1 CITY OF LA HABRA HEIGHTS MINUTES OF A SPECIAL MEETING OF THE LA HABRA HEIGHTS OPENING CEREMONIES 1. CALL MEETING TO ORDER CITY COUNCIL Mayor Stan Carroll called the Special Meeting of the La Habra Heights City Council to order at 7:03 p.m. at the Community Center, 1245 N. Hacienda Road, La Habra Heights, California. 2. ROLL CALL Those present: Mayor Stan Carroll, Mayor Pro Tem Ed Borrowe, Councilmember Bruce Douglas, Councilmember Fred Klein, Councilmember Tela Millsap. Also present John Hendrickson, City Manager; Director of Planning Sheryl Brady, Planning Technician Barbara Doppieri, City Attorney Michael Colantuono and Consultant Marc Blodgett. 3. FLAG SALUTE Nancy Acocks led the flag salute. 4. APPROVAL OF CITY COUNCIL MINUTES OF May 15, 2003 and May 29, 2003 Ms. Millsap stated on page 2 of the May 15 th minutes, Stephen Blagden lives on Citron, not Reposado. Mr. Borrowe moved to approve the minutes of May 15, 2003 as corrected. Seconded by Ms. Millsap. Ayes: 5 Noes: 0. Ms. Millsap moved to approve the minutes of May 29, Seconded by Mr. Borrowe. Ayes: 5 Noes: 0. SCHEDULED MATTERS Mayor Carroll opened the public hearing to take comments from the public. Margarita McCoy, Kashlan spoke regarding Circulation Policy 63, she suggested the addition of the following verbiage to the Policy; or to put their green waste in designated green waste containers for pick up and hauling. John Beau, Casalero spoke regarding the differences between what the GPAC Committee did and what the Planning Commission did; encourage the City Council to consider the time the Planning Commission spent on the document; discussed GPAC Circulation Policy 12, 13, 1

2 and 14, which was renumbered to #11; stated the policy doesn t read smoothly; passed out a sample of how Policy 11 should read. Nina Greene, Le Flore spoke regarding the need for a liaison between the residents and law enforcement. The Council then began their review of the Circulation Element starting with Policy 22. Circulation Element Issue Parking Policy 22 Mr. Douglas moved to strike to the extent permitted by law from the policy. Seconded by Ms. Millsap. Ayes 5. Noes 0. The motion passed. The policy will read The City will develop an ordinance to define, prohibit, and penalize nuisances created by illegal street and/or roadside parking or, if found appropriate, to ban such parking entirely in all or part of the City. Policy 23 Policy 24 Policy 25 Mr. Klein stated he does not want the home occupation ordinance changed, wants policy amended to coincide with the current ordinance. Mr. Colantuono suggested adding at the end of the policy unless permitted pursuant to a home occupancy permit. Mr. Klein s concern was with people who drive a vehicle home, but perform no work within the City. This policy was pulled for further discussion. Policy 26 Policy 27 Mr. Douglas moved to change the word institutional to non-residential. Seconded by Mr. Borrowe. Ayes 5. Noes 0. The motion passed. The policy will read, Require non-residential uses to provide landscaping, irrigation, and screening in required parking areas. Issue Transit and Paratransit Services Policy 28 Policy 29 Mr. Borrowe moved to removed the wording as funding allows. Seconded by Mr. Douglas. Ayes: Borrowe, Douglas, Noes: Carroll, Klein, Millsap. Motion failed. Mr. Klein moved to add the word type to the policy. Seconded by Mr. Carroll. Ayes: 5, Noes: 0. The motion was approved. The new policy will read, Continue to provide Dial-A-Ride type services arranged with an appropriate agency as funding allows. Mr. Borrowe asked to have the GPAC Committee Circulation Policy 32 put back into the document. This item was placed on the pulled list for further discussion. 2

Mr. Klein moved to accept Mr. Colantuono s suggestion. Seconded by Mr. Carroll. Ayes: Carroll, Douglas, Klein, Millsap. Noes: Borrowe. Mr. Carroll moved to change first sentence to read, Pursue undergrounding. Motion failed for lack of a second. Mr. Klein moved to change the first sentence to read Underground utility trunk lines Seconded by Mr. Borrowe. Ayes: 5, Noes: 0. The policy should read Underground utility trunk lines within the City, as utility funds are available for this purpose. Policy 38 Policy 39 This policy was pulled for further discussion. Policy 40 Mr. Borrowe asked to have GPAC Policy 46 replace this policy. Reduce and eliminate utility poles within the City. Mr. Borrowe moved to delete Policy 40 and delete the word trunk from Policy 37. Seconded by Mr. Klein. Ayes: 5, Noes: 0. The motion was approved. Policy 40 was eliminated and the word trunk was added to Policy 37. Issue Telephone Service Policy 41 Policy 42 Mr. Klein moved to amend the Policy to read Underground telephone lines within the City with the extent funds area available for this purpose. Seconded by Mr. Borrowe. Ayes: 5, Noes: 0. Policy 43 Policy 44 This policy was pulled for further discussion. 3

4 Policy 45 Mr. Klein moved to eliminate this policy. Ms. Millsap seconded the motion. Ayes: 5, Noes 0. Issue Wireless Communication Facilities Mr. Douglas asked to have line 3 of the introduction changed to read Communication facilities and removed the word towers. Mr. Klein seconded the motion. Ayes: 5, Noes: 0. Mr. Douglas moved to bring GPAC Policy 52 back as new Policy 45. Mr. Borrowe seconded. Ayes: 5, Noes: 0. Policy 46 Policy 47 Issue Cable Television and Broadband Internet Communications Policy 48 Policy 49 Mr. Klein moved to delete this policy. Mr. Carroll seconded the motion. Ayes: 5, Noes: 0. The motion was approved. Policy 50 Policy 51 Issue Domestic Water Supplies and Fireflow Policy 52 Policy 53 Staff was advised of a typographical error. The title of the Water Company is La Habra Heights County Water District. Policy 54 Policy 55 Policy 56 Policy 57 Policy 58 Policy 59 Policy 60 4

5 Issue Solid Waste Management Policy 61 Policy 62 Policy 63 Mr. Borrowed moved to add Ms. McCoy s recommended suggestion. Seconded by Mr. Klein. Ayes: 5, Noes: 0. The motion was approved. The policy will read Encourage residents to continue their practice of composting and mulching their green waste or to put their green waste in designated green waste containers for pick-up and hauling. Policy 64 Mr. Klein moved to change the word citizens to residents. Seconded by Mr. Douglas. Ayes: 5, Noes: 0. The motion was approved. The policy will read, Encourage residents to utilize available recycling programs. Issue Sanitary Sewer Systems Policy 65 Policy 66 Policy 67 Policy 68 Policy 69 Issue Storm Water Drainage Mr. Douglas asked staff to create a policy regarding run off patterns throughout the city to ensure the City is complying with NPDES requirements. Policy 70 Policy 71 Policy 72 Policy 73 Issue Pipelines and Resource Production Facilities Mr. Douglas stated the second paragraph; Sempra Energy Company should read Southern California Gas. Policy 74 5

6 Policy 75 Policy 76 Policy 77 Mr. Colantuono recommended changing the policy to read, Any necessary remediation shall be a condition of the consideration of any Zone Change or Amendment. Mr. Douglas moved to accept Mr. Colantuono s recommendation. Mr. Klein seconded the motion. Ayes: 5, Noes: 0. The policy was changed as follows: The City must be fully assured that remediation has been accomplished to the extent necessary for any proposed new use of the property before redesignation of the land use is considered. Any necessary remediation shall be a condition of the consideration of any Zone Change or Amendment. Issue Regional Planning Policy 78 Mr. Colantuono recommended changing the policy to read lanes and country roads, except as required to eliminate traffic hazards safety; Mr. Douglas moved to accept Mr. Colantuono s recommendation. Seconded by Mr. Klein. Ayes: 5, Noes: 0. The policy will read: Prohibit widening, straightening or leveling of local lanes and country roads, except as required to eliminate traffic safety hazards; their current configuration is the most effective deterrent against inappropriate short-cutting commuter traffic. Policy 79 Policy 80 This policy was pulled for further discussion. Policy 81 Mr. Klein moved to combine Policy s 81 and 82. Seconded by Ms. Millsap. Ayes: 5, Noes: 0. The new policy will read Post and enforce appropriate speed limits to discourage speeding and other unsafe driving throughout the City. Policy 82 This policy was combined with Policy 81 above. Page 4-10 Mr. Douglas moved to include Fire Zone 4 requirements within the third paragraph. Mr. Colantuono recommended inserting on line 12: and landslide-prone areas, its location in a very high fire zone, its dedicated open space, Seconded by Mr. Carroll. Ayes: 5, Noes: 0. Page 4-11 Trails - Ms. Millsap moved to have law enforcement and emergency vehicles added to the paragraph. Seconded by Mr. Klein. Ayes: 5, Noes: 0. Page 4-12 Mr. Douglas asked if this section needed to be in the plan. He asked that the text reflect the Community attitude. Exhibit 4-1 Mr. Douglas asked to have the box in the upper left hand corner reworked to remove the curbs and sidewalks. Stated will give his other corrections to staff. Exhibit 4-2 Mr. Douglas asked staff to verify the pipelines with BSI and to get a new map. 6

Policy 2 Policy 3 Policy 4 Policy 5 Policy 6 Policy 7 The Council asked staff to fix the typographical error La Habra Heights County Water Policy 8 Mr. Colantuono asked if it was the intention of this policy to have a no net loss of these resources or is it to say not one blade of endangered grass shall be mowed. He was concerned regarding all use out of property. Suggested The City will strive to ensure no net loss of protected animal species and sensitive native plant communities as a part of any new development or urban activity. He stated his word change would allow you to take an animal or plant habitat as long as you replace it. The existing wording says no disturbance at all. The City Council flagged this item for future discussion. Mr. Borrowe asked to bring back GPAC policy 7. PUBLIC COMMENT Gene Beckman, Skycrest stated Circulation Policies 12 and 13 deserve to stand-alone. John Beau, Casalero stated he didn t see a difference in the policies; stated utility poles could be an economic impact; significant could be defined in different ways; spoke regarding green waste. Norm Zezula, Canonita spoke regarding ERME 8, voiced same concerns as the City Attorney, and would like the word willfully removed from the policy. Suggested the introduction to the policy should read Consistent with the right of the property owner to enjoy a reasonable economic use of this property. Spoke regarding ERME 12, stated this policy in its present form does not protect anything or do anything. Suggested changing the last sentence of the policy to read, shall not affect natural surroundings, 7

8 ADJOURNMENT Mr. Klein moved to adjourn the meeting at 9:55 p.m. to the special budget meeting of June 26, Seconded by Ms. Millsap and approved as follows: Mr. Klein asked at the Special Meeting of June 26, 2003 that the City Manager address the utility tax from the City of La Habra that is being put on some of our residents phone bills.
