4 Introduction EFFECTIVE COMMUNICATION It is important to periodically evaluate our ability to communicate our position on issues with the state legislature. The legislative voting record on these issues is one way to measure our effectiveness in communicating our position. A brief summary of the bills from the 47 th Second regular session (2006) for issues on which the Game and Fish Commission has taken a formal position is included in this summary. SUMMARY OF THE 47 TH LEGISLATURE 2 ND REGULAR SESSION The Arizona State Legislature adjourned sine die on Thursday June 22, 2006 at 12:12am. The Legislative Session was lengthy and contentious placing fifth on the list of the longest regular sessions. Leadership in both houses had agreed upon an 82 day time-table for adjourning which included sending the budget to the Governor by March 7 th, the Governor received the budget on June 20 th. The Game and Fish Commission legislative representatives and the Legislative Affairs Division faced a lengthy session as well. Over one hundred bills were tracked many of them potentially affecting the Department. Subject Number Days of Session 164 Bills Posted 1,453 Bills Passed 438 Bills Vetoed 34 Bills Signed 375 Memorials, Resolutions Posted 134 Memorials, Resolutions Passed 26 The Commission voted to oppose four bills: HB 2127 nonresident big game permits; limits, SB 1291 shooting range; prohibition, SB 1300 wildlife habitat restoration committee and SB 1448 refundable hunting licenses. (SB 1441 wildlife habitat restoration fund was later supported by the Commission.) HB 2127 was the only bill that was passed, giving the Department a 75% success rate in preventing the passage of bills the Commission formally opposed. The Commission formally supported nine bills, however up to 12 bills were supported at one point or another. (Budget bills were duplicated in the House and Senate) The Department s success rate on passing Commission formally 4

5 supported bills was 77.7%. (This takes into consideration SB 1438 unlawful feeding of wildlife that was added to HB 2129 illegal hunting; penalties.) Among these is HCR 2045 state trust land reform. This referendum, sponsored by Representative John Nelson, will be on the November ballot. The Commission has not taken a position on this pending ballot measure. Special Session 47 th Legislature 1 st Special Session A special session was called by the Governor encompassing the subject of English Language Learners. Five bills were posted, one passed and one vetoed. The special session lasted 41 days and was adjourned on Monday, March 6 th, 2006 at 4:03pm. Governor s nominee to the Game and Fish Commission The Governor nominated Jennifer Lynn Martin to the Commission to serve the fixed term of 5 years. Ms. Martin was confirmed by the Senate Natural Resource and Rural Affairs Committee on Wednesday, March 1, 2006 by a vote of 4-3. Ms. Martin s confirmation was never before the full Senate for a vote. See ARS Commissioner Martin was appointed by the Governor to the Game and Fish Commission on June 22, General Effective Date The general effective date for 2006 enactments not containing an emergency clause, or other specified date is the 90 th day after the Legislature adjourns the session. For this past regular legislative session, the general effective date is September 21,

8 HOUSE BILLS ENACTED INTO LAW HB 2127 nonresident big game permits; limits (Chapter 126, Laws 2006) Sponsor: Representative Jerry Weiers Summary: The Game and Fish Commission shall limit the number of big game permits awarded to nonresidents during random drawings to 10% or fewer of the total number awarded except in extraordinary circumstances, at a public meeting the commission may increase the number of permits issued to nonresidents in a random drawing if, on separate roll call votes the members unanimously support the finding of an extraordinary circumstance and adopt the increased number of nonresident permits for the hunt. Disposition: Signed by Governor Janet Napolitano 4/17/06 Impact Level: HIGH (Yes Vote -3, No Vote +3) HB 2129 illegal hunting; penalties (Chapter 238, Laws 2006) Sponsor: Representative Jerry Weiers Summary: Minimum fines for illegal taking of wildlife are increased. The Commission may permanently revoke or suspend for a period of five years or more a person's hunting privileges for repeat violations, unlawful taking of trophy (defined) or endangered species or taking three times the established limit. The Commission may initiate proceedings to intercept a violator's state tax refund to pay the fine and the bill creates a tiered civil assessment and revocation system based on the number of convictions an individual has for unlawful take or wounding of wildlife. The maximum balance in the Wildlife Theft Prevention Fund is no longer limited to $50,000. A petty offense for feeding wildlife in the counties of Maricopa and Pima is created. Tree squirrels, birds, title 17 authorized actions and normal livestock and agricultural activities are exempt. The list of actions that constitute interference with rights of hunters (a class 2 misdemeanor) is expanded to include item such as making or attempting to make physical contact 8

9 with a person lawfully taking wildlife, interjecting oneself into the line of fire, disturbing real property intended for use in a hunt, and using loud noises, gestures, scents or any other "natural or artificial visual, aural, olfactory or physical stimuli to disrupt or annoy a hunter. Disposition: 4/25/06 Was not heard in rules, reassigned to Appropriations P for an additional strike everything amendment. Impact Level: MEDIUM (Yes Vote -2, No Vote +2) SB 1300 wildlife habitat restoration committee; appropriation Sponsor: Senator Marilyn Jarrett Summary: In FY , and an appropriation of $5 million is made to the Wildlife Habitat Restoration and Enhancement Fund. An 8-member Wildlife Habitat Restoration and Enhancement Committee and fund are established to address issues regarding the establishment and monitoring of specific projects for which the legislature appropriates money to the Wildlife Habitat Restoration and Enhancement Fund, prioritize the order, importance and funding of such projects and submit an annual report on the work, goals, objectives and funding of the committee to the governor, Arizona Game and Fish Department, Speaker of the House, President of the Senate, Secretary of State and director of the Arizona State Library, Archives and Public Records. 14 SB 1438 unlawful feeding of wildlife 11 Sponsor: Senator Toni Hellon Summary: A person, in a county with a population of 280,000 or more people, is guilty of unlawful feeding of wildlife, a petty offense, by intentionally or recklessly feeding, attracting or otherwise enticing wildlife into an area, with exceptions for public employees performing their lawful duties and normal agricultural or livestock operations. Tree squirrels and birds are exempt. Disposition: 3/27/06 Did not receive a hearing in the House Judiciary Committee. Impact Level: MEDIUM (Yes Vote +2, No Vote -2) SB 1448 refundable hunting licenses Sponsor: Senator Ron Gould Summary: Conditions are stipulated under which the fee for Class G (general) hunting licenses may be refundable if the licensee was unsuccessful in a big game draw. Disposition: 2/8/06 Failed 2-4 in the Senate Natural Resource Committee. Impact Level: HIGH (Yes Vote -3, No Vote +3) SB 1508 regulation of off-highway vehicles Sponsors: Senator Jake Flake, Senator Ken Bennett Summary: Current monies in the Off Highway Users funds will be used by the Game and Fish Department not the State parks board. 15 MISCELLANEOUS BILLS HB 2661 state employees; pay increases (Chapter 1, Laws 2006) Sponsor: Representative Bill Konopnicki Summary: A Legislative Intent section states that state employees be granted a pay increase consisting of a lump-sum amount of $1,650, and 2.5% in performance pay. Each agency must establish a list of performance measures designed to result in cost reductions, increased productivity and/or improved quality. For meeting or exceeding the performance measures, performance pay may be granted to an entire unit, a department, division, section or individual. List of duties of the Performance Based Incentives Program Oversight Committee is expanded by adding a review of performance measures submitted by agency heads and monitoring the effectiveness of agencies in meeting the goals. Employees of the Legislature, governor's staff and state universities are excluded from the provisions of the section on performance pay. An appropriation of $51,738,300 in current fiscal year and $169,079,000 in fiscal 06-07, of which approximately 77% shall come from the general fund and the remainder from other appropriated funds. (i.e. game and fish fund) Salary adjustments to commence on March 11, Emergency clause. Disposition: Signed by Governor Janet Napolitano 1/30/06 (lineitem veto) No Commission position taken on HB 2661 HB 2577 border security and immigration reform Sponsor: Representative Russell Pearce) Summary: Specifically > The sum of $200,000 is appropriated from the state general fund in fiscal year to the state land department to enter into a contract with a private contractor for an environmental impact study of the effects of illegal immigration on state lands in the southern Arizona border counties. 16 Analysis HOW LEGISLATORS VOTED Below you will find the non weighted and weighted results of how members of the legislature voted. KEY TO THE TABLES ON THE FOLLOWING PAGES Impact Non Weighted Many times legislators are not available for a vote on the floor and subsequently their position is not recorded. A non weighted scale takes in the amount of times a legislator simply voted with the Commission position on legislation. The last recorded vote is depicted only. The scale is as follows: Voted for the Commission position = 1 Voted against the Commission position = 0 The number of times the legislator voted an AGFD position is divided by the total number of bills (the Department has taken a position on) the legislator voted on. Example: Mr. L supported the Commission position 5 times out of a possible 10 Commission position bills. Mr. L supports the Commission position 50% of the time. Impact Weighted Because not all bills impact the Department to an equal degree, the bills are assigned a level of impact in order to place a greater emphasis on more important bills in which the Department sought more support or emphatically opposed. The votes on all bills are weighted in accordance with the degree of impact on the Department. In general, the level of impact of a bill is measured by considering the bill s affect on the existing authority of the Commission, the Department s financial security, or the Department s overall ability to effectively manage wildlife.
