1 ALASKA STATE LEGISLATURE TWENTY-NINTH LEGISLATURE SECOND SESSION Juneau, Alaska Saturday April 9, 2016 Eighty-second Day Pursuant to adjournment the Senate was called to order by President Meyer at 12:08 p.m. The roll showed eighteen members present. Senator Gardner was excused from a call of the Senate. Senator Olson was absent. The prayer was offered by the Chaplain, Senator Costello. Senator Hoffman moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. Lord in Heaven, We thank you for the beauty and resources of our State, the friends and families that support us while we serve the State, and for the opportunities we have to act for the good of all Alaskans. Please guide us here, the people s body, with good judgement, kindness, and wisdom. May your guidance aid each of us in the difficult decisions we face. As we reflect on the proverb: A reed before the wind lives on, while mighty oaks do fall, we ask for compassion and humility to survive the trials we face together here. (a) A person convicted during or in the five years preceding a period in which the person is receiving public assistance under AS of an offense under AS

11 April 9, , (a)(2)(B), or by the law of another jurisdiction that has as an element the possession, use, or distribution of a controlled substance, as defined in AS , is disqualified from receiving public assistance under this title unless the person participates in a testing program implemented by the department at least quarterly, on renewal of public assistance eligibility, and on a random basis for the use of illegal controlled substances. A person subject to this section who tests positive for the illegal use of controlled substances or who refuses to submit to a test required under this section is disqualified from receiving public assistance for six months following the date of notice that the person tested positive for the use of illegal controlled substances or from the date the person refused to submit to a test required under this section. (b) The department shall adopt regulations to implement (a) of this section. The regulations adopted by the department must (1) include an appeal process for a person disqualified under (a) of this section; and (2) provide that, where available, an alcohol safety action program approved under AS shall perform the drug testing. (c) In this section, "public assistance" means (1) a program that provides (A) day care assistance under AS ; (B) general relief assistance under AS ; or (C) adult public assistance under AS ; (2) the Alaska affordable heating program under AS ; or (3) the food stamp program under AS " Renumber the following bill sections accordingly.
