1 Vietnam Natinal Cnsultatin n the Prtectin and Prmtin f the Rights f Migrant Wrkers March 3-4, 2008, Hani, Vietnam We, the participants f the Vietnam Natinal Cnsultatin n the Prtectin and Prmtin f the Rights f Migrant wrkers, recgnize the respnsibility that every state has t prtect, prmte and fulfill the rights f migrant wrkers. We agree that ASEAN, as a self-prclaimed caring and sharing cmmunity, shuld act in a clear and cncrete way s that the peple f ASEAN wh wish t migrate can benefit frm a new arrangement that ensure their rights as migrant wrkers will be prtected. ASEAN has set frth plans fr full ecnmic integratin f its ten member natins by the year Clearly, a new arrangement fr migrant wrkers shuld reflect the fact that in the future a reginally integrated Sutheast Asian market means the divisins that cntinue t separate the wrk frces f the ASEAN cuntries will be difficult t maintain. Like all ASEAN states, Vietnam will face an imprtant challenge t prtect its wn peple in an increasingly glbalized wrld where mvement f peple acrss brders becmes the nrm rather than the exceptin.. As ASEAN cuntries cntinue t grw mre ecnmically interdependent, we believe that it is increasingly imprtant fr states t adpt peple-centered plicies and agreements that create pprtunities fr greater acceptance f the principles f decent wrk, and respect fr ecnmic, scial and cultural rights fr all wrkers and their families. We nte that natinal cnsultatins n the prtectin and prmtin f the rights f migrant wrkers have already been held in Indnesia, the Philippines, and Thailand, and sub-reginal cnsultatins have been cnducted in Singapre and Malaysia, and we appreciate the value f this imprtant ASEAN reginal slidarity in the prtectin f migrant wrkers We nte that Vietnam and the Gvernments f ASEAN, UN agencies, and ther stakehlders in the internatinal cmmunity have been engaged in preparatins t accmmdate the challenges f this increasingly integrated and develped ASEAN regin. Accrdingly, we cmmend ur Gvernment, and the ther Gvernments f ASEAN fr prmulgating the ASEAN Declaratin n the Prtectin and Prmtin f the Rights f the Migrant Wrkers in January By this actin, ASEAN has demnstrated its cmmitment t prvide a new reginal arrangement that is fair and just t all wrkers. Althugh we recgnize that the ASEAN Declaratin is nt a legally binding instrument, it clearly paves the way fr new reginal framewrk agreement fr migrant wrkers. We particularly nte that Article 22 f the Declaratin requires the harmnizatin f natinal labur laws with ILO cre Cnventins, which is als in line with the ILO s Fundamental Principles and Rights at Wrk. The harmnizatin f labur laws with ILO standards presumes that legal prvisins will be applicable t all persns irrespective f their natinality, thereby prviding the principle f natinal treatment. As a leading member in the United Natins, Vietnam is playing an imprtant rle t ensure there is cntinued pririty placed n building respect fr the cre ILO Cnventins by Gvernments and civil sciety alike. We further reiterate ur belief that immediate implementatin f the ASEAN Declaratin is vitally imprtant fr ASEAN. Fr this reasn, we supprt the decisin f the ASEAN Freign Ministers n July 30, 2007, t set up an ASEAN Cmmittee n the Implementatin f the ASEAN Declaratin n the Prtectin and Prmtin f the Rights f Migrant Wrkers. Hwever, we are cncerned that the prgress f the natinal Gvernments in establishing fcal

2 pints t serve n this imprtant ASEAN Cmmittee has been quite slw, since we believe that the earliest pssible functining f this Cmmittee is in the interest f all ASEAN members. We believe that this Cmmittee has very imprtant wrk that it must take up and therefre the members f the Cmmittee shuld be named as sn as pssible. We als express ur appreciatin fr the cntinuus effrts f the CSO-TU Task Frce n ASEAN Migrant Wrkers t assist the effrts t fulfill the prmise f this Declaratin. We strngly supprt the effrts f the CSO-TU Task Frce n ASEAN Migrant Wrkers t mve frward with its mandate under ASEAN s Vientiane Actin Plan t draft a mdel Framewrk Instrument n the Prtectin and Prmtin n the Rights f Migrant Wrkers which will be prpsed later t ASEAN fr cnsideratin. We als wish t express ur thanks t the Canadian Internatinal Develpment Agency (CIDA) and the CIDA-funded SEARCH reginal prject fr supprting this Natinal Cnsultatin wrkshp and fr their cmmitment t assisting the Task Frce n ASEAN Migrant Wrkers in its wrk t expand the prtectin and prmtin f the rights f migrant wrkers in ASEAN. We call n the ASEAN Cmmittee n the Implementatin f the ASEAN Declaratin n the Prtectin and Prmtin f the Rights f Migrant Wrkers t wrk jintly with the CSO-TU Task Frce n ASEAN Migrant Wrkers, thereby answering the call f the new ASEAN Secretary-General, H.E. Surin Pitsuwan, t supprt the greater participatin and invlvement f ASEAN civil sciety in imprtant matters that affect the welfare f the peples f ASEAN. Reflecting this imprtant spirit f cperatin between the Gvernment, trade unins, natinal rganizatins, and civil sciety representatives, we the participants f this Vietnam Natinal Cnsultatin have cme tgether t wrk n cmmn ideas and recmmendatins that we hpe will infrm the Gvernment s agenda t prtect and prmte the rights f migrant wrkers. This Natinal Cnsultatin is particularly valuable because it prvides the pprtunity fr dialgue n cmmn cncerns regarding migrant wrkers between the Gvernment and all key stakehlders. We sincerely hpe that this cnsultatin will pen mre drs fr increased cmmunicatin and exchanges in the future amng stakehlders in civil sciety grups and the Gvernment abut the imprtance f prviding decent wrk and life fr all migrant wrkers. We sincerely hpe that ur effrts during this Natinal Cnsultatin will assist the Gvernment in building a manageable and transparent safe-migratin prcess that includes specific steps and prcedures fr pre-departure training in Vietnam, services and assistance prvided in the cuntry f destinatin by Vietnamese gvernment fficials, and plicies that will assist returning migrant wrkers t successfully re-integrate back int Vietnamese sciety. In bth Vietnam and in the ASEAN regin, we als believe it is imprtant that existing measures t prtect rights f migrant wrkers will be strengthened and new measures intrduced. We nte that all member Gvernments f ASEAN are nw members f the ILO, and as a cnditin f membership, must recgnize the ILO Declaratin n Fundamental Principles and Rights at Wrk. This Declaratin bliges recgnitin f the cncept f cre labur standards, and many f the Gvernments in ASEAN have already included a number f these standards in their natinal labur laws. We encurage all cuntries in ASEAN t bring their laws int harmny with all f the ILO s cre labur standards. We als urge all Gvernments f ASEAN t ratify the tw ILO Cnventins (97 and 143) cncerning migrant wrkers. Furthermre, we urge all ASEAN Gvernments t sign and ratify the United Natins Internatinal Cnventin n the Prtectin f the Rights f All Migrant Wrkers and Members f their Families.

3 The Situatin in Vietnam In 2006, Vietnam s wrkfrce was a ttal f 45.2 millin persns. Vietnam s ecnmy has been creating additinal emplyment pprtunities fr many f ur citizens. During 2006, there were apprximately 1.5 millin new jbs created that year, f which apprximately 60,000 cnsist f Vietnamese citizens seeking verseas emplyment in that year.. The ttal number f Vietnamese migrant wrkers verseas increased t 300,000 between the years f 2001 t Nw in 2008, there are mre than 500,000 Vietnamese migrant wrkers wh are living and wrking verseas, deplyed in ver 40 cuntries and territries. These wrkers prvide imprtant supprt fr their family members wh have remained behind in Vietnam and help cntribute t the develpment f ur natin. Hwever, since the number f Vietnam citizens wrking verseas has increased, we believe there is a need fr imprved laws, regulatins, prcedures and systems t prtect them. We recgnize and appreciate the fact the gvernment has ratified 5 f the 8 ILO Cre labur standards and encurage the gvernment t ratify the remaining cnventins. Vietnam has ratified cnventins n. 29, 100, 111, 138 and 182. The cre ILO Cnventins are: Freedm f assciatin and cllective bargaining (C. 87 and C. 98) Eliminatin f frced and cmpulsry labur (C. 29 and C.105) Eliminatin f discriminatin in respect f emplyment and ccupatin (C.100 and C.111) Ablitin f child labur (C.138 and C.182) We als appreciate and supprt the effrts made by Gvernment t place strict limits n recruitment agency fees charged t migrant wrkers. We als supprt Gvernment effrts t prvide increased skill develpment fr intending migrant wrkers and t design a credit prgram fr Vietnamese migrant wrkers. We sincerely hpe that the Gvernment will make cntinuus effrts t expand its imprtant wrk t prtect the rights f migrant wrkers nw and int the future. Challenges faced by verseas Vietnamese migrant wrkers: We nte that the ILO Tripartite Cmmittee f Experts meeting in 1997 fund that Asian migrant wrkers were suffering and described their plight as fllws: Malpractices exist where the treatment f migrant wrkers and members f their family is nt in accrdance with natinal legislatin r ratified internatinal standards and where such treatment is recurrent, deliberate and invlves grups f peple rather than merely individuals. Explitatin exists where such treatment incurs very serius pecuniary r ther cnsequences, such as when migrants are charged fees bearing little resemblance t actual recruitment r placement csts, have remittance transfers impsed n them withut their vluntary cnsent, are enticed int emplyment under false pretences, are made t sign wrk cntracts by g-betweens wh knw that the cntracts will generally nt be hnured upn cmmencement f emplyment, have their passprts r ther identity dcuments cnfiscated, are dismissed r blacklisted when they jin r establish wrkers' rganizatins, suffer deductins frm wages withut their vluntary cnsent which they can recuperate nly if they return t their cuntry f rigin, r are summarily expelled withut regard t their rights arising ut f past emplyment, stay r status.

4 In the decade since that statement was made by this highly respected meeting, little has changed in the situatin f mst migrant wrkers in the ASEAN regin. Unfrtunately, Vietnamese migrant wrkers are nt an exceptin t this cmmn situatin faced by migrant wrkers frm cuntries all ver Asia. We have fund sme f the fllwing challenges are faced by Vietnamese and ther migrant wrkers in the regin: weak and limited prtectin f the rights f migrant wrkers; nn-payment f salaries, r wrkers being paid significantly less than specified by the written cntract; unsafe wrking cnditins, resulting in frequent injuries, and unhygienic living cnditins; harassment and abuse specifically directed at wmen migrant wrkers; high recruitment fees in bth the sending and receiving cuntries, leaving wrkers with significant debts and impverishing their families because migrant wrkers cannt send hme sufficient remittances; cases f labur cntracts being unilaterally changed by the final emplyer in the cuntry f destinatin -- but the wrkers still must pay the recruitment agency high cmpensatin fees r face alleged breach f the labr cntract if they chse t leave the jb; frequent seizure f wrkers passprt and persnal dcuments by emplyers r agents; in desperatin wrkers are frced t becme undcumented, leaving them mre vulnerable t becming victims f trafficking. RECOMMENDATIONS T the Gvernment f Vietnam: The gvernment shuld take apprpriate and prmpt measures t ensure the prtectin f the migrant wrkers and t meet their basic needs (n the basis f the ILO principles n decent wrk) in the fllwing ways: Plicies and Actins t Prtect Migrant Wrkers Befre Departure frm Vietnam Recruitment f Migrant Wrkers We agree that MOLISA shall cntinue t be the administrative agency fr migrant wrkers. Hwever, we recmmend that lcal authrities shuld be empwered particularly in relatin t preventing deceptive recruiting practices at the village and cmmune level. The prcess f granting labr recruitment licenses must be serius and strictly managed. There shuld be cntinuus mnitring f the activities f migrant recruitment enterprises and prmpt actin t withdraw licenses f thse enterprises which vilate the law, r wh are judged t nt have mandate and capacity t effectively carry ut their recruitment activities. MOLISA shuld maintain and cntinually update a list f recruiting cmpany wners and administratrs wh have been fund t be invlved in deceiving and cheating wrkers. These wners and administratrs n this list shuld nt be allwed t be invlved in any way with any cmpany licensed t be invlved in labr recruitment

5 The Gvernment shuld ensure that infrmatin n the legal prcess f recruitment, assciated prcedures, recruitment fees allwed t be charged, and ther related infrmatin is widely publicized at all levels f sciety. Infrmatin n the legal status f labur recruitment agencies, including their mandate, respnsibilities and authrity shuld be publicized thrughut Vietnam. The Gvernment shuld carry ut a study f the experience f ther ASEAN cuntries in adpting and implementing the ne stp service center apprach (meaning t cnslidate prcedures and services related t registratin and administratin f migrant wrkers in ne service center, where representatives f all relevant Gvernment agencies are present). A study shuld be undertaken t develp cmprehensive and factual infrmatin n the functining and current practices f the frmal and infrmal labr recruitment agencies in Vietnam. A prminent part f this study shuld examine the degree t which these recruitment agencies cmply with the law. The Gvernment shuld cnsider establishing a mechanism t recrd and update data derived frm the registratin and emplyment f migrant wrkers, and maintaining relevant paper-based infrmatin and dcuments as archives). Specifically, the Gvernment shuld develp a plan that included designating a fcal pint fr this wrk, identifying the resurces needed, prviding fr training n basic skills fr the persns respnsible fr this wrk, and ensuring the sustainability f this wrk. Cntracts f Migrant Wrkers The Gvernment shuld ensure that all migrant wrkers receive and agree t a written cntract with the emplyer in the receiving cuntry and that cntract shuld be in bth the lcal language f the receiving cuntry and in Vietnamese. The recruitment agency shuld be required t prvide a cpy f each wrker s cntract t MOLISA s that these cntracts can be verified by the Gvernment. Each wrker cntract shuld include at least the fllwing infrmatin: Specific prvisins n the type f jb, the salary, the psitin, hurs f wrk, ccupatinal safety and health, and ther terms f emplyment, and ther relevant binding prvisins designating the rights and respnsibilities f the wrker and the emplyer. All cntracts must be strictly in cnfrmity with bth the laws f Vietnam and the laws f the receiving cuntry. The terms and cnditins f the cntracts shuld be in accrdance with ILO cre labr standards. Plicies and Supprt fr Migrant Wrkers The Gvernment shuld ensure that migrant wrkers are prvided with pre-departure training (at n cst t the wrker) and an infrmatin package befre departing Vietnam t wrk verseas. This training and infrmatin package shuld include at least the fllwing: Infrmatin abut all relevant laws and regulatins in the receiving cuntry Infrmatin abut the cultural and scial custms f the receiving cuntry Cntact infrmatin abut the fcal pints/cmplaint desks where migrant wrkers can file a cmplaint and receive assistance

6 Infrmatin abut basic knwledge and skills required in emergency situatins Other infrmatin, as deemed necessary by the Gvernment There shuld be a system f effective legal aid that specifies measures that shuld be taken t assist the migrant wrkers when they ldge cmplaints abut ill treatment and vilatins f the law. The Gvernment shuld be aware f the vulnerability f female migrant wrkers in jbs knwn t have a high level f ptential explitatin and sexual harassment such as service sectr jbs and dmestic wrk. Special measures shuld be taken t prtect wmen wh chse t enter such emplyment. There shuld be effrts t increase the resurces and strengthen the capacity f agencies (such as the Cmmittee n Managing Vietnamese Wrkers Overseas) which represents the interests and prtect the rights. The Gvernment shuld cnsider the pssibility f creating a safe migratin fr emplyment prgram and incrprating this int the teaching curriculum at the University n Labr and ther universities. Agreements between Vietnam and Labr-Receiving Cuntries in ASEAN The Gvernment shuld integrate prvisins t prtect the rights and interests f migrant wrkers in the bilateral and multilateral MOUs and agreements that are cncluded between Vietnam and ther cuntries. The Gvernment f Vietnam and the Gvernments f receiving cuntries shuld cnduct a training needs assessment amng intending migrant wrkers that will supprt the develpment f pre-departure training prgrams that are practical and relevant t the wrkers needs. Natinal Laws and Regulatins in Vietnam Fr the sake f effective implementatin, the Law n Cntract-Based Wrkers Abrad shuld be further clarified thrugh additinal Ministerial decrees and regulatins. Ministerial regulatins must be simple and specific in rder t guide effective implementatin f the labr laws regarding the activities f the migrant recruitment agencies. There shuld be Ministerial regulatins that specify measures n the prtectin f migrant wrkers. There shuld be increased mnitring t ensure the effective implementatin f Chapter 3 f the Law n Cntract-Based Wrkers Abrad, and that Law shuld be strengthened with mre severe sanctins against thse wh vilate the Law. Further studies shuld be undertaken t infrm next steps that the Gvernment shuld take t harmnize natinal labr laws with the ILO cre labr standards. The Gvernment shuld cnduct a study n the feasibility and desirability f ratifying the UN Cnventin n the Prtectin f the Rights f All Migrant Wrkers and Members f their Families. As part f this prcess, the Gvernment shuld cnduct cnsultatins with representatives f trade unins, NGOs and mass rganizatins. Prtectin and Supprt fr Vietnam Migrant Wrkers in Receiving Cuntries

7 There shuld be a clear fcal pint t prvide prmpt prtectin measures fr Vietnamese migrant wrkers in the receiving cuntries s that it is clear where and frm whm the migrant can ask fr supprt. There shuld be effrts t build effective cllabratin amng all stakehlders in the receiving cuntry -- representatives f the Vietnam labr recruitment enterprises, the Vietnam Embassy, trade unins and civil sciety rganizatins frm the receiving cuntry, and the migrant wrkers -- s that it is clear n the respnsibility and prcedures t handle cases/issues related t the migrant wrkers. Officials at Vietnamese Embassies and Cnsulates shuld receive training and clear plicy guidance n the imprtance f faithfully and diligently implementing plicies t prtect the rights f migrant wrkers. These fficials shuld be prvided with resurces and infrmatin s that they can effectively intervene and prvide supprt t migrant wrkers facing difficulties. Specifically, these fficials shuld be required t reach ut t representatives f trade unins, NGOs, and mass rganizatins in receiving cuntries t ensure that Vietnamese migrant wrkers receive prmpt and practical supprt. The Gvernment shuld establish a system t enable the psting f representative f the Vietnam trade unins verseas in Embassies t help prtect the rights f migrant wrkers. The Gvernment shuld cntinually request the Gvernments f receiving cuntries t implement prvisins t prtect the rights f the migrant wrkers that the receiving Gvernments have cmmitted t prtect. The Gvernment and the receiving cuntries with which the Gvernment cncluded migrant labr agreements shuld negtiate general prvisins n skill training fr Vietnamese migrant wrkers which grant mutual recgnitin f skills pssessed by the wrkers. As part f these agreements, the Gvernment and the Gvernment f the receiving cuntry shuld negtiate and reach a cnsensus n certain fundamental standards fr prviding skill training fr wrkers. T the ASEAN and the Member Gvernments f ASEAN The ASEAN Declaratin n the Prtectin and Prmtin f the Rights f Migrant Wrkers is an imprtant milestne. T fully realize its gals, the Natinal Cnsultatin firmly believes that there is a need fr cntinued brad based cnsultatins at natinal and sub-reginal levels, especially invlving trade unins and civil sciety rganizatins. The Natinal Cnsultatin als believes that ASEAN shuld take immediate steps t encurage each member Gvernment f ASEAN t immediately appint their natinal fcal pint t the ASEAN Cmmittee t Implement the Declaratin n the Prtectin and Prmtin f the Rights f Migrant Wrkers, as called fr in the reslutin adpted by the ASEAN Freign Ministers n July 30, We recmmend that these fcal pints shall be appinted n later than the ASEAN Labr Ministers Meeting (May 6-9, 2008, in Bangkk, Thailand), and that the full membership f the Cmmittee be frmally annunced as ne f the results f the ALMM. We urge the ASEAN Senir Labr Officials Meeting (SLOM) and ASEAN Labr Ministers Meeting (ALMM) t als raise fr discussin the statements and recmmendatins f the Natinal Cnsultatins cnducted by the Task Frce n ASEAN Migrant Wrkers in 2007 and 2008.

8 We believe that ASEAN must recgnize that there must be a new deal that affrds rights t migrant wrkers regardless f their rigin r current dcumented status. We recmmend that this new deal shall be set ut in a binding framewrk and be based n the principle that migrant wrkers shall be guaranteed natinal treatment in their cnditins f wrk and life utside f wrk. We recmmend that ASEAN cnsider using the mdel Framewrk Instrument n the Prtectin and Prmtin f the Rights f Migrant Wrkers (being develped by the Task Frce n ASEAN Migrant Wrkers thrugh the natinal cnsultatins prcess) as the basis fr develping the binding framewrk discussed abve. The frmulatin f the abve-mentined ASEAN Framewrk Instrument shuld be dne in a way that cntributes directly t the harmnizatin f natinal labur laws with the eight ILO cre Labur Cnventins and the UN Cnventin n the Prtectin f the Rights f All Migrant Wrkers and Members f Their Families. We als believe that because f the very serius prblem f human trafficking in ASEAN, especially affecting wmen and children but als nw extending t impact men, we reaffirm the imprtance f ASEAN s Vientiane Declaratin against Trafficking in Persns, Especially Children and Wmen, adpted in Nvember Specifically, the Natinal Cnsultatin believes that ASEAN shuld nw firmly implement its decisin t establish a reginal fcal netwrk t prevent and cmbat trafficking in persns, particularly wmen and children, in the ASEAN regin, and urge that the netwrk be given the supprt required t crdinate with gvernments, emplyers, trade unins, and NGOs t ensure effective implementatin f that Declaratin. In additin, we have the fllwing specific recmmendatins fr ASEAN, and the member Gvernments f ASEAN: ASEAN shuld establish an ffice at the ASEAN Secretariat that is respnsible fr the supervisin and evaluatin f the implementatin f laws and plicies relating t the rights f migrant wrkers. ASEAN member gvernments shuld sign bilateral and multilateral treaties n migrant wrkers rights and establish mechanisms t effectively versee the implementatin f thse treaties. ASEAN migrant-sending cuntries shuld encurage the establishment f netwrks cmpsed f labr exprt cmpanies, trade unins, NGOs, and Gvernment ffices fr the purpses f sharing experiences and helping each ther t prtect migrant wrkers. ASEAN cuntries shuld develp and reach an agreement n the cntent f a cmmn mdel labur cntract that wuld be applicable fr emplyment f all migrant wrkers in all ASEAN states. ASEAN cuntries negtiate and reach agreement n cmmn standard prcedures fr recruitment, pre-departure, transit, pst-arrival briefing, dispute mediatin and settlement, and repatriatin and reintegratin f migrant wrkers. ASEAN cuntries shuld agree that the principle f natinal treatment will be applied t all migrant wrkers.

9 ASEAN natins shuld accrd special attentin t issues f ccupatinal safety and health affecting migrant wrkers, and take preventive measures t ensure that wrkers health and lives are nt endangered as a result f their wrk. ASEAN receiving cuntries set up sci-cultural cmmunity centers fr migrant wrkers in rder t imprve their lives. T Trade Unins and NGOs in the ASEAN regin Trade unins in ASEAN shuld actively engage and play the key rle in the prtectin f migrant wrkers regardless their citizenship. They shuld accmplish this by wrking t establish effective links and building cperative relatinships between trade unins, NGOs, and cmmunity based rganizatins in the regin. Trade unins in cuntries f ASEAN that receive migrant wrkers shuld establish units t assist migrant wrkers, and set up mechanisms t carry ut cncrete activities t prtect migrant wrkers wrking in their cuntries. Activities shuld include educating their trade unin members t nt discriminate against migrant wrkers, helping build greater scial acceptance fr migrant wrkers, and supprting migrant wrkers in cases where they suffer maltreatment frm emplyers and are invlved in labr disputes. The Vietnam General Cnfederatin f Labr (VGCL) shuld wrk with the Gvernment t ensure that VGCL representatives are psted t cuntries that receive significant number f Vietnam migrant wrkers, and ensure that Vietnam migrant wrkers knw that VGCL s supprt cvers wrkers wh may nt be VGCL members. NGOs and civil sciety rganizatins in ASEAN shuld use their clse relatinship with lcal cmmunities t play an imprtant rle in the prtectin f migrant wrkers, thrugh carrying ut activities such as disseminating relevant infrmatin and prviding them with legal and scial educatin, and wrking t diminish discriminatin by receiving cmmunities against migrant wrkers.
