3 BUITENGEWONE PROVINSIALE KOERANT, 18 JULIE 2014 No GENERAL NOTICES NOTICE 2291 OF 2014 it4 THE CONSUMER AFFAIRS COURT FOR THE PROVINCE OF GAUTENG HELD AT JOHANNESBURG In the matter between: CASE NO: GCC25/20i02113 ISABELLA DA StLVA Complainant And [Fag-SUPPORT (PTY) LTD Respondent SETTLEMENT AGREEMENT WHEREAS the Complainant entered Into a contract for the Respondent to design and host a website for the Complainant entitled Portuguesenet.co.za on or about April 2011 for the amount of R13 400,00 (thirteen thousand four hundred rand). At all material times herein the Respondent was represented by Mr Adil Benkina, the managing director of the Respondent; AND WHEREAS the Complainant paid a deposit of R5 320,00 (five thousand three hundred and twenty rand) of the total amount of R13 400,00 (thirteen thousand four hundred rand) as per the invoice, to the Respondent; AND WHEREAS the Respondent completed the design of the website; AND WHEREAS the Complainant has not yet paid the balance of the contract price; AND WHEREAS the Complainant lodged a complaint against the Respondent with the Gauteng Office of Consumer Affairs; AND WHEREAS the Consumer Protector has now entered into negotiations with the Complainant and the Respondent and has concluded an arrangement: AND WHEREAS this arrangement I settlement subject to the Gauteng Consumer Affairs Court confirming it has the effect of an order of the Court by publication In the Gauteng Provincial Government Gazette;

4 4 No. 193 PROVINCIAL GAZETTE EXTRAORDINARY, 18 JULY 2014 THEREFORE THE PARTIES CONCLUDE THE FOLLOWING SUBJECT TO CONFIRMATION BY THE COURT IN TERMS OF SECTION 21 OF THE ACT AND AGREE AS FOLLOWS: The Complainant will pay the balance of the contract price of R8 080,00 (ei thousand and eighty rand) less R300,00 (three hundred rand) commission due to the Complainant which amounts to R7 780 (seven thousand seven hundred and eighty rand) In full and final settlement, The aforesaid amount Is payable In monthly instalments of R2 000,00 (two thousand rand) with payment commencing on 31 January 2013 and thereafter on or before the last day of each succeeding month until the amount is paid in full. The parties agree that there will be no interest payable on the capital amount. In the Interim and until final payment Is made the Respondent will upload the website on the Internet and the website will be fully functional. The website will be hosted by a provider of the Complainant's choice. The Complainant will provide the Respondent with the provider's credentials In order to effect the uploading of the website. Once the website has been uploaded the Respondent loses all control of said site and cannot be held liable for the functionality of the website nor Is able to effect any changes or alterations on the said site.

(i) All Interested persons are hereby Invited to submit their written nominations for appointment of members to the Consumer Affairs Court. (ii) Members of the court will be appointed the responsible Member of the Executive Council In concurrence with the standing Committee of Economic Affairs, (iii) The court will consist of five persons, namely a Chairperson, who will be a retired ludge of the Supremo Court; or an attorney, advocate, retired magistrate or lecturer in law at a university, with no less than ten years' cumulative experience in one or more such capacities; four additional members having special knowledge of or experience in consumer advocacy, economics, industry or commerce.
