7 Agenda Report MPO Transportation Technical Committee January 2014 Item No. 4 ISSUE: Election of Calendar Year 2014 Officers VOTE: Consider approval of the Calendar Year 2014 Nominating Committee s recommendation for the TTC Chair and Vice-Chair positions. BACKGROUND: The MPO TTC Chair annually appoints a nominating committee to recommend a slate of candidates for the election of the MPO TTC Chair and Vice-Chair for the calendar year (CY). Chair Ben Champ appointed Vern Willey, City of Altoona, and John Peterson, City of Ankeny, to serve on the CY 2014 Nominating Committee. The CY 2014 Nominating Committee will present its recommended slate of candidates at the January 9, 2014, MPO TTC meeting. Nominations from the floor will also be accepted at the meeting. The CY 2014 Chair and Vice-Chair will assume their responsibilities beginning in February RECOMMENDATION: Approve CY 2014 MPO TTC officers. 8 Agenda Report MPO Transportation Technical Committee January 2014 Item No. 5 ISSUE: Walnut Creek Watershed Management Authority REPORT and OPTIONAL VOTE: Report on the formation of the Walnut Creek Watershed Management Authority. BACKGROUND: In 2010, the Iowa Legislature authorized the creation of Watershed Management Authorities (WMAs), recognizing that effectively addressing flooding problems stretches beyond the means of a single jurisdiction. WMAs are comprised of two or more cities, counties, or soil and water conservation districts in a watershed. WMAs: Assess and reduce flood risk; Assess and improve water quality; Monitor federal floor risk planning and activities; Educate residents of the watershed regarding flood risks; Allocate moneys made available to the WMA to address water quality and flood mitigation; Do not acquire property by eminent domain; and, Can coordinate with other agencies. The MPO is leading the development of a WMA for the Walnut Creek watershed. The 28E agreement is included as a supplemental item. RECOMMENDATION: Authorize the MPO as a signatory to the Walnut Creek Watershed Management Authority 28E cooperative agreement. 9 Agenda Report MPO Transportation Technical Committee January 2014 Item No. 6 ISSUE: Traffic Incident Management Plan REPORT: Brief update on the Traffic Incident Management Plan. BACKGROUND: The Iowa Department of Transportation (DOT), in conjunction with a consultant, is working with the MPO member communities on an update to the regions Traffic Incident Management Plan. The overall team has split into three smaller working groups to break-up the work as follows: Traffic Management (Planning and Engineering); On-scene Incident Management; and, Communications and Coordination (Dispatch) The next step for the Traffic Management group is to discuss Diversion Routes. The Iowa DOT and their consultant will begin reaching out to each community individually to assess the routes within each community. The overall Traffic Incident Management Plan process is expected to continue for approximately six-months. RECOMMENDATION: None. Report and discussion only. 10 Agenda Report MPO Transportation Technical Committee January 2014 Item No.7 ISSUE: Retroreflectivity Standards REPORT: Brief discussion regarding potential MPO planning assistance for retroreflectivity. BACKGROUND: As discussed at the December meeting, the Manual on Uniform Traffic Control Devices (MUTCD) updated retroreflectivity standards in 2012 and included a requirement that all jurisdictions have a plan in place to manage and maintain signs at or above the established minimum levels. This plan must be adopted by June of MPO staff has heard from several members communities that would like planning assistance from the MPO. The MPO is in the process of drafting a plan and would anticipate a first draft being available at the March Technical Committee meeting. This plan would provide overall guidance on the process and techniques covering the MUTCD requirements. Implementation of the plan would be the responsibility of the individual member communities. 11 Agenda Report MPO Transportation Technical Committee January 2014 Item No. 8 ISSUE: Transportation Management Association Overview REPORT: Report on changes to the Transportation Management Association. BACKGROUND: Beginning in 2014, the Downtown Community Alliance will transfer responsibility of the Transportation Management Association (TMA) to the MPO. Originally created to address and prevent congestion along I-235, the Downtown Community Alliance (DCA) and MPO agree the TMA needs a transportation systems approach. The MPO has begun research into potential direction for the TMA. The goal of Transportation Management Associations is to reduce traffic congestion, parking problems, and pollution emissions by encouraging more efficient use of transportation and parking resources. TMAs are frequently non-profit coalitions consisting of businesses, public agencies, and Chamber of Commerce frequently working together to decrease commuter congestion. Common strategies and activities of a TMA include: Flextime or telework support; Parking management; Commuter financial incentives; Guaranteed ride home services; Rideshare, vanpool coordination; Transit improvements; Shuttle services; Special event and tourist transport management; and, Pedestrian and bicycle planning and promotion. MPO staff is currently assessing what existing programs of the TMA, such as Avoid the Rush, should remain and which related programs administered by partner agencies, such as DART, play a role in traffic congestion management. Staff recommends the following next steps to support the goals of the TMA: Include traffic congestion management strategies in the long-range plan including support for infrastructure projects that support multi-modal transportation; Strategize land-use policies that can decrease vehicle miles traveled as a preventative measure against congestion; Support behavioral changes to use transit, biking, or walking for a variety of trips (not just commuting) through support of DART and Bike Collective activities; and, Work with downtown employers to strategize employer sponsored incentives and programs. 12 Agenda Report MPO Transportation Technical Committee January 2014 Item No. 9 ISSUE: Energy Efficiency through Transportation Planning REPORT: Report on a grant submission to the Iowa Economic Development Authority. BACKGROUND: The Tomorrow Plan vision to achieve social, economic, and environmental resilience for a greener greater Des Moines includes several energy efficiency goals. In November, the MPO submitted a short summary of possible energy efficient transportation strategies to the Iowa Economic Development Authority s Energy Office and received an invitation to submit a full project proposal to fund: Long Range Transportation Plan support an increase in skill sets of staff to effectively use climate change data and incorporate climate change adaptation and mitigation strategies, particularly those that promote energy reduction, into the next long-range transportation plan; Transportation Choices develop a regional on-street bike feasibility study to shift more users from automobile to non-motorized transportation modes; and, Clean Vehicles, Clean Fuels develop a plan for the location of plug-in electric vehicle (PEV) charging stations and electric vehicle implantation strategies throughout Greater Des Moines. BACKGROUND: The deadline for submission of Federal Fiscal Year (FFY) 2018 Surface Transportation Program (STP) applications was Friday, December 6, The MPO staff received 22 applications. Included, as a supplemental item, is a listing of the projects that applied for FFY 2018 STP funding. Included, immediately following, is a map showing project locations. The MPO staff is currently developing preliminary scores for the FFY 2018 STP projects. Projects are required to score 50 points or higher to be considered eligible to receive FFY 2018 STP funding. The STP Funding Subcommittee will meet on January 22, 2014, to hear presentations from sponsors with eligible projects. This workshop provides project sponsors with the opportunity to discuss their projects and to answer specific questions from the STP Funding Subcommittee. Following this workshop, the STP Funding Subcommittee will meet to develop a funding recommendation for consideration by the MPO Executive Committee and the MPO Policy Committee. The MPO staff is compiling the composite scores for the FFY 2018 STP TAP projects. Projects are required to score 50 points or higher to be considered eligible to receive FFY 2018 STP funding. The STP Funding Subcommittee will meet on January 22, 2013, to hear presentations from sponsors with eligible TAP projects. This workshop provides project sponsors the opportunity to discuss their projects and to answer specific questions from the STP Funding Subcommittee. 16 Agenda Report MPO Transportation Technical Committee January 2014 Item No. 12 ISSUE: Traffic Impact Analysis Guidelines REPORT: Report on new guidelines from the Iowa Department of Transportation regarding the development of Traffic Impact Analysis for new highway connections. BACKGROUND: The Iowa Department of Transportation (DOT) has developed new guidelines for developing Traffic Impact Analysis for new highway connections. This analysis is required by the Iowa DOT when proposed developments require additional access to the primary highway system. The analysis helps the Iowa DOT identify the impacts and appropriate mitigation measures to address the transportation system s safety, performance, maintenance, or capacity needs. Traffic Impact Analysis typically will be prepared by a developer and/or the developer s consulting firm. In instances where an analysis is required, the MPO staff asks that the MPO be notified, as it will help ensure the MPO is aware of the latest development proposals that may impact its travel demand model. 17 Agenda Report MPO Transportation Technical Committee January 2014 Item No. 13 ISSUE: Mobilizing Tomorrow Update REPORT: Brief report on Mobilizing Tomorrow, the MPO s next long-range transportation plan. BACKGROUND: The MPO has initiated work to develop its next long-range transportation plan, named Mobilizing Tomorrow. This plan will serve as the federally required long-range transportation plan and will be among the first activities the MPO undertakes to implement and refine The Tomorrow Plan s transportation-related elements. According to the US Code of Federal Regulations, an MPO s long-range plan must include the following: Projected transportation demand of persons and goods; Existing and proposed transportation facilities; Operational and management strategies to relieve congestion and maximize safety; Consider the region s Congestion Management Process; Assess projects and strategies to preserve the existing system and projected future system; Design concepts and cost estimates for proposed transportation facilities; Identify potential environmental mitigation strategies; Include transportation enhancement, pedestrian, and bicycle facilities, as appropriate; and, A financial plan that demonstrates how the projects can be implemented. Additionally, MAP-21 focused on the following topics that should be included in the long-range plan: Including measures to evaluate the plan s ability to maximize the efficiency and effectiveness of the transportation system; Increased consideration of the importance of freight to the transportation system and economy; Identification and consideration of sustainable transportation and context sensitive solutions; Proactive linkage to environmental processes, such as NEPA; Climate change adaptation; and, Scenario planning. The long-range plan steering committee met for the first time on December 19, 2013, to begin discussing the plan s development. The committee s initial focus will include the growth scenario, financial forecasts, and identifying needs within the system. The steering committee will reach out to other committees within the MPO, including the TTC s Planning and Engineering Subcommittees, for assistance as the long-range plan is developed. BACKGROUND: The MPO TTC has maintained a Planning Subcommittee and an Engineering Subcommittee for approximately 10 years. At the request of the MPO Chair, TTC Chair Ben Champ has appointed formal representatives to each committee for calendar year The 2014 Chairpersons are listed below; the remaining committee members will be announced at the January TTC meeting. The trend charts for all crashes in the four-county region can be seen to the right. The overall trend for major injuries tells us there was a decrease in injuries during the ten-year period. The total number of fatalities peaked in 2010 at 59 and has decreased by more than half in the following two years. BACKGROUND: The MPO Chair annually appoints an Executive Director Review Committee (Review Committee) to complete an evaluation of the Executive Director s performance over the past year. Additionally, the MPO staff provides all MPO TTC and Policy representatives with a copy of the Fiscal Year (FY) 2014 MPO Executive Director s Annual Review Survey. Surveys are also provided to the Chairs of the MPO s multiple subcommittees, the primary representatives of the MPO s advisory and associate member organizations, the MPO staff, and key personnel of the following partner organizations that the MPO works closely with: the Iowa Department of Transportation, the Greater Des Moines Partnership, and the Transportation Management Association. Surveys will be distributed in early January. MPO staff requests that all responses be submitted by February 14, MPO staff will deliver the responses to the Review Committee for their consideration. 22 Agenda Report MPO Transportation Technical Committee January 2014 Item No. 17 ISSUE: Urban Land Institute Iowa District Council REPORT: Report on the development of the Urban Land Institute Iowa District Council. BACKGROUND: The MPO is working with the Greater Des Moines Partnership to establish a local District Council of the Urban Land Institute (ULI). The ULI, with more than 30,000 members worldwide, is a nonprofit education and research institute dedicated to providing leadership in the responsible use of land and in creating and sustaining thriving communities worldwide. Its membership represents all aspects of land use and development disciplines. The establishment of a local District Council serving Iowa will further expand ULI s existing network of 51 District Councils, which serve members and advance ULI s community-building mission at the local and regional level throughout the United States. The District Council in Greater Des Moines would explore urbanization issues, land conservation, regeneration, land use, capital formation, and sustainable development, all aimed at improving the quality of life for residents in the region and boosting economic prosperity. The local organizing committee hosted a kickoff event on December 18, 2013, with approximately 150 people participating. Information on next steps will be provided at the January 9, 2014, meeting. 23 Walnut Creek Watershed Management Authority Agreement Between Dallas County, Polk County, City of Clive, City of Dallas Center, City of Des Moines, City of Grimes, City of Johnston, City of Urbandale, City of Waukee, City of West Des Moines, City of Windsor Heights, Dallas County Soil and Water Conservation District, Polk County Soil and Water Conservation District, and the Des Moines Area Metropolitan Planning Organization. This Joint and Cooperative Agreement (hereinafter referred to as the Agreement ) is entered into pursuant to the authority of the Code of Iowa, Chapter 28E as of the day of, 2014 by and between Dallas County, Iowa; Polk County, Iowa; the City of Clive, Iowa; the City of Dallas Center, Iowa; the City of Des Moines, Iowa; the City of Grimes, Iowa; the City of Johnston, Iowa; the City of Urbandale, Iowa; the City of Waukee, Iowa; the City of West Des Moines, Iowa; the City of Windsor Heights, Iowa; the Dallas County Soil and Water Conservation District; the Polk County Soil and Water Conservation District; and, the Des Moines Area Metropolitan Planning Organization. All entities shall be referred to hereinafter as the Parties. WHEREAS, Iowa Code section 466B of the Code of Iowa authorizes two (2) or more political subdivisions, defined as including cities, counties and/or soil and water conservation districts, all of which must be located within the same United States Geological Survey Hydrologic Unit Code (HUC) 8 watershed, to enter into agreement under Chapter 28E of the Code of Iowa to establish a watershed management authority to enable cooperation in supporting watershed planning and improvements for the mutual advantage of the political subdivisions involved; and, WHEREAS, pursuant to Code of Iowa Section 466B.22, a watershed management authority may perform all of the following duties: 1. Assess the flood risks in the watershed. 2. Assess the water quality in the watershed. 3. Assess options for reducing flood risk and improving water quality in the watershed. 4. Monitor federal flood risk planning and activities. 5. Educate residents of the watershed area regarding water quality and flood risks. 6. PURPOSE. 3.1 The purpose of this Agreement is to provide for the manner in which the parties shall cooperate with one another to successfully encourage, plan for, and implement watershed activities within the Walnut Creek watershed, including but not limited to the following activities authorized pursuant to Code of Iowa Section 466B.22: Assess the flood risks in the watershed Assess the water quality in the watershed Assess options for reducing flood risk and improving water quality in the watershed Monitor federal flood risk planning and activities Educate residents of the watershed area regarding water quality and flood risks Seek and allocate moneys made available to the Authority for purposes of water quality and flood mitigation Make and enter into contracts and agreements and execute all instruments necessary or incidental to the performance of the duties of the Authority. The Authority shall not have the power to acquire property by eminent domain. All interests in lands shall be held in the name of the Party wherein said lands are located. SECTION 4. GOVERNANCE. 4.1 It is the intention of this Agreement that the Authority be established as an administrative agency and that the inherent governmental powers of any Party not be affected in any way beyond the terms of this Agreement. 4.2 A joint board of the Parties known as the Walnut Creek Watershed Management Authority Board (herein after referred to as the Board ) shall be responsible for coordinating watershed planning and improvements and executing activities directed to fulfilling the purposes of this Agreement. The Board shall be comprised of one appointee from each county, city, and district participating in this Agreement. Except as otherwise provided in this Agreement, the actions of the Board shall be the actions of the Authority. 4.3 The Board shall comply with the Open Meeting Law (Iowa Code Chapter 21), Open Records Law (Iowa Code Chapter 22) and gender balance requirements (Iowa Code Section 69.16A).

27 4.4 The Board will develop, adopt, and from time-to-time amend governing bylaws, operating policies, and administrative procedures. SECTION 5. DURATION. This Agreement shall be in effect in perpetuity until terminated pursuant to Section 12. SECTION 6. POWERS AND DUTIES. 6.1 The parties to this Agreement shall retain all powers and duties conferred by law but shall work together in the exercise of such powers and the performance of this Agreement. These powers shall not be transferred to the Authority. Each party shall be responsible for: Identifying opportunities for funding and in-kind support for the undertaking of watershed planning and improvements within the Walnut Creek watershed boundary; Identifying opportunities for infrastructure development and planning capable of assessing and mitigating flood risks in the watershed; Identifying the most effective best management practices for water quantity and water quality improvements in the watershed; Participating in educational/outreach programs regarding water quality and flood risks; Identifying opportunities for infrastructure development and planning to assess and mitigate water quality in the watershed; Providing support for the administration of any projects, including technical, financial and clerical, as agreed to by the Parties; Securing such financing, including grants, loans and the issuance of bonds of loan agreements, as determined by the respective Party to be necessary or desirable to achieve the objectives of the agreement; Designing and bidding of projects; Administering contracts; and Observing construction.

28 SECTION 7. OPERATIONS 7.1 Within its available resources through funding or in-kind support, the Authority may employ one or more staff members. 7.2 In addition to other powers and duties, the Authority will oversee the performance of all staff members and in-kind contributions to the Authority of personnel, materials, and equipment. 7.3 Within its available resources through funding or in-kind support, the Authority may acquire or lease equipment and supplies necessary to its work, acquire or lease office space, acquire and manage facilities related to its work, and insure against identified risks. 7.4 The Authority may enter into cooperative agreements and other contracts with other agencies, entities, and individuals. 7.5 The Board may create committees and task forces to support its work and, within its available resources through funding or in-kind support, engage experts and consultants. SECTION 8. MANNER OF FINANCING. 8.1 The Board may solicit, accept and receive donations, endowments, gifts, grants, reimbursements and other such funds, as well as in-kind contributions, as necessary to support work pursuant to this Agreement. It is agreed and understood by the parties hereto that no financial obligations upon any party are intended to be created hereby. 8.2 No action to contribute funds by a Board member of the Authority is binding on the Party that he or she represents without official approval by the governing body of that Party. No Party may be required to contribute funds to the Authority. 8.3 The Board will review each opportunity for funding or in-kind support. After review of the opportunity, a fiscal agent will be nominated. The fiscal agent would be a Party or other organization meeting the fiscal agent standards outlined in the bylaws. 8.4 All funds received for use by the Authority shall be held in a special fund by one of the Parties who shall act as the fiscal agent, pursuant to a written Fiscal Agent Agreement between the fiscal agent and the Authority. When funds are provided as a grant or loan directed to a Party of the Authority for a project administered by that Party, the funds shall be retained and administered by that Party. SECTION 9. SEVERABILITY/INVALIDITY. If any term, provision or condition of this Agreement shall be determined to be invalid by a court of competent jurisdiction, such invalidity shall in no way effect the validity of any other term,

29 provision or condition of this Agreement, and the remainder of the Agreement shall survive in full force and effect unless to do so would substantially impair the rights and obligations of the Parties to this Agreement or substantially frustrate the attainment of the purposes of this Agreement. SECTION 10. GOVERNING LAW. This Agreement shall be governed by and interpreted under the laws of the State of Iowa. SECTION 11. AMENDMENTS This Agreement may be amended at any time by the Parties. All amendments shall be in writing, signed by all of the Parties, and filed in an electronic format with the Iowa Secretary of State as required by Iowa Code section 28E.8 (2011) Any Party desiring an amendment to this Agreement shall notify other Parties of its desire, and the reasons for the request. Such a request shall be in writing to the other governing bodies of the Parties, and shall be considered by their governing body without unreasonable delay and within no more than ninety (90) days of receipt If the request is agreed to by the other Parties, each Party shall prepare and submit to the others a certified resolution confirming the affirmative vote of the Party s governing body The Amendment shall take effect ten (10) days following receipt of the last such resolution by the other Parties. Amendments shall be filled and recorded as required by Section 15 hereof. SECTION 12. ADDITIONAL PARTIES A City, County, or Soil and Water Conservation District within the Walnut Creek Watershed who is not a Party, may request, in writing to the Authority, to become a Party Such a request shall be considered and decided by a 2/3 vote of the Board, and shall become effective when the new Party has signed the then-current Agreement pursuant to a resolution of its governing body and the requisite filing with the Iowa Secretary of State and/or County Auditor has been accomplished.

30 SECTION 13. TERMINATION OF AGREEMENT. This Agreement shall terminate upon the mutual agreement of the governing bodies of all Parties in the Authority. Upon termination, all property and money then owned by the Authority shall be distributed equally among its members after payment of all debts. Any funds donated under a stipulation limiting their use shall be dispersed consistent with the owner s direction. The governing body of each jurisdiction may individually withdraw from their participation in the Agreement after providing the Authority a written 90 notice of intent. Such withdrawal will forfeit any right to a distribution in conjunction with a subsequent termination of this Agreement. SECTION 14. EFFECTIVE DATE. This Agreement shall take effect upon execution by the Parties as required by law and filing with the Secretary of State in an electronic format. SECTION 15. NOTICES. Notices under this Agreement shall be in writing and delivered to the representative of the party to receive notice (identified below) at the address of the representative designated to receive notice for each Party as set forth in this Agreement. The effective date of any notice under this Agreement shall be the date of actual delivery of such notice and not the date of dispatch. The preferred means of notice shall be either actual hand delivery, certified US Mail, return receipt requested with postage prepaid thereon, or by recognized overnight delivery service, such as FedEx or UPS. SECTION 19. NO ASSIGNMENT OR DELEGATION. Neither this Agreement, nor any right or obligation under it, may be assigned, transferred or delegated in whole or in part to any outside entity without the prior approval of the Board. SECTION 20. AUTHORITY AND AUTHORIZATION. Each party to this Agreement shall supply to the Authority a copy of the resolution by the governing body of each Party as evidence of the power and authority of each Party to enter into this agreement. SECTION 21. HEADINGS AND CAPTIONS. The paragraph headings and captions set forth in this Agreement are for identification purposes only and do not limit or construe the contents of the paragraphs.
