1 April 10, 2018 The Marion County Council held its regular meeting on Tuesday, April 10, 2018, at 9:00 A.M. in the Marion County Council Chambers, Administration Building, Marion, South Carolina. Members present were Buddy Collins, Chairman; Elista H. Smith, Vice Chairperson; Councilman John Q. Atkinson, Jr., Chaplain Allen W. Floyd, Councilman Oscar Foxworth, Councilman Thomas E. Shaw, and Councilman Milton W. Troy, II. Also present were G. Timothy Harper, Administrator; Charles L. McLain III, County Attorney; and Sabrina Davis, Clerk to Council. A representative from the Star & Enterprise was present and duly notified. Chairman Collins called the meeting to order and asked Chaplain Allen W. Floyd to lead the Invocation, after which he welcomed visitors and read the Freedom of Information Announcement. unanimously, to approve the minutes of the regular meeting held on March 22, unanimously, to approve the minutes of a special called meeting on March 28, Motion was made by Councilman Shaw, seconded by Councilman Foxworth, and carried unanimously, to recess the regular meeting and open the public hearing for Ordinance # The County Attorney opened the floor to the public for questions. There were no questions from the public regarding this ordinance. unanimously, to close the public hearing and reconvene the regular meeting. The County Attorney told Council that items A, B, C, D, E, F, G, H first second & third readings for ordinances listed on the agenda as follows were ready: A. Third Reading of Ordinance # An Ordinance Authorizing Pursuant to Chapter 44 of Title 12, South Carolina Code of Laws 1976, As Amended, the Execution and Delivery of a Fee Agreement between Marion County, South Carolina and Rhubarb One, LLC and certain Affiliates and Matters Relating Thereto; B. Second Reading of Ordinance # An Ordinance to Convey the real property bearing Marion County Tax Id Number more commonly known as the Nichols Library Building, from Marion County to the American Legion Auxiliary of Nichols, to authorize the County Administrator to execute the same, and to authorize all Other Matters Related Thereto; C. Motion was made by Councilman Foxworth, seconded by Councilman Floyd, to approve third reading of Ordinance # There was no report given by Committee #2. Chairman Collins read the report from Committee # 1 which met on Tuesday, March 27, Committee #2 discussed the municipal court request from the City of Mullins. The Administrator went over the proposal regarding operation cost, personnel, and other items. It was the recommendation of the committee to accept the proposal for the balance of this fiscal year and fiscal year (A copy of this report is filed with the Clerk to Council). Vice Chairperson Smith stated that Committee #2 has two meetings pending. The County Attorney had nothing to report. Ms. Martha Ray the Volunteer Coordinator with Pee Dee Coalition appeared before Council to give a brief update in reference to Sexual Assault Awareness Month. Ms. Ray provided information regarding domestic violence and sexual assault. Pee Dee Coalition provides direct and support services for victims of sexual assault and their families. Pee Dee Coalition provides community education and awareness on sexual assault, family violence, and child
4 Minutes, April 10, 2018, Page 4 abuse through programs for faith-based, civic, social and school groups. In-service training for professionals, materials distribution, special events etc. She stated that there needs to be more community involvement regarding this issue. Chairman Collins thanked Ms. Ray for her presentation. Mr. Bill Crowther the Economic Developer with Congressman Tom Rice Office appeared before Council requesting support of I-73. Mr. Crowther stated that I-73 will create jobs, attract industry, increase safety and grow tourism. The route will cross Dillon, Marion, and Marlboro counties three of the most distressed communities in the state. This will create 29,000 jobs $43 million in local tax revenue $86 million in state tax revenue and a total economic impact of $1.98 million. Chairman Collins thanked Mr. Crowther for his presentation. The Administrator updated Council on the Capital Sales Tax. Mr. Harper told Council that the Britton s Neck Training Grounds and the Mullins Fire Station project is moving forward. The Administrator had nothing new to report in reference to Hurricane Matthew. The Administrator asked Council's approval to purchase from State contract a John Deere Mower from Sparrow & Kennedy in the amount of $9, Motion was made by Councilman Foxworth, seconded by Councilman Floyd, and carried unanimously. The Administrator provided Council information from Ms. Ogleretta White in reference to Citizen Participation Plan Public Hearings for the purpose of public input on issues such as community needs. The meeting dates are as follows: Wednesday, April 11 th at 5:30 pm at the Marion County Administration Building. Thursday, April 12 th at 5:30 pm at the Saffold Center in Britton s Neck. The Administrator told Council that Marion County Progress and Marion County Economic Development has put together an industry appreciation to be held on Wednesday, April 25 th at 5:00 pm at the Marion County Economic Development Office. Mr. Harper also told Council that the employee health screening will be held on Friday, April 27 th from 8:30-12:00 at the Administration Building. The County Attorney opened the floor for the appointments to the Capital Sales Tax Commission. Councilman Floyd nominated Mr. Johnny Floyd, Vice Chairperson Smith nominated, Mr. Sidney Miller and Councilman Atkinson nominated Dr. Paul Demarco. Motion was made by Councilman Floyd, seconded by Councilman Foxworth, and carried unanimously, to approve and appoint Mr. Johnny Floyd, Mr. Sidney Miller, and Dr. Paul Demarco the fill the three seats on the Capital Sales Tax Commission. Councilman Troy made a motion to present a proclamation to Pee Dee Coalition recognizing April as Sexual Assault Awareness Month. The motion was seconded by Councilman Atkinson and carried unanimously. Councilman Troy asked Mr. Harper to contact Pee Dee Regional Council of Governments regarding funding to complete the West Mullins Drainage Project. Motion was made by Vice Chairperson Smith, seconded by Councilman Foxworth, and carried unanimously, to go into executive session for personnel and an economic development matter.
5 Minutes April 10, 2018, Page 5 Motion was made by Councilman Floyd, seconded by Councilman Foxworth, and carried unanimously, to close executive session and reopen the regular meeting. Chairman Collins stated that no action was taken during executive session called for personnel and an economic development matter. The Administrator provided Council a copy of an invitation to the Grand Opening of the Dillon County Inland Port to be held on Monday, April 16 th. The County Attorney told Council that he executed a contract on behalf of the County to inquire some property related to project Squirrel. The term of the contract slightly exceeded the authority that was granted. Mr. McLain told Council that he needed their ratification on his execution of that contract. Motion was made by Councilman Atkinson, seconded by Councilman Foxworth, and carried unanimously. There being no further business to discuss, motion was made by Councilman Floyd, seconded by Councilman Foxworth, to adjourn the meeting at approximately: 10:44 A.M.
