1 ALASKA STATE LEGISLATURE TWENTY-NINTH LEGISLATURE FIRST SESSION Juneau, Alaska Tuesday April 7, 2015 Seventy-eighth Day Pursuant to adjournment the Senate was called to order by President Meyer at 11:05 a.m. The roll showed twenty members present. The prayer was offered by the Chaplain, Senator Coghill. Senator Hoffman moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. Almighty God, creator of all we see and feel, maker of all life and giver of great love to every person. We come before you today with grateful hearts, to be able to serve the people of our state, for the strength of body and heart we enjoy and this form of government we are a part of. We look to you for guidance in clarity of mind and wisdom of heart in order to do well for our friends and neighbors. We honor those who have gone before us and left us a good heritage, those who sacrifice to serve in our armed services and those who keep us safe at home. Our time here is short in comparison to history, so help us to work diligently as if it may be our last day on earth, and look to the next generation for their good. 843

Messages from the House HJR 6 Message dated April 6 was read stating the House concurred in the Senate amendment to HOUSE JOINT RESOLUTION NO. 6, thus adopting: SENATE CS FOR HOUSE JOINT RESOLUTION NO. 6(RES) Supporting the introduction and enactment of federal legislation acknowledging that the federal government is financially responsible under the Alaska Native Claims Settlement Act for the remediation of contaminated land subject to conveyance under the Act; urging the United States

3 April 7, Department of the Interior to implement the six recommendations to identify and clean up the Alaska Native Claims Settlement Act lands in its 1998 report to the United States Congress; and urging the President of the United States and the United States Congress to remediate and make free from pollutants lands in the state conveyed under the Alaska Native Claims Settlement Act. SCR 6 Message dated April 6 was read stating the House passed and returned: SENATE CONCURRENT RESOLUTION NO. 6 Proclaiming April 2015 as Sexual Assault Awareness Month. The resolution was referred to the Secretary for enrollment. SB 64 Message dated April 7 was read stating the House failed the effective date in CS FOR SENATE BILL NO. 64(EDC), thus passing: CS FOR SENATE BILL NO. 64(EDC)(efd fld H) "An Act relating to school bond debt reimbursement." The bill was referred to the Secretary for enrollment. Message dated April 6 was read stating the House passed and transmitted for consideration: First Reading and Reference of House Resolutions HCR 7 CS FOR HOUSE CONCURRENT RESOLUTION NO. 7(STA) BY THE HOUSE STATE AFFAIRS COMMITTEE,

First Reading and Reference of House Bills HB 115 CS FOR HOUSE BILL NO. 115(FIN) BY THE HOUSE FINANCE COMMITTEE, entitled: "An Act relating to the sovereignty of the state and the state's right to a credit or setoff for amounts or injuries inequitably or unlawfully caused or claimed by the federal government; requiring the United States to lift certain land orders and federal withdrawals; relating to the transfer of public land or interests in public land from the federal government to the state and to the disposal of that land or any interest in land; and providing for an effective date." was read the first time and referred to the Resources, Judiciary and Finance Committees. Message dated April 7 was read stating: The Senate is invited to meet with the House for a joint session on Friday, April 17 at 1:00 p.m. The purpose of the joint session is to take up confirmation hearings. Senator Coghill moved and asked unanimous consent that the Senate accept the House invitation to meet in Joint Session. Without objection, it was so ordered. SB 100 SENATE BILL NO. 100 BY THE SENATE RULES COMMITTEE BY REQUEST OF THE GOVERNOR, entitled: "An Act relating to the assessment of property for oil and gas exploration, production, and pipeline transportation property tax on a North Slope natural

8 850 April 7, 2015 gas project; amending the definition of "taxable property"; adding a definition for "North Slope natural gas project"; and making conforming amendments." was read the first time and referred to the Community and Regional Affairs, Resources and Finance Committees. The following fiscal information was published today: Fiscal Note No. 1, zero, Department of Revenue Governor's transmittal letter dated April 6: Dear President Meyer: Under the authority of Article III, Section 18, of the Alaska Constitution, I am transmitting a bill relating to the assessment of property for the property tax for a North Slope natural gas project. Due to the achievements by the Municipal Advisory Gas Project Review Board and the Alaska Liquefied Natural Gas project, it is time to move forward with legislation to address the property tax on a North Slope natural gas project. Revenues from the property tax on a North Slope natural gas project are anticipated to provide vital support for the State and local governments to establish sustainable fiscal platforms. The bill would provide a framework for the assessment of property tax on a North Slope natural gas project once the project begins to transport gas. The assessment for property exclusively used for a North Slope natural gas project would be based on the full and true value of the property determined by adjusted original cost and annualized throughput. The bill would define a North Slope natural gas project for the purposes of the property tax to include a gas treatment plant, a gas pipeline, a liquefaction plant, and a marine terminal. Consistent with the concerns expressed by local governments and legislative direction last year, the property tax on existing North Slope oil and gas and pipeline properties would be unchanged by this bill.

This bill demonstrates my administration s continued commitment to building a gasline to provide gas to Alaskans and liquefied natural gas to world markets. Senator MacKinnon, Cochair, moved and asked unanimous consent for the adoption of the Finance Committee Substitute offered on page 847 Senator Gardner objected, then withdrew her objection. There being no further objection, CS FOR SENATE BILL NO. 86(FIN) was adopted. CS FOR SENATE BILL NO. 86(FIN) will advance to third reading on the April 8 calendar. Second Reading of House Bills HB 1 CS FOR HOUSE BILL NO. 1(EDA) am "An Act declaring the Arctic policy of the state" was read the second time. Senator Stoltze, Chair, moved and asked unanimous consent for the adoption of the State Affairs Senate Committee Substitute offered on page 377. Senator Gardner objected, then withdrew her objection. There being no further objection, SENATE CS FOR CS FOR HOUSE BILL NO. 1(STA) was adopted.
