2 CITY OF SPARTA PUBLIC SAFETY September 9, 2013 PRESENT: Jim Church, Ed Lukasek and Alii Karrels ABSENT: None ALSO PRESENT: Todd Fahning, Chief Kass, Mark Sund, Kevin Brueggeman, Paulette Hansen and citizens. Mayor Button arrived at 6:05. Chairman Church called the meeting to order at 5:00 p.m. A motion was made by Ed Lukasek and seconded by Alii Karrels to approve the consent agenda consisting of the August 5, 2013 minutes and Police Department's monthly report for July and bills. Motion carried 3-0. Upon payment of all fees and fines, a motion was made by Ed Lukasek and seconded by Alii Karrels to approve the following new or renewed bartender's licenses. Motion carried 3-0. Paige Trones Michael Austin Virginia Backus Nicole Genske There was discussion on our current Dog Ordinance and recommendations heard to change this Ordinance due to some complaints in the last few months. Our City Ordinance does not address a dog harming another animal nor is the leash law very clear. Some items in or current Ordinance need to be explained in better detail. Paulette Hansen, the County Humane Officer, was in the audience and was asked some questions about some of the County Ordinances and State Statutes that pertain to this topic. She explained the process of taking a complaint about an animal, when an animal can be taken away and talked about hybrid animals. Paulette said she is willing to help with recommendations to re-do our Ordinance. After our Attorney's review, a draft of the proposed ordinance will be presented at the October Public Safety meeting. If approved, it will be presented to the Council for final approval. Kevin Brueggeman stated he appreciated the committee's prompt efforts in getting this changed. The Committee appreciated the recommendations and concerns of the citizens. Chief Kass presented a draft of a Social Host Ordinance that he is recommending be approved. Other communities in Wisconsin are now adopting similar ordinances. A motion was made by Ed Lukasek and seconded by Alii Karrels to approve the Social Host Ordinance with the change in the penalty from $1, to $ as the minimum amount and also forward to Council for approval. Motion carried 3-0. Alii Karrels spoke in reference to disposal of Hypodermic needles in the City. At a recent Blue Ribbon Committee meeting, this was discussed and then decided that a community group should run this and not the City. No action was taken at this time. The City has been notified from the Canadian Pacific Railroad that they are requesting permanent closure of the Milwaukee Street/Hazelwood Avenue railroad crossing. Canadian Pacific studies railroad crossings for safety issues and this crossing is dangerous because there are no lights or gates. We have been told that the railroad has $15,000 of grant money that should be available to the city to construct a

3 cul-de-sac at the end of this road. Chief Kass and Chief Arnold see no problems with this. This closure will take place next year. There will be a temporary crossing available during the Milwaukee Street bridge reconstruction that will take place in Since there were no citizen complaints and no effect on future plans, Ed Lukasek made a motion to go ahead with the closure near the Milwaukee Street/Hazelwood railroad crossing, seconded by Alii Karrels. Motion carried 3-0. There were no items mentioned for future consideration. A motion was made by Ed Lukasek and seconded by Jim Church to adjourn at 6:15 p.m. Motion carried 3-D. 5 Activity Report: During the month of September the Sparta Police Department responded to 1258 calls for service, issued 181 traffic citations, arrested 18 persons for Operating While Under the Influence and made 150 non-traffic related arrests. Overall activity level was average with the prior year. The panel recommended 8 of the 17 be interviewed by the Police Commission; which will occur in mid-october. Alcohol compliance checks were conducted on all 27 licensed establishments in the City. We're pleased to report that 22 businesses refused to sell to the underage persons. The 5 establishments that did sell were cited for the violation. Chief Kass and Detective Meyers presented at a Community Wide Drug Awareness Forum hosted by the Monroe County Safe Communities Coalition. They discussed current drug trends in the community and offered advice on what residents could do if they suspected drug usage in family members or in their neighborhood. Training Officer Nelson attended the Crime Information Bureau Training Conference Officer Nelson & Sgt. Ames were recertified as TASER instructors. Sgt. Ames completed a 3 week Leadership in Police Organizations course. Officer Johnson was trained in the Pursuit Intervention Technique (PIT). SRO Seubert attended the Juvenile Officer Training Conference. Page 3

Oak St. Sparta, WI RE: Operator (Bartender) License Application for Samantha Harry Julie: SpartaPD.com The Department recommends denial of an Operator (Bartender) License to Samantha Harry at this time. On September 20, 2013 Ms. Harry sold alcoholic beverages to underage persons in violation of state law and City of Sparta municipal code. Ms. Harry was cited for the violation and the case has not yet been adjudicated. Chapter 12.03(5)B.2(1) allows denial of an operator's license based on pending charges when the offense substantially relates to the circumstances of the licensed activity. Committed to Excellence

The Water Department Superintendent shall be under the immediate supervision and direction of the Public Works Director, subject to general control of the City Council.
