Call to Order and Roll Call Chair Ruth Evans called the meeting to order at 12:07 p.m. Present: Evans, Domingos, Hunsaker, Solis, Ahle, Gordon, Torossian, Zabrycki, LeMay, Jacobsen, Avakian, Ewell, Miller, Kloose Absent: Salisch, Salazar, Smith Staff: Nathan Alonzo II. Legislative Updates Chelsea Avaizian from Assemblyman Patterson s office updated the GAC on the committee hearing date for one of their legislative items. Sandra Garcia from Rep. Costa s office relayed information from their congressional office and asked that consideration be given on weighing in on a number of issues, which she would be following up on with staff. Crystal Ragan from Rep. Nunes office reported that the House is still revising the new GOP Healthcare Plan. III. Approval of Minutes for the meeting of February 8 th, 2017 A motion to approve the minutes of the February 8 th meeting was made LeMay, was seconded by Zabrycki and passed unanimously. 2

Citizens Public Safety Advisory Board- Mayor Lee Brand INFORMATION/ACTION Mayor Lee Brand presented his legislation to the GAC and along with FPOA President Damon Kurtz answered questions about the specifics of his plan. After discussion a motion to support was made by Hunsaker, was seconded by Solis and passed unanimously. O. AB-301 (Patterson) California Transportation Commission: Members INFORMATION/ACTION Nicholas Sinclair from Asm. Patterson s office presented the legislation and answered questions from the GAC. After discussion a motion to support was made by LeMay, was seconded by Jacobsen and passed unanimously, with Zabrycki abstaining. P. AB-199 (Chu) Public Works: Private Residential Projects (Job Killer) INFORMATION/ACTION A motion to oppose was made by Domingos, was seconded by Ahle and passed unanimously. Q. AB-176 (Salas) Water Projects: Friant-Kern Canal INFORMATION/ACTION A motion to support was made by Solis, was seconded by Jacobsen and passed unanimously. R. AB-181 (Lackey) Taxation: Renters Credit INFORMATION/ACTION A motion to support was made by Domingos, was seconded by Solis and passed unanimously. S. T Pubic Policy Platform: Immigration Policy (CLOSED SESSION) DISCUSSION/ACTION In closed session the GAC discussed and voted on revisions of the immigration section of the public policy platform, specifically on verbiage. A motion to adopt changes was made by Ahle, was seconded by Solis and passed by a vote. VI. 4 Legislative Item A AB-831 (Patterson) Personal Income and Corporation Taxes: Credits: Compliance Source: Leg Info Background: The Personal Income Tax Law and the Corporation Tax Law allow various credits against the taxes imposed by those laws. Summary: This bill would allow a credit against those taxes for each taxable year beginning on or after January 1, 2017, for qualified small businesses, as defined, for costs paid or incurred during the taxable year with regard to compliance with state laws and regulations in an amount equal to $25 for each person-hour spent on compliance with state regulations and, laws, or $5,000, as provided. Pros: This gives small-business owners and ability to write-off the expense and time associated with complying with state regulations. Cons: N/A Support: Assemblyman Patterson and Co-Authors Opposition: None yet on record Fiscal Impact: Unknown at this time, but it would ultimately result in lost revenue to the state because of the write-offs. Platform Issue: State and Local Budgets. Staff Recommendation:. The ability to provide any taxation relief to business owners in California is commendable. SB-181 (Berryhill) Administrative Regulations Source: Senator Berryhill s Office, Leg Info Legislative Item B Background: With the overregulation of the business community in California and with it becoming increasingly more difficult for business to comply with an ever-changing regulatory environment this legislation is aimed at helping to provide needed regulatory relief. Summary: For every new regulation that is proposed to be added. The identification of two existing regulations that shall be repealed upon the adoption of the proposed new regulation. Pros: The 1 in 2 out provision would drastically reduce the number of regulations that businesses need to comply with in California. Cons: N/A. Support: Senator Berryhill and Assemblyman Bigelow 4

5 Opposition: None yet on record. Fiscal Impact: The passage of this bill may result in some significant state administrative costs associated with the management of its requirements. Platform Issues: Local and State Budgets. Staff Recommendations:. The ability to provide California business owners with regulatory relief is encouraged. AB-86 (Calderon) Entrepreneur-in- Residence Act of 2016 Source: Leg Info Legislative Item C Background: Existing law establishes within the Governor s office the Government Operations Agency, which consists of several state agencies, including the Department of General Services and the Department of Technology, and is governed by the Secretary of Government Operations Summary: This bill would enact the Entrepreneur-in-Residence Act of 2017, which would establish the state entrepreneur-in-residence program within the Government Operations Agency for the purpose of utilizing the expertise of private-sector entrepreneurs to help make state governmental activities and practices more streamlined and accessible. The program would authorize the Secretary of Government Operations to appoint a maximum of 10 persons each year to serve within a state agency as an entrepreneur-in-residence, with duties as established in the bill, on a voluntary basis also require the secretary to establish an informal working group of entrepreneurs-inresidence to discuss best practices, experiences, obstacles, opportunities, and recommendations, and to report on the program to the Governor and the Assembly Committee on Jobs, Economic Development, and the Economy. Pros: The passage of this legislation would help provide needed guidance to state agencies on how to streamline processes and become more business-friendly. Cons: The program and EIR s advice may not be followed by the legislature and future governor. Support: California Association of Independent Businesses, California Chamber of Commerce, California Manufacturer & Technology Association, Small Business California, TechNet. Opposition: None yet on record. Fiscal Impact: Unknown, according to committee analysis. Policy Platform Issue: State and County Budgets Staff Recommendation:. Guidance by private sector advisors with the goal of making state agencies more efficient is commendable. 5

6 Legislative Item D AB-190 (Steinorth) Local Government: Development Permits- Design Review Source: Leg Info Background: The Permit Streamlining Act within the Planning and Zoning Law requires the lead agency that has the principal responsibility for approving a development project, as defined, to approve or disapprove the project within a specified number of days from the date of certification of an environmental impact report, the date of the adoption of a negative declaration, or the determination by the lead agency that the project is exempt from the California Environmental Quality Act. Summary: This bill would require a lead agency, where an ordinance requiring design review applies to a development project, to approve or disapprove the design of the development project within 30 days of the date that application has been determined to be complete. Or the date of the certification of the environmental impact report, the date of the adoption of a negative declaration, or the date of a determination that the project is exempt from the California Environmental Quality Act, whichever occurs later. provide, that if the lead agency has not approved or disapproved the design of the development project within that 30-day period, the design of the project is deemed to be approved on the 31st day. Pros: The passage of this legislation would mean a quicker pace at the state level in either the review or the approval process of design review process. Cons: N/A. It is important to create processes whereby the design approval process for development projects is streamlined. AB-278 (Steinorth) CEQA: Exemption: Existing Transportation Infrastructure Source: Leg Info Legislative Item E Background: CEQA requires a lead agency, as defined, to prepare, or cause to be prepared, and certify the completion of, an environmental impact report on a project that it proposes to carry out or approve that may have a significant effect on the environment or to adopt a negative declaration if it finds that the project will not have that effect. 6

7 CEQA also requires a lead agency to prepare a mitigated negative declaration for a project that may have a significant effect on the environment if revisions in the project would avoid or mitigate that effect and there is no substantial evidence that the project, as revised, would have a significant effect on the environment. Summary: This bill would exempt from the provisions of CEQA a project, or the issuance of a permit for a project, that consists of the inspection, maintenance, repair, rehabilitation, replacement, or removal of, or the addition of an auxiliary lane or bikeway to, existing transportation infrastructure and that meets certain requirements. require the public agency carrying out the project to take certain actions Pros: The passage of the legislation would help to streamline the inspection and approval of certain transportation projects. AB-380 (Dababneh) Electronic Transactions: Motor Vehicle Finance Source: Leg Info Legislative Item F Background: Existing law, the Uniform Electronic Transactions Act (UETA), generally allows parties to contract to conduct transactions by electronic means, imposes specified requirements on electronic transactions in order to comply with the act, and provides specified protections for electronic transactions conducted pursuant to the act. Existing law defines and regulates the form and content of conditional sale contracts and lease contracts for motor vehicles and excepts these contracts from the application of the UETA. Summary: This bill would delete the exemption from the UETA for conditional sale and lease contracts for motor vehicles. require sellers and lessors to offer buyers and lessees the option of signing their respective contracts and agreements electronically. 7

8 require certain disclosures to be made in this regard and to be in a document separate from a conditional sale contract or lease contract. prohibit a seller or lessor from charging a buyer or lessee for a decision not to sign electronically and would prohibit charging more or less for vehicles based on the decision to sign electronically. require that the disclosures described here be signed at the seller s or lessor s place of business. This bill would require an exact copy of the executed contract to be furnished to the buyer or provided to the lessee at the time the contract is electronically signed, as specified. AB-12 (Cooley) State Government: Administrative Regulations: Review Source: Leg Info and Cal Chamber Legislative Item G Background: Existing law authorizes various state entities to adopt, amend, or repeal regulations for various specified purposes. The Administrative Procedure Act requires the Office of Administrative Law and a state agency proposing to adopt, amend, or repeal a regulation to review the proposed changes for, among other things, consistency with existing state regulations. Summary: This bill would require each state agency to, on or before January 1, 2020, review that agency s regulations, identify any regulations that are duplicative, overlapping, inconsistent, or out of date, to revise those identified regulations, as provided, and report to the Legislature and Governor, as specified. repeal these provisions on January 1, Pros: This helps to identify and reduce the number of duplicative and needless regulations. Legislative Item H AB-449 (Calderon) Income Taxes: Administration Source: Cal Chamber and Leg Info Background: Under existing law, the Franchise Tax Board is authorized to impose a penalty for failure to file a return upon notice and demand and failure to furnish information in response to a written request. Under existing law, this penalty amount is 25% of the amount of tax determined to be owed or of any deficiency tax assessed by the Franchise Tax Board. Summary: This bill would instead reduce the penalty amount that the Franchise Tax Board may impose to 15% of the amount of total unpaid tax or of any deficiency tax assessed. Existing law specifies liaison duties that include reviewing and updating content on the agency Web site that is accessible through the small business link at the State of California Internet portal and assisting the agency secretary, department director, or executive officer in ensuring that the procurement and contracting processes of the applicable entity are administered in order to meet or exceed the 25% small business participation goal. AB-1148 (Steinorth) Commercial Property: Disclosures: Disability Access Source: Cal Chamber, Leg Info Legislative Item J Background: Existing law requires the State Architect to establish a program for the voluntary certification by the state of any person who meets criteria as a Certified Access Specialist (CASp). This position requires certain knowledge and training on standards governing access to buildings for persons with disabilities. Existing law also requires a commercial property owner or lessor to state on every lease form or rental agreement executed on or after January 1, 2017, whether or not the premises have undergone inspection by a CASp. Summary: This bill would define commercial property for the purposes of that provision as property that is offered for sale or lease to persons operating, or intending to operate, a place of public accommodation or facility to which the general public is invited at those premises. This bill would declare that it is to take effect immediately as an urgency statute.
