1 Public Disclosure Authorized Public Disclosure Authorized Public Disclosure Authorized Public Disclosure Authorized ABBREVIATED RESETTLEMENT ACTION PLAN RP285 V. 3 For the North Septage Treatment Plant Barangay Gitnang Bayan II, San Mateo Rizal Manila Third Sewerage Project Manila Water Company March 4, 2005 PROJECT BACKGROUND: The Manila Third Sewerage Project (MTSP) is a Manila Water Company, Inc. (MWCI) project funded by the World Bank that ultimately aims to address the escalating waterborne pollution in Metro Manila, Laguna de Bay and Manila Bay and to improve the living conditions of urban residents, including the poor, through strategic investments in sewerage and sanitation. It comprises three main components: Septage Management, Sewage Management and Technical. The Septage Treatment Plants (SpTP) is a component of the MTSP which aims to collect and treat septage in the East Concession Area. Presently, the east concession area has around 545,000 households that are using septic tanks, equivalent to nearly 2.5 million residents. Septic tanks provide only primary treatment for domestic wastewater which is insufficient to meet sewage discharges compliant with environmental standards. Most septic tanks are ill-maintained and/or poorly designed, significantly contributing to the pollution loading to local bodies of water. Recent studies show that around 70% of all water pollution in Pasig River comes from domestic sources. Regular desludging of the settled solids in septic tanks prevents septage overflows and assures efficient primary treatment. From 1997 to 2004, Manila Water has desludged around 35,000 septic tanks. The collected septage is currently being used as soil conditioner in lahar fields in Pampanga. As Manila Water plans for the expansion of its sanitation services, two SpTPs are proposed to be constructed in order to optimize haulage distance and increase treatment capacity. A northern facility will primarily serve Quezon City, Marikina and San Juan, and a southern facility will primarily serve Mandaluyong, Pasig, Makati, Pateros and Taguig. The proposed North Septage Treatment Plant will be located in Barangay Gitnang Bayan II, San Mateo, Rizal. The property has a total lot area of 15,243 square meters and is adjoined by an industrial plant, agricultural lands and sheds, and residential houses. Presented in Figure 1 is the location map. The lot itself used to be a frog farm. Presently, eleven families are residing in the project site. The heads of the families were former employees of the previous lot owner. San Mateo RAP 1
2 POTENTIAL IMPACTS: The construction of the SpTP will necessarily require the clearing of the lot and will involve the resettlement of the 11 families. OBJECTIVES: Consistent with MWCI s Land Acquisition, Resettlement and Rehabilitation Policy, this abbreviated RAP aims to ensure that all adverse impacts of acquisition of assets and properties are fully mitigated and that the eleven displaced families are benefited and are not worse off as a result of their resettlement. 4 SOCIO-ECONOMIC SURVEY A survey/census was conducted on February 7, 2005 by MWCI wastewater project development officers with the representative of the lot owner. 5 Total families: 11 Total population: 53 The Bgy. Gintang Bayan property (the property ) is used as a warehouse for the Advance Engineering Corporation, which is owned by the previous lot owner. Back in 1999, the property also had a farm for edible frogs raised for export. The house and lots occupied by the families residing in the property were offered by the previous owner as Housing Benefit to employees of Advance Engineering Corp and/or of the frog farm. As beneficiaries of the housing benefit, the families have also acted as caretakers of the lot for the previous lot owner. Families 8 to 11 are families of the children of Romy Sta. Maria that have resided in the property since January The families built their houses using salvaged materials owned by the lot owner. Household income is estimated at an average of 15,000 monthly. Evidence of electrical appliances like television sets and refrigerators and the fact that a couple of families have more than one earning member indicate a reasonable level of disposable income available for discretionary spending. This indicates better capacity for the affected families to adapt to the relocation. CONSULTATION: The families were consulted prior to the negotiation for the sale of the property in February The identified families have agreed that they will vacate the premises once the lot is sold. However, financial assistance for the relocation will be provided to the displaced families by MWCI, in accordance with MWCI s Land Acquisition, Resettlement and Rehabilitation Policy. Options that were presented to the families are the following: Option 1: Provision of alternative housing in a 24-hectare property of the previous owner in Montalban, Rizal Salvaging of reusable construction materials from their present houses Cash compensation for the affected house s computed at replacement cost Free transportation from place of origin to new location. Option 2: A financial assistance package of P 18, (the law prescribes only minimum daily wage P multiplied by 60 days or P 17,100.00) per family as minimum. San Mateo RAP 5
6 Cash compensation for the affected house s computed at replacement cost Salvaging of reusable construction materials from their present houses Free transportation from place of origin to new location. The families have signified their preference for option 2 as it provides them with money they can use to start small livelihood businesses. Some families expressed their intention to return to their home provinces in Luzon and Visayas. IMPLEMENTATION AND MONITORING ARRANGEMENTS: Manila Water as project proponent and implementing agency shall be responsible for ensuring its project is compliant with its Resettlement Policy (RP). In line with the RP, Manila Water will follow guidelines for the just and humane relocation of informal settlers and will provide the displaced people with applicable entitlement. Manila Water will submit to the World Bank a formal report on the conduct and result of the resettlement of the 11 families. GRIEVANCE PROCEDURES: Grievance procedure under the MWCI Resettlement Policy will be followed. Grievances will be handled through negotiations and are aimed at achieving consensus. Complaints will pass through two stages before they may be elevated to a court of law as a last resort. IMPLEMENTATION SCHEDULE: Affected families will be given at least sixty (60) days notice before demolition. Notice will be issued sometime in the second quarter of 2005 after Manila Water/lot owner obtains the necessary PCUP clearance. Where applicable, compensation and/or other assistance required for relocation will be provided and sites for relocation will be prepared prior to any taking of land and/or assets. COST ESTIMATE: Manila Water has committed to pay the cost of resettlement assistance at PhP 198, (PhP 18, x 11) and transportation assistance with a value of Php 33, (PhP 3,000 x 11). The valuation of houses/s has yet to be finalized. Sufficient budget has been allocated under the Wastewater Capital Expenditure. San Mateo RAP 6
