5 1 Introduction 1. The Government of India has obtained a loan from the Asian Development Bank towards financing the North Eastern Region Capital Cities Development Investment Program. The loan is under the Multi Tranche Financing Facility of the Asian Development Bank to improve certain prioritized urban infrastructures mainly in the sectors of water supply, solid waste management and sanitation in 5 North Eastern Region Capital Cities namely, Agartala, Aizwal, Gangtok, Kohima and Shillong. The Program will (i) improve the urban infrastructure (ii) strengthen the urban institutions towards better service delivery, project management and implementation. 2. The NERCCDIP is estimated to be completed in a span of 6 years. The program in Kohima envisages investments in three projects corresponding to three loan tranches of ADB. The State Investment Program Management & Implementation Unit is the implementing agency at State level. M/s CDM Smith India Private Limited (Formerly Wilbur Smith Associates) has been engaged as the Design, Construction Supervision & Management Consultant (DSMC) for this city. 3. Two subprojects are taken up under tranche-1, one in the sector of Water Supply (WS) and another in Solid Waste Management (SWM), are now under implementation in Kohima. The water supply sub project is for the refurbishment of the existing Kohima Water Supply Scheme. The solid waste management sub project focuses in developing a new solid waste management site in the outskirts of Kohima at Lerie. Apart from the above said sub project components certain additional works also proposed in SWM under tranche 1, details of the proposed components are given in table Two subprojects are planned under Tranche-2.The major one is the civil work for providing a new underground water supply distribution pipe system for a total length of 318 km. The contract agreement has been executed in February 2013 and the trenching & laying of pipes was started in January, 2014, around 11.02% of the works has been completed against the targeted progress of 77.65% (as on 31 st December, 2014). The other subproject in Tranche-2 is installation of 21 bulk water meters & 6000 metered connections in the new distribution system. As the works can be started only after the completion of laying the pipe line network, the bidding has been postponed. 5. This is the consolidated report on implementation of Social Safeguard Activities for the period from 1 st July, to 31 st December, 2014, and this is prepared in compliance with the ADB s Safeguard Policy Statement, (SPS 2009). 2 Implementation Arrangements 6. The Ministry of Urban Development (MOUD) is the national-level executing agency (EA) of the program. An IPCC is also established in MOUD incorporating a Social Safeguard Officer. A National Steering Committee (NSC) will monitor the fund use and overall implementation performance of the Investment Program. In each State there will be a State Steering Committee (SSC), an Investment Program Empowered Committee (IPEC) and a State Investment Program Monitoring and Implementation Unit (SIPMIU).The SIPMIU is responsible for overall program implementation, monitoring and supervision in the respective cities. 7. The SIPMIU will have a Social Safeguards Unit headed by a sociologist. Depending on the anticipated volume of resettlement and other related issues, a Resettlement Officer & supporting NGOs may be required as part of the Unit. 3

6 ROs/and NGOs will be responsible for RP implementation. However, in small projects where resettlement issues are is not anticipated or minimal, an extensive staffing in the SSU is not essential. In case any resettlement issues arise during the subsequent stages of implementation, the services of competent personnel/agencies like RO/NGO shall be engaged. The generalized institutional roles of the involved entities are identified in Table 1 as a guide line. The Social Safeguards Unit under SIPMIU will take care of redressing grievances and mitigating negative social impacts caused due to the project with the aid of the existing system and shall request the Program Director for further reinforcement of support staff/ngos if required. Introduction distribution tanks, main storage tank at the water treatment plant and other nodal points Procurement & installation of 6000 domestic water meters and changing over the existing consumer connections from the bunch system to the underground loop system which will be installed under subproject-3 above 9. In order to identify the Resettlement Impacts, if any, due to the subproject implementation, the SIPMIU officials & the DSMC experts have carried out sufficient site visits and consultative inspections in the project areas during the preparation of RP. Based on this and further discussions held with the local public in the city, it has been confirmed that the implementation of the above subprojects would not have any Involuntary Resettlement (IR) impact at any stage. Hence all the sub projects of tranche-1&2 with respect to Involuntary Resettlement impact would be under Category C. However, periodic site visits and discussion with local public will be continuing during the project implementation to confirm that no resettlement issues remain unnoticed or unaddressed Scope of Impact Tranche -1 Sub Projects 10. Solid Waste Management: Permanent land acquisition is not envisaged in both the sub projects taken up under tranche -1. The development of Solid Waste Management Plant at Leire is confined in the land owned by the Kohima Municipal Corporation. The work is in progress and as per the revised program finalized by the civil contractor, on 10th Nov 2014, all works are targeted to be completed by April, As the Leire (SWM) site is surrounded by agricultural lands, three households those who are having agricultural land nearby the SWM site encroached to the area earmarked for SWM (away from construction site as well as green belt area) and constructed cattle shed and shelter for cattle caretakers. This was noticed in the month of September, 2013 and a meeting was arranged by resettlement specialist of DSMC immediately (on 21st September, 2013) to discuss the issues with encroachers. During that meeting they had agreed to vacate the land based on the request of SIPMIU (details of the meeting was illustrated in the semiannual report prepared for the period from July to December, 2013). However this issue was remained unsettled for a long period, further district administration was informed by SIPMIU to intervene in the issue and now it is in the process. District Collector (DC) has inspected the site in the month of June, 2014 and consultations with the encroachers are in progress. 12. Water Supply: 10 tanks out of 18 are commissioned and another 7 are ready for commissioning. The construction work of 7 tanks and the refurbishment of the old water treatment plant at Jotsoma including installation of two new electro chlorinators are in progress. The construction of the remaining 1 tank (Assam 6

9 Rifles HQ) is now proposed under Tr-2 (Construction of storage reservoirs for 9 hydraulic zones ). No IR issues are identified at these project locations during this reporting period Tranche -2 Sub Projects 13. Laying of new water supply distribution network of pipe lines of total length of 318 km in Kohima Municipal Area is the major work planned under water supply sub project of tranche-2. The civil works are proposed to be carried out within the existing RoW and road shoulders. Therefore, no land acquisition is envisaged in this sub project. Digging along the existing right-of ways (RoW) of city roads for laying of these lines will have no impacts as the proposed pipelines will be laid on the edge of the road. The maximum required trench width for laying down of different sizes of pipe lines range between 30cm to 100 cm only and can be accommodated in the road shoulders. At locations where there are permanent structures blocking the alignment of pipe lines, suitable measures to deviate these structures by using appropriate pipe bends are provided at the stage of pipe line design itself. Care is also taken to minimize adverse impacts by selection of appropriate alignment for the pipe lines. The trenching, pipe laying, jointing & pressure testing works etc inside the city will be done in a phased manner & fast pace to minimize the period of disruption. The details of the works have been communicated to the State PWD who is maintaining the PWD& Municipal roads in Kohima. 14. Advance notices (based on the construction plan developed by the civil contractor) to the residents of the area will be given at least 7 days prior to the commencement of the civil works in the respective locality. The community organizers mobilized in SIPMIU under Social Development Officer shall undertake the activities of construction facilitation with the guidance of Community Development and Construction Facilitation expert of DSMC. The COs shall be trained periodically. Sufficient provision is also made in the contract agreement for the repair of roads, providing temporary access across the pipe line trenches (wherever necessary), repair of existing water pipe lines, cables, electric posts, dust prevention, soil erosion and all other similar menaces. 15. The joint site visits carried out by the Resettlement Specialist of DSMC along with water supply design engineers did not identify any IR impact and the presence of IPs. However, in case of any change in locations and scope of work, IR screening and RPs (if required) shall be prepared and disclosed in ADB & EA web sites. 16. Since Nagaland Government is not maintaining any land records, disputes on ROW shall be settled through discussions during the time of project implementation, the service of Community Organizers (appointed under SIPMIU for community participation) shall be utilized for these activities. Social Safeguard Expert of SIPMIU, Resettlement Specialist and Construction Facilitation and Public Awareness Experts of DSMC will play a leading role in addressing the people s concerns during the project implementation Additional Works proposed under Tranche Integrated SWM: Works under this subproject includes the procurement of vehicles, construction of rest rooms and construction of dry waste segregation unit. As construction of rest rooms and dry waste segregation unit is planned within the boundary of existing SWM site, no additional land is required for this sub project. The base line (Involuntary Resettlement Screening) survey conducted on , shows that all the lands earmarked for construction of community toilet block are uninhabited and barren. 7

Construction of 5 community toilet blocks; The lands earmarked for the two locations are belonging to Kohima Municipal Council (KMC) and one location belongs to the PHED, Government of Nagaland. The remaining two belong to three private individuals. However, all the three land owners have voluntarily surrendered the land required for the project. The base line (Involuntary Resettlement Screening) survey conducted on , shows that all the lands earmarked for construction of community toilet blocks are uninhabited and barren. Based on the above assessments the subproject has been categorized as C for Involuntary Resettlement (IR) impact as per the ADB s Safeguard Policy Statement, Hence no Resettlement Plan (RP) needs to be prepared for this sub project at this stage. A SIA& IR screening report was prepared for this sub project and submitted for ADB s review. The report shall be further modified based on the review comments. 19. Construction of 7 service reservoirs; under this subproject 7 service reservoirs are proposed for 9 hydraulic zones (with multiple compartments at two locations). The lands earmarked for relocating the 6 storage tanks (out of 7) are in possession of the forest department and consent from the department as well as from the traditional land owners (T-Khel ) have been obtained. The 7th land belongs to private individual. The land owner has voluntarily surrendered the land for the project. All the lands are uninhabited. This subproject will not entail any private land acquisition and involuntary resettlement. Based on the above assessments the subproject has been categorized as C for Involuntary Resettlement (IR) impact as per the ADB s Safeguard Policy Statement, Hence no Resettlement Plan (RP) needs to be prepared for this sub project at this stage. A SIA& IR screening report was prepared for this sub project and submitted for ADB s review. The report shall be further modified based on the review comments. 20. Septage Management: The Plant shall be constructed in the land owned by KMC at Dzuruzou (outskirts of the city around 3 Km from habitation), KMC is having around 94 Acres of land in that particular location and the project requires only one hector. The land earmarked for the construction of plant is uninhabited. The approach road is already in place and under use by villagers and vehicles transporting solid waste to dumping site. The IR screening report prepared for this work is attached as appendix -1 of this report Status of RP implementation 21. As discussed above the subprojects taken up under tranche 1 & 2 do not impart any sort of IR and IP impacts and hence the status of RP implementation is not relevant here. However the subproject wise IR impact status is summarized in table.3 below. As part of sensitizing the importance and reviewing the status of safeguard compliance during the subproject implementation periodic meetings have been conducted at construction sites, details are summarized in table 4. The project managers and site engineers of civil contractors and safeguard specialists of SIPMIU and DSMC along with technical staff were attended the work shop and clarified their doubts. Table 3. 15 5 Compliance status of loan covenants 23. The compliance status with respect to loan covenants is presented in table 5 below Table 5. Adequate compensations are provided prior to the signing of relevant civil work contracts, and involuntary resettlement is carried out in accordance with the resettlement frame work (RF) and resettlement plans (RPs) agreed upon between the Government and ADB. An RP will be prepared for each sub project involving land acquisition and resettlement and shall be submitted to ADB for review and approval prior to award of any related civil work contract. 2 GOI and the State will ensure that sub projects will not negatively impact on vulnerable groups, such as indigenous people. In the event of their involvement in any of sub projects, the GOI and the states will ensure the that the sub projects are carried out in accordance with the Indigenous People Development frameworks (IPDF) agreed up on between GOI, the States and the ADB and comply with ADBs policy on Indigenous People (1998) 3 In the event any issues related to indigenous people arise in course of project implementation, the borrower and the state shall ensure to address those issues in accordance with the applicable laws and policies of the borrower, ADB s policy on indigenous Peoples (1998) and the Indigenous Development Framework for the facility as agreed between the Borrower, the State and ADB. The implementation of the subprojects will not create any major adverse impact on community. 7 Policy and Legal Framework 25. The policy framework and entitlements for all the subprojects of the investment program under tranche 1&2 are based on the National Resettlement and Rehabilitation Policy, 2007 (NRRP) and ADB s Safeguard Policy Statement, (SPS) Validation and Verifications of APs 26. Since the subprojects are falling in the C category as per ADB Policy on Involuntary Resettlement (1995) for Tranche-1 and ADB Safeguards Policy Statement (2009) for Tranche-2, no RP was prepared. 9 Public Consultations and Disclosure of RP 27. Public consultation and information dissemination are treated as a two way process through which the information is passed on to public and their feedback is sought to understand their issues. In addition to the discussion of specific issues, details about the safeguard policies and GRC of the project are broadcasting in all public meetings. The consultative process shall be continued throughout the project period. The activities conducted during the current reporting period is summarized in table.4 10 Grievance Redressal 28. A Grievance Redressal Committee has been constituted as per the guideline of EMP. The same is attached as Appendix Monitoring and Reporting 29. As part of streamlining the collection and segregation of household solid wastes before commissioning the SW plant at Leire, a pilot project has been developed and the same is under implementation at two wards of KMC, this activity plan shall be updated frequently based on the feedback from the field. Gender sensitisation activities and plan for inclusive (gender) development shall also be discussed throughout the program. 14

22 1 Introduction 1 The NERCCDIP envisages achieving sustainable urban development in the project cities of Agartala, Aizawl, Kohima, Gangtok and Shillong through investments in urban infrastructure sectors. The urban infrastructure and service improvements targeted in Kohima under the program are in the following sectors (i) water supply, (ii) solid waste management (iii) sewerage and sanitation and (iv) capacity development of the stake holders. The expected impact of the NERCCDIP in this city is some of the increased basic amenities, reduced poverty and social & financial imbalances. The expected outcome of the program will be an improved urban environment and living standards for the people expected to be living in Kohima till the end of the design period of the program which is apparently the year The program will provide support to (i) improve and expand the few of the prioritized urban infrastructure and its subsequent services in Kohima (ii) strengthen the institutional, management, and the financing of KMC. The program of Kohima will be implemented over a six year period beginning in 2009, and will be funded by a loan via the MFF of the ADB. The SIPMIU of Kohima is the Project Implementation Unit (PIU). The program in Kohima is now under implementation under the tranche-1& 2 loan support of the ADB. 2 The following are the major deficiencies in basic amenities in the City in the sector of water supply, garbage disposal and sanitation. The PHED water supply system is connected to only one fifth of the households of the City and that too limited to certain areas. The water supply is limited to once in three to seven days in the lean season. The present water sources are inadequate to meet the water requirement. The garbage collection is not satisfactory. Collection from households is twice in a week. Garbage is not segregated at its source. There is no sewerage system in the City. Human waste is disposed into pits or septic tanks. 3 Except for a sewerage system for the City, efforts are being taken to rectify the above deficiencies through the subprojects now being implemented undertranche1& 2 as well as the subprojects proposed under variations in Tranche -2 4 This Social Impact Assessment and Involuntary Resettlement (IR) screening report discuss about the Septage Management Scheme for Kohima Municipal Council This subproject proposed to be taken up under tranche -2 in sanitation sector. 2 Existing Sanitation and Septage Management Infrastructure in Kohima 5 At the present, sanitation infrastructure is looked after by Kohima Municipal Council (KMC). The City is divided into 19 wards, each having a sanitation committee that helps citizens in improving the sanitation in their premises. The Sanitation committees are also monitoring the functioning of existing sanitation mechanism. There is no sewerage system in the City. Household Sanitary wastewater is discharged into Septic tanks for treatment and disposal into soak pits or in surface drains. Sludge in the wastewater gets accumulated in the septic tanks and get anaerobically digested. This sludge is periodically removed and disposed. Normally Septic tanks are designed for a cleaning frequency of two years. However, In Kohima, because of space constrains and other reasons, the septic tanks provided are not of correct design and capacity; most of them are under sized. These septic tanks are required to be cleaned more frequently; also accumulated septage is not getting fully stabilized. Disposal of this septage without further treatment is an 3

23 environment hazard. Citizens awareness about hygiene is good and there is preparedness for improvements in the existing system. 6 Toilets & Septic Tanks: Almost all houses are having lavatories and about 95 % are connected to septic tanks and the remaining to open dug pits covered at top. Lavatories are pour- flush/cistern type. Septic tanks have not been constructed in a scientific way. They have been provided as per the availability of land, finances of the house owner as well as mason s skill. Major problem in many cases is the volume of the tank. Because of space constraints, soak pits have been provided for very few tanks only. Other septic tanks are discharging the effluent into storm water drains. The septage accumulated in the tanks is collected by vacuum tankers and disposed off untreated at the waste dumping site belonging to KMC at Dzuruzou, about 12 km from Kohima. This practice of collecting and transportation to dumping site was started in 2006 after KMC acquired a 3000 lit capacity Vacuum tanker. Prior to this, septic tanks were emptied in to the adjacent storm water drains through a bottom outlet during rainy season. This practice is still continuing, but to a lesser extent, as KMC s infrastructure is not adequate to provide vacuum tanker service to all the dwellings. Because of insufficient volume and poor maintenance, the septic tanks get filled up with septage with in short durations, resulting in short circuiting & overflow of sullage of improper quality into storm water drains. Thus more frequent emptying of septic tanks is required in Kohima 7 Collection and Transport of Septage; As pointed out, till the year 2006, there was no mechanized arrangement for cleaning and emptying of the septic tanks. It is still a practice still in Kohima to drain the septic tanks in to the steep storm water drains during rainy season taking advantage of the torrent flow and steep gradient. KMC acquired its first vacuum tanker in the year Second vacuum tanker arrived in 2009 and third one is procured in the year Out of these three, one acquired during 2009 is out of service. Thus only two vacuum tankers are in operation and in a week of 5 working days, 20 to 30 tanks are emptied. 8 Treatment and Disposal: At the present there is no arrangement for the treatment of septage. Untreated Septage is disposed off at the disposal site at Dzuruzou without treatment, causing serious environmental pollution at Dzuruzou. 9 Administrative Mechanism: In the present, operating mechanism, citizens submit request to KMC for the removal of septage from their septic tank as and when septage accumulates to full level. The KMC shall inform the date of convenience after collecting the service charge. The tariff is Rs per trip for the 3000 lit capacity vacuum tanker and Rs 4500 for the 5000 lit capacity vacuum tanker. The ward level sanitation committees monitors the malfunctioning septic tanks as well as illegal draining of septic tanks in to storm water drains. There is provision in KMC to penalize illegal draining of septic tanks. 3 Project Description 10 Since Kohima is not having sewerage system, City s sanitation is fully dependent on proper functioning of septic tanks as well as proper collection, transportation, treatment and safe disposal of septage. This situation will remain to significant extent, even after the introduction of a sewerage scheme in future. This is because of the topography of the City and narrowness of some roads; it will not be possible to cover the entire City under sewerage scheme. Thus providing a good septage management system and replacement of existing septic tanks with scientifically designed septic tanks is a necessity for safeguarding City s environment. 4

24 11 Existing Septage management Infrastructure is unscientific and also inadequate even to serve the present population. The infrastructure requires improvement and expansion to make it suitable for the expected future increase in population. There are two major short comings in the existing system Inadequate collection & transportation arrangements Unscientific disposal of septage 12 As the present system is not adequate to serve entire City, many households are draining their septic tanks into storm water drains. Disposal of untreated septage and sullage is cause of several concerns. 13 Considering the present practice of septage collection,3 nos 3 cubic metre capacity and 5 nos of 5 cubic metre capacity vacuum tankers are proposed for septage transportation from the City. The septage will be unloaded in a collection chamber from where it will flow through a de-gritting channel to Equalization cum conditioning tank. In the de-gritting channel, heavy particles like sand, grit etc will settle down, which will be removed periodically. Two grit channels one working and one standby will be provided with isolation gates. 14 In equalization tank, water will be aerated and stirred with air flowing through it. Here lime will be added for correcting the ph as well as for conditioning of the water for better solid liquid separation. By addition of lime, release of hydrogen sulfide which causes odor will be arrested. Septage is expected to have suspended solid in the range of 1 to 2 %. In order to increase this concentration to 5 to 7 % for economical mechanical dewatering, sludge from Equalization tank will be feed to Sludge Thickeners. 15 In Sludge Thickener, solid liquid separation will take place by gravity separation process. Underflow from thickener will be collected in the sludge storage tank and over flow will be taken to biological treatment section (Activated Sludge process). 16 Sludge from Sludge Storage Tank will be fed to mechanical sludge drying equipment. Solid Bowl Centrifuge/Filter press will be used for this purpose. Sludge cake form mechanical dewatering will have 30 to 40 % solids and will be of spadable consistency. It shall be stored in a shed for further drying and packed & disposed off for use as farm manure. 17 The liquid from dewatering machine will be sent back to an equalization tank for re processing. Polyelectrolyte will be added for improving solid liquid separation in thickener and in mechanical dewatering. Separated Liquid will be treated for removal of biological matter by activated sludge process. The effluent from the activated sludge process will be disinfected and disposed off into inland surface water. 25 the construction of plant is uninhabited. The approach road is already in place and under use by villagers and vehicles transporting solid waste to dumping site. The location map of the project location is shown in the google imagery attached as appendix -1, further the land ownership details of the land earmarked for the project is attached as appendix The subproject will not entail any private land acquisition and involuntary resettlement. This was confirmed during the field reconnaissance conducted on 9th December, 2014 by the Resettlement Specialist of DSMC and Assistant Engineers of SIPMIU along with KMC officials. 5 Conclusion 20 Based on the above assessments the subproject has been categorized as C for Involuntary Resettlement (IR) impact as per the ADB s Safeguard Policy Statement, Hence no Resettlement Plan (RP) needs to be prepared for this sub project at this stage. 6
