provded by and mantaned by and at the expense of the Owner Other than the connecton to the Buldng or Premses beng servced all other ppe connectons to a Sewer Servce Connecton or Dranage Servce Connecton requre the pror wrtten approval of the Engneer The Corporaton wll not remove any obstructon n a buldng dran under a buldng nor w The Corporaton be responsble for any excavaton wthn the lmts of a buldng At the request of the Owner of any Buldng Sewer that s obstructed the Corporaton w nvestgate the sad Buldng Sewer and wll attempt to remove the obstructon provded that al of the followng condtons are met: a) That no excavaton for or breakng nto sd Buldng Sewer s necessary. b) That the obstructon s removable by the use of sewer roddng equpment only. c) That the obstructon es wthn the Buldng Sewer. d) That access for roddng of the Buldng Sewer s provded from an acceptable cleanout wthn the Buldng. Roddng wll be done only from the cleanout nearest to the Buldng Sewer Should an nvestgaton under Secton reveal that there s no acceptable cleanout the owner wll be responsble for all costs related to dspatch of and works completed by sad crew. The Corporaton w attempt to remove the obstructon but followng such attempt. the Engneer or desgnate shal. by wrtten notfcaton to the Owner request the Owner to nstall an acceptable cleanout n accordance wth the Standards of the Corporaton Should the Owner fal to nstall an acceptable cleanoutfollowng notfcaton under Secton then n the event of any subsequent request by the Owner to remove an obstructon the Corporaton shall requre the Owner to do one of the followng: a) Engage a plumber of the Ownets choce and assume all costs assocatec: wth clearng the obstructon. b) Request the dspatch of a work crew and equpment of the Corporaton upon the clear understandng that: ) The Owner s responsble for all costs related to dspatch of and work completed by sad crew. ) The Corporaton gves no guarantee of successfully clearng the obstructon. ) Should the obstructon be cleared the Corporaton gves no guarantee that further obstructons w not occur The fees payable to the Corporaton for servces under Sectons through are set forth n Schedule "A" to ths By-law The Corporaton gves no guarantee that obstructons wll be cleared or that further obstructons w not occur The provson nstallaton and constructon operaton and mantenance of Mantenance Holes. Catch Basns and nterceptors shall be n accordance wth Part 5 of ths By-law and the current Corporaton Standards Grease. ol sand and grt nterceptors shal be provded when n the opnon of the Engneer or Chef Buldng Offcal they are necessary ncludng for exstng facltes for the proper handlng of Sewage or Dranage Water contanng grease ol or petroleum products n excessve amount or any nflammable wastes andfor sand or grt n excessve amounts or other harmful matter. 12

72 a) Where a Sewer Servce Connecton Muncpal Sewer Lateral or Prvate Sewer Lateral or Prvate Sewage Collecton System or Dranage Servce Connecton or prvate Dranage system s made by an Owner contrary to the provsons of ths By-law the Owner shall repar or replace such defectve work or materal wthn seven (7) calendar days after recept of notce from the Corporaton requrng the Owner to do so. b) Where an Owner fals to repar or replace a connecton n accordance wth Secton (a) above the Corporaton may cany out the repar or replacement at the expense of the Owner and such costs of sad repar or replacement shall be pad by the Owner and f not pad the costs shall be added to the tax rol for the propert and collected n the same manner as property taxes The nstallaton of Sewer Servce Connectons and Dranage Servce Connectons and Appurtenances shall be nspected and approved by the Corporaton before backfllng commences Fnal acceptance and approval to backfll and put nto servce a Sewer Servce Connecton or Dranage Servce Connecton s not a guarantee or warranty on the part of the Corporaton that the servce wll perfonn satsfactorly and be trouble free. 3.5 SEWAGE BACKFLOW PREVENTON An approved Sewage Backfow Preventon Devce shall be nstalled n the santary Sewage dscharge plumbng n advance of the Prvate Sewer Lateral n all new Buldngs wth basements or below grade crawl spaces unless otherwse approved by the Chef Buldng OfcaL f n the opnon of the Chef Buldng Offca n consutaton wth the Engneer an exstng Buldng s lkely to experence or has experenced Sewage backup as the result of a stonn event the Corporaton may provde fnancal assstance to the Owner upon wrtten applcaton for the nstallaton of an approved Backfow Preventon Devce to a maxmum of $ subject to budget approval by Councl and the avalablty of funds Backftow Preventon Devces shall be of a desgn approved by the Corporaton and nstalled as prescrbed by the Ontaro Buldng Code Part 7 and n a manner specfed by the Chef Buldng OffcaL Backfow Preventon Devces shall be nstalled and mantaned readly accessble for nspecton and mantenance Backftow Preventon Devces shall be mantaned n good workng order and protected ncludng protecton from freezng by the Owner at hs/her expense. 3.6 STORM DRANAGE REQUREMENTS Stonn Water ppes Dranage Servce Connectons Dranage water ppes Dranage sump pump dscharge laterals Foundaton Drans Storm Water leaders or Downspouts shall not be connected drectly or ndrectly to the Sewer Works unless otherwse approved by the Engneer The dscharge of Storm Water leaders Downspouts sump pumps and Foundaton Dranage water from any Buldng shall be n accordance wth the latest verson of the corporate standards When a Corporaton Storm Sewer s constructed wthn a street or Rght-of-Way that was prevously served only by a Corporaton Combned Sewer the Corporaton Combned Sewer shall subsequently be dedcated as a Corporaton Santary Sewer and all Stonn Dranage from any abuttng Buldng or propert shall be dsconnected from that Corporaton Santary Sewer. Abuttng propert Owners may connect ther Buldng or propert Storm Dran to the new Corporaton Storm Sewer on applcaton and approval as per the Standards of the Corporaton or may dscharge the Stonn Water to the surface of the lands from whch t emanates as specfed by the Corporaton's Lot Gradng and Dranage Polcy. 13

73 3.6.4 f Corporaton Dranage Works are not avalable to a property the Corporaton may at ts dscreton requre the constructon of a Storm Sewer or Storm Dran from that property to the cosest avalable legal Dranage Outlet at the Owner's expense before authorzng ssuance of a buldng permt Before ssung a buldng permt or before approval of the constructon of a Dran or modfcatons to a Dran or before approval of a connecton to a Dran or n antcpaton of possble adverse consequences from potental future floodng of the subject or surroundng lands or potental adverse Dranage Water qualty the Corporaton may requre at the request of the Engneer the Owner to complete one or more of the folowng: a) a study on Storm Water qualty and/or quantty; b) modfcaton and/or constructon of Storm Water facltes: c) adopton and mplementaton of polluton preventon technques and measures: d) adopton of a Storm Water Management pan; or e) any other requrement as specfed by the Engneer or Councl Where an Owner fals to comply wth Subsecton the Engneer may make an Order drectng the Owner wthn seven (7) calendar days of the ssuance of the Order to take such steps as are necessary to comply as outlned n the Order. f the Owner fals to comply wth the Order wthn seven (7) calendar days. the Engneer may cause such work as necessary to be done at the Ownets expense; and f not pad the costs may be added to the tax rol for the propert and collected n lke manner and wth the same prorty as muncpal taxes. 3.7 COMMENCEMENT OR DSCONTNUANCE OF SERVCE The termnaton of Servce Connecton or Connectons to Prvate Sewage Collecton Systems or Prvate Dranage Systems shall be capped or plugged to the satsfacton of the Chef Buldng Offcal untl connecton to the Sewer Works or Dranage Works s approved by the Engneer Once a Sewer Servce Connecton or a Dranage Servce Connecton has been nstaled and put nto servce such connecton shall not be dsconnected from the Sewer Works or Dranage Works wthout the pror wrtten approval of the Engneer Where a new or replacement Servce Connecton s nstaled or where the Corporaton has Blanked the dscharge from an exstng Servce Connecton; no Person other than an Employee or an Agent of the Corporaton so authorzed by the Engneer or Chef Buldng Offcal shal remove the Blank so as to recommence or renstate the Servce Connecton Where an exstng Servce Connecton s approved and operatng notwthstandng Subsecton a duy qualfed and lcensed plumber when makng repars may temporarly Blank the Connecton and upon completon of the repars shall mmedately renstate the collecton of dscharge f frst authorzed by the Engneer or Chef Buldng Offcal a duly qualfed and lcensed plumber may notwthstandng Subsecton temporarly ntate the colecton of Sewage or Dranage water to test and correct any Servce Connecton nstallaton and upon completon of the test and correcton mmedately renstate the blockage of dscharge Where the Corporaton has caused a Servce Connecton beleved to be defectve to be Blanked due to a defectve Sewer servce the Servce Connecton shall not be restored untl the Engneer or Chef Buldng Ofcal has been satsfed that no such defect exsts or that any defect theren has been properly rectfed n accordance wth Corporate Standards and the requrements establshed under ths By-law n complance wth Subsecton an Owner of a Buldng wth a Servce Connecton shall provde wrtten notfcaton to the Corporaton when use of the Servce Connecton s to be dscontnued and shall obtan the requred permt and pay the requred fee as prescrbed by Councl. 14

74 3.7.8 Any Owner requrng the dscontnuaton of a Servce Connecton for the purpose of demolton or for other reasons shall excavate backfll and renstate the excavaton so that the Servce Connecton may be properly Blanked and nspected by the Corporaton Where Buldng demolton s undertaken the Owner shall Blank all Servce Connectons to the satsfacton of the Chef Buldng Offcal and before the commencement of demolton work The Blankng of a Servce Connecton shall be completed at such locaton and n such manner as specfed by the Chef Buldng Offca and shall be nspected pror to backfll Where a Buldng has been demolshed and the property Owner proposes to utlze the exstng Servce Connecton or connectons to serve a new Buldng the Owner must frst obtan the wrtten approval of the Engneer to do so A dsconnected or Blanked Servce Connecton shall not be reconnected or renstated wthout reapplcaton for the Servce Connecton n accordance wth the Standards of the Corporaton and payment of the applcable fees prescrbed by the Councl. 3.8 RESPONSBLTY OF OWNER The entre cost of provdng nstallng operatng mantanng reparng replacng relocatng or renewng any Prvate Sewer Lateral or Prvate Sewer Collecton System and any Prvate Dranage Lateral or prvate Dranage or Storm Water Management System and Appurtenances connected thereto ncludng nspecton Tees shall be the responsblty of and pad for by the Owner Every Owner shall mantan ther Prvate Sewer Lateral or Prvate Sewage Collecton System and Prvate Dranage Lateral or Prvate Dranage or Storm Water Management Systems ncludng Appurtenances connected thereto n good workng order and condton and adequately protected from blockage and freezng. Prvate Sewer Laterals and Prvate Sewage Collecton Systems shall be mantaned free from Dranage and Storm Water nflow and nftraton Every Owner whose property abuts or ncludes a Dranage Dtch of the Dranage Works shall mantan the Dranage Dtch free of debrs and obstructons or blockages to Dranage flow a) Where a leak occurs from a Prvate Sewer Lateral Prvate Sewage Collecton System Sewage holdng tank septc tank system or any other Prvate Sewage treatment system the Owner shall take correctve acton to repar the leak at the Owner's expense. b) Where after seven (7) days' notce by the Corporaton requrng that the leak be repared the Owner fals to comply wth the requrement to repar the leak the Corporaton may repar the leak and the cost of such repar shall be pad by the Owner and f not pad the cost may be added to the tax roll for the propert and collected n the same manner as propert taxes The Owner shall ndemnfy the Corporaton for any loss or damage to the Corporaton or to any Person that may occur n or as a result of any work carred out or actons by the Owner or an Agent of the Owner as requred under ths By-law Every Owner and occupant shall at all reasonable tmes and upon reasonable notce provded by the Corporaton allow and provde access to a Buldng or Premses ncludng a dwellng to the Engneer Chef Buldng Offca or any other Person duly authorzed by the Corporaton for the purposes of nspectng mantanng reparng dsconnectng or renstallng a Sewer Connecton or a Dranage Servce Connecton or for takng correctve acton and/or carrng out work requred by ths By-law Every Owner shall be responsble for advsng the Corporaton attenton to the Drector of Fnance and Drector of Engneerng & Publc Works of any change n the Sewer Servce Connecton or Dranage Servce Connecton applcaton nformaton ncludng changes to the Ownets address and telephone number and selected method of account payment. 15

75 3.8.8 Only the Owner may request the dscontnuaton of Sewer Servce Connecton or Dranage Servce Connecton. Such requests shall be made n wntng attenton to the Drector of Fnance n a form specfed by the Corporaton At the wrttten request of the Owner and when resources can be made avalable and at the dscreton of the Engneer; the nspecton of Prvate Sewage Collecton Systems and/or prvate Dranage or Storm Water management systems ncludng the preparaton of a report on the condton of the systems may be carred out by the Engneerng and Pubc Works Department of the Corporaton on a cost recovery bass. 3.9 COMPLANCE NSPECTONS AND CORRECTVE ACTONS The Engneer Chef Buldng Offcal or any Person duly authortzed by the Corporaton shall be allowed access to a Buldng or Premses ncludng a dwellng at all reasonable tmes and upon reasonable notce for the purpose of nspectng mantanng reparng dsconnectng or renstallng a Sewer Servce Connecton or a Dranage Servce Connecton n accordance wth the provsons of ths By-law. 16

76 Part V - Restrctons 4.1 GENERAL RESTRCTONS Except as authorzed n wrtng by the Engneer only Sewage that orgnated from the Water Works may be dscharged to the Sewer Works No Person shall dscharge to the envronment wthn any area under the junsdcton of the Corporaton any Sewage contamnated or polluted water except where sutable treatment of the dscharge s provded and approved by the Engneer or the Chef Buldng OffcaL No Person shall dscharge or depost or cause or pemt to be dscharged or deposted nto or n the Sewer Works or nto or n the Dranage Works a substance materal or object whch s or may become harmful to the Sewer Works or Dranage Works or the envronment No Person shall conceal nterfere wth construct or mantan anythng or cause or pemt to be concealed or nterfered wth or constructed or mantaned anythng that has the effect of concealng or nterferng wth access to a muncpal or prvate Mantenance Hole nterceptors Catch Basns or a Sewer Lateral nspecton Tee No Person. except an employee of or Agent of or contractor engaged by the Corporaton shall uncover enter make any connecton to or openng nto use alter or dsturb the Sewer Works or Dranage Works wthout frst Obtanng the approval of the Engneer Notwthstandng Subsecton an abuttng Owner or hs Agent may wthout approval enter nto a Dranage Dtch of the Dranage Works for the purpose of clearng the Dtch of growth or debrs or to clear an obstructon or blockage. Such cleanng or clearng shall not alter the nvert of the Dtch No Person shall remove or tamper wth or cause or permt any removal or tamperng wth any Mantenance Hole cover grate cap or any other openng nto the Sewer Works or Dranage Works wthout the pror approval of the Engneer Upon the provson of reasonable notce permtted by the requrement or crcumstance the Engneer may temporary restrct the use of the Sewer Works or Dranage Works ncludng the temporary shut-off of water from the Water Works from tme to tme as necessary to carry out nspectons cleanng mantenance repars Servce Connecton modfcatons replacement relocaton or rehabltaton to any part of the Sewer Works or Dranage Works. 4.2 SEWER WORKS USE RESTRCTONS Unless pemtted to do otherwse under ths By-law no Person wthn a servced area shall fal to ensure that Sewage from a Budng or Premses s dscharged nto a Santary Sewer of the Sewer Works No Person unless specfcally authorzed by the Engneer n wrtng shall cause or permt the entry of Stom Water or Dranage water of any knd nto the Sewer Works Foundaton Dranage system sumps shall not be constructed wth hgh water level overfow provsons dschargng drectly nto the Buldng dran unless otherwse authorzed n wrtng by the Engneer No Person shall dscharge or depost or cause or permt to be dscharged or deposted nto or n the Sewer Works any materal whch contans more than 100 mllgrams per ltre of fat ol grease or other matter of anmal or vegetable orgn No Person shall dscharge or depost or cause or permt to be dscharged or deposted nto or n the Sewer Works any materal whch contans more than 15 mlgrams per ltre of o grease or tar or other matter other than anmal or vegetable orgn No Person shall nstall any food or garbage-grndng devce the effuent from whch wl dscharge drecly or ndrectly nto the Sewer Works. 17

77 4.2.7 The use of the Sewer Works and Sewage dscharge characterstcs shall conform to the restrctons of the Regonal Muncpalty of Nagara Sewer Use By-law No as amended from tme to tme A Person responsble for: a) a dscharge to the Sewer Works whch may be consdered hazardous to Persons propert or anmals; b) a dscharge whch may be consdered detrmental to the effcent operaton or safety of the Sewer Works or the treatment systems of the Regonal Muncpalty of Nagara or Personnel thereof; c) a dscharge whch contravenes the Sewage dscharge characterstc restrctons prescrbed by the Regonal Muncpalty of Nagara Sewer Use By-law No as amended: shall mmedately notfy the Corporaton and the Regonal Muncpalty of Nagara of such dscharge No Person shall drectly or ndrectly dscharge or depost or cause or pennt to be dscharged or deposted any type of hauled Sewage or hauled Sewage Sludge nto or n the Sewer Works wthout the pror wrtten approval of the Engneer. 4.3 DRANAGE WORKS USE RESTRCTONS Unless penntted to do othewse under ths By-law no Person shall fal to ensure that Storm Water or Dranage water s dscharged nto the Dranage Works or nto an approved Storm Water management system or to an approved Dranage Outlet All mult-unt resdental commercal recreatonal ndustral and nsttutonal Buldngs and Premses shall be served wth storm Sewer or Dranage system or Stonn Water Management systems separate from the Sewer Works All Storm Water or Dranage water of any nature or knd ncludng roof water surfaæ water ground water and water from sump pumps or Foundaton Dranage systems must ether: a) be dscharged nto the Dranage Works of the Corporaton b) be allowed to dsburse only upon the lands of the Owner of the Buldng or lands from whch such Storm Water or Dranage water exts c) be dscharged to a prvate Dranage system or to a prvate Stonn Water management system d) be dscharged to a watercourse e) be dscharged to an approved Dranage Outlet or f) such other place as the Corporaton may drect No Person shall drectly or ndrectly dscharge or depost or cause or pennt to be dscharged or deposted any Sewage of any knd n or nto the Dranage Works No Person shall drectly or ndrectly dscharge or depost or cause or pennt the dscharge or depost of matter of any type n or nto the Dranage Works or nto any Dranage Servce Connecton or nto any Dtch or Dran or nto any Stormwater Management system where: a) To do so may cause or result n ) damage to the Dranage Works; ) nterference wth proper operatons of the Dranage Works; ) blockage obstructon or restrcton of Slormwater flows or Dranage flows theren; 18

78 v) a hazard to any Person anmal property or vegetaton; v) mparment of the qualty of the water n any well lake rver pond sprng stream resevor or other water or watercourse; v) the contraventon of a certfcate of approval or provsonal certfcate of approval ssued under the Ontaro Water Resources Act or the Ontaro Envronmental Protecton Act as amended wth respect to the storm Sewer and/or ts dscharge; v) the contraventon of the Fsheres Act wth respect to the Dranage Works and/or ts dscharge from the Dranage Works nto a water course: or b) The matter has characterstcs prohbted by the Regona Muncpalty of Nagara Sewer Use By-law No as amended from tme to tme. 4.4 MANTENANCE. REPAR AND ALTERATON OF PRVATE DRANS No Person shall alter fll obstruct block or n any way ntefere wth a prvate Dran ncludng allowng a prvate Dran to fall nto dsrepar such that the flow of storm ground surface or subsurface water from or to another prvate land s nterfered wth to the extent that the Owners lessees Operators or occupants of such other prvate land suffer damages or are nconvenenced Every Owner lessee Operator or occupant of land shall keep n repar any prvate Dran on land owned or occuped by them. Every Owner lessee Operator or occupant of land shall alter relay or repar any prvate Dran as may be requred by the Engneer The Engneer may send to or serve on. the Owner lessee Operator or occupant of any land a notce requrng the Owner lessee Operator or occupant or any of them to mantan repar alter relocate or relay any prvate Dran wthn a specfed number of calendar days as may be requred by the Engneer pursuant to Subsectons f an Owner Jessee Operator or occupant of any land fals to comply wth the Engneer's notce sent or served under Subsecton the Engneer may cause the requred work to be done: and the cost of such work shall be pad by the sad Owner lessee Operator or occupant; and f not pad may be added to the muncpal tax roll of the propert of whch the work was done and collected n lke manner and wth the same prorty as muncpal taxes. 4.5 CORRECTON OF OBSTRUCTONS TO DRANS f any Person causes or permts the blockage or obstructon of any Dran or Prvate Dran the Engneer may by wrtten notce to or served on such Person requre such Person to remove the blockage or obstructon wthn a specfed number of calendar days of recept of sad notce f a Person fals to remove a blockage or obstructon of a Dran or Prvate Dran wthn the specfed number of caendar days as requred by the Engneets notce; the Engneer may cause the blockage or obstructon to be removed at the expense of sad Person; and f costs are not pad the costs may be added to the tax roll of the propert wthn whch the blockage or obstructon occurred and collected n lke manner and wth the same prorty as muncpal taxes. 4.6 SUPPLY OF SERVCES FOR CONSTRUCTON PURPOSES Owners Bulders or Contractors requrng Sewage collecton and/or Dranage servces for constructon purposes shall make an applcaton to the Corporaton as specfed n the Standards of the Corporaton and shall furnsh all nformaton so requred and shall pay to the Corporaton the fee prescrbed by CouncL Owners bulders and contractors shall only be permtted to dscharge Sewage to the Sewer Works and Storm or Dranage water to the Dranage Works 'at connecton locatons and n a manner specfed by the Engneer and as may be altered from tme to tme by the Engneer. 19

79 4.6.3 Any Storm Water or surface water or groundwater collected wthn any excavaton or n any completed basement shall be draned to a Storm Water Dranage system Storm Sewer or roadsde Dtchng by pumpng f gravty Dranage s not possble No connecton shall be made ether drecty or ndrecty to the Muncpal Sewer Lateral or to any Mantenance Hoe or nterceptor or other part of the Sewer Works untl the Budng roof s completed unless otherwse approved n wrtng by the Engneer. 4.7 THAWNG OF FROZEN SERVCE CONNECTONS No Person shall undertake the thawng of any Man or Sevce Connecton of the Sewer Works or Dranage Works except wth the pror approval and under the drecton of the Engneer Thawng of Prvate Sewer Laterals or Prvate Dranage Laterals shall ony be carred out at the request of the Owner and at the Owner's rsk and at the fee prescrbed by Councl Thawng of Prvate Sewage Collecton Systems and prvate Dranage systems may be carred out by the Engneerng and Publc Works Department of the Corporaton at the dscreton of the Engneer at the wrtten request of the Owner on a cost recovery bass when resources can be made avalable Thawng operatons shall not be undertken by any Person when n the opnon of the Engneer such acton presents an unaccptable hazard. 4.8 DSCONNECTON OF DRANAGE CONNECTONS TO THE SEWER WORKS The Owner of any Buldng or Premses whch has a Dran Storm Water Leaders Downspouts Foundaton Drans and/or sump pumps connected to the Sewer Works shall at ther own expense. dsconnect such Dran Storm Water leaders Downspouts Foundaton Drans and sump pumps from the Sewer Works Provded that funds are avalable as approved through the Corporaton's annual budget delberatons fnancal assstance to a maxmum rembursement of $ may be consdered to assst Owners wth the costs of the followng repars to dsconnect Dranage connectons from and to reduc'e Extraneous Flow nto the Sewer Works: ) Removal of roof leaders from the Santary Sewer. ) Removal of exstng sump pump connectons from the Santary Sewer. ) Repar or replacement of a leakng Prvate Sewer Laterals. v) Removal of Foundaton Drans connectons from the Santary Sewer. 20

80 Part V - Multple Resdental Commercal nsttutonal and ndustral Premses 5.1 Councl may mpose restrctons on the Multple Resdental Dwellng ndustral commercal recreatonal and/or nsttutonal use of the Sewer Works or Dranage Works as may be set out n a resoluton adopted by Counc from tme to tme. 5.2 Every Mantenance Hole nterceptor Catch Basn devce or Appurtenance nstalled as requred by ths By-law shall be desgned and constructed n accordance wth Ontaro Provncal Standards the Standards of the Corporaton and good Engneerng practce to the satsfacton of the Engneer; and shall be constructed and mantaned at a locaton and n a manner prescrbed by the Engneer at the Owner's or Operator's expense. 5.3 All necessary Dranage ppng Drans Catch Basns nterceptors and connectons to the Dranage Works shall be provded to accommodate Storm Dranage from roof and anclary hard surfaced areas (parkng storage areas roadways etc.) from all multple resdental ndustral recreatonal commercal and nsttutonal Premses. 5.4 The Owner or Operator of a multple resdental Buldng or commercal recreatonal nsttutonal or ndustral Premses wth one or more connectons to the Sewer Works shall nstall and mantan n good repar and operatng condton n each connecton a sutabe nterceptor to prevent the entry of grease ol petroleum products. sand grt and drt nto the Sewer Works uness otherwse approved n wrtng by the Engneer. 5.5 When a change n occupancy or use of a Buldng or Premses may result n the dscharge of grease ol petroleum products or lke substance the Sewer Servce Connecton to such Buldng or Premses shall be provded wth an approved grease ol and petroleum products nterceptor. 5.6 All Dranage Servce Connectons frm commercal recreatonal ndustral and nsttutonal parkng facltes shall be provded wth sand grt ol and petroleum products nterceptors meetng Ontaro Mnstry of the Envronment standards for Storm Water qualty management. 5.7 Food preparaton areas of every hotel boardng or eatng house restaurant or bed and breakfast establshment or other smlar establshment shall be connected to a grease nterceptor nstalled n conformance wth the Ontaro Buldng Code Part 7 and the Standards of the Corporaton and so placed as to be easly accessble to open and clean. 5.8 The Owner or Operator of a Multpe Resdental Dwellng or commercal nsttutonal or ndustral Premses wth one or more connectons to the Sewer Works shall nstall and mantan n good repar and operatng condton for each connecton a sutable Mantenance Hole of a desgn and at a locaton approved by the Engneer; to allow observaton samplng testng and measurement of the flow theren. 5.9 The Owner or Operator of a Multple Resdental Dwellng or commercal nsttutonal or ndustral Premses shall connect to and dscharge Stonn Water and/or Dranage water to the Dranage Works through a Mantenance Hole of a desgn and at a locaton approved by the Engneer unless otherwse approved n wrtng by the Engneer The Owner or Operator of a Multple Resdental Dwellng or commercal recreatonal nsttutonal or ndustral Premses shall at the dscreton of the Engneer. nstall devces to montor dscharges to the Sewer Works or Dranage Works to the satsfacton of the Engneer; and f requred to make such nstallaton shall submt regular reports to the Corporaton regardng such dscharges as specfed by the Engneer An Owner or Operator requred by ths By-law to nstall a Mantenance Hole or nterceptor or alternatve devce shall ensure such Mantenance Hole or nterceptor or alternatve devce s accssble at all tmes for the purposes of observng mantanng cleanng samplng testng and measurng the flow theren All Mantenance Holes nterceptors Catch Basns devces or Appurtenances requred under ths By-law shall be mantaned by and at the expense of the Owner or Operator n a contnuously effcent and safe operatng condton at all tmes Where the Owner or Operator of a Multple Resdental Dwellng commercal recreatonal nsttutonal or ndustral Premses fals to nstall or mantan any Mantenance Hole nterceptor Catch Basn or alternatve devce requred under ths By-law such nstallaton or mantenance may be done by the Corporaton at the drecton of the Engneer at the expense of the Owner or Operator; and f not pad the costs ncurred may be added to the tax roll for the propert and collected n lke manner and wth the same prorty as muncpal taxes. 21

81 5.14 Subject to the pror approval of the Ontaro Mnstry of the Envronment ndustral coolng water or unpolluted process waters may be dscharged to the Dranage Works or to a Dranage Outlet at a locaton and n a manner approved by the Engneer. 22

82 Part V - Prohbtons Enforcement and Penaltes 6.1 NTERFERENCE WTH THE SEWER WORKS OR DRANAGE WORKS No person shall: 1. throws dscharges or deposts any substance or materal nto or n the Sewer Works or Dranage Works whch n any way fouls obstructs or blocks flows n the Sewer Works or n Dranage Works or causes or permts the same to be done; or 2. dscharges or deposts or causes or permts to be dscharged or deposted nto or n the Sewer Works or Dranage Works a substance whch s or may become harmful to a Person; or 3. dscharges or deposts or causes or permts to be dscharged or deposted nto or n the Dranage Works a substance whch s or may become harmful to the natural envronment; or 4. dscharges or deposts or causes or permts to be dscharged or deposted nto or n the Sewer Works or Dranage Works. Sewage Wastewater lqud or any substance whch s prohbted by ths By-law or by the Regonal Muncpalty of Nagara's Sewer Use By-law as amended: s gulty of an offence and on convcton s lable to a fne n accordance wth Secton PROHBTONS AND OFFENCES No person shall: 1. beng a Buldng or Premses Owner fals to connect to a Santary Sewer constructed wthn a road Rght-of-Way abuttng sad Owner's propert as requred by ths By-law; or 2. beng an Owner or Operator fals to control the dscharge of Storm Water or Dranage water as requred by Corporaton Standards; or 3. wthout a permt or pror authorzaton connects or causes to be connected any ppe or Prvate Lateral to any ppe or Man or Mantenance Hoe or other Appurtenance of the Sewer Works or Dranage Works; or 4. fals to obtan an approved Sevce Connecton permt; or 5. fals to construct a Prvate Sewer Lateral or Prvate Dranage Lateral n conformance wth ths By-law and Corporaton Standards; or 6. fals to construct a Prvate Sewage Collecton System or prvate Dranage system n conformance wth Corporaton Standards; or 7. connects a Prvate Lateral to the Sewer Works or Dranage Works pror to approval and nspecton; or 8. connects a prvate Dranage system to the Dranage Works pror to approval and nspecton; or 9. connects a Prvate Sewage Collecton System to the Sewer Works pror to approval and nspecton; or 10. fals to nform the Chef Buldng Offcal that nstallaton of a Prvate Sewer Lateral or Prvate Dranage Lateral s avalable for nspecton; or 11. fals to undertake and report the results of specfed tests requred under ths By-law to ensure that the nstallaton of a Servce Connecton meets standards and specfcatons and functons adequately; or 12. havng been gven approprate and adequate notce fals to provde access to a Buldng or Premses for the purpose of nspectng mantanng reparng modfyng or replacng a Servce Connecton ncludng Appurtenances thereof; or 13. havng been gven approprate and adequate notce fals to provde access to a Buldng or Premses for the purposes of nspectng and ensurng complance wth ths By-law and takng correctve acton as requred ncludng accss to a prvate Sewer collecton system or to a prvate Dranage system and Appurtenances thereof; or 14. wlfully hnders or nterrupts or causes to be hndered or nterrupted; the Corporaton or any of ts offcers Agents workers or contractors n the exercse of any of the powers or dutes conferred by ths By-law; or 23

83 15. wthout pror wrtten approval of the Engneer dscharges or causes or permts to be dscharged to the Sewer Works any Sewage contanng water from a source other than the Water Works; or 16. wthout pror wrtten approval of the Engneer dscharges or causes or permts to be dscharged ether drectly or ndrectly Storm Water. ground water or Leachate or Dranage Water nto or n the Sewer Works; or 17. wthout the pror wrtten approval ofthe Engneer dscharges or deposts or causes to be dscharged or deposted any type of hauled Sewage or hauled Sludge nto or n the Sewer Works; or 18. fals to notfy the Corporaton of a dscharge to the Sewer Works or Dranage Works that s n volaton of the Sewer Works use or Dranage Works use restrctons of ths By-law; or 19. fals to notfy the Corporaton of a dscharge to the Sewer Works or Dranage Works that s or may be hazardous to a Person; or 20. fals to notfy the Corporaton of a dscharge to the Dranage Works that s or may be hazardous to the natural envronment; or 21. fals to adequately protect a Servce Connecton from damage ncludng from freezng: or 22. fals to provde the as constructed data and locaton of a Prvate Lateral to the Engneer; or 23. fals to adequately mantan or repar a Prvate Lateral; or 24. backfls an excavaton or trench created for the nstallaton repar relocaton or replacement of a Servce Connecton or part thereof pror to nspecton and approval; or 25. fals to mantan a Prvate Sewage Collecton System; or 26. fals to mantan a prvate Dranage system or prvate Storm Water management system; or 27. fals to provde wrtten notfcaton to the Engneer that a Servce Connecton has been dsconnected; or 28. Blanks or causes or permts to be Blanked any Servce Connecton wthout pror approval: or 29. fals to Blank a Servce Connecton n complance wth ths By-law n the manner specfed by the Chef Buldng Offcal; or 30. fals to Blank a Muncpal Lateral mmedately followng nstallaton whle awatng approval to connect to the Sewer Works or Dranage Works; or 31. fals to Blank a Servce Connecton requred for the demolton of the Buldng or faclty sevced; or 32. fals to obtan the wrtten permsson of the Engneer to reuse a Blanked Servce Connecton; or 33. fals to provde adequate excavaton backfll and renstatement of a trench to enable the Blankng of a Servce Connecton as requred under ths By-law; or 34. fals to obey or conform to any Sewer Works or Dranage Works use restrctons mposed by Councl; or 35. fals to obey or conform to any temporary Sewer Works or Dranage Works use restrctons mposed by the Engneer permtted under ths By-law: or 36. fals to nstall a Mantenance Hole as requred by ths By-law; or 37. fals to ensure a prvate Mantenance Hole s readly accssble for use and nspecton at all tmes; or 38. fals to mantan a prvate Mantenance Hole requred by ths By-law n good workng order; or 39. fals to nstall an ol grease petroleum product sand or grt nterceptor as requred by ths By-taw; or 40. fals to mantan and ensure adequate functonng of a grease ol petroleum product sand or grt nterceptor as requred by ths By-law; or 41. fals to provde mantenance records for any requred nterceptor; or 24

Appurtenance or apparatus or thng belongng to the Corporaton's Sewer Works or Dranage Works or causes or permts the same to be done; s gulty of an offence and upon convcton s lable to a fne n accordance wth Secton ENFORCEMENT AND PENALTES Every Person other than a corporaton who contravenes any provson of ths By-law s gulty of an offence and upon convcton s lable for every day or part thereof upon whch such offence occurs and contnues to occur to a fne of not more than $ for a frst offence and $ for any subsequent offence Every corporaton that contravenes any provson of ths By-law s gulty of an offence and upon convcton s lable for every day or part thereof upon whch such offence occurs or contnues to occur to a fne of not more than $ for a frst offence and $ for any subsequent offence n ths By-law a subsequent convcton means a convcton for an offence whch offence occurs after the date of convcton for an earler offence under ths By-law No Person shall hnder or obstruct an offcer apponted under ths by-law or employed to enforce ths by-law from carryng out an nspecton of lands nor shall any Person obstruct any employee or Agent authorzed to carry out work for the Cty specfed n an Order ssued hereunder. 25

Part V - General Provsons 7.1 Should a Court of competent jursdcton declare a part or a whole of any provson of ths by-law to be nvald or of no force or effect the provson s deemed severable from ths by-law and t s the ntenton of Councl that the remander survve and be appled and enforced n accordance wth ts terms to the extent possble under the law. 7.2 The Schedules attached hereto are and form part of ths By-law.
