2 Victor Canning, Township Administrator, stated this institutes a smoking ban throughout the whole property where the Dog Park is located. NO. 3 ORDINANCE NO OF THE TOWNSHIP OF MONTVILLE, COUNTY OF MORRIS, AND STATE OF NJ ACCEPTING A DEED OF DEDICATION FOR A PORTION OF THE PROPERTY KNOWN AS MARS INDUSTRIAL PARK AND DESIGNATED AS BLOCK 3, LOT 38 ON THE MONTVILLE TOWNSHIP TAX MAP: Chairman Sandham opened the public hearing. REPORTS: NO. 1 ADMINISTRATOR: Canning reported on the two-hour parking limit on Main Road in the area adjacent to the Shops at Main, Towaco. We would like to address the concern of parking space swapping. Will prepare an ordinance for the next meeting - January agenda. Waxberg Lane request to install no-thru traffic signs. Township Committee ok. Canning reported that Montville received $15,244 from the Morris County Freeholders for our 2018 municipal alliance program. Field turf publicity our turf is not the turf in question, and we have all of our warranties in place. Letter from Montville Condominium complex. They wanted to recognize our county and municipal police officers for all they do protecting and serving the Township of Montville. NO. 2 ATTORNEY: Fred Semrau, Township Attorney, reported we are still waiting for the JCP&L decision that would memorialize the settlement. NO. 3 TOWNSHIP COMMITTEE LIAISON REPORTS AND COMMENTS: Committeemen Gallopo and Cooney no reports. Committeeman Conklin reported on the Rockaway River Watershed Cabinet meeting. They are trying to retool their mission statement for the future. Personal goals and objectives lists can we do that again for 2017? Sandham stated yes, and I would encourage you to start preparing those as we will make that a priority as soon as the new Township Committee is seated. Conklin requested that the street signs be kept on the front burner. 2

3 Chairman Sandham reported reorganization is January 1 at 3 p.m. at the municipal building followed by a reception at the Lake Valhalla Club at 5 p.m. to help kickoff the 150 th anniversary year. We are doing a special issue of the Montville Messenger in January and a reprinting of the history book of Montville. Library Board of Trustees met last night and passed their budget - $1.7 million roughly. I would like to say that they have been very prudent and judicious in how they are watching taxpayers money. They cut expenses by $10,000 and there is a $113,000 capital spending decrease. Planning Board approved a church on Skyline Drive. Concerns about traffic at certain times. When it is complete I would like Administration to look at the parking on that street. There were eight heroin and opiate deaths in I think it is incumbent on us in 2017 along with the Drug Awareness Municipal Alliance, the Police, the First Aid Squad, and the school system to work hand in hand to see what we can do to improve that situation. We need a game plan. That should be one of the top priorities of OLD BUSINESS: NO. 1 PROJECT STATUS REPORT: No comments. NEW BUSINESS: NO MUNICIPAL BUDGET RECREATION: Canning reported on his memo. The salary is based on a 2% increase. The operating expenses are decreased by $8,000. NO CAPITAL BUDGET AND OPEN SPACE: Canning stated you asked us to revisit the proposed long-term maintenance plan and utilization of open space. June Hercek, Assistant Township Administrator, reported at last meeting we had the amount for open space at $1,078,000. We reduced that amount to $640,000 for We shifted some items to 2018 and We listed the five items that we reduced. We kept the open space tax rate the same. That is our recommendation. Canning stated we will revisit the capital side at the January meeting. Gallopo stated playgrounds and equipment. Are we expanding? Canning stated we need to add safety padding. Some of that money will also be used for other facilities as well. Sandham stated the playground was built almost 20 years ago. There are PEOSHA standards now that we have to get up to. I would expect some extra spending on that. When the open space trust fund was established and the referendum was passed, I don t think people envisioned that we would use it to paint buildings and stuff like that. I think it was mostly to buy and maintain property, maybe put some lighting, but not necessarily used to maintain buildings. We have been very judicious with the use of the open space trust on an annual use basis other than for a direct land purchase. At some point the open space debt will drop off and we will start to generate significant surplus in the open space trust. I think we should spend say $200,000 per year out of open space going forward. I realize we need to play catch up now. We are still keeping to the Long-Term Financial Planning Committee s recommendations. We are holding even for this particular year. I am ok with everything. Gallopo stated good points. I also think we have to recognize that you are going to get to a point where the open space balance is going to start to balloon. Technically you are going to have to make a choice of either cutting the open space tax, not to accumulate that cash, and it is going to bleed back into the other capital budget. We are way behind the eight ball on road improvements and I don t think we will 3

4 ever be able to roll back our spending on them going forward because we are that far behind. Money has to come from somewhere. NO. 3 DRUG AWARENESS MUNICIPAL ALLIANCE INCREASE MEMBERSHIP: Sandham reported a few years ago we cut the membership for lack of volunteers. We have a number of interested people this year. There is a push to increase the membership from 13 to 15. Semrau stated we can do a resolution temporarily at reorganization until we have the ordinance in place. Township Committee ok. Motion approved. RESOLUTION AUTHORIZING CONSENT AGENDA NO CA22: Motion: Gallopo. Second: Cooney. Roll call vote Gallopo, yes; Cooney, yes; Conklin, yes; Nielson, absent; Sandham, yes. Resolution adopted. CONSENT AGENDA ITEM A RESOLUTION AUTHORIZING CANCELLATION OF TAX OVERPAYMENTS OR DELINQUENT AMOUNTS LESS THAN $10.00: WHEREAS, N.J.S.A. 40A:5-17 allows for the cancellation of property tax overpayments or delinquent amounts in the amounts of less than $10.00; and WHEREAS, the governing body may authorize the Tax Collector to process, without further action on their part, any cancellation of property tax overpayments or delinquencies of less than $ NOW, THEREFORE, BE IT RESOLVED that the Governing Body of the Township of Montville, County of Morris, State of New Jersey, hereby authorize the Tax Collector to cancel said tax amounts as deemed necessary. BE IT FURTHER RESOLVED, that a certified copy of the Resolution be forwarded to the Tax Collector, the Chief Financial Officer and the Municipal Auditor. 5 10 Cedar Road (T) Lien Redemption Certificate # $ To: US Bank Cust BV002 Trst & Crdtrs CONSENT AGENDA ITEM C RESOLUTION AUTHORIZING THE PURCHASE OF POLICE RADIOS FOR THE MONTVILLE TOWNSHIP POLICE DEPARTMENT UNDER STATE CONTRACT #83909 (T0109): WHEREAS, the Montville Township Police Department is in need of police radios; and WHEREAS, Motorola Solutions, has a valid State Contract #83909 T0109 for radio communication equipment APX 6000/6500 Mobile/Portable Radios Trunked and Conventional for a total of $37,506.71; and WHEREAS, Township s Chief of Police recommends this purchase; and WHEREAS, this purchase is permitted under N.J.S.A. 40A:11-12, the New Jersey State Cooperative Purchasing Program; and WHEREAS, the Chief Financial Officer has certified that sufficient funds are available for this project. NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Montville, in the County of Morris, and State of New Jersey authorize the purchase of APX 6000/6500 Mobile Radios Trunked and Conventional for a total $37,506.71, under valid State Contract #83909 (T0109). BE IT FURTHER RESOLVED that the Township s Chief Financial Officer has certified the availability of funds for this purchase. BE IT FURTHER RESOLVED that this resolution shall be available for public inspection in the office of the Township Clerk. This Resolution shall take effect immediately. CONSENT AGENDA ITEM D RESOLUTION AUTHORIZING CONTRACTS WITH ADDITIONAL APPROVED STATE CONTRACT VENDORS FOR CONTRACTING UNITS PURSUANT TO NJSA 40A:11-12a: WHEREAS, the Township of Montville, pursuant to N.J.S.A. 40A: 11-12a and N.J.A.C. 5: (c), may by resolution and without advertising for bids, purchase any goods or services under the State of New Jersey Cooperative Purchasing Program for any State contracts entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury; and WHEREAS, the Township of Montville has the need on a timely basis to purchase goods or services utilizing State contracts; and WHEREAS, it has been or will be necessary to enter into contracts with the attached Additional Referenced State Contract Vendors through this resolution and properly executed contracts, which shall be subject to all the conditions applicable to the current State contracts. NOW, THEREFORE, BE IT RESOLVED that the Township of Montville authorized the Purchasing Agent to purchase certain goods or services from those approved New Jersey State Contract Vendors on the below list of additional vendors, pursuant to all conditions of the individual State contracts; and BE IT FURTHER RESOLVED, that the governing body of the Township of Montville pursuant to N.J.A.C 5:30-5.5(b), the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Finance Officer. 6 CONSENT AGENDA ITEM E RESOLUTION ESTABLISHING RESERVE FOR TAX APPEALS: WHEREAS, the Township of Montville wishes to fund the Reserve for Pending Tax Appeals; and WHEREAS, there is a balance of $100,000 in the Tax Appeal line item in the Current Year budget; and WHEREAS, the unexpended Tax Appeal line item totaling $100,000 is to be charged off and utilized to fund the Reserve account for pending tax appeals.; NOW, THEREFORE, BE IT RESOLVED, that the Township Committee of the Township of Montville, County of Morris and State of New Jersey, hereby authorize the chief Financial Officer to fund the Reserve for Tax Appeals in the amount of $100,000. CONSENT AGENDA ITEM F RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE CASH BOND FOR RESTORATION MAROTTA (LAMB), 78 BOONTON AVENUE, BLOCK 1, LOT 29: Planning Board Application PSPP/FC16-01, $10, CONSENT AGENDA ITEM G RESOLUTION AUTHORIZING THE TOWNSHIP TO ENTER INTO A COOPERATIVE PRICING AGREEMENT: Cranford Police Cooperative Pricing System ID #47- CPCPS. CONSENT AGENDA ITEM H RESOLUTION AUTHORIZING THE EXECUTION OF AN INTERLOCAL SHARED SERVICES AGREEMENT WITH THE TOWNSHIP OF WEST CALDWELL FOR THE PROVISION OF ANIMAL CONTROL SERVICES 2017 TO 2019: WHEREAS, the Township of West Caldwell is in need of animal control services; and WHEREAS, the Township of Montville has a licensed and certified Animal Control Officer who is able to perform animal control services for West Caldwell; and WHEREAS, it is in the best interests of Montville to have the Animal Control Officer perform said services for West Caldwell; and WHEREAS, the Mayor and Township Committee have reviewed, are familiar with and have agreed to the terms and conditions of shared services agreement between Montville and West Caldwell for the provision of animal control services. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Township Committee of the Township of Montville, in the County of Morris, that the Mayor is hereby authorized and directed to execute the attached shared services agreement between Montville and West Caldwell for the provision of animal control services. CONSENT AGENDA ITEM I RESOLUTION AUTHORIZING THE EXECUTION OF AN INTERLOCAL SHARED SERVICES AGREEMENT WITH THE BOROUGH OF LINCOLN PARK FOR THE PROVISION OF TAX ASSESSOR SERVICES 2017 TO 2019: WHEREAS, Lincoln Park Borough has a need for a Tax Assessor; and WHEREAS, the Tax Assessor for Montville Township, Christopher Lauver ( Tax Assessor ), is a New Jersey Certified Tax Assessor; and WHEREAS, Christopher Lauver is available to assist Lincoln Park Borough with its tax assessment needs; and WHEREAS, in enacting the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq., the New Jersey Legislature has permitted municipalities to enter into agreements to provide or receive services to/from one another as a means to reduce municipal expenses; and WHEREAS, accordingly, Montville Township and Lincoln Park desire to enter into this Interlocal Shared Services Agreement ( Agreement) through which Christopher Lauver shall serve as Tax Assessor for Montville Township and Lincoln Park Borough. NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Montville, in the County of Morris, and State of New Jersey that the Mayor and Township Clerk are hereby authorized to execute an Interlocal Agreement with the Borough of Lincoln Park for Tax Assessor services; and 6

7 BE IT FURTHER RESOLVED that the Interlocal Agreement shall take effect upon the adoption of appropriate resolutions by all the parties thereto, and execution of agreements authorized thereunder as set forth in the agreement. This Resolution shall take effect immediately. CONSENT AGENDA ITEM J RESOLUTION AUTHORIZING THE RENEWAL OF A LIMOUSINE BUSINESS LICENSE FOR THE CALENDAR YEAR 2017 ACCARIA LIMO, LLC: WHEREAS, Revised General Ordinance Chapter 342 requires the issuance of a license by the Township of Montville for limousine services; and WHEREAS, Accaria Limo, LLC has filed an application, all necessary fees, and documentation for the renewal of the following limousine business license and three vehicles for the year 2017: Business License: Accaria Limo, LLC, 4 Craig Court, Montville, NJ Vehicle Parking Location: 4 Craig Court, Montville, NJ Vehicles (3): Lincoln Stretch Lincoln Town Car Lincoln Stretch 64 ; and WHEREAS, the application conforms to the requirements of the Township Ordinance and the ordinances of the Township of Montville, and the Township Clerk and the Police Department have approved the application; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Montville, in the County of Morris, and State of New Jersey, that a limousine business license be issued to Accaria Limo, LLC for the year CONSENT AGENDA ITEM K RESOLUTION AUTHORIZING THE ISSUANCE OF A LIMOUSINE BUSINESS LICENSE FOR THE CALENDAR YEAR 2017 RIYANK LIMO, LLC: WHEREAS, Revised General Ordinance Chapter 342 requires the issuance of a license by the Township of Montville for Limousine Services; and WHEREAS, Riyank Limo, LLC has filed an application and all necessary fees for the renewal of a limousine business license with two vehicles for the year 2017: Riyank Limo, LLC, 59 Davenport Road, Montville Parking Location: 59 Davenport Road, Montville 2007 Chevy Wagon Black, OL4692J 55 Route 46 East, Pine Brook 2007 Ford Expedition White, OL3363J ; and WHEREAS, the application conforms to the requirements of the Township Ordinance and the Police Department has approved the application; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Montville, in the County of Morris, and State of New Jersey, that a limousine business license be issued to Riyank Limo, LLC for the year CONSENT AGENDA ITEM L RESOLUTION AUTHORIZING TRANSFER OF FUNDS 2016: WHEREAS, various bills have been presented for payment; and WHEREAS, it is determined by the Chief Financial Officer that there is a need to transfer funds to cover bills presented for payment in the respective appropriation accounts; and WHEREAS, N.J.S. 40A:4-58 provides for the transfer of funds during the last two months of the fiscal year, to expend for any of the purposes specified in the budget an amount in excess of the 7

8 respective sums appropriated therefore and there shall be an excess in any appropriations over and above the amount deemed to be necessary to fulfill the purpose of such appropriation. NOW, THEREFORE, BE IT RESOLVED by the Committee of the Township of Montville, (not less than two-thirds of all members thereof affirmatively concurring) that the following transfers be made between the 2016 Budget Appropriations as follows: From Amount To Amount Current Fund Group Insurance $ 20, Roads S&W $ 40, Roads S&W (OT) $ 20, $ 40, $ 40, BE IT FURTHER RESOLVED, that the Chief Financial Officer is hereby authorized and directed to make the transfers. CONSENT AGENDA ITEM M RESOLUTION AUTHORIZING THE PUBLICATION OF BID SPECIFICATIONS FOR JANITORIAL SERVICES: WHEREAS, Montville Township s current janitorial services contract will expire on December 31, 2016; and WHEREAS, it is necessary for the Township to publish bid specifications for janitorial services for 2017; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Montville, in the County of Morris and State of New Jersey, that the Township Administrator is hereby authorized to publish bid specifications for janitorial services in the Township of Montville. CONSENT AGENDA ITEM N RESOLUTION AUTHORIZING THE PURCHASE OF TWO (2) DODGE CHARGERS FOR THE MONTVILLE TOWNSHIP POLICE DEPARTMENT UNDER STATE CONTRACT #A88729 (T2776): WHEREAS, the Montville Township Police Department is in need of police vehicles; and WHEREAS, Hertrich Fleet Services, Inc. has a valid State Contract #A88729 T2776 for 2017 Dodge Charger 4-door Sedan Police RWD LDDE48 Police Vehicles; and WHEREAS, the Township s Chief of Police recommends this purchase; and WHEREAS, this purchase is permitted under N.J.S.A. 40A:11-12, the New Jersey State Cooperative Purchasing Program; and WHEREAS, the Chief Financial Officer has certified that sufficient funds are available for this project. NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Montville, in the County of Morris, and State of New Jersey authorize the purchase of Two (2) 2017 Dodge Charger 4-door Sedan Police RWD LDDE48 Police Vehicles for a total of $53,811.60, under valid State Contract #A88729 (T2776). BE IT FURTHER RESOLVED that the Township s Chief Financial Officer has certified the availability of funds for this purchase. BE IT FURTHER RESOLVED that this resolution shall be available for public inspection in the office of the Township Clerk. This Resolution shall take effect immediately. RESOLUTIONS: NO. 1 RESOLUTION APPROVING THE LISTING OF BILLS AND SIGNING OF CHECKS: Motion: Gallopo. Second: Conklin. NO. 2 RESOLUTION AUTHORIZING THE SUBMISSION OF A 2017 COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION TO THE COUNTY OF MORRIS: 8

9 WHEREAS, 2017 Community Development Block Grant Funds are available through the County of Morris; and funds. WHEREAS, a public meeting was held on December 13, 2016 to discuss applications for such NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Montville, in the County of Morris and State of New Jersey, that the appropriate officials are hereby authorized to execute and submit a 2017 Community Development Block Grant Application entitled, Crosswalks, Sidewalks, & ADA Compliant Ramps in the Vicinity of the Valley View Elementary School in Montville Township. Motion: Conklin. Second: Gallopo. Roll call vote Gallopo, yes; Cooney, yes; Conklin, yes; Nielson, absent; Sandham, yes. Resolution adopted. Chairman Sandham thanked Committeeman Gallopo for his six years of service on the Township Committee. He always came to the dais with the best interest of Montville and the citizens at heart. Thank you for your faithful service. Committeeman Gallopo said thank you. REVIEW OF MEETING ACTION ITEMS: NO. 1 ADMINISTRATOR: Parking on Skyline Drive after the new development is complete. NO. 2 ATTORNEY: Closed session items; DAC resolution; and Main Road parking ordinance. NO. 3 TOWNSHIP COMMITTEE: None. Chairman Sandham wished everyone Happy Holidays.
