The Motion was carried unanimously by a 5-0 vote ACTION OUT OF CLOSED SESSION Mayor McCauley reported that the Council met in Closed Session on August 8, 2016, with no 40 action taken. He also commented for the record, that Vice Mayor Sloan has recused herself from 41 all labor negotiation meetings due to the fact that she is married to a Mill Valley Firefighter COUNCIL AND STAFF ANNOUNCEMENTS None. 46 ATTACHMENT 1

Minutes cu. of Mill Valier CITY MANAGER'S REPORTS City Manager McCann gave a brief report on the Miller Avenue Streetscape Project and asked 51 Public Works Director Poster to provide additional information on the current status of the 52 project. Director Poster discussed the project and noted that City staff holds two project- 53 planning meetings a week which include different representatives from the City, the construction 54 management team, the contractors, and the City's communications team in order to stay abreast 55 of activities and issues and to collaborate on outreach and problem solving Director Poster stated that construction related traffic congestion has been successfully 58 minimized and that staff is undertaking additional measures to mitigate traffic in anticipation of 59 the start of the new school year. The additional temporary parking approved by the Council for 60 use during construction has been used sparingly but staff expects it to get more use once summer 61 is over. He discussed project progress including such things as sewer lateral inspections, new 62 sidewalks, Americans with Disabilities Act (ADA) compliant curb ramps and rain gardens, and 63 project irrigation. He indicated that one tree has been removed (it was dead) which staff 64 originally thought would be able to remain; it will be replaced in-kind with a new healthy tree In response to the Mayor, Director Poster discussed construction hours, noting they can be 67 expanded if they would not cause any negative traffic or noise impacts In response to Councilmember Wickham, Director Poster stated that the Miller/Almonte area 70 is going to be reviewed again (due to public input) and discussed with the community. Mr. 71 Poster noted that the area is not due for construction activity for several months Director Poster stated that he had met with the Vice Principal of Tam High School regarding a 74 tentative plan to add parking on the outbound Miller lane in the Marsh area. He stated that staff 75 is not currently recommending that plan; however, they will monitor school conditions as school 76 returns to session In response to Councilmember Moulton-Peters, Director Poster stated that the general 79 completion goal for the Main Street portion of the Miller Project would be by the end of this 80 year. He clarified that "complete" denotes a return to final alignment of curbs and sidewalks. 81 Furniture and fixtures may still be added once the area is "complete." Councilmember Moulton 82 Peters discussed input from the public and requested a sketch of what Miller will look like when 83 done In response to Councilmember McEntee, Director Poster noted that no gas or waterlines had 86 been hit by the project contractor; however, PGE had dug into a PGE gas line PRESENTATIONS None Page 2 of6

Council concurred his corrections were appropriate. Mayor McCauley read into the record comments he had regarding Line 73 on the August 1, 2016 Regular City Council meeting. Council confirmed the addition of the comments. Mayor McCauley noted that he would the language to the City Clerk for inclusion into the final versions of both sets of minutes. 3. Authorization of the City's Response to the Marin Civil Grand Jury Report Entitled "Marin's Hidden Human Sex Trafficking Challenge." Chief Bernal provided an 128 overview of the Grand Jury report and the draft City response. He stated that human 129 trafficking is an estimated $32 billion global industry and that 72% of human trafficking 130 victims are from the United States. He stated that California is one of the top four 131 destinations for human trafficking. The Grand Jury determined that despite the fact that 132 the Bay Area is one of the largest areas for Human Trafficking -- the majority of its 133 citizens do not have a proper understanding ofthe issue Chief Bernal reviewed ongoing efforts to educate the public on the matter and offered 136 information regarding and how/when to report suspected trafficking. He indicated that 137 there is a Marin County Coalition on Human Trafficking that meets quarterly to share 138 information and make recommendations and that Mill Valley will participate on a 139 countywide task force that works on enforcement operations and special assignments 140 related to the issue Vice Mayor Sloan asked whether there are any symptoms that residents can look for as 143 signs of human trafficking. In response, Chief Bernal noted that community members can 144 help law enforcement by looking for evidence that someone is being controlled 145 emotionally, andlor physically etc. He indicated that foreigners will often have their 146 documents withheld, or one may see that there is an inability for a victim to leave a job. 147 He stated that there also may be signs of fear, depression, bruising or other physical abuse. 148 Chief Bernal stated that all of the City's law enforcement staff has been trained in victim 149 identification Mayor McCauley noted that in terms ofscope of response and tone of the response letter, 152 Findings F4, F7, and F9 are too broad, and that the City's response should be more 153 specific about what is going op in our town. He indicated that he would like to see more 154 precise language used for Mill Valley's official response. City Manager McCann noted 155 that the City'S response is due by September 15,2016, so staff does have sufficient time to 156 edit the response letter and bring it back to Council for final review and approval The Council discussed the desired tone and content of the letter and came to a consensus 159 that the letter should be revised and brought back to Council for further consideration at 160 the next Regular City Council meeting PUBLIC HEARING i8~ Consideration of an Appeal by Ken Mandelbaum, Liza Heath, Richard Rider and Dr. Jane Hightower of the Planning Commission's Approval of the Design Review and Second Unit Applications for the Proposed Project at 191 Elm Avenue for a New Single Family Residence and Second Unit. *Appeal has been withdrawn, no action needed (Amended 8/10/16) Item Elm Appeal - Under Separate Cover Item Elm Appeal Witlu/rllll'lIl No action required. 6 City Council Mcctillg Minutes City (?! Mill Vallcy 169 NEW BUSINESS Hq Consideration and Direction Regarding a Land Donation. Recommended Action: Receive report, discuss, and provide direction. Item 7 Land DOIlllliOll Propo sal City Manager McCann presented the staff report and noted that there was an approximate 1.8 acre parcel in the Middle Ridge Area that a family would like to donate to the City. He explained that in the early 2000's a Site Priority Committee had identified dozens ofproperties that had potential for development and if developed, would present a host of negative environmental issues; therefore the Committee recommended specific properties to be acquired to prevent such impacts. He stated that this particular property was included in that report and was on the on the list prepared by the Committee; the Boas Family wishes to dedicate the property to the City. He introduced Robin Glazer, attorney who represents the Boas Family, noting that she also participated in Site Priority Committee and is familiar with the issues surrounding such land matters. City Manager McCann noted that thus far staff has not encountered any potential red flags with the property in question, and will move forward with the donation at the Council's direction. Robin Glazer noted she was involved with the Mill Valley Site Priority Committee in She stated that the Committee reviewed specific sites that may have impacts to endangered species, riparian issues, andlor have sensitive trails running through. She noted that the site is along unimproved Myrtle Ave. and an unpaved portion oftamalpais so to develop the site would require road construction. She also stated that the site is adjacent to 3 Steps, Lanes and Paths and a large portion of Marin Municipal Water District land and open space. Councilmember Moulton-Peters questioned whether there were any ongoing maintenance or liability insurance costs associated with the site. City Manager McCann noted that site hazards a.re unknown but will be confirmed. In regards to insurance, the City owns dozens of properties and this parcel would not significantly impact the premiums the City pays. Other land the City owns are often found in wildland areas and the City pays to maintain vegetation management programs. Mayor McCauley opened the public comment time for the Item. John Leonard, 49 Molino, Former Chair of the Site Priority Committee, stated that there is an environmental benefit and a larger (safety) benefit to the community to keep open sites undeveloped. He stated he supports this particular donation and any and all efforts the City can make to acquire the properties in these types of locations that are better left undeveloped. Mayor McCauley closed the public comment period. Councilmember Moulton-Peters thanked City Manager McCann for looking into the issue and noted she was glad it came back to the City Council after years of talking about similar issues and desires of the City's General Plan and prior Councils. It was MOVED by Councilmember McEntee and SECONDED by Councilmember Wickham to adopt Resolution No confirming the Council's appointments to the Planning Commission and the Arts Commission (Urban Carmel and Janet Goodman). The Motion was carried unanimously by a 5-0 vote. 9. Consideration of a Resolution Designating a Voting Delegate and Alternate for the Annual League of California Cities Conference: October 5 - October 7, Recommended Action: Adopt Resolution 16-_. Item 9 LOCC Conference Delegates 160R15 It was noted that Councilmember McEntee and Councilmember Moulton-Peters will be attending the League's Annual Conference. It was MOVED by Vice Mayor Sloan and SECONDED by Councilmember Wickham to adopt Resolution No authorizing Councilmember Moulton-Peters (delegate) and Councilmember McEntee (alternate) to represent the City at the 2016 annual League of California Cities conference. The Motion was carried unanimously by a 5-0 vote. COUNCIL LIAISON REPORTS All opportunity for Councilmembers to report 011 activities of the local and regional governmental bodies I/POIl which they serve.
