ORDINANCES: SECOND READING AND PUBLIC HEARING O ORDINANCE OF THE TOWNSHIP OF GLOUCESTER, COUNTY OF CAMDEN AND STATE OF NEW JERSEY ADOPTING AMENDMENT NO. 2 OF THE GLEN OAKS REDEVELOPMENT PLAN TO ALLOW RENEWABLE ENERGY FACILITIES SOLAR AS PERMITTED USE PURSUANT TO N.J.S.A. 40A:12A-1 ET SEQ. Mr. Bianchini opened the public hearing. There being no comment, the public hearing was closed. Mr. Mercado made a motion to adopt, seconded by Mr. Hutchison. Roll call vote: All in favor. Motion carried 7-0. O ORDINANCE AMENDING ORDINANCE O KNOWN AS THE FIRE PREVENTION COMMITTEE OF THE TOWNSHIP OF GLOUCESTER Mr. Bianchini opened the public hearing. Mr. Brown, Captain Breeze, and Mr. Kibelstis of Fire District 6 stated that these fees are in line with the County. He stated that these changes will make everything uniform. Mr. Mercado made a motion to adopt, seconded by Mr. Hutchison. Roll call vote: All in favor.. O ORDINANCE AMENDING ORDINANCE O KNOWN AS THE FIRE SAFETY CODE OF THE TOWNSHIP OF GLOUCESTER Mr. Bianchini opened the public hearing. Mr. Brown, Captain Breeze and Mr. Kibelstis of Fire District 6 stated that these fees are for non-life hazardous inspections. Mr. Mercado made a motion to adopt, seconded by Mr. Hutchison. Roll call vote: All in favor- motion carried O ORDINANCE AMENDING ORDINANCE O KNOWN AS CHAPTER 4 OF THE CODE OF THE TOWNSHIP OF GLOUCESTER ENTITLED, BLACKWOOD LAKE ADVISORY COMMITTEE Mr. Bianchini opened the hearing to the public. There being no comment, the public hearing was closed. Mr. Mercado made a motion to adopt, seconded by Mr. Hutchison. Roll call vote: All in favor. Motion carried 7-0.

2 ORDINANCES: FIRST READING O ORDINANCE AMENDING CHAPTER 26 ALCOHOLIC BEVERAGES OF THE TOWNSHIP OF GLOUCESTER, COUNTY OF CAMDEN, STATE OF NEW JERSEY BE IT ORDAINED by the Township Council of the Township of Gloucester, County of Camden, State of New Jersey that Ordinance amending Chapter 26 of the Township of Gloucester be and is hereby amended as follows: SECTION 1. That Chapter 26, Article 5, and Section 26-17, shall be amended as follows: 26-17a b c d e. Minors entering premises with intent to purchase. It shall be unlawful for a minor to enter any premises licensed for the retail sale of alcoholic beverages in the Township of Gloucester for the purpose of purchasing or having served or delivered to him or her any alcoholic beverages. Any person violating this section shall be punished in accordance with Section below. Any person under the legal age to purchase alcoholic beverages who knowingly possesses without legal authority or who knowingly consumes any alcoholic beverage on public or private property shall be punished in accordance with Section below. This section does not prohibit an underage person from consuming or possessing an alcoholic beverage in connection with a religious observance, ceremony or rite or consuming or possessing an alcoholic beverage in the presence of and with the permission of a parent, guardian or relative who has attained the legal age to purchase and consume alcoholic beverages. This section does not prohibit possession of alcoholic beverages of any such person while actually engaged in the performance of employment by a person who is licensed under N.J.S.A. 33:1-1 et seq. or while actually engaged in the preparation of food while enrolled in a culinary arts or hotel management program at a county vocational school or post secondary education institution; however, no ordinance enacted pursuant to this section shall be construed to preclude the imposition of a penalty under this section, N.J.S.A. 33:1-81 or any other section of law against a sale of alcoholic beverages. Statutory immunity will apply when: (1) One of the underage persons called and reported that another underage person was in need of medical assistance due to alcohol consumption; (2) The underage person who called and, if applicable, one or two other persons acting in concert with the underage person who called provided each of their names to the operator; (3) The underage person was the first person to make the report; and (4) The underage person and if applicable, one or two other persons acting in concert with the underage person who made the call remained on the scene with the person under the legal age in need of medical assistance until assistance arrived and cooperated with medical assistance and law enforcement personnel on the scene. All ordinances and provisions thereof inconsistent with the provisions of SECTION 2. this Ordinance shall be and are hereby repealed to the extent of such inconsistency. SECTION 3. If any section, subsection or part, clause or phrase of this Ordinance shall be declared invalid by judgment of any court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of the ordinance. SECTION 4. This Ordinance shall take effect immediately after final passage and publication as required by law. Introduced: April 11, 2012 Adopted:

Mr. Mercado made a motion to adopt on first reading, to have second reading and public hearing on April 25, 2011, and to advertise by synopsis, seconded by Mr. Hutchison. 5 R-11: RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF GLOUCESTER, COUNTY OF CAMDEN, STATE OF NEW JERSEY APPOINTING WESTFIELD ARCHITECTS FOR STABILIZATION PLANNING REPORT FOR THE HISTORIC ROBERT MARSHALL HOUSE, A.K.A. MOFFA S FARM 510 ALMONESSON ROAD, BLENHEIM, NJ WHEREAS, there exists a need for a Stabilization Planning Report for the Historic Robert Marshall House, aka Moffa s Farm 510 Almonesson road, Blenheim, NJ WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-2 et seq.) requires that the resolution authorizing the award of contracts for "Professional Services" without competitive bids, must be publicly advertised, and WHEREAS, the Township Council of the Township of Gloucester does hereby designate Westfield Architects as Architects for the Township of Gloucester. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Gloucester, County of Camden, and State of New Jersey, as follows: l. That Westfield Architects be and is hereby appointed as Architects for the Township of Gloucester, since by nature of his qualifications and experience, he is well qualified. 2. This contract is awarded without competitive bidding as "Professional Service" under the provisions of the Local Public Contracts Law, because the aforesaid agreement encompasses the services of a recognized professional, licensed and regulated by law, and is of a nature where it is not possible to obtain competitive bids. 3. A copy of this Resolution shall be published in the newspaper within 10 days of its passage, as required by law. REGULAR AGENDA: R-11: RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF GLOUCESTER, CAMDEN COUNTY, NEW JERSEY AUTHORIZING THE SIGNING OF A SHARED SERVICE AGREEMENT WITH THE BLACK HORSE PIKE REGIONAL SCHOOL DISTRICT AND THE GLOUCESTER TOWNSHIP PUBLIC SCHOOLS BOARD OF EDUCATION FOR THE SOLICITING OF BIDS FOR THE DESIGN, DEVELOPMENT, OPERATION, FINANCING, AND MAINTENANCE OF SOLAR PHOTOVOLTAIR FACILITIES. WHEREAS. The Township Council of the Township of Gloucester, desires to secure proposals for the design, development, financing, operation and maintenance of a Solar Photovoltaic facilities at multiple locations throughout the Township of Gloucester, and WHEREAS. The Township Council has determined that it is beneficial to all tax payers of the Township of Gloucester to participate with the Black Horse Pike Regional Board of Education and the Gloucester Township Schools Board of Education in the development, construction and maintenance of Solar Photovoltaic facilities, and NOW THEREFORE, it is herein resolved by the Township Council of the Township of Gloucester to enter into a Shared Services Agreement with the Black Horse Pike Regional Board

6 of Education and the Gloucester Township Public Schools Board of Education for the soliciting of bids for the design, development, operation and maintenance of Solar Photovoltair facilities. The Township of Gloucester shall assume the lead agency responsibility for the cost and development of appropriate Request for Proposals (RFP) for the design, development, financing, construction, operation and maintenance of a Solar Photovoltair facilities, which RFP will be prepared, advertised in accordance with the Local Public Contract Laws of the State of New Jersey. The Black Horse Pike Regional School District Board of Education and the Gloucester Township Public Schools Board of Education, as well as the Township of Gloucester shall make their respective facilities and lands available for prospective bidders to investigate, evaluate and examine for availability and use as a Solar Photovoltair facility. All responsive bids will be received and opened by the Township of Gloucester and documented and provided to the Township Council of the Township of Gloucester and the Black Horse Pike Regional Board of Education and the Gloucester Township Public Schools Board of Education for respective review and determination of participation. The Township of Gloucester, and the Black Horse Pike Regional Board of Education and the Gloucester Township Public Schools Board of Education shall have the right to reject all bids, as well as participation in any award by either participating agency if it determined that that bid received are not in the best interest of the participating agency. NOW, THEREFORE, BE IT RESOLVED by the Township of Council of the Township of Gloucester that the Township is hereby authorized to execute, a Shared Service Agreement with the Black Horse Pike Regional Board of Education and the Gloucester Township Public Schools Board of Education, as hereby authorized. R-11: RESOLUTION APPOINTING A MEMBER TO THE GLOUCESTER TOWNSHIP HISTORICAL AND SCENIC PRESERVATION COMMITTEE BE IT RESOLVED by the Township Council of the Township of Gloucester that the following persons be and are hereby appointed to the Gloucester Township Historic and Scenic Preservation Committee Jacqueline Pinolini to fill the unexpired term of 4/11/11 to 12/31/14 MaryAnn Coyle R-11: RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF GLOUCESTER, CAMDEN COUNTY, NEW JERSEY AUTHORIZING THE SOLICITING OF SEALED BIDS FOR THE LEASE OF LANDS KNOWN AS OWENS CORNING SITE FOR THE DESIGN,

7 DEVELOPMENT, OPERATION AND MAINTENANCE OF SOLAR PHOTOVOLTAIC FACILITIES PURSUANT TO N.J.S.A. 40A:12-14 WHEREAS. The Township Council of the Township of Gloucester, desires to secure sealed bids for the lease of lands known as the Owens Corning Site for the design, development, operation and maintenance of a Solar Photovoltaic facilities for the transmission of electrical power, and WHEREAS. The Township Council has determined that the lands are without public purpose and that it is beneficial to all tax payers of the Township of Gloucester to lease the lands for the stated purpose. NOW THEREFORE, it is herein resolved by the Township Council of the Township of Gloucester that the administration is herby authorized to seek sealed bids for the lease of lands known as the Owens Corning Site, located on Somerdale Road, pursuant to N.J.S.A. 40A: The Township of Gloucester shall have the right to reject all bids determined not in the best interest of the Township of Gloucester. Any such sealed bid shall clearly reflect that any award shall be first subject to the appropriate fee simple title being secured by the Township of Gloucester pursuant to agreement and transfer from Owens Corning. NOW, THEREFORE, BE IT RESOLVED by the Township of Council of the Township of Gloucester that the Township is hereby authorized to execute, the soliciting of sealed bids for the lease of land known as Owens Corning, as hereby authorized. R-11: RESOLUTION AUTHORIZING THE SOLICITING OF RFP/RFQ S VIA THE GLOUCESTER TOWNSHIP WEBSITE FOR THE DEVELOPMENT OF A COMMUNITY FORESTRY PLAN FOR GLOUCESTER TOWNSHIP WHEREAS, the Township of Gloucester is in need of the development of a COMMUNITY FORESTRY PLAN FOR GLOUCESTER TOWNSHIP, and WHEREAS, the Township Council of the Township of Gloucester hereby authorizes the Township Administrator to go out for RFP/RFQ s for the development of a COMMUNITY FORESTRY PLAN FOR GLOUCESTER TOWNSHIP. Mr. Mercado made a motion to adopt, seconded by Mrs. Evans. On the Question: Mrs. Evans asked that this not supersede the $3, grant. Mr. Cardis stated that the RFQ is already ready, with a $3, not to exceed limit. Roll call vote: All in favor.. MOTIONS: RA1283 Knights of Columbus Lodge 1913 June 4, MAYOR S REPORT Mayor Mayer thanked the Gloucester Township Scholarship Committee for the scholarships presented this evening and for doing this for that last 26 years. He stated that the committee

8 should be commended. He also thanked the Council for their support with the shared services with the Black Horse Pike Regional School District and the Gloucester Township School District, as well as with the Owens Corning property. He stated that the township is working on their energy Master Plan. Mayor Mayer stated that this will be one of the largest shared services partnerships in South Jersey. He stated that the township is continuing to looking at partnering with other government entities. GT E-GOV ACCESS- There were no e-gov questions for this meeting. PUBLIC PORTION: Mr. Bianchini opened the public portion. Mr. Joseph Reed asked about the ordinance adopted on first reading this evening. He questioned the fact that this ordinance will allow the police to go onto private property. Mr. Bianchini stated that this was an initiative from the Police Department and it will give them jurisdiction for a violation of the ordinance. Mr. Reed stated that as an American, he has a problem with the private property aspect of the ordinance and the potential for abuse. Chief Earle stated that this has to do with house parties and juveniles drinking underage when no adult is present in the home. He stated that the police have an interest in protecting the child. Michelle Winters of the Gloucester Township Hockey Association thanked the Council for approving the rinks. She invited Council to come down to the rinks on April 23, 2011 at 9:30 am for an opening ceremony. She thanked Council again for the rinks. Darren Gladden of 44 Greensway asked who cleans up the baseball fields. He stated that the Al Raws fields have not been cleaned up this season. Mr. Moffa stated that all fields are on the schedule to be cleaned up and they are somewhat behind because of the rain. Mr. Bianchini stated that all fields are on the schedule. Tanya Brown of Sicklerville thanked the Council for introducing the ordinance concerning alcohol. She questioned the ordinance and the stipulations of it. Joseph Berry of Broadacres Drive spoke about a problem he is having with a neighbor, who is constantly calling Code Enforcement on him. He asked that when someone calls Code Enforcement their call should not be anonymous. Mr. Korczewski of 29 Mayapple Road stated that there is still damage done to the curbs in his development from the 2009/2010 snow storm. He stated that some were fixed and others were not. He also stated that his foundation is cracking and he believes it is because his house is adjacent to the Atlantic City Expressway. He stated that he is getting the run around with the South Jersey Transportation Authority. Mrs. Evans stated that she will speak with someone. Mr. Bianchini instructed the engineer to look into this also. He also stated that in his development there is an open field and kids are ripping down the trees. Mr. Bianchini asked the Mayor to have Mr. Moffa look into this. There being no further comment, the public portion was closed. POLLING OF DIRECTORS: Chief Earle showed everyone a picture of Officer Lisa Hatcher who is currently serving in Afghanistan. He stated that the Police Department will now be on You Tube with Community Relations Videos. POLLING OF COUNCIL: Mrs. Evans thanked the Gloucester Township Scholarship Committee for all the scholarships that they gave away this evening. She apologized to Mr. Gladden and thanked him for coming to Council with his concerns. She stated that she is moving forward with the PAL program application. She stated that she would like to see this go Countywide. She thanked those individuals that sent her letters for indoor recreation. Mr. Hutchison stated that he has attended several sports related functions over the weekend. He stated that it is nice to see the residents all pulling together. Mr. Garbowski thanked the residents for coming to the meeting. He congratulated the Gloucester Township Scholarship Committee recipients. Mr. Schmidt thanked the residents for coming to the meeting and sharing their views. Mrs. Gentek thanked the residents for coming out. She congratulated the Gloucester Township Scholarship Committee as well as the scholarship recipients. She also thanked the Chief of Police. Mr. Mercado thanked the residents for coming out to the meeting. He told Mr. Gladden that his son played at the Al Raws field last weekend in the morning, and the parents of both teams pulled together to dry out the fields. He stated that Mr. Moffa spends a lot of time on the fields

9 and that the Al Raws field was one of the townships older fields. He congratulated Aiden Mickle on winning the Township Scholarship Committee Race. Mr. Bianchini thanked the residents for coming to the meeting. He stated that he along with some other Council members attended the opening day of many of the baseball organizations. He stated that it all begins with teamwork. Mr. Bianchini stated that the government has its hands in many things and that it takes a lot to run the different organizations. He stated that people need to step up and help out the organizations and the township. He congratulated all the scholarship winners. Mr. Mercado made a motion to adjourn, seconded by Mr. Hutchison.
